한국형 경항공모함 항공관제체계에 대한 연구 (A Study on the air traffic control system of Korea Light Aircraft Carrier)

  • 항공모함은 해상에서 항공기지 역할을 하는 전투함으로 항공기를 운용하는 군용함정으로 탑재된 항공기를 통하여 전투를 수행한다. 해군은 2033년경 수직이착륙 전투기와 헬기를 탑재할 수 있는 4만 톤급의 경항공모함 운용계획을 제시하였는데 본 연구는 이러한점에 착안하여 해외사례를 기초로 우리나라에서 경항공모함을 운영에서 요구되는 항공지원시스템 가운데 항공관제장비의 운영에 대해 고찰하였다. 필수장비로 공역 관제를 위한 PriFly, TWR의 ILARTS, ILM와 접근관제를 위한 ASR, PAR, LAAS 또는 RNAV, PALS(JPALS) 이 필요하며, 항행안전시설을 위한 URN-25 TACAN, ICLS(El/Az), ACLS OLS, MOVLAS, IFLOLS 등과 함께 통신네트워크를 위한 LINK-16 및 CEC, SATCOM이 요구되며, 적아 식별장비의 구축이 요구된다. 본 연구는 2부로 구성되며 2부에서는 구체적인 항공모함에서의 관제 방법을 기술할 것이다.

  • The Safe Operating Envelope (SOE) combined with Short-Take-Off and Vertical Landing (STOVL) performance is an essential consideration of a light aircraft carrier for design of hull shape with excellent seakeeping performance in terms of naval air operations as well as traditional naval ship missions such as Transit and Patrol (TAP), and Replenishment at Sea (RAS) and so on. A variety of procedures are systematically combined to determine SOE considering rather complicated missions associated with operation of aircraft onboard. The evaluation of take-off and landing safety missions onboard should consider wind effect on deck and severer seakeeping indices and standards compared with conventional naval ships. In order to support take-off and landing missions, various support activities of the crews are required. So, additional evaluation is needed for indicators such as MSI(Motion sickness Index) and MII(Motion Induced Interruptions), which are quantitative indicators of work ability that appear as a result of motion response. In this study, a standard procedure is developed including the seaworthiness performance indicators, standards, and evaluation procedures that should be considered during design of STOVL aircraft carrier. Analysis results are discussed in terns of air-wake on deck as well as seakeeping indices associated with design parameter changes in view of conceptual design of a light aircraft carrier.

  • 항공모함은 군용함정이 항공기를 통하여 전투를 수행하기 위하여 항공기의 질서정연한 흐름유지가 필요하다. 항공기 흐름유지는 함정과 항공안전을 강화하기 위한 중요한 요소이다. 항공기 흐름유지를 위해서는 현재 운용 중인 레이더 기반의 감시정보와 CNS 통합 기술에 기반을 둔 감시 장비들에 의한 감시정보를 동시에 수용하여 보다 양질의 관제정보를 제공하는 최첨단 항공관제시스템을 개발이 필수적이다. 이를 위하여 본 연구는 이러한 점에 착안하여 해외 사례를 기초로 우리나라에서 경항공모함을 운영하기 위해 요구되는 항공지원시스템(Aviation Support System)과 항공관제장비(Air Traffic Control System)의 운영에 대해 구체적인 관제 장비의 기능 및 운영 방법 관하여 기술 한다.

  • Today distant oceans around the world are regarded as a major 'global commons' for international trade and transportation. Korea is not an exception, because Korea hugely depends on sea lines of communication (SLOC) for supplying vital commodities such as food and energy resource. As a result, assuring a free and safe use of distant ocean beyond territory is also an important agenda for Korea's maritime security. However there are a number of challenges for Korea to enjoy a free and safe use of distant ocean; dangers of regional maritime conflict in East Asia, naval arms race of China and Japan, and concerns on possible decline of U.S naval presence and power projection capabilities. These factors provide a reasonable basis for Republic of Korea Navy (ROKN) to pursue capabilities for major naval operations at distant ocean in a long-term perspective toward the year 2030. The introduction of aircraft carrier and nuclear-powered submarine is a key requirement for achieving this goal. ROKN needs to acquire a 'multi-role strategic landing platform' type of light aircraft carrier, which takes a role to escort naval task force by providing air superiority at distant ocean. Additionally nuclear-powered submarine will offer ROKN a formidable power to carry out offensive missions effectively at distant ocean.

