A Study on limit of Policeman's Exertion in Police Questioning (불심검문시 경찰관의 유형력행사의 한계)

  • Police questioning is police measure for acquiring information or inquiring an identification without questionee's will in order to accomplish the goal under the Police Act. However, like spear and shield, it has its own inherent limits between both sides of public power and human right and has stirred an hot issue in our society for longtime. The core problem is whether policeman can force a questionee stop when the questionee refuses policeman's stop requirement, the first step for police questioning. Some opinions argue that police questioning has somewhat effects on crime prevention and suspect arrest but people still have inconvenience and refusal from experiences of reckless police questioning in the past. Because of this, the police needs to recover people's trust on police questioning. In order to do so, in case of police questioning, human right should be superior to crime prevention or suspect arrest. This is the time's call. So when there is a police questioning, policeman's exertion of it on the questionee who refuse it should be conducted under strict conditions.

Temperature Reduction Effect According to Light Transmittance of Urban Street Trees - Focused on Seocho-gu in Seoul - (도시 내 가로수의 광선투과량에 따른 온도저감 효과 - 서울시 서초구를 중심으로 -)

  • With rapid urbanization and reckless urban development in the 21st century, the urban environment has gradually gotten worse, and urban heat island effect has been dramatically intensified. Thus, the importance of street greenery that can mitigate the urban heat island effect has further been highlighted. In this regard, this study was aimed at selecting suitable plant species for street greenery to reduce the urban heat island effect. Towards this end, five roads located in Seocho-gu, Seoul were selected as study sites, and plant species composition and difference of surface temperature were compared and analyzed in relation to the light transmittance. The street with the greatest temperature difference is Bangbae-ro(Platanus occidentalis). On the other hand, the road with the lowest temperature difference is Nambusunhwan-doro(Metasequoia Glyptostroboides). The effect of temperature reduction was found to be associated with light transmittance.Bangbae-ro(Platanus occidentalis) with the lowest light transmittance showed the highest temperature difference and Nambusunhwan-doro(Metasequoia Glyptostroboides) with the highest light transmittance showed the lowest temperature difference. It is analyzed that there are most differences in temperature when the amount of lights coming in between the crown is small. The temperature reduction effect can be obtained by planting deciduous broad-leaved trees. Also species with dense crown and broad width of crown will be able to maximize the effect of temperature reduction. In future studies, it will be necessary to expand the other species of trees in the street, and analyze the germicidal trees and shrubs as well as the differences in the packaging materials.

  • A lubricant used in the transport sector have been developed for the purpose of improving vehicle performance. To improve the engine oil for some terrible conditions, various studies have been conducted to improve vehicle performance. There are limitations in development of lubricant for the economic point, but various additives have beed developed in the technical point. Recently, government tried to prohibit reckless use of additives in base oil because of the environmental issues. The institutionalized quality standards of the additives has been estabilished. In this study, physicochemical properties and environmental effect of vehicle engine oils in domestic sector were investigated.

A Study on the Alteration in Duty of Disclosure in the Marine Insurance Act 1906 (1906년 해상보험법상 고지의무의 변경에 관한 연구)

  • In the UK, the legal principle for the duty of disclosure established in Carter v Boehm case was codified in the Marine Insurance Act 1906("MIA"). The duty of disclosure under the MIA is the pre-contractual duty by the insured and therefore, the insured should disclose the every material circumstance that would influence a prudent insurer's judgement. If the insured violates the duty of disclosure, the insurer is entitled to avoid the insurance contract, regardless of whether there was the deliberate or reckless breach, which is unfavorable to the insured. The Law Commission reviewed the duty of disclosure under the MIA in detail and provided the Insurance Act 2015 for the purpose of enhancing the interests of the insured. The Insurance Act 2015("Act"),while the basic legal structure of the duty of disclosure under the MIA still remains, amends it in respect of non-consumer insurance and furthermore, integrate the duty of disclosure and the duty not to misrepresent into the duty of fair presentation of risk. And according to the Act, the insurer is required to more actively communicate with the insured before entering the contract with the result that, if the insured fails to disclose the material circumstance but provides the sufficient information to put the insurer on notice, the insurer should further inquire for the purpose of the insured's revealing the material circumstance. In addition, the Act details the insured's constructive knowledge of material circumstance by reviewing the current case law and introduces a new system for the insurer's proportionate remedy against the insured's breach of the duty of fair presentation of risk.

Study on the Classification of Gyeonggi-Do's Conservation Areas by Improvement of National Land Environmental Assessment (국토환경성평가 개선을 통한 경기도지역의 보전지역 구분에 관한 연구)

  • Due to rapid and reckless economic development, natural resources of the national land have been damaged and polluted. Accordingly, the necessity for environment-friendly development has been on the rise and many have made efforts to assess the environmental value of the national land. This study divides the conservation areas by means of using relative elevation, slope, and development of housing land based on environmental evaluation of the national land. The relative elevation is obtained by the difference of altitude at the edge of the forest patch extracted from the land cover classification map based on the ridgeline, and the slope is obtained by environment-oriented land suitability analysis. The development of housing land is classified in accordance with the progress of each project. Twenty-six evaluation criteria are divided into five different grades using the minimal indicator approach and then sub-divided into ten grades by means of using the following two scenarios. The first one uses the weight of input materials while the second one relies on the size of patches that are emphasized in landscape ecology. Consequently, such a study demonstrated the following results. The method relying on the weight of input materials revealed the limitation of emphasizing input materials excessively, whereas the method of considering the size of patches resulted in the division of conservation areas that embody regional characteristics. This study is meaningful in that it classifies the conservation areas by reflecting the regional characteristics and the ecological values of animals and plants.

