  • At a time when Korea and the rest of the world recently faced the unprecedented situation of "COVID-19," the view of actively "disclosure" of information to prevent the spread of infectious diseases is at odds with the view of "protecting" personal information as these social measures are coupled with the infringement of individuals' basic rights. In order to see the nation's response to the infectious disease crisis, we examined the current status and characteristics of public records according to crisis alert levels based on the manual for responding to infectious disease. Especially we analyzed the types and disclosure status of records containing personal information. For detecting personal information-related issues on news media, we collected online news articles and performed text anlaysis. • In the case of uploading privacy information of an information owner in the Internet, the information owner may want to deliver the privacy information itself or remove such information from the search list in order to prevent third parties from accessing the privacy information of the information owner. Such a right to be forgotten may collide with the freedom of expression of a third party. The right to be forgotten, which originates from the self-determination right on privacy information based on Article 10 and 17 of the Constitution and the freedom of expression, which is based on Article 21 thereof are all relative basic rights and are both limited by Item 2 under Article 37 of the same law, which is the general limitation provision for the basic rights. Therefore, when the right to be forgotten and the freedom of expression collides, it is not possible to give priority to one of the those unilaterally. It depends on the nature of the case at hand to find a natural balance for the harmonious solution for both parties. The criteria can be the sensitivity to the privacy of the information owner caused by the disclose of the privacy information, the public benefits such information may serve, the social common good that could be expected by the disclosure of the privacy information and the damages suffered in terms of the personal interest caused by the disclosure of the information, in a comprehensive manner.

  • Purpose - The purpose of this paper is to investigate the determinants of corporate anti-corruption practice disclosure (ACPD) from the perspective of rent-seeking theory. Research design, data, and methodology - Data are hand-collected from corporate social responsibility reports (CSRR) issued by 724 A-share listed firms in China. This paper provides an empirical analysis of the relationship between ownership structure and corporate ACPD as well as its moderating role in the institutional environment. Results - Our findings indicate that rent-seeking is a key factor in influencing corporate ACPD. State-owned enterprises disclose significantly more anti-corruption information than private ones in order to achieve personal promotion of top executives. Monopoly enterprises reported significantly less anti-corruption information than enterprises in competitive industries due to their rent-seeking behavior. The reduction of government intervention and improvement of legal environment are helpful to curb corporate rent-seeking activities and enhance the level of corporate ACPD. Conclusions - Rent-seeking is an important factor in explaining corporate voluntary disclosure in emerging countries. Institutional environment also plays a moderating role in the relationship between ownership structure and corporate voluntary disclosure. Our results are of interest to policy makers, regulators and market participants that are interested in corporate voluntary disclosure and corruption prevention.

  • Objective: The purpose of this study was to analyze the operation and personal information management of public and private kindergarten homepages. Methods: A total of 2,846 kindergartens were selected from the I-Sarang portal service for analyzing operation, and 217 self-operating homepages were selected for evaluating management. Seven evaluation items from three domains (information gathering procedures and scope, information security, and management of file exposure protection) were used. Wireshark and Google were used for analyzing some evaluation items. Results: The operating ratio of kindergarten homepages was low and most of the kindergartens self-operated their homepages. The evaluation of the information gathering procedures and scope showed that the rule of consent process was not rigidly followed but that the rule of legality for information gathering was followed. Items related to information security were followed at very low levels. As for the management of file exposure protection, the evaluation of items related to the prevention of attachment disclosure showed that the rule of protecting personal information included in an attached file was followed but that the notice regarding information protection was not. Across all evaluation items, the level of personal information management was higher in public (vs. private) kindergartens. Conclusion: These results indicate methods to more securely and effectively manage personal information on kindergarten homepages.
