This paper review about the relationship between the prohibition against medical refusal and the principle of private autonomy in medical contracts. The obligation to this Prohibition in Medical Law does not restrict the liberty of contracting a medical contract. On the other hand, the prohibition limits the freedom to terminate medical contracts. Medical contracts can be terminated if the trust between doctors and patients is vanished. However certain restrictions should be placed on termination of the medical contract, because termination of the contract should not be detrimental to patients' health. According to the current medical law the medical contract is to be enforced in principle and can be revoked only with justifiable reason. At the Civil Code on Medical Contracts the freedom to terminate the medical contract is permitted, but this paper suggests the restrictions of the revocation under certain conditions. The Criminal Punishment Regulations against medical refusal should be removed. Refusal the provide medical service should be regulated by administrative sanctions under the National Health Insurance Act's obligation.
In accordance with Article 15 of the Medical Law, medical personnel in Korea cannot refuse treatment of a patient unless there is a justifiable reason, and violation of this obligations is subject to criminal penalties. Japan also stipulates the same content in the law. However, this violation of obligations in Japan is not subject to criminal penalties, and is used as a judgment element of the liability for damages of doctors only in the case of damage to the patient. However, in both countries, it is difficult to interpret and apply the law because the regulation is a little ambiguous. In particular, the key is to find out what is the justifiable reason for the doctor to refuse treatment of the patient. Recently, Japan has completed the work of re-examining the discussion on medical refusal from a modern perspective in terms of improving the excessive working environment of doctors. On the other hand, in Korea, it is not clear in what cases it is possible to refuse treatment. because there is a lack of systematic discussion on medical refusal. Rather, unnecessary misunderstandings and controversies have resulted in the loss of trust between patients and doctors. In Korea, there is already a legal right for a doctor to reject it according to his religious beliefs or conscience in the implementation of the suspension of life-sustaining treatment decisions. And in the case of an abortion, debates are underway that doctors should be given the right to refuse it. This study introduces the current state of discussion in Japan, and examines the issues surrounding medical refusal in Korea. It is hoped that this study will facilitate further discussions on the medical refusal.
Purpose: This study was to test the reliability and validity of a Drinking Refusal Self-Efficacy Questionnaire-Revised (DRSEQ-R) in Korean college students, Methods: The DRSEQ-R was designed to assess an individual's belief in their ability to refuse drinking alcohol by Oei et al. (2005) and consisted of three factors (social pressure, opportunity, and emotional relief). A methodological study design with an exploratory factor analysis for validity and correlation coefficients for reliability was used. DRSEQ-R was translated into Korean and a translation equivalency was obtained. DRSEQ-R was tested with a sample of 201 college students in Korea. The subjects consisted of 106 males and 95 females. Principal component factor analysis was used for construct validity and Cronbach's alpha was used to evaluate for internal consistency of the instrument. Results: The factor analysis showed three factors explaining 66.3% of total variance and the corresponding factors were emotional relief (48.01%), drinking contextual opportunity (11.18%), and social pressure (7.14%). The internal consistency was acceptable (Cronbach's alpha=.937). All three factors of DRSEQ-R negatively correlated with alcohol dependency and a heavy drinker showed a lower DRSEQ-R than a moderate drinker. Conclusion: Based on the findings, DRSEQ-R is a reliable and valid instrument to measure for drinking refusal self-efficacy in Korean college students.

Purpose: This study was done to determine the effect of drinking prevention program on the levels of drinking related knowledge, attitude, drinking refusal self-efficacy and behavior in high school girls. Method: This was nonequivalent control group pre-post test design. The subjects were 133 high school girls who were conveniently assigned to experimental and control group. The data were collected from May to September, 2005 and analyzed using Chi-square test, t-test and ANCOVA. Results: 1. The 1st hypothesis, "The drinking-related knowledge score of experimental group will be significantly higher than that of control group in posttest" was supported (F=256.30, p= .001). 2. The 2nd hypothesis, "The drinking-related attitude score of experimental group will be significantly higher than that of control group in posttest" was supported (F=43.35, p= .001). The 3rd hypothesis, "The drinking refusal self-efficacy of experimental group will be significantly higher than that of control group in posttest" was supported (F=43.86, p= .001). 4. The 4th hypothesis, "The number of drinking of experimental group will be significantly lower than that of control group in posttest" was supported (F=6.12, p= .015). 5. The 5th hypothesis, "The drinking amount of experimental group will be significantly lower than that of control group in posttest" was supported (F=8.52, p= .004). 5. Conclusion: This drinking prevention program was effective in increasing the drinking-related knowledge and attitude, and the drinking refusal self-efficacy, and in reducing the drinking behavior of high school girls.

Purpose: This study was conducted to identify the consumption of alcohol as well as to compare drinking refusal self-efficacy and mental health between an average drinking group and a problem drinking group of Korean nursing students. Methods: A questionnaire using the Alcohol Use Disorders Identification Test (AUDIT) measuring drinking refusal self-efficacy and mental health was given to 938 students of two universities in Gyeongsangnam-do. Results: Among the respondents 381 (40.6%) were problem drinkers. The score of alcohol consumption in the AUDIT were 3.38 for the average group and 12.50 for the problem drinking group. There were significant differences between the average group and problem drinking group in age, living place, smoking, parent's drinking, age of the first drink and reasons for first drink. Participants of the average group had significantly higher drinking refusal self-efficacy than the problem drinking group. Regarding mental health, there were differences between the two groups in attempted suicide. The risk factors significantly associated with problem drinking were living place, smoking and reasons for the initial drink. Conclusion: These results provide guidance for developing strategies, such as an educational program, to promote safe alcohol consumption in nursing students.

