이 연구는 최근 독립 다큐멘터리의 성과와 변화를 살펴보고 그 과정에서 어떠한 시사점이 있는지 한국 다큐멘터리 생태계에 던지는 활성화 방안을 모색하고자 했다. 이를 위해 방송사와 독립진영의 다큐멘터리 제작자와 사업, 운영에 참가하는 종사자들을 심층 인터뷰하였고 미국의 가장 오래된 독립 다큐멘터리 시리즈인 POV(Point of View) 사례를 분석하였다. 분석결과, 독립 다큐멘터리들이 보여준 콘텐츠의 경쟁력과 영화적 배급과 펀딩의 확장은 프로듀서 시스템의 도입, 해외 피칭과 영화제를 통한 글로벌 배급 네트워크의 개척, 영화적 마케팅과 적극적 관객전략 등을 통해 산업 생태계적 면모를 보이는 성과를 이뤘으나, 독립 다큐멘터리가 디지털 확장으로 인한 생태계적 발전을 이루기 위해서는 영화적 통로 이외의 다양한 플랫폼이 필요함이 드러났다. POV는 독립 제작자들에게 개방되어 '오픈 소싱(Opensourcing)'형태의 협업 구도로 운영되며, PBS에 방송되고 온라인 플랫폼으로도 연결되어 있으며, 공동체 상영이라는 다큐멘터리의 특별한 배급 형태가 모두 실현되는 플랫폼으로 분석되었으며, 현재 한국 다큐멘터리 생태계에 적절하고 실현가능한 독립 다큐멘터리 플랫폼 형태로 볼 수 있다. 한국 다큐멘터리 시장에 이러한 형태의 플랫폼을 운영해 볼 것을 제안하며, 다큐멘터리 시장의 활성화를 위해서 새롭고 다양한 플랫폼 구축과 생성에 연구와 노력이 확장되길 기대해 본다.

본 논문은 우리사회의 성매매문제를 다루고 있는 한국 독립다큐멘터리 <언니>에 초점을 맞추고 있다. <언니>를 둘러싸고 이루어질 수 있는 다양한 담론 중 '영화의 정치성', '투쟁의 도구로서 한국 독립다큐멘터리', '영화의 사회적 영향력', '성매매문제와 성매매여성인권', '반성매매와 성노동 진영의 논쟁', '<언니>의 반성매매를 위한 내러티브 구성' 등을 중심으로 살펴본다. 그리고 마지막으로 대학생 202명을 대상으로 설문조사를 실시하여 <언니>를 통한 '관객의 인식변화'와 '참여적인 관객성'의 가능성에 관해 진단한다.

본 연구는 디지털 방송 환경 하에서 독립제작사 제작 방송 다큐멘터리의 소재 유형을 다양화하고 전문화 함으로써 시청자의 시청 권리를 확대하는데 연구목적을 두고 있다. 이를 위해 독립제작사 제작 방송 다큐멘터리인 <수요기획>(KBS 1TV)의 지난 10년 간 방송분을 분석대상으로 방송 소재를 유형화했다. 연구결과에 의하면, 완전 공모제 방식의 외주제작 방송 다큐멘터리인 <수요기획>의 제작에 국내 대부분의 독립제작사들이 참여했고, 제작규모 면에서 영세한 독립제작사들이 완전 공모제 방식을 적극 활용해 제작해 온 것으로 나타났다. 방송 소재 유형을 9가지로 분류해 분석한 결과, 시사 소재 유형이 33.4%, 휴먼 소재 유형이 18.5%를 차지하고 있었으며 독립제작사의 수익 극대화를 위해 연작 형식이 채택되기도 한 것으로 분석되었다. 방송 다큐멘터리의 소재 유형화 과정을 분석한 본 연구는 독립제작사의 방송 다큐멘터리 소재 선정의 유형을 체계적으로 분석했다는데 연구의의를 찾을 수 있다.