  • The 1st Incheon Rapid Transit Line opened in October, 1999. However, the current development plans for areas near stations do not involve plans for the both urban planning and transportation together. As the focus on only the aspect of installing a new transportation mode, the developments even make the problems such as reckless development and traffic congestion gets worse. It is required to analyse status of the current land uses and land use plans in the future and consider distribution of functions of the areas near stations and aims of development plans so as to harmonize the functions of each region in view of making balance in the whole city. The aims of developments of areas near stations has to focus on the study follows steps to find and suggest aims and strategies for the revitalization plan for areas near stations with considering the both transportation and land uses together. The plans for the areas near stations of the Incheon 1st Rapid Transit Line are analysed and then the features and rational strategies are derived. The impact is analysed as applying the development strategies derived from the step into the areas near the stations of Incheon 1st Rapid Transit line.

Design and Implementation of Harmful Video Detection Service using Audio Information on Android OS (안드로이드 OS 기반 음향 정보를 이용한 유해동영상 검출 서비스의 설계 및 구현)

  • The smartphone emerged due to the rapid development of the Internet has brought greater convenience to life in a positive manner. Recently, however, because of unconstrained exposure to harmful video, reckless use of smart phones has become a domestic issue in our society. In this paper, a service which detects harmful videos by using the acoustic information is designed and implemented on the Android OS. In order to implement the service of Android OS-based detection of the harmful movie, the speed of existing sound-based detection method for harmful videos is improved. The GMM(Gaussian Mixture Model) was used for classifier and the number of Gaussian Mixture was 18. The implemented service shows a detection rate of 97.02% for a total of 1,210 data files (approximately 687 hours) which comprises 669 general videos files (about 424 hours) and 541 harmful video files (about 263 hours). It's speed is 5.6 times faster than the traditional methods whitout reducing the detection rate.

The Character of Contents Production System in the Comprehensive Programming Channels (종합편성채널의 콘텐츠 생산 방식의 특성)

  • It has become five years since comprehensive programming licenses were rendered in Korea. Allocating a lion's share of their air time on live news and news commentaries, those channels have established a unique live production system or a broadcasting system which is heavily live production-oriented, to be exact. The live commentaries are filled with a mixture of news flashes, conventional news commentaries, and debates. Those channels get their news and commentary programs made through subsidiaries' where production directors and studio staffs belong. They, being very sensitive about viewer rating, tend to be aggressive about reruns of highly rated programs and they do not even seem to care when the regular programs actually went out. This kind of reckless strategy to pursue a higher viewer rating could limit not only new programming attempts but also exposure diversity.

  • Major and reckless development which have been continued during the last half century, have caused decrease and damage of urban green spaces in the point of qualitative and quantitative view. Particularly, it brought about reduction to urban neighborhood park which has taken the main role for landscape ecological value. Recently, neighborhood park planning based on the landscape ecological results has been increasing gradually. Most of all, diverse attempts such as the application of shape character analysis and the step of landscape ecological planning in urban park planning have been proposed. Today, we recognize the importance of comprehensive approach in urban green planning and neighborhood park planning, but landscape ecological approach which is analyzing character and making proposal with isolation, connection and circulation is still insufficient. Most of neighborhood parks in Korea are surrounded by buildings and isolated from adjacent green spaces. Besides, these parks have landscape ecological problems such as reduction of size, isolation from adjacent green spaces, decline of nature, and excessive pavement which we ignored during urban development process. We have sympathy for understanding landscape ecological characters and considering improvement proposals for neighborhood parks Therefore, the purpose of this study was to 1) select five neighborhood parks in Daegu, 2) analyze landscape ecological characters with isolation, connection and circulation, and 3) compare data. It is certain that these results should be the main data for the arrangement of improvement proposals which landscape ecological characters were appled to.

A Study on the Prediction of Fuel Consumption of a Ship Using the Principal Component Analysis (주성분 분석기법을 이용한 선박의 연료소비 예측에 관한 연구)

  • As the regulations of ship exhaust gas have been strengthened recently, many measures are under consideration to reduce fuel consumption. Among them, research has been performed actively to develop a machine-learning model that predicts fuel consumption by using data collected from ships. However, many studies have not considered the methodology of the main parameter selection for the model or the processing of the collected data sufficiently, and the reckless use of data may cause problems such as multicollinearity between variables. In this study, we propose a method to predict the fuel consumption of the ship by using the principal component analysis to solve these problems. The principal component analysis was performed on the operational data of the 13K TEU container ship and the fuel consumption prediction model was implemented by regression analysis with extracted components. As the R-squared value of the model for the test data was 82.99%, this model would be expected to support the decision-making of operators in the voyage planning and contribute to the monitoring of energy-efficient operation of ships during voyages.
