조망경관계획에서 조망점 설정 특성에 관한 연구 -전라남도 중소도시 사례를 대상으로- (A Study on Characteristics of the View point Setting in Urban scape Plan -In the case of the Regional Small & Medium Cities in Jeollanamdo-)

  • This study is designed to examine characteristics and types of basic landscape design established by 7 local governments in Jeollanam-do and its availability as the index of landscape administration and present a guideline with view landscape plan of local governments. The results of this study are described below. In case of view landscape, while Korean cities have not many historical assets like landmark, they have locational characteristics with mountain or coast in the center or surroundings of downtown. Therefore, since view landscape has many cases of restricting individual property rights as well as having a value as public property of city which makes recognition of sharing city, it is very sensitive problem and establishing guideline of it is needed. But, it was found that view landscape plan of local governments established location of view spot with the nature of relief viewing downtown or coast from high spot. Selection of viewing objects in view plan require deciding an object as the public property of city and big cities require selection from the zone and small cities must select 1~2 spots from the viewpoint of whole downtown. 3~4 view spots of middle and distant views which makes city community centering around the subject of view must be selected through enough discussion and in case of natural landscape, View shaft or visible rays require setting of range that 30% of viewing objects is seen. View spot or viewing objects should be selected over twice as extra spots through public hearing and civil participation as the process.

  • 국가배상법 제5조 영조물책임법리에 적용되는 대표적인 영조물에는 인공공물인 도로와 자연공물인 하천이 있다. 최근 하천범람과 수재로 인한 국민들의 피해가 빈번하게 발생하고 있고, 국민들도 더 이상 천재로 보지 않고 인재로 보고 국가배상을 청구하는 경향이 있다. 특히 하천의 범람, 하천제방의 붕괴로 인한 수해가 빈번히 발생하였고, 개수중인 하천에서 다시 수해가 발생하는 경우도 일어나고 있다. 그리하여 국가는 하천관리상의 하자로 인한 손해발생에 대한 책임을 떠맡아야 하며, 하천관리시설의 확충과 내실화를 기울여야 함과 아울러 책임범위를 확대해야 하는 시점에 왔다고 본다. 따라서 본 연구의 범위는 국가배상법 제5조 영조물의 설치 관리상의 하자로 인한 손해배상 중 하천관리상의 국가배상에 한정하기로 한다. 이러한 범위내에서 자연공물에 해당하는 하천관리상의 하자로 인한 손해배상에 관한 제반 법리와 판례를 분석 검토함에 따라 하천관리를 둘러싼 국가배상책임에 관한 문제점과 대처방안을 모색하는데 연구의 목적이 있다.

Trends and Prospects for the Development of Virtual Reality and Digital Property

  • The study considers trends and prospects for developing virtual (augmented) reality and civil transactions in relation to digital property. In jurisprudence, there is a need to determine the legal status of virtual and augmented reality to regulate legal relations in the digital environment. Legal relations using new digital technologies require the creation of new legislative approaches and rules of their legal regulation. The article dwells on the legal status of virtual (augmented) reality and determines the methods of regulating legal relations in the sphere of digital property. The study utilized methods for collecting single and multiple facts in order to identify the main trends in the civil circulation of digital assets, as well as private law methods. The methods of generalization, concreteness, induction and deduction reveal the legal nature and main features of virtual (augmented) reality and digital property. The paper highlights the specifics of virtual reality and civil transactions in relation to digital assets. The research has concluded that the sale, exchange and other actions with digital objects in virtual reality have distinctive features, while digital property has also unique characteristics since it is involved in civil circulation and legal relations.

흄의 인위적 덕으로서의 정의 (Hume's Justice as an artificial Virtue)

  • 이 논문은 흄의 정의(justice) 개념에 초점이 맞추어져 있다. 고대 이래 많은 철학자들은 정의를 아리스토텔레스의 모범에 따라 "분배적 정의"로 이해하고 있다. 정의에 대한 이러한 이해는 근대에까지 이어오는데, 근대에서는 특히 소유권 혹은 사적 재산과 연관해서 다루어진다. 근대에서 사적 소유권은 어떤 경우에도 침해되어서는 안 되는 절대적 권리로 간주된다. 흄은 이 사적 소유권을 정의와 동일시하고 있다. 사적 소유권을 절대 침해해서는 안 된다는 것은 정의를 절대 깨트려서는 안 된다는 것과 동치이다. 흄은 이러한 정의가 어디에서 기원하는가의 문제에 관심을 기울이고 있다. 즉 흄은 칸트식의 정의의 정당화(justification)에 관심을 가지고 있는 것이 아니라, 정의라는 관념의 발생 과정이라는 심리학적 논의에 관심을 두고 있다. 흄의 대답은 "사회적 효용성"이 그 기원이라는 것이다. 공적 사회는 인간이 존재하기 위한 필연적 조건이다. 즉 공적 사회가 존재 혹은 존립하지 않는다면, [현재와 같은] 인간은 존재할 수 없다. 그러면 인간이 존재하기 위한 전제 조건인 공적 사회는 어떻게 존재 혹은 유지될 수 있는가? 흄에 따르면 정의를 통해서 유지된다는 것이다. 그러면 정의의 존재 근거는 어디에 있는가? 흄은 정의의 존재 근거는 자연이 아니라, 인간의 묵계(convention)에 있다는 것이다. 인간은 묵계를 통해서 정의를 암묵적으로 받아들이며, 그렇게 함으로써 인간은 자신의 존재를 유지할 수 있다. 이것이 흄의 개략적인 통찰이다. 흄은 이런 자신의 주장을 관철하기 위해서 매우 다양한 개념들을 구사한다. 본 논문은 이러한 다양한 개념을 중심으로 인간의 정의 개념이 어떻게 형성되는가를 흄의 관점에서 조망하고자 한다.

