특허 연계 스토리텔링의 멀티소스/멀티유즈 모델 (Multi-Source/Multi-Use Model of Storytelling Related to Patent)

  • 본 연구에서는 지식재산의 일종인 특허와 관련된 비즈니스 영역에서 스토리텔링을 융합한 특허 연계 스토리텔링의 모델을 새롭게 제안하였다. 특허와 관련된 스토리텔링의 대상고객, 목적, 응용분야의 다양성이라는 관점에서 기존의 OSMU 모델, 트랜스미디어스토리텔링 및 크로스미디어 스토레텔링과의 차이를 살펴보았다. 비즈니스에서는 특허 기술의 발명에서부터 특허 출원과 등록, 무효소송과 침해소송 및 손해배상소송 등의 법적분쟁, 특허를 이용한 상품화, 홍보 및 마케팅 등의 다양한 과정이 존재한다. 또한 하나의 특허가 다양한 응용분야에 융복합적으로 활용되는 점과 각각의 과정에서 요구되는 목적에 따라 갖가지 스토리의 원천이 다양하게 존재할 수 있고 설득하고자 하는 대상과 목적에 따라 스토리텔링을 다양하게 활용할 수 있다. 이러한 관점에서 다중출처-다중활용 또는 멀티소스-멀티유즈(MSMU, Multi-Source Multi-Use)의 특징을 가지는 특허 연계 스토리텔링의 모델을 새롭게 제안하였다. 또한 특허 연계 스토리텔링 사례를 통해 MSMU 모델의 효용성과 유용성을 제시하였다.

저작권 소송 절차에서 디스커버리 도입에 관한 소고 (A Study on the Adoption of Discovery in Copyright Litigation)

  • 우리나라 소송 체계에서 증거 등의 구조적 편재문제는 여전히 해소되지 않는 난제로 남아있다. 과거 이를 해결하기 위하여 많은 방법론적 논란이 있었으나, 최근에는 미국의 디스커버리와 같은 제도의 도입이 필요하다는 점이 더 이상 논란이 되지는 않는다. 이에 지식재산권 분야에서는 특허법을 중심으로 한 다양한 입법적 시도를 통한 제도 개선이 도모하고 있는 상황이다. 반면 컴퓨터프로그램저작물 등에 대한 저작권 침해 소송이 점차 고도의 기술적 특징을 배경으로 하는 경우가 많아짐에도 불구하고 디스커버리에 관한 논의는 거의 발견되지 않는다. 특허법 등의 경우 디스커버리와 같은 제도를 나름의 형태로 도입함으로써 이 문제를 적극적으로 해결하려는 모습과 대비된다. 컴퓨터프로그램저작물을 중심으로 한 저작권법 체계 역시 침해 소송에서 증거 등의 확보는 매우 중요하나 현실적으로 많은 한계를 나타내고 있다. 그러다 보니 실무에서는 침해물을 적절히 확보하지 못한 상태에서 소송을 진행할 수 밖에 없는 모습도 나타난다. 이에 저작권 침해 소송에서도 디스커버리와 같은 제도 보완이 요구되며, 현재 활용되는 다양한 방법을 중심으로 어떠한 방법론으로 접근이 필요할 지 검토해 보았다. 구체적으로는 미국의 디스커버리 제도 직접 적용, 특허법의 자료제출명령 준용 및 저작권법에 별도 제도 마련 방안을 검토하였다.

  • 특허권은 처음 새로운 아이디어를 생각해낸 창작자에게 독점권을 제공하여 꾸준한 창작에 도움을 주기 위한 권리이지만, 때로는 창작의 자유를 침해하는 결과를 낳기도 한다. 본 연구는 아케이드 게임기 분야에서의 음악게임 분야의 특허를 살펴보고, 이 분야의 주요 업체인 코나미사가 특허 소송을 반복함으로써 경쟁사를 견제하고 시장을 정체시킨 사례를 통해서 게임 분야에서의 기술 특허권의 남용 문제를 밝히고자 한다. 아이디어 산업인 게임 분야에서 새로운 기술에 대한 특허권을 보장하는 것은 타당하지만, 조작 장치 등 일부 하드웨어의 기술적 특허만을 근거로 소송을 반복하는 것은 새로운 창작의 가로막아 시장 전체에 부정적인 영향을 줄 수 있다는 것을 살펴본다. 한국, 일본 등 세계 각지에서 진행된 여러 소송 사례를 살펴보고 그로 인한 시장의 변화를 통해서 분석해 보았다.

