In cost-only incentive contract the emphasis is the attainment of efficient and effective cost control. In contrast multiple incentives contract correlates contractor's profit motives with the generalized government objective function, the decision variables of which are performance or quality (technical progress), time or schedule (timely development and delivery) and the cost (efficient and effective cost control) Under multiple incentive structure, it is essential to formulate the trade-off curves between cost and performance, which are called iso-fee curves. Trade-off curves depict the combination of cost and performance achievement for which the contractor will be rewarded with the same fee. The basic function of trade-off curves is to show he the contractor will be motivated by incentive arragement to trade off or sacrifice the achievement in one incentive element for the acnievment in another.

The purpose of this thesis is to provide an appropriate trade-off information for the conflicting interests caused by the various factors between building owner and contractor during selecting the contractor and performing the construction work, in which the construction was contracted by open bidding from the government or private organizations. In order to propose the legitimate evidence, the differences between the domestic contract sheet of drawing change and the process of drawing change and those of the foreign countries were compared and analysed The number of construction ordered in Youngdong area in 2001 whose construction expenses are more than 100,000,000 won is 218 items and 147,005,000,000 won in total cost Among them, the number of 218 items whose total cost amounts to 16,705,000,000 (11.36$\%$) is in case of increase of construction expenses due to the drawing changes, and the number of 48 items whose tool cost amounts to 2,009,000,000 won (1.37$\%$) is the case of decrease. In conclusions, the contractor could have more benefits than the building owner in case they submit the detailed estimate sheet without eliminating the increasing expenses of construction. It is shown that the building owner's loss is increasing whenever the labor cost is higher material cost Therefore, this thesis proposes a proper standards for the harmonious compromise between the contractor and the building owner for the problems caused by the drawing changes when the contract agreement is occurred.

본 연구는 가맹본부의 과도한 통제로 인하여 가맹점사업자가 독립적 사업자가 아닌 피용자로 전환될 수 있음을 시사한 Williams v. Jani-king of Philadelphia Inc. 사건을 고찰하였다. 이 사건에서 법원은 가맹점사업자의 지위를 판단하기 위해 계약상 가맹본부가 행하는 통제의 성격이 유일하고 명백한 증거라고 판단하였으나 계약상 내용뿐만 아니라 실질적으로 가맹본부가 가맹점 사업자에게 행사는 통제의 정도도 함께 고려되어야 할 필요성이 있다. 또한 계약상 통제의 성격을 판단함에 있어 그 기준이 명료하지 않기 때문에 가맹점사업자의 지위 판단이 상황에 따라 달라질 수 있으므로 기존의 가맹사업상 내제된 통제와 그 이상의 일상적인 관리상 통제로 구분하여 가맹점사업자의 지위를 판단하는 것이 적절할 것이다.

공정 및 작업단위등이 다양하고 복잡한 건설산업에서 작업일보의 관리는 매우 중요하다. 그러나 건설산업 분야의 다양한 건설프로젝트 관리 시스템은 작업 및 작업시 발생하는 정보들을 효율적으로 관리하지 못할 뿐만 아니라 하수급업체와의 연계가 되지 않아 실제적으로 이용되지 못하고 있다. 이것은 하수급업체에 대한 배려 없이 원수급업체 주도로 시스템이 구축/이용되기 때문이다. 이러한 이유로 하수급업체 중심의 시스템이 발전하지 못할 뿐만 아니라 프로젝트 진행에 있어서 발생하는 작업정보의 축적에 있어 누락 및 왜곡이 발생하는 문제점이 발생하고 있다. 따라서 본 논문의 목적은 웹을 기반으로 원수급업체와 하수급업체간 원활한 작업정보 관리 시스템의 개발에 관해 연구/분석하고 모델을 제시하는데 있다.

Construction projects are fraught with risks from cost or other overruns to accidents along with other issues. This is true whether the relevant organization is an owner, general contractor, CM, specialty-trade contractor, or other entity. When cost issues or other issues confront arise, how should an organization proceed whether attempting to gain additional compensation in terms of cost/other damages or protecting the same against such claims if they do not appear to be warranted? Enter construction cost forensics. This presentation will focus on strategies/techniques with construction cost forensics in these areas in order to be successful. Covered techniques include those to develop and analyze claims including fundamental construction cost analysis techniques. When an unexpected event disrupts a construction project, using sound analytical methods to identify the cause and quantify the extent of the issue will be important for negotiating a fair result or for obtaining a successful outcome in arbitration or litigation. Key examples of uncovering issues via construction cost forensics will be covered in this presentation.

