The Transformation of Alternative Public Sphere and its Motive in Korea (한국 대안적 공론장의 변화과정과 추동 요인에 대한 고찰)

  • The concept of alternative sphere is terminologically various; resistance media, counter media, minjung media, grassroots media, underground media, alternative media, civic media, etc. Each terminology reflect the feature of times and the emphasis of advocator. This article explore the transformation of alternative public sphere and its motive in Korea. In a world, Korea's alternative public sphere has changed as following: resistance media and liberty media in 70', counter media and minjung media in 80', alternative media in 90', and alternative media and civic media in 2000'. The motive of transformation is basically the expansion of civil society and extension of social movement in Korea. As social movement's character has changed, the feature of alternative public sphere has also changed. Minjung movement played key role of social movement in 1980', the alternative public sphere characterized as minjung media or counter media which was based on working class consciousness. After this, According as civil movement have initiative of social movement, the character of alternative public sphere changed by alternative media and civic media. Besides, this article argue that the alternative public sphere of Korea has changed dialectically with social movement.

T. Hobbes' view of man and commonwealth (홉스의 인간관과 국가관)

  • The aim of this study is to newly interpretate to T. Hobbes' view of man and commonwealth in his On Man and On Citizen. An established reputation of the Hobbes' view is as follows. The nature of every man is egoistic. Therefor in the state of nature every man struggles against every man to acquire the good for himself. To suppress this egoistic nature of every man commonwealth established through the covenant of every man. And every man is absolutely subject to the common power of commonwealth. By doing so, every man preserves the life of himself. In that opinion, it seems that commonwealth have absolutely superiority over a man, and suppresses the liberty and autonomy of every man. This study different from that opinion speaks as follows. The nature of every man is not egoistic, but the nature of some men is egoistic. Therefor commonwealth dose not suppress the liberty and autonomy of every man, but suppress the aggression of some egoistic men through the common power. By that work, commonwealth gives every man the hope of his safety and peace. If that hope is not preserved, the duty or need that every man is subject to commonwealth will be discharged. In that state, rather the common power of commonwealth is the power of enemy, by the law of nature man struggle against commonwealth as an enemy. Therefor we can know the meaning of 'mortal god' that commonwealth is called by Hobbes.

The Role of Reason in Aquinas' Theory of the Freedom of Will (의지의 자유선택에 있어서 이성의 역할 - 토마스 아퀴나스에게서 의지와 이성의 관계에 대한 하나의 고찰 -)

  • The overemphasis of the priority of reason over will runs the risk of resulting in intellectual determinism. On the contrary, it is also unfair to underestimate the role of reason in Saint Thomas Aquinas' theory of the free will to avoid intellectual determinism. For, according to Thomas, "the will inclines to the good, insofar as it is an appetite, and it follows the judgment of the reason in the pursuit of the good, insofar as it is a 'rational' appetite." It is the objective of this article to show that, for Thomas, the idea of the free will is not contradictory to that of the will's following the judgment of reason. For this purpose, it is decisive to adequately evaluate the role of reason in Thomas's theory of the free will. This article therefore proves that in principle Thomas argues the priority of the will over reason as well as the freedom of the will, and that he nevertheless recognizes the role of reason which precedes the choice of the will by making the second-level judgment even when the will chooses not to follow the first-level judgement of reason. It is entirely up to the will to follow the judgement and order of reason or not. It explains the freedom of the will. But 'not to follow reason' is contradictory to the essential determination of the will as the 'rational' appetite. For from the will's not following reason, wrong-doing follows; the human act which does not conform to reason. This article therefore argues that for Thomas, the 'true' liberty of the will corresponding to its determination as the rational appetite consists in its following the rule and order of reason, not in acting against the judgement of reason.