대학 기숙사의 기숙사비 결정 요인에 관한 연구 (A Study on Boarding Fee Determinants of University Dormitory)

  • Properties of school foundation are divided into fundamental property for education and fundamental property for profit. As school sites and teachers used for educational and study activities of students, fundamental property for education includes practice sites, farms and support research attached facilities in addition to school facilities. According to the Clause 1 of Article 4 of the University Foundation and Management Regulation and the Attached Table 2 of the Same Regulation, dormitory is classified as property for education(non-profit). In other words, there is no need to create profit for dormitory management. It is supposed that there are little regional differences in construction cost of dormitory with general specifications. In this case, boarding fees of university dormitories should make no difference. This study analyzed boarding fees, depending on regional factors(Seoul, Gyeonggi-do, metropolitan cities and provinces), and depending on foundation subjects(national public university and private university), classes(four-year university and college) and principal schools-branch schools. The result of One-Way ANOVA showed that Seoul showed the highest average boarding fee and it was followed by Gyeonggi-do, metropolitan cities and provinces. Also, the average boarding fees of private universities and four-year universities were higher than national public universities and than colleges, respectively. In addition, branch school's boarding fee was higher than principal school's. Additionally, this study extracted a model using the hedonic model to see how various characteristics such as region, foundation subject and class influence the boarding fee. This study would serve as fundamental research on the boarding fee. Thus far, there have been difficulties in obtaining accurate data and analyzing boarding fees, since there is no open data about dormitories and it isn't mandatory to open it, but it is anticipated that this would be used as fundamental research for estimating and analyzing boarding fees of many universities in the future.

Urban Campus Expansion in City Block A Case of New York University, New York City, USA

  • This study explores the issue of campus expansion of an urban university using an in-depth case study of New York University in New York City, USA. It investigates the physical pattern and development mechanism of the campus expansion process on a city grid structure. The three elements that characterize NYU's recent campus expansion, are (1) the university's commitment to building a student community around a public open space on a subway network, (2) four types of property acquisition and building development practiced by the university with private developers for space leasing, building renovation and development under changing local development circumstances, and (3) the city's initiative for attracting the private sector whose development activities influence the university's development dynamics. These findings suggest that the expansion planning of an urban university, due to its location in a city, should be placed on a local planning agenda, which can positively contribute to public goals through the collaborative engagement of the private and public sectors.

  • 현재의 퍼블릭 블록체인은 누구나 원장의 내용을 볼 수 있도록 설계가 되어있다. 하지만 응용에 따라서 비밀 정보를 블록체인에 저장해야 하는 경우도 있으나 이에 대한 연구는 아직 미진한다. 본 논문에서는 DPoS(Delegated Proof of Stack) 합의 방식을 사용하는 블록체인을 대상으로 공개 블록과 비공개 블록의 두 개층으로 이루어진 블록체인을 제안하고 비공개 블록의 암호화를 위한 요구사항을 도출하였다. 도출된 암호화 요구사항을 만족하는 dealer없는 t-of-n threshold 암호화를 제안하였다. 제안된 기법이 대표노드간의 공평성과 동일한 신뢰성을 만족하는 특징을 가진다.

  • As Dutch structuralism discovered a possibility that can improve the problem of modem architecture through study on non-western area. Dutch structuralism had tremendous impact on Philosophy, psychology, art history and the style of a dress and many other cultural trend. In architecture, Aldo van Eyck embodied that theory and succeeded to Herman Hertzberger and Piet Blom. As result Structuralism related with architecture has dealt with the participation and domain of residents, namely public domain and private domain, the approach property of public space, middle domain which shows the harmony between public domain and private one, and the structuralism discovered that each element of public space and private space has been developed as an architectural type that makes a group by repetitive arrangement and it found out a possibility that can make up problems overlooked in modem architecture through development and change.

공적개발원조사업(Official Development Assistance)의 방향과 환경평가 (Official Development Assistance and Environmental Assessment)

  • ODA projects such as multi-purpose dam, industrial complex, road construction etc. have resulted in environmental damage and resident relocation including destruction of site of living. Even the grandiose developments as ODA projects have made clear the value clashes between development and environmental conservation, and have brought about conflicts between public interests and public environmental right, and the discordance between public interests and private property rights in the recipient country. This study summarizes and analyses the Korea's ODA projects and will suggest the public participation and governance system based on Saemaul Movement, Strategic Environmental Assessment and Environmental Impact Assessment based on the guideline of OECD DAC, and emphasize Strategic Environmental Assessment and Social Impact Assessment in the procedure of ODA projects. In the future the ODA project should be implemented for the overcome of poverty and response to climate change based on the experience and trial and errors of Korea's compact growth and past ODA projects.

이동통신망을 이용한 지리 기반 재난경보서비스의 국가별 동향 분석 (Service Trends by Country in Geography-based Public Warning Using Commercial Mobile Network)

  • Governments intend to use the public warning system to deliver timely and accurate information using accessible communication technologies for protecting the population and reducing damage to life and property. In particular, many countries implement system interworking with smartphones to notify of disasters or emergencies. In Korea, since 2020, due to the influence of the coronavirus disease, frequent emergency text messages led people to turn off related notifications, and complaints for receiving irrelevant messages from nearby warning areas have increased. Therefore, technical improvements for issuing more accurate disaster information to a specific region should be devised through a geography-based emergency disaster message transmission service. We analyze development trends of public warning systems and service cases of geography-based emergency text transmission services in various countries.
