아웃소싱 성과를 위한 IT 서비스 관리에서 IT 거버넌스 커미트먼트의 중요성에 대한 연구 (An Empirical Study on the Importance of IT Governance Commitment in IT Service Management for Outsourcing Performance)

  • IT outsourcing studies have centered on the separate effect of formal contract and relational trust on IT outsourcing performance. In addition, previous studies ignored the importance of the relational capability that combine the formal contract and partnership can be able to deliver IT outsourcing effects. In this paper, we propose an IT governance commitment as a mediated role between relational capability and IT outsourcing performance. We collected data from 143 client companies of IT outsourcing and analyzed it using the PLS method. Our findings are revealed as following: At first, relational capability significantly and directly influence IT governance commitment as well as indirectly through formal contract and partnership. Secondly, IT governance commitment mediate between relational capability and IT outsourcing effect, and in turn affect IT outsourcing performance. The results and implications are further discussed.

CISG에서 매수인구제조항(買受人救濟條項)에 관한 비판적(批判的) 연구(硏究) (A Critical Study on Buyer's Remedy Articles under the CISG)

  • Under the CISG, there is a unequitable factor in comparing buyer's remedy with seller's remedy. In my opinion, CISG is more unequitable remedy clause than UCC or UNIDROIT principle of International Commercial Contract(1994) between seller and buyer. First, buyer who accepted defect goods must give seller notice the facts that seller delivered defect goods in two years after accepting defect goods. The cap of two year is unreasonable in a position of aggrieved buyer. This is being provided as 'within reasonable time' in UCC and there is no such provision in UNIDROIT Principle. Second, Buyer can avoid contract when seller breached fundamentally contract or seller didn't set a additional performance period about breaching of contract. Accordingly if buyer would not set a additional performance period, although seller's breachment of contract, he could not avoid the contract. Therefore, From a viewpoint of aggrieved buyer avoidable right of contract is restrainted. Third, to compare seller's remedy with buyer's, seller have more opportunity to cure breachment of contract than buyer. Under the CISG buyer is relatively placed at disadvantage in remedy of aggrieved party. In connection with remedy of aggrieved party, 'UNIDROIT principle of international commercial contracts' instead seller and buyer of aggrieved party, so there is not unequitable factor in remedy of aggrieved parties.

  • The EPC/Turnkey Contract goes to the extreme in allocating risks to the contractor and depending on the types of project, this may be regarded as unacceptable. It has also gone to the extreme in the extent to which the contractor is responsible for the specification and design of the Works. The employer is not responsible for correctness of any information provided by him nor for correctness of any specification or other matter included in the Employer's Requirements, except the definition of the intended purpose and criteria for testing and performance. With such conditions it is surprising that the employer is entitled to interfere in the contractors performance to an extent that is close to what is norm for a construction contract with employer design and with normal risk allocation. The combination of risk allocation and inappropriate administrative provisions makes the EPC/Turnkey Contract a document that will meet severe resistance from contractors. It is also likely that employers will see the risks and difficulties from their own perspective. It is a fiction that the EPC/Turnkey Contract will give the employer a contact with a certainty of final price and completion date. It is not a fiction that the EPC/Turnkey Contract carries many seeds for disputes between the parties. The Orange Book has become an accepted document even if it clearly contains some weaknesses. Some of these have been corrected in the Plant Contract. In my opinion FIDIC should let users become more familiar with the Plant Contract as a follow up to the Orange Book.

Impact of Revenue Sharing Contract on the Performance of Vendor

  • Purpose: Focusing on the role of the special contract to collaborate the supply chain operations, this study investigates how the revenue sharing contract affects the performance of Vendor Managed Inventory (VMI). Research design, data, and methodology: The optimization model is formulated to represent two stage supply chain system where the supplier and retailer manage the operations to maximize their own profits. Three supply chain models including the traditional system, VMI, and VMI with revenue sharing contract are compared in the numerical examples. Results: According to the numerical analysis, the entire supply chain system has greater profit under VMI than the traditional system, while VMI alone sacrifices the supplier's profit. With the proper sets of revenue share ratio and wholesale price discount rate, VMI with revenue sharing contract results in the increased profit for both supplier and retailer compared with VMI alone as well as the traditional system. Conclusions: The numerical examples imply that VMI, when it is combined with the revenue sharing contract, can be the effective collaboration program that satisfies every supply chain member. To make VMI with revenue sharing contract to be fair to all supply chain members, they need to agree on the appropriate contract content.