지적재산의 국제적 분쟁해결합의 (Agreements on International Intellectual Property Dispute Resolution)

  • This paper discusses to what extent the party autonomy can be allowed in intellectual property dispute resolution agreements in determination of governing law, international jurisdiction, and ADR agreement for arbitration, etc. in considering of the territoriality principle of IP. The party autonomy in choice of governing law and jurisdiction can be fully enjoyed in IP contract disputes. However, the freedom of choice is limited to the disputes regarding IF infringement disputes. The party autonomy is denied in the issues of determination of validity of patent or other IP rights. The author seeks the possibility to allow as much freedom in making choice of applicable law or jurisdiction, or entering into arbitration agreement.

특허 등록 예측을 위한 특허 문서 분석 방법 (Analysis method of patent document to Forecast Patent Registration)

  • 최근 지식재산권의 모방과 권리 침해는 국가 산업발전의 저해요소로 인식되고 있다. 많은 연구자들은 이러한 저해요소로 인하여 발생하는 막대한 손실을 막기 위해 지식재산권의 보호와 효율적 관리에 관한 연구를 다양하게 진행 중이다. 특히, 특허 등록 예측은 지식재산권 보호와 권리 주장을 위해 매우 중요한 연구이다. 본 연구는 텍스트 마이닝 기법을 이용한 특허문서 분석을 통하여 특허 등록 및 거절 여부를 예측하는 방법을 제안한다. 먼저 거절된 특허문서들의 단어 빈도수를 이용하여 데이터베이스를 생성한다. 그리고 생성한 데이터베이스와 다른 특허문서들을 비교하여 각 문서와 데이터베이스와의 유사한 정도를 판단하는 유사치를 도출한다. 본 논문에서는 특허 거절 기준 값을 선정하기 위하여 분할 군집화 알고리즘인 k-means 사용하였다. 그 결과로 거절된 특허 문서와 유사한 특허 문서는 거절될 가능성이 높다는 결론을 얻을 수 있었다. 실험을 위한 데이터는 현재 미국에 출원되어 있는 블루투스 기술, 태양전지 기술 그리고 디스플레이에 관한 특허 문서를 이용하였다.

전자상거래 보험의 담보범위에 관한 고찰 (A Study on the coverage of e-commerce insurance)

  • Todays, computers in business world are potent facilitators that most companies could not without them, while they are only tools. They offer extremely efficient means of communication, particularly when connected to Internet. What I stress in this article is the risks accompanied by e-commerce rather than the advantages of Internet or e-commerce. The management of e-commerce companies, therefore, should keep in mind that the benefit of e-commerce through the Internet are accompanied by enhanced and new risks, cyber risks or e-commerce risks. For example, companies are exposed to computer system breakdown and business interruption risks owing to traditional and physical risks such as theft and fire etc, computer programming errors and defect softwares and outsider's attack such as hacking and virus. E-commerce companies are also exposed to tort liabilities owing to defamation, the infringement of intellectual property such as copyright, trademark and patent right, negligent misrepresent and breach of confidential information or privacy infringement. In this article, I would like to suggest e-commerce insurance or cyber liability insurance as a means of risk management rather than some technical devices, because there is not technically perfect defence against cyber risks. But e-commerce insurance has some gaps between risks confronted by companies and coverage needed by them, because it is at most 6 or 7 years since it has been introduced to market. Nevertheless, in my opinion, e-commerce insurance has offered the most perfect defence against cyber risks to e-commerce companies up to now.

A Study on the Improvement of the Intelligent Robots Act

  • The intelligent robot industry is a complex which encompasses all fields of science and technology, and its marketability and industrial impact are remarkable. Major countries in the world have been strengthening their policies to foster the intelligent robot industry, but discussions on liability issues and legal actions that are accompanied by the related big or small accidents are still insufficient. In this study, therefore, the patent law by artificial intelligence robots and the legislation for relevant legal actions at the criminal law level are presented. Patent law legislation by artificial intelligence robots should comply with the followings. First, the electronic human being other than humans ought to be given legal personality, which is the subject of patent infringement. Even if artificial intelligence has legal personality, legal responsibility will be varied depending on the judgment of whether the accident has occurred due to the malfunction of the artificial intelligence itself or due to the human intervention with malicious intention. Second, artificial intelligence as a subject of actors and responsibility should be distinguished strictly; in other words, the injunction is the responsibility of the intelligent robot itself, but the financial repayment is the responsibility of the owner. In the criminal law legislation, regulations for legal punishment of intelligent robot manufacturing companies and manufacturers should be prepared promptly in case of legal violation, by amending the scope of application of Article 47 (Penal Provisions) of the Intelligent Robots Development and Distribution Promotion Act. In this way, joint penal provisions, which can clearly distinguish the responsibilities of the related parties, should be established to contribute to the development of the fourth industrial revolution.

