Related Factors to Korean Hospital Nurses in Burnout during the COVID-19 outbreak: A Systematic Review

  • In this paper, we propose a crucial issue to require further management plan for Korean hospital nurses in burnout during COVID-19 pandemic. The purpose of this study was to conduct a systematic review of factors related to hospital nurses in burnout for the COVID-19 outbreak. Appropriate studies in the recent three years were selected from database. To perform a systematic review, the databases of RISS, KISS, DBPIA, and Kyobo scholar were searched using the key words, 'nurse in burnout' or 'burnout for nurse'. Fifty-five references were checked, but only seven studies were decided inclusion criteria to review. It was founded that Korean hospital nurses felt moderate or higher burnout level for COVID-19 pandemic. We were confirmed that related factors of hospital nurses in burnout were personal characteristics, physical symptom, depression, compassion satisfaction, compassion fatigue, and resilience, and occupational characteristics, shift work and job stress. It may be necessary to provide regulating programs for hospital nurses in burnout and to set up a policy and guidelines so as to reduce burnout of nurses working.

Breeding of Early Heading Date with High Yield Using CRISPR/Cas9 in Rice

  • Recent unpredictable climate change is a major cause of rice yield loss. In particular, methane is a key factor in global warming. Therefore rice breeders are trying to breed the reducing-methane gas emission rice using the crossbreeding method. However, the traditional crossbreeding method takes 8 to 10 years to breed a cultivar, and the anther culture method developed to shorten the breeding cycle also takes 6 to 7 years. On the other hand, CRISPR/Cas9 accurately edits the target trait and can rapidly breed rice cultivars by editing the target trait as a homozygous in 2-3 years. In addition, exogenous genetic elements such as Cas9 can be isolated from the G1 generation. Therefore, the flowering time was regulated by applying CRISPR/Cas9 technology, and OsCKq1 genome-editing (OsCKq1-G) rice with early flowered and high yield was bred in the field. Genome-editing of OsCKq1 applied CRISPR/Cas9 technology up-regulates the expression of the flowering promotion gene Ehd1 under long-day conditions induces early flowering and increases the yield by increasing the 1,000-grain weight. And as the generations advanced, each agricultural trait indicated a low coefficient of variation. As a result, indicated that OsCKq1 plays an important role in regulating the flowering time and is related to the trait determining yield. Therefore, OsCKq1-G can suggest a breeding strategy for the Net-Zero national policy for reducing-methane gas emission rice by shortening the breeding cycle with the early flowered, and high-yield rice. CRISPR/Cas9 technology is a rapid and accurate breeding technology for breeding rice cultivars with important characteristics.

The assessment and political subject of Revised Security Industry Law (개정 경비업법의 평가와 정책과제)

  • This research analyzes and evaluates The Korean Security Industry Law(TKSIL) putting the regulation of the present government about the private security industry. It nowadays becomes the important axis of the police services offered in the aspect of 'the national life safety' in connection with 'the materialization of society which is safe from the crime'. TKSIL is one of the national administration strategies which Park Gun-hye government aims on supervision policy. After seeking out the core values of the private security industrial policy which sets up in order to approach the national life safety which Park Gun-hye government aims, we make some assessments of this revised security industry law systematically. Particularly all keynote of policy about the private security of the police tried to be confirmed and the desirable direction of policy tries to be presented as to the security industry law application and real operation. In the site of organized civil complaint, the revised security industry law was revised as the direction which intensifies the administrative regulation as to the partial regulation such as it established the reason of the introduction of the arrangement license system. And grounds for disqualification of security instructor and guard, and rules of punishment is intensified order to intercept previously illegal and violent act of the security company etc. However it has the feature that it accomplishes 'the law principle(principle of statute)' the substantial portion through the effort of them changing a lot the content for the form of the law when being the clauses of the fundamental human rights limit, although it has been prescribed in "the security industry law enforcement ordinance" or "the security industry law enforced regulation". The security industry law revised this time brought from the change of the sharp policy through the revision of 17 clauses or new establishment. It can divide into 4 categorizes. (1) strictness of punishment in the site of organized civil complaint (2) Intensification of throwing out for the violation person in the private security business market time-limitedly (3) Intensification of the legal guide supervision power of police (4) upstream of the capital, name tag attachment under compulsion and the limit about other equipment use etc. Essentially "the security industry law" cannot help regulating the national interference of the private security and regulation with this content. However as to this interference and regulation, the limit has to be possible within reasonable range. As the history proved, excessive regulation by the country is not only due to bring the distortion of the security system of nation but also provoke national social cost. It can't be disregards ever that it premises the harmony which appropriate as well as reasonable in the socio-economic dimension for drawing the best combination that all things which get the compulsory education, it limits the person providing the private security service to the corporation, or it limits to the certificate of qualification holder are the ultimate for 'the safety of the national life'.

