유엔에서 협약한 국제거래법규는 국가간의 물품매매 계약시에 지대한 영향을 행사하며 앞으로의 국제거래법에서 중요한 표준규범이 되리라 전망된다. 특히 국제거래법규는 영미법의 표준거래규범과 유사한 점이 많지만 세부적으로 살펴보면 상이점 또한 지대하다고 하겠다. 본 연구는 국제거래법규의 형성과정을 영미법을 근간으로 하고 있는 표준거래규범의 측면과 대륙법적 측면에 대한 이론적 구성을 계약형성과정을 통하여 세부적으로 검토하고자 한다. 아울러 국제거래법규의 입법취지의 이해를 돕고자 유엔에서 협약했던 유사한 국제거래규범들의 입법에 관한 역사를 연대순으로 정리하였다. 본 연구의 결론은 계약형성과정에서의 이론적 구성이 대륙법적 측면보다 영미법의 표준거래규범 측면에 있다는 것이다. 그러므로 본 연구는 영미법의 표준거래규범(U.C.C)과 더불어서 물품거래 계약시에 지대한 영향을 미치는 국제거래법규(CISG)에 대해서 근접적인 접근방식으로 고찰하였다.

국제거래에서 분쟁이 소송으로 발전될 경우 당해 사안에 적용될 준거법의 결정문제와 어느 나라의 법원에서 재판을 받을 것인가에 대한 국제재판관할권의 문제가 빈번히 대두되고 있다. 소송을 제기하는 당사자들로서는 자신에게 유리한 재판결과를 얻을 수 있는 법이 준거법으로 선택될 가능성이 있는 국가의 법원에 소송을 제기하는 소위 '포럼 쇼핑 (forum shopping)' 전략을 세우기도 한다. 이러한 포럼 쇼핑에 대응하기 위해 영미 판례법인 common law에서는 오래 전부터 forum non conveniens를 확립하였다. 본 논문에서는 forum non conveniens를 심리한 미국 대법원의 판단기준을 살펴보면 먼저, 적절한 대체관할지의 존재여부이며, 둘째 사적이익 부분에서 자국민이 현저하기 불리한 위치에 처하는지를 확인하고, 셋째 공적이익 부분에서 미국의 이익이 심각하게 침해되지는 않는지를 검토하여 판단하게 된다. 이러한 법리적 판단근거를 제시하고 이에 대한 적용사례를 분석하여 향후 무역거래를 포함한 일련의 국제계약에 있어 분쟁시 국내기업들이 미국법정에 재판받지 않고 국내법원으로 재판관할지를 선택할 수 있는 전략을 제시함으로써 패소가능성 등의 계약위험을 줄일 수 있을 것으로 판단된다.

핵물질 불법거래에 의해 제기되는 가장 큰 문제는 국제 핵확산 금지의 체계를 파괴하여 핵 위협을 가중시키는 것이며, 핵물질에 이해가 없는 사람에 의한 운반이나 보관 등의 책임에 의하여 방사선 방어상의 문제점을 일으킬 수 있다는 것이다. 최근에 급증하고 있는 핵물질 불법거래는 핵물질 확산금지에 커다란 문제를 야기하고 있다. 우리나라도 핵물질 불법거래 발생의 가능성이 있음을 인식해야 하며, 이에 대한 국가적 대책을 마련하여야 한다.

Adoption of applicable law for the international trade of artworks is closely related to the results of lawsuits. Recently, starting with New York, the hub of the international artworks market, a modern, mixed-law is gradually being adopted more. It is difficult to designate an applicable law of an international trade of artworks through private laws regulations of relevant countries, and the public laws regulations must also be considered in relation to individual benefits and the public benefits to the relevant countries. With regards to the foreign relations issues, Korea's private international law embraces a so-called public order theory, and according to the Section 7 of the Act on the Private International Law and its enactment history, the compulsory provision, which seems appropriate for application to the corresponding matter, applies without regards to the selection of the applicable law. The Civil Act of Korea acknowledges bona fide acquisition of a cultural asset, in principle, if the Cultural Heritage Protection Act is not applicable. Moreover, a lost artwork is also a subject of bona fide acquisition; however, if the relevant artwork is either stolen or lost, the original owner has the right to demand the return of that artwork within 2 years of being stolen or lost according to the Section 250 of the Civil Act. Also, if the buyer purchased from a distributor specializing in the artworks, such as auction, open market or gallery, the buyer could request a compensation of the purchase price from the original owner, and if the buyer purchased through a private transaction, the buyer cannot demand a compensation of the purchase price and must return the artwork.