중.고등학교 급식 운영특성에 따른 종합적 품질경영(TQM)에 근거한 HACCP 시스템 활동 및 위생관리 수행수준 분석 -서울, 경기, 인천, 강원, 충청지역 중.고등학교를 중심으로- (Analysis of TQM-based HACCP System and Safety Management Performance in Middle and High School Foodservice Operations - Seoul, Gyeonggi, Incheon, Kangwon and Chungcheong Areas in Korea -)

  • The following study was taken in the Seoul, Gyeonggi, Incheon, Kangwon, and Chungcheong areas to analyze the performance levels of safety management by characteristics of school foodservice. The following results were obtained from a survey conducted on 2,271 middle and high school dietitians in 808 schools. Out of the 808 schools surveyed, 513 schools (63.5%) were self-operated and 295 schools (36.5%) were managed by a contract. Regarding the performance level of the hygiene duties, contract-managed schools were rated as 4.02 points while self-operated schools were rated relatively higher (4.16 points). The self-operated schools had an average score of 3.60 points for the TQM-based HACCP system, and the areas that scored lower than the average were strategies, human resources, data and analysis. The average score of the contract-managed schools was 3.42 points, and such areas as leadership, human resources, data and analysis, and customer satisfactory level scored below the average. For the analysis of CCP performance level, the contract-managed schools scored 4.28 points while self-operated schools scored 4.34 points. Overall, the hygiene duties, CCP performance level, and TQM-based HACCP system performance of the contracted schools were lower than those of the self-operated schools. Therefore, it is advised that the contract-managed schools consider new measures to strengthen their performance level for improved safety of school foodservice.

  • 건설프로젝트를 수행하는 과정에 있어 계약당사자간에 다양한 계약방식에 기초하여 시설물 건설에 요구되는 업무 또는 서비스를 제공하고 있으나, 건설사업의 주요 성과지표라 할 수 있는 비용, 일정, 안전등의 측면에서 계약방식에 따라 발생할 수 있는 성과의 차이에 대한 실증적 인 비교연구는 미흡한 실정이다. 건설사업이 다수의 건설전문조직과 계약을 기반으로 운영되는 프로젝트라는 특성을 고려할 때 계약방식의 유형에 따라 사업성과에 대한 차이를 비교분석 함으로써 계약방식 선정에 대한 적정 의사결정을 지원하는데 유효한 자료를 제공할 수 있다. 이에 본 연구에서는 건설계약방식 중 실비정산방식과 총액계약방식을 대상으로 건설사업의 주요 성과에 대한 비교 분석을 시도하였다. 계약방식별 프로젝트 성과는 미국 Construction Industry Institute(CII)의 Benchmarking and Metrics(BM&M) 프로그램에서 활용하는 성과측정기준을 기초로 비용, 공정, 안전, 변경, 재작업(rework) 등 5개 분야를 대상으로 하였다. 또한 계약방식으로 인한 각종 성과지표의 차이가 통계적 의미를 지니고 있는가를 판단하기 위하여 통계적 기법인 t-test를 이용하여 데이터의 유의성을 분석하였다.

Development of a Composite Revenue Sharing-Quantity Flexibility Contract

  • In supply chain management, the supply contract can induce collaboration and coordination among the supply chain members in order to optimize supply chain performance. Numerous supply contracts have been examined; however, some difficulties related to the application of these contracts still occur. One of the solutions is to apply the composite supply contract which can assist in the supply chain coordination. This research examines the composite contract of the revenue sharing and quantity flexibility contracts in a two-stage supply chain, which comprises a retailer and a supplier. In this research, a mathematical model of the composite contract is developed; then, the applicability of the proposed composite contract is examined by investigating its capability in terms of supply chain coordination and profit allocation. In the numerical experiments, the composite revenue sharing-quantity flexibility contract showed that it is superior to both component contracts in terms of supply chain coordination and profit allocation among supply chain members.