The Prohibition Against Medical Refusal and the Principle of Private Autonomy in Medical Contracts (보건의료관련 법률의 진료거부금지에 관한 규정이 의료계약에서 계약의 자유를 제한하는지에 관하여)

  • This paper review about the relationship between the prohibition against medical refusal and the principle of private autonomy in medical contracts. The obligation to this Prohibition in Medical Law does not restrict the liberty of contracting a medical contract. On the other hand, the prohibition limits the freedom to terminate medical contracts. Medical contracts can be terminated if the trust between doctors and patients is vanished. However certain restrictions should be placed on termination of the medical contract, because termination of the contract should not be detrimental to patients' health. According to the current medical law the medical contract is to be enforced in principle and can be revoked only with justifiable reason. At the Civil Code on Medical Contracts the freedom to terminate the medical contract is permitted, but this paper suggests the restrictions of the revocation under certain conditions. The Criminal Punishment Regulations against medical refusal should be removed. Refusal the provide medical service should be regulated by administrative sanctions under the National Health Insurance Act's obligation.

A Study on the Ontological Meaning of Life in The Canonical Scripture (『전경』에 나타난 생명의 존재론적 위상)

  • This study aims at determining the meaning of Life in The Canonical Scripture of the Daesoon Thought upon the ontological bases of occidental philosophies; especially upon those of Plato and Bergson. In western philosophy, the word ontology designates investigating the meanings of being, which is derived from the Greek 'onto (being)' and 'logia (logical discourse).' The various meanings of life have been sought from ancient times all over the world, for these are the critical and vital questions that pertain to the nature of human existence. Plato had asserted that life, in his word, soul, had three different kinds of aspects of meaning. Immortal, reciprocal, and divine. Plato scheme was such that the soul could die, but after death it could became reborn into another various forms of living creatures. The real inner life of humans, the soul, would live eternally. Henri-Louis Bergson, a famous French philosopher from the 20th century, claimed that life had three different kinds of aspects. Self-identity, Élan vital (vital impetus) and liberty. Bergson insisted especially the real meaning of life had been characterized by "unité multiple et multiplicitéune," "unity as something multiple and multiplicity something singular." The meaning of life in Daesoon Thought could be said to have three different characteristics, solidarity, earthly immortality and grievance-resolution. Some similarities can be found between certain western ontological meanings of life and those of Daesoon Thought. Namely, the qualities of eternity, reciprocity, and divinity.

Living as Severe COPD Patient - Life of Stepping on the Thin Ice (중증 만성폐쇄성 폐질환 환자로 살아가기 -살얼음판 위를 걸어가는 삶-)

  • Purpose: The purpose of this study was to explore the life experiences of patients with a severe Chronic Obstructive Pulmonary Disease (COPD). Methods: The data were collected through in-depth interviews of six patients suffering from severe COPD. The interviewed data were audio-recorded and transcribed verbatim and checked for accuracy. The Giorgi method of phenomenology was used for analyzing data. Results: Eight themes forming the, units of meaning, were: Repeated and Unpredictable Suffering of Dyspnea, Confidence Loss/Exhaustion Life due to non-efficient breathing, Gradually Deprived Liberty, Absolute Being to Sustaining my life, Source of Burden but Significant Person I am in the Family, Endless Tug-of-War-Capability/Endeavor to Breath, Longing for my Life, and Dead-end of breathing. Conclusion: The study results provide an in-depth understanding of life experiences of patients suffering from severe COPD. The findings will be useful to nurses caring for this population.