본 연구는 새로운 국제 전자결제수단으로 개발된 무역카드(TadeCard)에 대한 검토와 활용 가능성에 관하여 검토한 것이다. 무역카드는 세계무역센터협회가 인터넷을 통하여 국제무역대금을 결제할 수 있는 전자결제시스템으로 개발되었다. 무역카드시스템은 제시되는 전자문서의 일치성 점검 및 국제무역거래의 모든 이행과정을 온라인(on-line) 상에서 전자적으로 이행되는 것을 특징으로 하고 있으며 부대비용 등 경제성 측면에서 여타 결제수단보다 우월한 결제시스템이라고 하고 있다. 그러나 가상공간을 통한 전자결제시스템은 거래당사자에게 대금지급의 확실성과 거래의 안정성 및 신속성 보장이 전제되어야 한다. 실제로 무역카드시스템은 특정 보증보험회사의 보증에 기반을 두고 있어 국제 기업간 거액거래상의 신용취급의 한계점과 금융네트워크 등에서의 취약점을 가지고 있다. 따라서 무역카드가 국제전자결제시스템으로 정착되기 위해서는 정보보안 등 기술적인 안정성이 검증되고 결제상의 신뢰성 보장을 위하여 상업은행들의 참여가 확대되어야 한다. 또한 인터넷상에서 결제가 이루어지기 위해서는 담보권과 유통성이 보장되는 볼레로전자선화 증권 등의 활용과 기존의 모든 종이문서에 의한 결제서류도 전자문서로 대체되어야 한다.

무역거래의 패턴이 최근 크게 변화하고 있는데, 기존 무역거래방식에서 인터넷무역방식으로 그 비중이 확대되면서 인터넷 무역거래알선사이트에 관한 관심과 활용도가 점차 높아지고 있으며 특히 무역거래알선사이트의 구축 및 운영은 국내외의 무역 유관기관과 지방자치 단체, 대기업 종합무역상사 및 개별기업을 중심으로 활발히 진행되고 있다. 이에 실제 우리 나라 무역업체들의 사이트 이용 및 현황과 이용만족도 조사를 위해 설문조사를 한 결과, 현재까지 무역업체들이 가장 선호하는 사이트는 무역 유관기관이 운영하는 사이트들이다. 또한 실제 무역거래알선사이트를 이용한 결과와 관련하여 거래알선사이트 제공서비스에 대한 만족은 대상 업체 중 불과 17.9%의 낮은 수준으로서 이렇듯 낮은 만족도를 보이는데는 다음과 같은 문제점들이 있었다. 즉, 정보 인프라 측면에서의 관련정책의 분산, 보안 인프라의 우려, 오프라인 상의 결제 및 세금문제, 인터넷무역 관련 국제협력문제 등을 들 수 있으며, 무역업체의 측면에서는 전문인력의 부족, 최고경영자의 정보화 인프라에 대한 마인드 부족과 업체내의 웹 기반 환경 구축 미흡 등을 들 수 있다. 이상의 문제점들을 개선하기 위한 활성화방안을 살펴보면 첫째, 거래정보 보호기술의 육성 둘째, 무역거래알선사이트의 적극적인 국내외 홍보 셋째, 무역거래알선사이트 관련 분쟁 신용조회 등의 통합관리 넷째, 사이트관련 온라인과 오프라인상의 제반환경 개선 및 국제거래 규약 개선 다섯째, 무역거래알선시스템의 효율성제고를 위한 전문인력 양성 및 교육훈련 강화 등이 절실히 요망되고 있다.

This study discusses some theoretical implications for efficient utilization of the global E-commerce in a world of uncertainty by beginning with measures of risk and return for the global E-commerce, and by moving to risk and return for a efficient transaction portfolio of many risky methods of transaction. Decision rules are developed to show how individuals choose optimal transaction portfolios that maximize their expected utility of wealth. First, the individuals will generally want to allocate positive amount to the global E-commerce, which requires that the expected marginal utility of wealth equals zero. Secondly, the optimal transaction portfolio will be determined by finding the point of tangency between the efficient trading line and the hightest indifference curve in the mean-variance plane. Thirdly, if the global E-commerce is positively correlated with wealth, it must have an expected return that is higher than the risk-free transaction methods in order to compensate for its risk. Fourthly, on the other hand, if the global E-commerce is negatively correlated with wealth, it will have an expected return that is less than the risk-free transaction methods. Finally, the valuation of global E-commerce depends on the degree of individual's risk aversion and the covariance between the expected return of total wealth and the return of global E-commerce.

This paper investigates how blockchain technology which is an innovation technology of the 4th Industrial Revolution has been settled in international trade. FinTech technology is expected to expand because a new remittance method for replacing the letter of credit has been introduced. In addition, since the purchase of individual customers makes international trade increase rapidly, more convenient FinTech technology will stand in a spotlight. Thus, we confirm that cryptocurrency use will increase in order to maintain stability and reduce risk in international transactions. However, since the legal standing of blockchain technology is now insufficient, the slow spread of FinTech technology will be made for a while.