유럽법제에서 형평성 원칙에 따른 표준계약조건의 유효성에 관한 소고 (A Study on the Principle of Equilibrium in Standard Terms Contract in European Law)

  • In English Law it seems that it is essential to apply the principle of equilibrium in the contract, however, it does not seemed to apply as the general rule of the principle of contract. Especially it seems that English Court didn't pay attention to the principle of equilibrium in 18th century. If one of the party do not appeal the equilibrium of the contract, it does not make any difference even today. However the Court may cancel or withdraw the construction of contract between the parties where the principle of equilibrium is damaged by fundamental problems like just-price. In French Law it seems that they have more wide definition of the principle of equilibrium. The French Court may consider that the application of good faith is the performance of condition of the contract between the parties and has no power to relieve of one party of his expressed obligations or warranty. In German Law, it seems that the principle of good faith is fundamental to take into account interest of the parties. They may agree to supply information or not to interfere with a commercial agent regarding performance and maintenance of the contract.

무기계약직의 평가관리, 성과, 교육훈련 간의 관계: 지방자치단체 인사담당자의 인식을 중심으로 (Evaluation Management and Performance of Indefinite-term Contract Workers in Local Governments: Moderating Effect of Training)

  • 본 연구는 지방자치단체 무기계약직의 평가관리가 성과에 미치는 영향을 실증적으로 분석하였다. 이와 더불어, 교육훈련이 평가관리와 성과의 관계에서 유의미한 조절효과가 있는지를 검증하였다. 분석 결과, 무기계약직의 평가관리는 성과관리에 긍정적이며 유의미한 영향을 미치는 것으로 확인되었다. 또한, 조절효과의 크기는 작지만, 교육훈련은 평가관리와 성과의 관계에 있어 유의미한 조절효과를 가지는 것으로 나타났다. 본 연구는 지방자치단체 무기계약직을 대상으로 인사관리의 구성요소들 간의 양적관계를 검증함으로써 무기계약직 선행연구들의 연구 범위 및 영역의 확장과 후속연구 수행의 활성화에 기여할 수 있다고 판단된다. 또한, 본 연구는 무기계약직의 인사관리를 담당하는 공무원과 조직이 보다 실질적이고 합리적인 무기계약직을 위한 인사관리 지침 및 방안을 구축하는 것에 활용될 수 있을 것이다.

전사적 계약관리(ECM) 지표를 활용한 프랜차이즈 기업 성과분석: 프랜차이즈 계약관리 레버리지의 유용성 (The ECM Score Index for Franchise Performance Analysis : Availability of Franchise Contract Management Leverage)

  • 프랜차이즈 산업의 발전과 더불어 프랜차이즈 기업과 관련한 다양한 연구들이 진행되고 있다. 그 중 프랜차이즈 성과와 관련된 논의들은 가맹본부 성과, 가맹점 성과, 관계특성에 대한 성과, 재무적 성과, 비재무적 성과 등 연구의 주제나 목적에 따라 다양한 관점에서 제시되어 왔다. 그러나 기존의 프랜차이즈 성과와 관련된 논의들이 너무 포괄적으로 제시되거나 만족, 장기지향성 등 정성적인 측면만을 강조하는 한계를 안고 있다. 따라서 본 연구는 프랜차이즈 기업의 성과를 보다 명확하게 제시할 필요성에 의해 진행하게 되었다. 즉, 프랜차이즈 기업의 특성을 반영한 계량화되고 수치화된 정량적인 성과지표를 제시하고자 한 것이다. 이를 위해 프랜차이즈 기업의 계약관리 실태를 체계적으로 분석 정리하고 이를 전사적 계약관리(ECM)지표로 제시하였으며, 보다 정량적인 분석을 위해 계약관리 레버리지를 제안하였다. 계약관리 레버리지는 가맹점과의 계약증가율이 가맹본부의 매출액증가율의 변화에 어떠한 유의적인 변화를 가져오는가를 보여주는 지표로서 프랜차이즈 기업을 대상으로 분석한 결과, 주목할 만한 시사점을 발견할 수 있었다. 따라서 본 연구는 프랜차이즈 기업의 성과를 매출액이나 가맹점증가율, 만족 또는 재계약의도라는 일면적 측면에서 제시되던 관점에서 보다 종합적이고 입체적인 차원에서 계량화된 분석 틀을 제공함으로써 프랜차이즈 기업 성과연구와 실무적인 차원의 기업 성과관리에 새로운 방법론을 제시하였다는데, 그 목적과 의의가 있다.