Korean won overseas construction projects worth 71.6 billion US Dollars in 2010, which exceeded that of 2009 by 45.6%. An overseas construction project is a transaction of large scale, long term project, many parties participating, deferred payment, and of high-technology. It contributes to foreign currency earning, and also leads the nation's export restructuring work towards high value-added one. There are various kinds of risks towards the relevant parties respectively, which are key elements in successfully performing the overseas construction project. There are completion risk, financing risk, operating risk, revenue risk etc, in an employer's place. A contractor may be confronted with payment risk, issuance risk of performance bond, financing risk, performance risk of sub-contractors, and exchange rate risk. In lenders place there are repayment risk, completion risk, and political risk in the host country. In order to mitigate risks, the parties shall take relevant measures or require relevant securities. A contractor needs to evaluate the credibility of an employer in respect of payment risk, and can also request export insurance cover by the Korea Trade Insurance Corporation(the former 'Korea Export Insurance Corporation"). An employer can require a contractor to provide performance bond in respect of completion risk, and employ a well-known first class bank as a mandated arranger to arrange financing with regard to completion risk. Lenders needs to evaluate the credibility of an employer and accomplish feasibility study of the project. Lenders can request insurance cover from export credit agency. Once the parties assess the respective risks and obtain relevant securities, the project will be successfully completed. The success of the project will be sure to bring the parties involved enormous profits and another opportunity to participate in overseas construction project afterwards.

다수의 공사수행주체가 복잡한 생산프로세스 내에 존재하는 건설산업의 특성상 참여주체간에 발생하는 문제와 공정 간섭은 생산성 저하의 주된 원인이 된다. 이를 해결하기 위해 최근에 '다공종 통합발주방식'이 제안되었고 일부 대형업체를 중심으로 시범 운영되고 있다. 그러나 통합발주는 아직 제안 초기단계로 실질적인 시행을 위해서는 다양한 기초연구가 선행될 필요가 있다. 따라서 본 연구에서는 통합발주를 시행하여 원${\cdot}$하도급업체 모두가 효율성을 증진시킬 수 있는 작업요소를 규명하고자 한다. 이는 건설업 전반에 통합발주의 필요성을 인식시키고, 통합발주 시행 시에 다수의 공종을 통합하는 기준을 제공할 수 있을 것으로 기대된다.

The construction industry can be described as one of the most volatile industry depending on the situation. As such, a contractor, who is usually positioned to take all kinds of risk, may frequently require to form a strategic partnership for better execution of a project. In this study, we are going to review act or behavior that may happen among such partnership. For such review, a survey targeted at domestic construction companies has been conducted on their thoughts as regards opportunism, risk perception, and the contractual governance between partners. The analysis result of structural equation and regression has indicated that there exists a positive effect on the opportunistic behavior from the risk perception, a moderating effect on contractual governance between the performance risk and opportunism, whereas no such moderating effect on the same between relational risk and the opportunism. The output of this study may assist various domestic individuals who wish to participate large scaled overseas projects.

국내 건설산업의 경우 전통적으로 원도급업체와 하도급업체의 관계를 수직적, 종속적 관계로 인식하고 있는 실정이다. 이러한 문제점을 개선하기 위해서는 원${\cdot}$하도급업체를 동반자로 인식하고 상생협력과 발전을 모색할 수 있는 새로운 건설 환경을 조성하여야 할 것이다. 이를 위하여 원${\cdot}$하도급업체간의 상생협력을 위한 성과공유제를 적용하기 위해서는 건설 생산방식과 생산조직 등의 특수성을 반영할 수 있는 적용방안을 제시할 수 있어야 할 것이다. 다라서 본 연구는 건설산업에서 성과공유제의 적용 현황 및 문제점을 조사하여 건설산업에 성과공유제 적용을 위한 기초적인 자료제공을 연구의 목적으로 한다.