A non-documentary conditions is a condition contained in the credit without reference to the presented document in compliance therewith, thereby causing many problems to all parties involved in letter of credit transactions. The purpose of this study is to examine the regulations on the non-documentary conditions under Uniform Customs and Practice for Documentary Credits: UCP, International Standby Practices: ISP98, United Nations Convention on Independent Guarantee and Stand-by Letters of Credit: CIGSLC and Uniform Commercial Code: UCC and also the opinions on the effect of non-documentary conditions through the analysis of several cases on the non-documentary conditions. The result of this study can be summarized as follows: First, UCP, ISP98, CIGSLC and UCC stipulate that banks will deem non-documentary conditions as not stated and will disregard them. Second, courts used to permit the effect of non-documentary conditions. Finally, all parties should not attempt to put in any non-documentary conditions in order to prevent disputes on the effect of non-documentary conditions.

본 연구는 신용장거래에서 은행의 독립지급의무 및 이 의무에 대한 예외적인 취급원칙과 방향에 대한 문제를 소재로 취급하였다. 독립원칙과 독립원칙에 대한 예외문제는 신용장의 본질에 관계되지만 국가마다 이러한 문제를 취급하는 태도에 차이가 존재한다. 본 연구에서는 영국에서의 태도를 분석하기 위해 독립원칙과 예외문제를 취급한 판례 중에서 지도적인 판례로 인정되는 사례를 중심으로 하여 독립원칙과 예외문제를 취급하는 영국의 입장을 분석하였다. 영국법원은 가능한 한 상인들 간에 형성되어 온 상관습을 존중하려는 입장을 취해 왔으며 독립원칙의 실무적인 적용에 있어서도 이러한 입장을 반영하여 독립원칙의 중요성을 강조하면서도 실질적으로는 개개의 사안마다 당사자의 형평을 고려하여 예외문제를 취급하여 왔다. 그러나 미국의 Sztejn 사건을 계기로 하여 영국에서도 독립원칙의 적용에 대한 태도의 변화를 보여 신용장거래에서의 사기뿐만이 아니라 기초계약에서의 사기도 독립지급의무에 대한 예외사유로서 인정하기 시작하였다. 그렇지만 독립원칙에 대한 예외의 운영방식에 따라 신용장제도의 존재의의가 상실될 우려가 있고 또한 발행의뢰인에 의해서 예외적용을 남용할 가능성도 있다는 문제점들을 감안하여 영국은 비록 사기적인 요소가 존재하지만 수익자 자신이 선의의 입장에 있는 경우에는 수익자를 보호하는 입장을 채택함으로써 예외인정과 예외의 남용문제 간의 조정을 도모하고 있다.

While a performance type guarantee is required as a security for non-performance risk by a seller, a payment guarantee is used as a security for non-payment risk by a buyer(or a borrower in a loan agreement). A payment guarantee is a type of independent bank guarantee, bank guarantee, bond, demand guarantee, or standby letter of credit. A guarantor accepts a credit risk of a principal which is normally a buyer in a contract for sale of goods. A payment guarantee is independent of the underlying relationship between the applicant and the beneficiary. The guarantor is only empowered to examine the beneficiary's demand and determine the payment on its face to the terms of the guarantee. A payment guarantee is thus different from a suretyship. The principle of independence carries a significant advantages for a guarantor as well as for a beneficiary. While a documentary credit requires B/L, commercial invoice, packing list, inspection certificate, etc., a typical payment guarantee does not require any evidence for a seller's performance of the underlying contract other than written demand. In this respect payment guarnatee can be a more secured facility than a documentary credit. A payment guarantee normally comes into force from the issuing date and shall remain in effect until all sums guaranteed shall be paid in full by a buyer(or a borrower) or by a guarantor. Although a guarantor shall pay a demand made in accordance with the terms and conditions of the payment guarantee, a payment demand may be denied when it is determined to be abusive or unfair.