A Study on Important Matters of the State Tort Liability (국가배상책임(國家賠償責任)의 요건(要件)에 관한 고찰(考察) - 위법성(違法性)과 과실(過失)을 중심(中心)으로 -)

  • The current consitutional law 29-1 is ordaining the State Tort Liability for the illegal action of public service personnel. Based on this regulation, the State Tort Liability Act 2-1 actualizes by indicating, the nation or the local self-governing community is responsible for the public service personnels damaging others during their office hours whether it is accidental or intentional. However, the same law is considered to be inappropriate for the damage relief. In order to supplement this problem, through examinations at both theoretical and systematic levels of Prima facie as well as the objectification and standardization of the damages are required for the national compensation for the police action. According to the objectification and standardization of the damage theory, the faulty actions of the public service personnel are the defects occurred during the office hours. In the case of the police action that frequently uses infringement administration, invading the liberty and rights of the people, it is necessary to interpret faulty damages during the office duties more comprehensively so as to extend its scope of the ordinary public service personnel accidental illegality. In order to warrant effectiveness of the securing the rights, it is crucial to distinguish whether the faulty actions are accidental or intentional. When proven to be damages by illegal police action, the police personnel is responsible for the faults, called Prima facie, the nation is liable for the damage relief.

  • This study puts emphasis on showing the change of Stripe Pattern, which has been popular for a long period of time in many societies, with change in time, assessing its value as an art. During medieval period, Strife Pattern had a strong negative meaning as a sign of disgrace or inferiority, or had been used as discrimination against a mental or a sinner, who had been rejected or banished from the society. Through French Revolution, Stripe Pattern has become a symbol of liberty and equality, furthermore, the notion of society as well as countries. This event had positively affected on reevaluating its image, from inferior, negative to significant, artistic. Eventually the variety of aesthetic values of Stripe Pattern led its way to the variation of its functional value expanding its use other than fashion industry. It is anticipated that our fashion industry will flourish in creating new, creative design by understanding design and appreciating their aesthetic values with their applications to human sensibility.

  • Purpose: This study was aimed at understanding the nature of the suffering of families with patients in mental health nursing homes and hoped to contribute to the rehabilitation process of those with a chronic mental disorder. Method: Research methodology was based upon Parse's human becoming research methodology. Results: a) Despite the despair the family feels by the violence caused by their now-institutionalized relative, they also realize anew the importance of their role as protectors b) Although they fear social stigmatization they also try to be supportive, out of guilt feelings; c) They regret their severe rearing style and wish to be more sympathetic, d) They find courage and hope through family therapy, which leads to a better understanding of the illness, e) With hopes of rehabilitation, the family members feel happy and go through an emotional release, by sharing the pain with each other. Conclusion: Families of nursing home residents share a focus on the process of human-health-universe. This is a positive,'human-becoming' process with which, based on past feelings of despair, fear, resignation, and pain, one can render meaning into his or her experiences in the present in the pursuit of love, conquest, hope, liberty and success.

Various Types of Costumes for Ganggangsullae (강강술래 공연 복식 실태 연구)

  • In this study, we have focused on various types of costumes for traditional Ganggangsullae and daily dance Ganggangsullae. To analyze their costumes, spot photographs of Ganggangsullae contests from 2011 and 2013 were collected from the Department of Culture and Tourism, Jindo County Office and the Jeonnam Information & Culture Industry Promotion Agency. Costumes were analyzed by categorising them as type, shape and color. Traditional Ganggangsullae costumes are two types: traditional hanbok and saenghwal hanbok. Traditional hanbok design dates back to the late Joseon dynasty and saenghwal hanbok design to the middle Joseon Dynasty. They reflects confucianism, a male-dominated society, totemism, shamanism and Yin-Yang and the five elements theory in agrarian society and community life. Daily dance Ganggangsullae has various types of costumes such as the fusion hanbok, saenghwal hanbok, cheering uniform and casual wear. They show modern color schemes. There is not any magical meaning from Yin-Yang and the five elements theory. Instead, they have individualism, liberty, equality and welfare in information-oriented society. So its costumes are easy and comfortable clothes. But traditional hanbok, fusion hanbok and saenghwal hanbok are inspired from Korean identiry. Even though traditional Ganggangsullae and daily dance Ganggangsullae have different costumes and ideology, they have a common denominator 'playfulness.' It will function as a key for Ganggangsullae to be performed continuously over the period.