Limitations and Challenges of Game Regulatory Law and Policy in Korea (현행 게임규제정책의 한계와 과제 : 합리적인 규제를 위한 고려사항)

  • The laws and policies governing Korea's game regulations are becoming more and more topics for debate as we enter the Age of Internet. The nature of the basis for Internet regulations and policies are not rooted in freedom of speech or fundamental values of democracy, but rather focused on solving real-world problems such as protection of the youth. Furthermore, the reality is that regulatory devices for keeping the social order such as regulating gambling are being applied directly to games without consideration on the characteristics of Internet gaming, raising concerns that the expansion of constitutional values and innovative empowerment inherent to the Internet are being weakened. The Geun-Hye Park Administration which succeeded Myung-Bak Lee's Administration, even went so far as to implement the so-called "Shutdown Policy", which prohibits access to Internet games during pre-defined time zones and also instigated a time zone selection rule. In order to curb the gambling nature of Internet games, government-led policies such as the mandatory personal identification and prohibition of player selection or in other words mandatory random player selection are being implemented. These institutions can inhibit freedom of speech, which is the basis of democracy, violate the right of equality through unreasonable discrimination between domestic and foreign service providers, and infringe upon the principles of administrative law, such as laws, due process in policies, and balance in among policies and governmental bodies. Going forward, if Korea's Internet game regulations and polices is to develop in a rational manner, regulatory frameworks will need to be designed to protect the nature of the Internet and its innovative values that enable the realization of constitutional values; for example, the Internet acting as the "catalytic media for freedom of expression as a fundamental human right ", which has already been acknowledged by the Korea's Constitutional Court. At the same time, transparent procedures should be put into place that will allow diverse participation of stakeholders including game service providers, game users, the youth and parents in the legislation and enforcement process of regulatory institutions; policies will also need to be transformed to enable not only regulatory laws but also self-regulation system to be established. And in this process, scientific and empirical analysis on the expected effects before introducing regulations and the results of enforcing regulations after being introduced will need to be strengthened.

Deficiencies of China's General Aviation Law and its Improvement (중국 일반항공법의 법적 흠결과 개선방향)

  • General aviation is an integral part of civil aviation and involves the widest range of aviation segments except commercial aviation. Featured with different operational procedures and practices to satisfy the economic needs and safety requirements of a sovereign state, general aviation tends to be regulated by an individual state. The last three decades have seen exponential growth of commercial air transport in China, but its general aviation sector has remained disproportionally underdeveloped. With the deepening of the reform of low-altitude airspace, the sector is poised for a radical change and rapid growth. However, legislation governing general aviation activities in China is distorted causing inconsistency and confusions in their application and implementation. This paper aims to analyse China's prevailing legislation regulating general aviation activities. It first discusses the various definitions adopted by ICAO and its member states and reviews the development of general aviation in the US, EU, Australia and China. It then examines the sources of China's general aviation laws, e.g. Chicago Convention and its annexes, and Chinese domestic legislature which covers legislation, laws, directives, rules and procedures. The paper continues to analyse and establish the deficiencies of its prevailing legal framework by pointing out the following: variation of definitions in different regulations, inconsistency of principles in existing laws and regulations, legal vacuum concerning government subsidy, environment protection, safety and security, and other operational areas such as aerial club, sightseeing, and search and rescue. In this process, the paper argues that a coherent, consistent and systematic legal framework is required in order to ensure fair competition and safety for a healthy, progressive and sustainable general aviation growth. Suggestions for rectification and improvement are proposed.

  • Recently the concerns on online ticket resale have been globally soared. Numerous countries have dealt with problems about online ticket tout and resale platforms in various ways in spite of differences of scope and method on restrictions. However, in contrast with the worldwide concerns and actions, Korea has been relatively slow to take any action against regulating online ticket resale issues, and any legislation has not been made. At the end of 2020, a revised Performance Act was passed and enforced from June, 2021. With the enforcement of the bill, this study aims to provide an exploratory analysis to present current situation related to online secondary ticket resale policy in Korea. It examined how US and England have coped with legislation for online ticket resale. And then it attempted to illuminate the current situation of legislation and restrictions on online secondary ticket market in Korea and examined the effectiveness of the revised Act. Finally, this study suggested that there should be prompt consideration and actions to carry out related policies for establishing stable market ecosystem and providing fair opportunities to consumers.

Risk Assessment on the Water BOT Business Participation in China : Domestic EPC Contractor's View (해외기업의 중국 수처리 BOT시장 참여 저해 위험요인 분석 : 국내 EPC 건설기업의 관점)

  • China water market has huge potential for increased use of BOT mode and one of the most attractive markets of doing business. However, the current China water BOT market shows that many foreign companies are retreating from the market while Chinese water companies fast growing. From the view no domestic companies have track records in China BOT water market, the research identified twenty market access barriers in terms of construction laws, regulations, BOT-related policy and the recent market situation. These are evaluated based on interview results with 10 professionals direct or indirect having a China water BOT experience. All the factors are found to be highly influential to foreign company's decision on the market participation. Among those, no fixed return policy and low water price, difficulty in water price adjustment and approval, and no government guarantees, all directly related to the project viability and under the control of government, were the most critical factors, implying government's role is the key in increasing the market competition by attracting more foreign participation on the market. In addition, new construction law regulating foreign EPC contractor's construction work, namely Decree 113, and requirement of applying competitive bidding in selecting EPC contractor in a BOT project are also considered signigicant barriers on foreign participation, which contradicts international norm and therefore necessitates an adjustment on current decision process in domestic companies.