  • Aircraft carriers: are they national platforms to maximize national interest or just simply paper tigers to be little useful for states' development? To some states such as U.S., U.K, and France, aircraft carriers functioned as national assets which is indispensable to their interest. By contrast, Thailand's aircraft carrier was a dead platform which is useless to its national interest and India's ones were little used on the mission field. What is the mechanism leading to this difference? The key is whether states make aircraft carriers connected to overall national evolution when it comes to establishing military strategy and planning a long-term force structure. Put it another way, conditions to acquire them need to be analyzed regarding two variables-national status(prestige and economic power) and threat(mission)-for the future as well as in the present. The former acquired carriers under the condition of making them becoming national platforms which is balanced with their overall development. However, the latter simply bought them without carefully taking account of economic obstacles, e.g., the poverty rate, when it comes to force planning. At the same time, we should not neglect to identify that states of the former cases might have a hard time in maximizing their key interests if they did not have carriers. Accordingly, conditions on carriers' acquisition need to be carefully examined and a typological theory suggested here could shed light on this process. This theory shows that South Korea's status is eligible to have a necessary and sufficient condition to acquire carriers.

함정의 작전중 항해 안전성에 관한 종합 평가 (An Integrated Evaluation of Navigational Safety for Navel Vessels)

  • The seakeeping performance can be defined as the ability of a ship to go to sea, and successfully and safely execute its missions even in adverse environmental conditions. From the viewpoint of safe operation, it is primarily important to estimate the seakeeping performance of a ship in a seaway. A method of evaluating navigational safety is presented by means of the integrated seakeeping performance index(ISPI) by measuring only vertical acceleration. Judgement of dangerousness is carried out for two types of naval vessels in applying the involuntary speed losses. The used models for computer simulation are Lpp 175m light aircraft carrier and Lpp 93m frigate. In developing the practical evaluation system of navigational safety, it is expected to be useful to solve the difficulties in measuring factors by sensors. The results are also useful for developing the optimum type of naval vessels by applying at the initial design phase.

국제항공운송협약상(國際船空運送協約上) 사고(事故)의 개념(槪念) (The Concept of "Accident" under the Warsaw System)

  • 본고는 바르샤바 협약 제17조의 "사고"(accident)의 개념을 주로 미국의 판례를 통하여 분석하였다. 국제항공운송 중에 어떤 "사건"(incident)이 있었고, 그로부터 손해가 발생되었다고 하더라도 그것이 "사고"(accident)가 아니라고 판단되면 바르샤바 협약에 의한 손해배상이 불가능해지므로, 사고의 개념은 협약의 적용을 결정짓는 매우 중요한 개념이다. 근래 항공운송량의 증가와 항공운송체계의 변화에 따라, 항공기상 발생하는 사고의 유형도 매우 다양하게 나타나게 되었고, 이로써 협약 제17조의 의미와 범위에 대한 논쟁은 더욱 심화되었다. 특히 근래에 들어서는 승객간의 분쟁이나 승객과 승무원간의 분쟁, 그리고 이와 유사한 소란 등이 사고의 개념에 포함되는지 여부가 문제되고 있다. 본고에서는 바르샤바협약 제17조의 사고의 개념에 관한 각국의 판례의 추이를 검토하여 사고여부를 판단하는 기준을 제시하였다. 특히 근래의 새로운 현상인 승객간의 가해행위와 승객과 승무원간의 가해행위 등에 관하여 사고의 개념 적용여부를 살펴보았다. Saks 판결 이후 법원은 바르샤바 협약 제17조의 "사고"의 개념을 크게 확대 해석하는 경향이 있었다. Saks 판결은 사고를 예측불가능하고 비정상적인 항공기의 운항으로 정의하였다. Tseng사건에서 법원이 제17조의 사고는 일상적인 검색의 경우까지 포함한다고 판시하여 사고 개념파악을 더 복잡하게 만들었다. Wallace 판결은 혼란을 가중시켰다. 법원은 절대적 책임을 승객간의 불법행위에까지도 적용하였다. Wallace 판결은 항공 운송인의 원인 제공 관련성의 문제를 왜곡시켰을 뿐만 아니라, 사고 개념의 입법 의도나 바르샤바 협약의 제정목적을 일탈하여 항공 운송인의 책임을 가중시켰다. 본 판결은 항공운송인의 책임은 일반 운송 수단보다 훨씬 더 엄격한 책임인 것으로 파악하였다. 협약의 제정자들이 사고의 개념을 명확하게 정의하지 않음으로써 융통적인 해석의 여지를 남겨놓은 것은 시대의 변화를 수용하도록 한 것으로 이해할 수 있다. 그러나 그렇다고 해서 제정자들의 협약 제정의도를 무시하여서는 안 된다. 몬트리올 협약에서 제시된 새로운 책임체제나 2단계책임체제는 "사고"의 개념에 변화를 가져온 것은 아니다. 어떤 승객이 다른 승객에게 불법행위를 가한 경우 항공 운송인이 원인을 제공하지 않은 이상 항공기의 운항과 관계가 없으며 바르샤바 협약상 항공운송인의 책임이 성립하지 않는다고 보아야 할 것이다. 따라서 항공기의 정상적인 운행 가운데 발생한 손해이거나 항공여행 고유의 위험이 아닌 경우 항공운송인의 책임은 배제되어야 할 것이다. 현재 몬트리올 협약에서와 같이 조약 문언의 개정 없이 사고의 개념을 협약의 목적에 맞게 해석하기 위하여는 다음과 같은 분석이 필요하다고 본다. (i) 사고 승객 내부 요인이 아니라 예측 불가능 한 외부적 요인이 발생하였는가 여부, (ii) 사건이 항공기의 비정상적 운행으로 인하여 발생하였는지 여부, (iii) 사건이 손해의 직접적인 원인인지 여부, (iv) 항공 운송 고유의 위험인지 여부를 살펴보아야 한다. 모든 사고가 반드시 항공운송 고유의 위험일 필요는 없지만, 항공운송 고유의 위험이 발생한 경우에는 조약상의 사고의 개념에 포함될 수 있다. 다만 승객간의 분쟁에 의한 사고는 협약상의 사고로 보는 것은 지양되어야 한다.