Independent guarantee is new financial product developed in international commercial transaction. The nature of independent guarantee is an independent undertaking, which takes the form of documentary transaction. As long as the documents presented by the beneficiary are on their face complying with the terms and conditions of the guarantee, the guarantor is obliged to pay upon the complying presentation. Where parties choose to apply for issue of independent guarantee in international commercial transactions in China, Chinese court shall respect the autonomy of parties. If either the guarantor or the beneficiary is located outside of China, or the facts which cause the establishment, change or cancellation of independent guarantee relationship occurred outside of China, it shall be deemed as foreign related independent guarantee. If the interested parties requests for confirmation of the independence of foreign related independent guarantee, it shall be supported by Chinese court. However, parties dealing with Chinese domestic commercial transaction have not fully realized the severity of independent guarantee liability. The market credit is being cultivated and the financial innovation is being explored at present in China. In order to guard against the systematic and the regional financial risk, before relevant rules are promulgated, Chinese court shall not recognize the independence guarantees issued for the domestic commercial transaction, but treat it as joint liability surety.

Since the end of World War II, the standby letters of credit have been used as a surety device, serving as a performance bond and guarantee in the world. In Korea, the standby letters of credit have been also being used in international transactions. But there have been a few studies on the standby letters of credit. This study is carrying out to reveal the characteristics of the standby letters of credit and the documentary letters of credit and also between the standby letters of credit and guarantees. Secondly, this study is carrying out to indicate types of practical use of standby letters of credit in international transactions, i.e. bid bonds, performance bonds, advanced payment guarantees etc.. Finally, this study is carrying out to indicate governig rules regarding standby letters of credit, i.e. URCG, URDG, UCP, UN Convention on Independent Guarantees and Standby Letters of Credit, ISP etc..

Purpose: To determine effects of family conflict mitigation documentary programs on conflicts, autonomic nerve activation (ANA), and happiness of elderly in long-term care hospitals. Methods: This study used a non-equivalent control group with a pretest-posttest design. It was conducted on 39 elderly patients (19 in the experimental group and 20 in the control group) in long-term care hospitals. The experimental group (n=19) received family conflict mitigation documentary programs. The family conflict mitigation documentary programs consisted of four sessions (40-50 minutes per session). These programs were implemented in small groups, with each group having five elderly. Data were analyzed by sing the conflict checklist, the Oxford Happiness Questionnaire, Chi-square test with Fisher's exact test, independent t-test, paired t-test, and repeated measure ANOVA using the SPSS/WIN 21.0 program. Results: The participants in the experimental group showed significantly decreased scores of conflict (t=-2.31, p=.028) and the value of sympathetic nervous system activity (t=8.36, p=.007) compared with those of the control group. The participants in the experimental group showed significantly increased the value of parasympathetic nervous system activity (t=-2.91, p=.008) and scores of happiness (t=5.46, p<.001). Conclusion: The family conflict mitigation documentary programs on conflicts, ANA, and happiness of the elderly in long-term care hospitals are effective intervention programs for mitigating conflicts between elderlies and their families and for improving happiness of the elderly in long-term care hospitals.

본 연구에서는 소셜미디어를 통한 커뮤니케이션 문화의 변화가 대중의 소비문화에 적지 않은 영향을 미치고 있음에 주목하고 그러한 변화가 영화의 마케팅에 미치는 영향을 고찰하고자 한다. 특히 소셜미디어의 한 종류로 최근 가장 빠른 성장세를 보이고 있는 '트위터(Twitter)'가 어떤 기능적 특성을 가지고 있는지 살펴보고 이러한 특성이 영화마케팅에 어떠한 잇점을 제공하는지를 논한다. 자유로운 접근성, 단순성으로 인한 높은 주목도, 정보 확산의 신속성 그리고 저렴한 비용이라는 특성을 지닌 트위터는 일반 상업영화뿐 아니라 재정적인 문제로 충분한 마케팅 기회를 갖지 못했던 저예산 영화나 독립영화들에게 다양한 마케팅 기회를 제공한다. 본 논문의 분석 대상인 다큐멘터리 영화 <땅의 여자>(2010, 권우정)의 경우 제작과정에서부터 개봉과정을 거쳐 종영 이후까지 지속적으로 트위터를 통해 잠재 관객들과 활발히 상호소통하면서 광고, PR, 프로모션, 구전 등 영화마케팅의 모든 도구들을 구현하는 시도를 보여줌으로써 저예산영화 혹은 독립영화들이 트위터를 활용하여 어떠한 대안적인 마케팅 활동을 펼쳐나갈 수 있는지에 대한 하나의 모델을 제시하고 있다.