Effects of Salinity Stress on the Composition of Free Amino Acids of the Pacific abalone Haliotis discus discus (염분 스트레스가 둥근전복 Haliotis discus discus의 유리아미노산 조성에 미치는 영향)

  • Changes in 13 free amino acids (FAA) of Haliotis discus discus exposed to various salinities were investigated using a high performance liquid chromatography (HPLC). Taurine, glycine and alanine are three major contributors to the total FAA in the gill tissues of H. discus discus. Concentration of taurine was 114 imol/g dry tissue weights accounting for 76.64% of total FAA in H. discus discus. Levels of most FAAs in H. discus discus exposed to low and high salinities for 24 h decreased dramatically. Taurine concentration was slightly increased in the samples exposed to 20 psu and 25 psu for 48 h, and greatly increased after 120 h exposure. After 48 hrs exposure to 20 psu, 25 psu, 30 psu and 40 psu, methionine in H. discus discus was not detected; no methionine was detected in the sample exposed to 20 psu, 25 psu, 30 psu and 40 psu after 120 h of exposure. Taurine:glycine ratio increased depending upon hyper-hypoosmotic condition as well as period of osmotic stress. These data indicate that taurine, glycine and methionine play important role in regulating osmotic stress in H. discus discus. This study suggesting that FAA analysis is a useful tool to diagnose osmotic stress to H. discus discus.

Conflict resolution and political tasks on the usage of beauty care devices by beauty artists (미용업종사자의 미용기기 사용에 대한 분쟁해결과 정책적 과제)

  • In contemporary society interest in and consumption of beauty treatment are increasing, raising interest in health and beauty. However, beauty-related laws are becoming factors of hindrance of beauty development. Currently the Public Health Control Act plays a basic role in the beauty art business in Korea, However the contents are in discord with international laws and its definition is not clear. Therefore it is causing conflicts of different occupations and job associations which are similar to art business. Especially, because neither definitions nor policies on beauty care devices exist in the Public Health Control Act, beauty care devices using in foreign countries cannot be used in Korea due to classification as medical devices. Under this circumstance, therefore, beauty care device uses by beauty artists violate the law. The government has tried to solve these irrational regulations. Recently, the Small and Medium Business Administration announced 'the improvement plan of small business and young founders site regulation for public economy recovery' in a ministerial meeting on December 28, 2016. Regulations on policy preparation for skincare devices were inclusive in this announcement. It is the question whether the regulations will be executed or not. Even though beauty industrial competitiveness was presented in the 18th Presidential Council on National Competitiveness in 2009, it was not practiced. The proposal bills for beauty law improvement have been put forth several times since 2000 including an improvement plan for regulating beauty care devices. However, so far there have been no improvements. The damage on the regulation classifying beauty devices as medical devices is not only restricted to skincare. This develops beauty devices and the beauty industry which imports and exports beauty devices. When beauty devices are exported, complicated procedures are unavoidable and when beauty devices are imported, irrational problems like reregistration procedures and costs occur. The reason why an improvement plan has not gone into practice is the resistance of the dermatologists' association. Dermatologists tend to stand positively against harming public health by saying that beauty devices used by beauty artists cause people to suffer side effects. In contrast, anyone who has a licence to use beauty devices is able to use them in foreign countries. It is not only infringement of one's right as a beauty artist but also people's right to receive beauty care services. With this reason, Korean's current law under which beauty devices are ruled as medical devices should be revised with accordance to domestic surroundings. Therefore in order to advance and globalize the beauty industry, the support and cooperation of the Korean government and relevant associations is needed to legislate and revise the beauty devices laws. The relevant associations abandon regional self-centeredness and cooperate to define ranges, size and management of beauty devices for safe use. If no collaboration exists, an arbitration agency should be established to solve the problem.

  • In the mordern society, the reliance on the cyber domain and the cyber connectivity has been increasingly strengthened. Due to this phenomenon, the cyberterror against critical infrastructures and state organs might lead to fatal consequences. Lately, North Korea's cyberattacks against South Korea's national organizations and financial computer networks are becoming more and more intelligent and sophisticated. The cyberattacks against such critical infrastructures have caused enormous economic loss and social disorder. This paper is designed to examine comparatively the cyberterror related laws and organizations of the advanced countries such as U.S. and U.K. and to draw implications. Although those countries are under different institutional and cultural backgrounds with varying security envrionments, they are identically pursuing measures by establishing government-wide counterterror system for coordination and cooperation. They are also commonly focusing upon creating new organizations equipped with new system and upon enhancing intelligence performance and devising punishment regulations. Korea is lack of framework laws regulating cyber security, having only scattered individual laws. Since such legal base is far from efficient counterterror activities, it is necessary that the legal and policy response of the advanced countries should be closely studied for selective introduction. That will eventually lead to legislation of cyber security law. With such legislation on hand, it is subsequently required to strengthen crisis management for prevention of cyberterror and to create joint response team, cooperating with private organizations.