국제항공(國際航空)테러리즘으로 인한 여객손해(旅客損害)에 대한 운송인(運送人)의 책임(責任) ("Liability of Air Carriers for Injuries Resulting from International Aviation Terrorism")

  • The Fundamental purpose of the Warsaw Convention was to establish uniform rules applicable to international air transportation. The emphasis on the benefits of uniformity was considered important in the beginning and continues to be important to the present. If the desire for uniformity is indeed the mortar which holds the Warsaw system together then it should be possible to agree on a worldwide liability limit. This liability limit would not be so unreasonable, that it would be impossible for nations to adhere to it. It would preclude any national supplemental compensation plan or Montreal Agreement type of requirement in any jurisdiction. The differentiation of liability limits by national requirement seems to be what is occurring. There is a plethora of mandated limits and Montreal Agreement type 'voluntary' limits. It is becoming difficult to find more than a few major States where an unmodified Warsaw Convention or Hague Protocol limitation is still in effect. If this is the real world in the 1980's, then let the treaty so reflect it. Upon reviewing the Warsaw Convention, its history and the several attempts to amend it, strengths become apparent. Hijackings of international flights have given rise to a number of lawsuits by passengers to recover damages for injuries suffered. This comment is concerned with the liability of an airline for injuries to its passengers resulting from aviation terrorism. In addition, analysis is focused on current airline security measures, particularly the pre-boarding screening system, and the duty of air carriers to prevent weapons from penetrating that system. An airline has a duty to exercise a high degree of care to protect its passengers from the threat of aviation terrorism. This duty would seemingly require the airline to exercise a high degree of care to prevent any passenger from smuggling a weapon or explosive device aboard its aircraft. In the case an unarmed hijacker who boards having no instrument in his possession with which to promote the hoax, a plaintiff-passenger would be hard-pressed to show that the airline was negligent in screening the hijacker prior to boarding. In light of the airline's duty to exercise a high degree of care to provide for the safety of all the passengers on board, an acquiescene to a hijacker's demands on the part of the air carrier could constitute a breach of duty only when it is clearly shown that the carrier's employees knew or plainly should have known that the hijacker was unarmed. A finding of willful misconduct on the part of an air carrier, which is a prerequisite to imposing unlimited liability, remains a question to be determined by a jury using the definition or standard of willful misconduct prevailing in the jurisdiction of the forum court. Through the willful misconduct provision of the Warsaw Convention, air carrier face the possibility of unlimited liability for failure to implement proper preventive precautions against terrorist. Courts, therefore, should broadly construe the willful misconduct provision of the Warsaw Convention in order to find unlimited liability for passenger injuries whenever air carrier security precautions are lacking. In this way, the courts can help ensure air carrier safety and prevention against terrorist attack. Air carriers, therefore, would have an incentive to increase, impose and maintain security precautions designed to thwart such potential terrorist attacks as in the case of Korean Air Lines Flight No.858 incident having a tremendous impact on the civil aviation community. The crash of a commercial airliner, with the attending tragic loss of life and massive destruction of property, always gives rise to shock and indignation. The general opinion is that the legal system could be sufficient, provided that the political will is there to use and apply it effectively. All agreed that the main responsibility for security has to be borne by the governments. I would like to remind all passengers that every discovery of the human spirit may be used for opposite ends; thus, aircraft can be used for air travel but also as targets of terrorism. A state that supports aviation terrorism is responsible for violation of International Aviation Law. Generally speaking, terrorism is a violation of international law. It violates the soverign rights of the states, and the human rights of the individuals. I think that aviation terrorism as becoming an ever more serious issue, has to be solved by internationally agreed and closely co-ordinated measures. We have to contribute more to the creation of a general consensus amongst all states about the need to combat the threat of aviation terrorism.