Correlation between parent-child relationship and creativity 4. The relationship between creativity and number of siblings 5. Creativity and birth-order II. METHODS & PROCED URES 1. Instruments: Standardized Creativity Test and Parent-Child Relationship Test for children 2. Objects: 118 boys and 97 girls enrolled in primary schools in Seoul who were selected by random sampling 3. Procedure: (1) The data of the boy group and the girl group were analized by means of M,t, SD. (2)The relationships between creativity and the number of siblings as well as the relationship between creativity and birth order were analyzed by M. (3) Inter-correlations among the sub-factors of creativity were obtained in boys and girls. (4) Complex-correlations between creativity and parent child relationship were produced. III. RESULTS 1. There were no significant differences between boy and girl in creativity. 2. Inter correlation among the sub-factors of creativity Boy: The highest scores were obtained in fluidity, and adaptability, the lowest in originality and openness. Girl: The highest score were obtained in world scribbling and fluidity, the comparatively low were in originality and a match-problem. 3. Inter-correlation between creativity and parent-child relationship a. Father-son: The positive refusal type has the most significant relation and conflict type, discrepancy type, negative type in turn have significant inter-coorelations. b. Mother-son: Discrepancy type, conflict type, positive refusal type have high correlations, while negative refusal type, anticipation type, and anxiety show significance in 5% level. c. Father-daughter: Positive refusal type shows correlation of 5% level significance, while indulgence type shows negative correlation in 1% level significance. d. Mother-daughter: Discrepancy type shows 5% level significance, while indulgence type shows negative correlation in 1% level. 4. Concerning the number of siblings, it was found that, boys and girls alike, those grown among 3 or 5 showed most creativity. 5. Concerning the birth order, it was found that, boys and girls alike, the first child showed the most creativity, and the youngest showed the next to the most, while the middle showed the least creativity.

Purpose: The purpose of this study was to identify factors affecting problem drinking in male nursing students. Methods: This study was conducted using a cross-sectional survey. A total 126male nursing students completed a self-report questionnaire to assess alcohol consumption, motives for drinking, and self-efficacy in drinking refusal self-efficacy. The participants were divided into 2 groups, moderate and problem drinkers. Multivariate analysis was used to identify factors affecting problem drinking in these nursing students. Results: Problem drinkers was found to be related to young age (adjusted OR=0.83, 95% CI [0.71, 0.96], coping motives (adjusted OR=1.19, 95%CI [1.00, 1.42], and drinking refusal self-efficacy (OR=0.96, 95% CI [0.93, 0.99]). Conclusion: The findings highlight the important role that coping motives and drinking refusal self-efficacy play in the problems in the drinking behavior of male nursing students.
Purpose: The purpose of this study was to examine relationships between drinking motivation, drinking refusal self-efficacy, job stress and problem drinking, and identify contributing factors on employees' problem drinking. Methods: A total of 191 employees recruited from two worksites. Data were analyzed using descriptive statistics, t-test, ANOVA, and Pearson's correlation coefficient, and multiple regression. Results: A 65.5% of employees has shown as hazardous drinking. Employees' problem drinking was significantly influenced by coping motives as a sub-factors of drinking motives (${\beta}$=.25) and social pressure as a sub-factors of drinking refusal self-efficacy(${\beta}$=-.57), explained 51.2% of the total variance. Conclusion: Considering the results of this study, healthy workplace culture for preventing employees' problem drinking should be builded. In addition, alcohol education program and effective employee assistance program need to be developed.
Purpose: This study was performed to measure the influence of drinking motives, drinking refusal self-efficacy, and self-determination on the intention to control drinking among nursing students. Methods: A cross-sectional survey was done with the participation of 258 nursing students attending four universities in G city. Data collection was conducted from May to June, 2018, using a self-report questionnaire. Data were analyzed using the t-test, ANOVA, $Scheff{\acute{e}}$ test, Pearson's correlation coefficients, and Hierarchical multiple regression. Results: The average scores for drinking motives, drinking refusal self-efficacy, self-determination, and intention to control drinking were 2.29, 4.54, 3.89, and 4.29 respectively. There were significant differences in the intention to control drinking according to grade, religion, and age of alcohol initiation. The factors influencing the intention to control drinking in nursing students were identified as self-determination (${\beta}=.24$), drinking refusal self-efficacy (${\beta}=.17$) and drinking motives (${\beta}=-.17$). This factor explained 26% of the nursing students' intention to control drinking. Conclusion: Therefore, it is necessary to develop a alcohol education program to improve the drinking culture of nursing college students and to improve their self-regulation skills in order to help them form a desirable drinking habit, and it is also necessary to apply the developed intervention program and test the effect.

This study examined the factors affecting the readmission of patients with liver cirrhosis, and focused on self-care, social support, and drinking refusal self-efficacy. The subjects were 75 cirrhosis patients who were admitted to medium-sized hospitals at S-city for two months from May 2019 to June 2019. The data was analyzed with the SPSS (Version 25) program, and logistic regression analysis was performed on the factors affecting readmission. The results were self-care (27.49±0.53 out of 60), social support (52.80±16.44 out of 90), and drinking refusal self-efficacy (42.39±22.76 out of 80). The readmission method was classified into planned and unplanned admissions. Unplanned readmission was found to differ depending on the drinking experience (OR: 4.16) and the presence of complications (OR: 5.11) within a month of discharge rather than that of the planned readmissions, accounted for 19.7%. It will be very important to reduce the occurrence of complications by early management of patients with cirrhosis, and increase the drinking refusal self-efficacy, and so reduce unplanned readmission and prevent the progression and deterioration of cirrhosis. The drinking experience and the occurrence of complications can be reduced through interventions that increase self-care, social support, and drinking refusal self-efficacy. Nursing interventions are needed to prevent patients with cirrhosis from drinking and to manage the complications due to relapse into alcoholism.
