2017 의료법 개정에 따른 병실 모듈변화 연구 (Changes of Ward Modules according to the 2017 Revision of Medical Law)

  • Purpose : As the necessity of reinforcement of infections management in medical facilities after MERS increased, Ministry of Health and Welfare promulgated the enforcement regulations of medical law on February 3, 2017. Its main objective is to improve patients' safety and medical-care quality through the establishment of isolation facilities from infectious diseases and the set-up of standards for In-patient and ICU facilities. The purpose of this study is necessarily to propose a standardized spatial composition model for ward modules by analyzing changing environments of in-patient facilities according to the strengthened medical law. Method: Theoretical studies will be undergone of Evidence-based Designs to improve patients' safety, medical quality, and domestic/overseas in-patient room guidelines. With reference to the status of 24 general hospitals over 500 beds, the spatial compositions of the in-patient rooms and the types of multi/single bed room modules will be analyzed. The directions of future in-patient room module changes through the study of the minimum ward module types and various ward types will be presented. Result: This paper will hopefully provide guidelines for hospitalization rooms that can be applied to the revised rules of medical law enforcement and provide a basis for a comprehensive study of patients' safety and efficient infection control as well.

국내 항공법 체계 개정 방안 - 외국의 항공법 체계와의 비교를 중심으로 - (Study on the Trend for Changing Civil Aviation Law in Korea)

  • 2004년 7월에 항공법 개정안이 발표되었는데 그 주요 제안이유는 현행 "항공법"중 그 내용이 객관적이고 독립적인 항공사고 조사분야를 "항공사고조사에 관한 법률"로 분법하고, 최근 항공안전 강화추세에 따라 빈번하게 개정되고 있는 국제민간항공 조약 부속서의 표준 및 권고사항에 신속하게 대처할 수 있도록 그 근거규정은 법률로 정하고 세부기술적인 사항은 하위법령에서 정하도록 하며, 그 간 제도운영과정에서 나타난 일부 미비점을 보완하려 하고 있다. 이러한 항공법 개정의 변화과정에 대한 논의와 외국의 항공법 체계와 국내항공법의 체계비교를 통하여 국내항공법의 개정 변화에 대한 추이를 살펴보고자 한다. 본 조사 결과 대부분 국가가 항공법과 항공사고조사법을 분리하고 있기 때문에 현행 항공법을 "항공법"과 항공사고조사법으로 분법하려는 추진방향을 세운 것처럼 생각된다. 현행 항공법에서는 권리제한이나 의무부과, 인허가 관련 기본적인 사항만 정하고 나머지 세부적인 사항은 국제기준의 변경에 신속히 대응할 수 있도록 하위법령에서 정할 수 있도록 근거를 마련하는 방향으로 가닥을 잡아가고 있다. 이러한 흐름에 맞추어 국제표준과 항공선진국으로서의 위상에 걸맞고 급변하는 세계항공운송의 흐름에 순행하는 항공법을 제정하는 지혜를 모아야 할 것이다.

Some Considerations for the Modernization of the Rome Convention, in case of Unlawful Interference

  • Most compensation issues are regulated under domestic law where third parties are suffered damage from crushes of aircrafts or their falling objects. This issue was internationally recognized. A Convention to unify the rules of the law concerning damage caused by aircraft to the third parties on the surface was signed in May,1933( the 1933 Rome Convention) and it became effective in 1942. Later, modernization was carried out through the 1952 Rome Convention and the 1978 Montreal Protocol amending the 1933 Rome Convention. Ratifying States either to the Convention or to the Protocol is not as many as those States to the Warsaw Convention concerning air transport. In 1999, which was a turning point of changes of centuries from the twentieth century to the twenty first century, the Montreal Convention was passed to modernize the Warsaw Convention, and was quickly widespread. On September 11 2001, the coordinated simultaneous terror attacks occurred. In the circumstances, the issue modernizing the Rome Convention came up. Thus, workout under the initiatives of the Legal Committee of the ICAO is under operation to adopt new Rome Convention. In Japan, a study on the draft of the treaty was operated by which a working study group composed of experts from academy, industry and government was set up. This article, being based on that study, clarifies issues and gives future perspectives. This article presents author's individual views.

  • State information policy is an important component of foreign and domestic policy of the country and covers all spheres of society. The rapid development of the information sphere is accompanied by the emergence of fundamentally new threats to the interests of the individual, society, state and its national security. The article considers the components of the state information policy to ensure information security of the country and identifies the main activities of public authorities in this area. Internal and external information threats to the national security of Ukraine and ways to guarantee the information security of the country are analyzed. Information security is seen as a component of national security, as well as a global problem of information protection, information space, information sovereignty of the country and information support of government decisions. Approaches to ensure the process of continuity of the information security system of the state in order to monitor new threats, identify risks and levels of their intensity are proposed.