EC 항공여객보상규칙상 특별한 사정의 의미와 판단기준 - 2008년 EU 사법재판소 C-549/07 (Friederike Wallentin-Hermann v Alitalia) 사건을 중심으로 - (The Meaning of Extraordinary Circumstances under the Regulation No 261/2004 of the European Parliament and of the Council)

  • 본 논문은 국내 선행연구가 아직 이루어지지 않은 2008년 EU 사법재판소의 Friederike Wallentin-Hermann v Alitalia 판결을 검토하고, EU의 항공여객보상에 관한 EC 261/2004 규칙 제5조 제3항의 특별한 사정의 의미와 판단기준을 분석한 논문이다. EC 261/2004 규칙상 특별한 사정의 의미와 그 범위는 항공운송인의 여객보상책임을 면제한다는 측면에서 매우 중요한 의의를 갖는다. 그러나 EC 261/2004 규칙의 문면상 특별한 사정의 법리해석이 명확하지 않기 때문에 이를 구체적으로 파악하기가 쉽지 않다는 문제가 있다. 2008년의 Friederike Wallentin-Hermann v Alitalia 판결에서는 이에 대한 일정한 판단기준을 설정하였다는 점에서 지금까지 많은 사례들에서 확립된 선례로 인용되고 있다. 다만 그 이론구성에 관하여는 다음과 같은 2가지의 문제점이 있다. 첫째, 본건 항공기의 기술적 문제는 EC 261/2004 규칙 전문 (14)에서 특별한 사정의 예시로 들고 있는 '예상치 못한 안전운항상의 문제'와 관련된 것이다. 그러나 EU 사법재판소는 예상치 못한 안전운항상의 의미나 그 유형에 관하여는 아무런 언급이 없고, 본건 기술적 문제를 항공운송인의 통상적인 고유한 업무라는 측면에서 강조하고 있다. 항공기의 기술적 문제, 본건에서 문제된 엔진터빈의 복합적 결함은 안전한 항공운항의 장애요인으로, 안전운항상의 문제가 명확하다. 또한 항공운송인은 실제로 항공정비에 관해 법적인 정기검사를 시행해 오고 있었으나, 예상치 못한 엔진터빈 문제로 결항이라는 예상치 못한 사정이 발생된 것이다. 또한 수차례의 항공정비에 의해서는 발견되지 않는 기술적 문제가 비행기 이륙 직전, 항공기 기장에 의해 기술적 문제로 발견되는 경우에는 특별한 사정으로 판단될 수 있는 것은 아닌가 하는 의문도 제기된다. 만약 이러한 점들이 EC 261/2004 규칙 제5조 제3항의 특별한 사정이 아니라면, 무엇이 특별한 사정으로 포섭될 수 있는지 명확하게 단언하기 어려울 것이 다. 즉, 이와 같은 논리전개에 따른다면, 본건 기술적 문제는 EC 261/2004 규칙 제5조 제3항의 특별한 사정으로 판단할 여지도 있다는 점이다. 이에 대한 판단 자체를 유보한 사법재판소의 판시사항은 문제가 있다고 본다. 둘째, EU 사법재판소는 기술적 문제의 발생빈도 자체만으로는 EC 261/2004 규칙 제5조 제3항의 특별한 사정의 존재 여부를 결정짓는 요소로 판단할 수 없다고 설명하고 있는데, 이에 대하여도 의문이 제기된다. 본건 기술적 문제의 발생빈도 횟수가 만약 극도의 비정상적인 패턴으로 발생하는 경우라면, 이를 단순히 통상적 고유업무의 범위에서만 파악할 수 있겠느냐 하는 점이다. 즉, 항공정비와 같은 기술적 문제를 해결하고자 할 때, 항공운송인이 모든 주의를 기울여 합리적인 조치를 취했음에도, 비정상적인 발생빈도의 형태로 기술적 문제가 발생하는 경우라면, 이는 특별한 사정에 해당될 수도 있게 된다. 예컨대, 평균이상의 발생빈도라는 것이 추후에 항공기의 제조상 결함과 같은 문제로 판명될 수도 있으며, 기계적 설비의 운용상 발생할 수 있는 숨은 결함으로 인해 다발적인 기술적 문제가 발생할 수도 있다. 본 사안에서 EU 사법재판소는 평균적인 발생빈도와 본건 기술적 문제의 발생빈도 간의 특이성 규명 나아가 발생빈도로 인해 특별한 사정을 구성하게 되는 실질적인 요소 및 과정 등에 대하여 상세하게 검토하지 않았다. 리딩케이스로 취급되는 본 판결의 해석론 치고는 다소 아쉬운 점이라 볼 수 있겠다.