한국 의류산업의 의장(디자인) 등록 추세와 의장제도에 관한 연구 - 의복류(의장분류 B1)의 의장 등록을 중심으로 - (The Analysis of Registration of Design Rights in Korean Apparel Industry - Design Rights Registered in Apparel (Classification B1) -)

  • The present study was to analyze the trend of registration of design rights in apparel products and tc point out problems of current protection law to design. The research data was total 1,850 design rights in apparel that have been registered to the Korean Patent and Trademark Office from the first design registered in March 1, 1963 through those registered in April 24, 2003. All design rights were analyzed by the year, by the type of product, and by the type of applicant. And also design rights registered under the revised design registration system(without examination) were analyzed by the trait. The results of the study were as follows: (1) Sweater & polo shirts, underpants, and the Korean traditional dress were three major single categories registered in apparel : (2) 54.3% of total design rights in apparel was registered since the legal system of design rights has been revised in March 1, 1998 : (3) Registration by individual applicant were 71.7% of total; (4) About 60% of total design rights were for aesthetic, but in some categories such as vest. brassiere, undershirts, designs for function were more frequently registered than others. And total 68 design rights for the symbol of the organization or uniform, were registered in upper outerwear and pants : (5) As problems of the current legal protection system for designs, the term of “design”(expressed in Korean), double registration of similar designs, malicious intention to register other's trademark as his/her own design. The current legal system for design rights were more used for the product that has relatively long life cycle. And the revised law has been effective in encouraging the registration of design rights. However. the current design law still has some problems to be revised to prevent design rights or trademark infringement.

인체 유래 물질의 재산권성에 대한 의료법학적 고찰 (Medicolegal Study on Human Biological Material as Property)

  • (Background) Recent biotechnological breakthroughs are shedding new lights on various ethical and legal issues about human biological material. Since Rudolph Virchow, a German pathologist, had founded the medical discipline of cellular pathology, issues centering around human biological materials began to draw attention. The issues involving human biological materials were revisited with more attention along with series concerns when the human genome map was finally completed. Recently, with researches on human genes and bioengineering reaping enormous commercial values in the form of material patent, such changes require a society to reassess the present and future status of human tissue within the legal system. This in turn gave rise to a heated debate over how to protect the rights of material donors: property rule vs. no property rule. (Debate and Cases) Property rule recognizes the donors' property rights on human biological materials. Thus, donors can claim real action if there were any bleach of informed consent or a donation contract. Donors can also claim damages to the responsible party when there is an infringement of property rights. Some even uphold the concept of material patents overtaking. From the viewpoint of no property rule, human biological materials are objects separated from donors. Thus, a recipient or a third party will be held liable if there were any infringement of donor's human rights. Human biological materials should not be commercially traded and a patent based on a human biological materials research does not belong to the donor of the tissues used during the course of research. In the US, two courts, Moore v. Regents of the University of California, and Greenberg v. Miami Children's Hospital Research Institute, Inc., have already decided that research participants retain no ownership of the biological specimens they contribute to medical research. Significantly, both Moore and Greenberg cases found that the researcher had parted with all ownership rights in the tissue samples when they donated them to the institutions, even though there was no provision in the informed consent forms stating either that the participants donated their tissue or waived their rights to ownership of the tissue. These rulings were led to huge controversy over property rights on human tissues. This research supports no property rule on the ground that it can protect the human dignity and prevent humans from objectification and commercialization. Human biological materials are already parted from human bodies and should be treated differently from the engineering and researches of those materials. Donors do not retain any ownership. (Suggestions) No property rule requires a legal breakthrough in the US in terms of donors' rights protection due to the absence of punitive damages provisions. The Donor rights issue on human biological material can be addressed through prospective legislation or tax policies, price control over patent products, and wider coverage of medical insurance. (Conclusions) Amid growing awareness over commercial values of human biological materials, no property rule should be adopted in order to protect human dignity but not without revamping legal provisions. The donors' rights issue in material patents requires prospective legislation based on current uncertainties. Also should be sought are solutions in the social context and all these discussions should be based on sound medical ethics of both medical staffs and researchers.