  • 우리나라는 지금까지 항공기 개발에만 투자가 집중되어 필수적인 안전절차를 비롯한 인증활동 등에 대한 세부기준과 절차에 대해서는 소홀하였던 게 사실이다. 대부분의 항공 선진국들은 항공기의 안전한 운용을 위해 ICAO Annex 8에 근거한 감항증명을 법제화하여 의무적으로 시행하고 있으며, 미국은 국방부 및 FAA의 감항증명 체계를 자국의 현실에 맞게 적용하고 있다. 따라서 항공기 개발을 할 수 있는 국가로서 항공기의 높은 안전성 구축과 더불어 해외수출 기회 마련을 위해 항공기의 안전성을 보장할 수 있는 국제적 수준의 항공기 감항인증 체계의 구축이 필요하다. 이를 위해 국내 감항증명의 문제점을 분석하여 국외 선진사례를 반영하여 개선된 감항증명 체계의 구축방안에 대하여 연구를 수행하였다.

종합병원 병동부 피난환경 개선에 관한 연구 (A Study on the Improvement of the Evacuation in Ward of the General Hospital)

  • The purpose of this study is to suggest architectural planning guideline for the improvement of the evacuation environment in a ward. To suggest of guideline, the problem of irrational domestic criteria is searched according to compare National fire code (NFPA101, Life safety code) with Korea building law. This study includes stairs, corridors and exit door etc. but excludes fire facilities. To verify effectiveness of suggested guideline, egress simulation is run that based on databases according to literature survey. The results of this study could be summarized as follow: Suggested guidelines are subdivision(fire partition), evacuation by elevator, secure useful waiting space of elevator hall and smokeproof enclosures, the corridor is divided by fire or smoke barriers corridor from hazardous room, only wheeled items are arranged in corridors of a ward story. The result of computer simulation for suggested guidelines verify that egress time can be decreased 20% or above.

  • A public space of the general hospitals is for the patron, especially handicapped patrons, the aged, and pregnant women. Therefore, it should be designed with consideration of the users' specific requirements for the environment. The Universal Design has been introduced as the general design principle which satisfies the users' specific requirements for the environment. The main object of this study is to propose the universal design checklist of the general space for the medical space which guarantees the patients' comfort livings without the restriction of the physical environment. The general space is determined according to the orthopedic surgery outpatients' movements in the domestic general hospital. Based on the criteria set by the law, we visited the general hospitals located in Seoul and did on-the-spot research. In this paper, we analyze the present situation and the problems of the general hospitals and propose the Universal Design Checklist.

  • Clearly there are many legal arguments and criticisms surrounding the proposals for change in the Warsaw Convention and the need for a radical review. The question remains is unlimited liability the answer or should there be some other form of supplemental compensation and if so, what limits should be applicable. It does seem that the adopted limits of the Convention are seen by many as the first line of defence, which, dependent on political and cultural differences, the legal interpretation of contractual wording and the legal system globally have resulted in enormous differences in compensation paid whether or not the Convention limits were imposed. An example of this is in the United States, which highlights the significance of the problem in that domestic travellers without Convention Limits can, through the American legal system, obtain compensation in the multi-million dollar area for a death claim, whereas a passenger t1ying internationally would in the first instance be subject to Convention Limits. expensive legal action through litigation. To date, we can advise that insurers have not charged additional premium for unlimited liability coverage. Insurance rates as we have stated are hardening considerably. To date, average rate increases have been plus 56% for aircraft hull and plus 45% for liabilities. Insurers last year suffered global losses of around US $ 1.1 Billion against a premium income of US $ 800,000. The target premium income for 1993 is believed to be in the region of US $1.4 Billion.

  • MRO(Maintenance, Repair and Overhaul) 산업은 세계항공시장의 성장과 함께 발전하고 있다. 특히, 중국의 항공시장을 고려할 경우 아시아 지역의 MRO 산업은 상당한 성장 잠재력을 보유하고 있다. 아시아 지역에서 싱가포르는 한국보다 앞서 MRO 산업을 성공적으로 발전시킨 국가이며 그 중심에는 A*STAR가 있다. 본 논문은 MRO 산업의 성공적인 사례라 할 수 있는 싱가포르 A*STAR를 중심으로 분석하고 항공안전기술 전문기관을 통한 국내 항공산업과 항공분야 연구개발의 발전 방안을 제시하고자 한다.

플로팅 건축물 관련 국내외 법제도 사례 연구 (A Case Study on Legal Systems related to Floating Building)

  • 최근 해상을 비롯한 수상공간에 다양한 플로팅 건축물이 계획되거나 설치되고 있다. 그러나 관련 법제도의 미비로 인하여 플로팅 건축물의 설계 및 건설 혹은 관리운영에서 많은 문제점이 발생되고 있으며 이는 플로팅 건축물의 활성화를 저해하는 중요한 요인이 되고 있다. 따라서 본 연구에서는 플로팅 건축물에 대한 국내 법제도 적용 사례 및 해외 관련 법제도 사례 조사를 실시하여 우리나라에서 플로팅 건축물의 법제도 개선을 위한 기초자료와 개선방향을 제시하였다. 연구결과 플로팅 건축물은 선박이 아닌 건물로서 법적 지위를 확보하며 플로팅 건축물 설치 특별구역을 설정하여 건물의 대지를 조성하고 별도 기술기준을 적용하며 건축인허가 및 등기 절차를 활용할 수 있도록 법제도 개선이 필요하다.