최근국제항공보안대책(最近國際航空保安対策)의 제간제(諸間題) -특히 법적측면(法的測面)을 중심(中心)으로- (Some New Problems of International Aviation Security- Considerations Forcused on its Legal Aspects)

  • This article is concerned with the comment on "Some New Problems of International Aviation Security-Considerations Forcused on its Legal Aspects". Ever since 1970, in addition to the problem of failure to accept the Tokyo, Hague and Montreal Conventions, there has been also the problem of parties to them, failing to comply with their obligations under the respective treaties, in the form especially of nominal penalties or the lack of any effort to prosecute after blank refusals to extradite. There have also been cases of prolonged detention of aircraft, passengers and hostages. In this regard, all three conventions contain identical clauses which submit disputes between two or more contracting States concerning the interpretation or application of the respective conventions to arbitration or failing agreement on the organization of the arbitration, to the International Court of Justice. To the extent to which contracting States have not contracted out of this undertaking, as I fear they are expressly allowed to do, this promision can be used by contracting States to ensure compliance. But to date, this avenue does not appear to have been used. From this point of view, it may be worth mentioning that there appears to be an alarming trend towards the view that the defeat of terrorism is such an overriding imperative that all means of doing so become, in international law, automatically lawful. In addition, in as far as aviation security is concerned, as in fact it has long been suggested, what is required is the "application of the strictest security measures by all concerned."In this regard, mention should be made of Annex 17 to the Chicago Convention on Security-Safeguarding International Civil Aviation against Acts of Unlawful Intereference. ICAO has, moreover, compiled, for restricted distribution, a Security Manual for Safeguarding Civil Aviation Against Acts of Unlawful Interference, which is highly useful. In this regard, it may well be argued that, unless States members of ICAO notify the ICAO Council of their inability to comply with opecific standards in Annex 17 or any of the related Annexes in accordance with Article 38 of the 1944 Chicago Convention on International Civil Aviation, their failure to do so can involve State responsibility and, if damage were to insure, their liability. The same applies to breaches of any other treaty obligation. I hope to demonstrate that although modes of international violence may change, their underlying characteristics remain broadly similar, necessitating not simply the adoption of an adequate body of domestic legislation, firm in its content and fairly administered, but also an international network of communication, of cooperation and of coordination of policies. Afurther legal instrument is now being developed by the Legal Committee of ICAO with respect to unlawful acts at International airports. These instruments, however, are not very effective, because of the absence of universal acceptance and the deficiency I have already pointed out. Therefore, States, airports and international airlines have to concentrate on prevention. If the development of policies is important at the international level, it is equally important in the domestic setting. For example, the recent experiences of France have prompted many changes in the State's legislation and in its policies towards terrorism, with higher penalties for terrorist offences and incentives which encourage accused terrorists to pass informations to the authorities. And our government has to tighten furthermore security measures. Particularly, in the case an unarmed hijacker who boards having no instrument in his possession with which to promote the hoax, a plaintiff-passenger would be hard-pressed to show that the airline was negligent in screening the hijacker prior to boarding.
