A Study on the Sequence of Developing Marine Environmental Conventions (국제해양환경협약의 제정 과정에 관한 연구)

  • In recent years, the major interest in international environmental laws has focused on the ways to secure observation of the laws. For the implementation and compliance of international marine environmental convention, the new sequence of developing convention has been sdopted. The main convention is adopted in a form of 'Framework Convention' and the details are expressed in the Annex and/or Guidelines of the convention for the purpose of conveniense of adoption and to secure the observation of the convention And the Annexes or Guidelines are amended, revised and newly adopted continuously. Therefore this study is to analyze the tendency of sequence for developing new convention, which will help understanding one particular international marine environmental convention as a whole.

  • With the effectuation of United Nations Framework Convention on Climate Change(UNFCCC) and Kyoto Protocol in 2005, ever growing concern on the importance of overseas forestation is diffusing worldwide. However, fierce international competition to secure overseas forestation sites, inherent uncertainty in UNFCCC or overseas forestation projects, and imbalances among policies on overseas natural resources development make it difficult to realize Korean long-term overseas forestation objective to secure 1 million ha by 2050. In view of necessity of overseas forestation projects for sustainable forest management and securing sinks of carbon to mitigate climate change, various efforts to reform current Korean overseas forestation systems are required. This study suggests several alternatives to improve current Korean overseas forestation systems including expanding financial support for overseas forestation projects, cultivating overseas forestation experts, establishing official organization for overseas forestation, constructing effective support system for overseas forestation projects, fostering international cooperation in the field of forest resources, and so on. Many theoretical, empirical or policy-oriented studies on the influences of UNFCCC and countermeasures on it in various Korean industries should follow this study.

  • This study developed a conceptual model that integrated psychological and physical reactions resulting from online tourism reviews through a longitudinal trust-satisfaction model (LSTM) developed based on the extended valence framework and expectation-confirmation theory. Online reviews are essential factor of consumer's purchase decision. This phenomenon is well applied in a tourism context. However, investigations on online reviews in a longitudinal approach in a tourism context are quite limited. Therefore, this study suggests a conceptual model based on LTSM and several propositions about how online tourism reviews, which are divided into factual and experiential reviews, influence the future travelers' perceptions and attitudes, such as expectation, confirmation, and destination loyalty, in a longitudinal format by examining previous related studies. Finally, expected results were discussed and several implications were described theoretically and practically.

  • Since the global warming problem emerged in the international community, the problem has been sought to be not at the national but at the global level. As a result, the United Nations Framework Convention on Climate Change was agreed by international delegates in 1992, and the Kyoto Protocol which imposes industrialized nations to decrease their greenhouse gas emission was agreed by the international community in 1997. Kyoto protocol came into effect for reduction duty of greenhouse gas.(16-Feb-2005) High developed countries press environmental regulation. It will strengthen an environment regulation from advanced nation with this protocol. This study is intended to examine unfolding transition on negotiations of Conference of Parties(COP), the Kyoto Mechanism referred as a cost-effective tool to meet a targeted level of greenhouse gas decrease, and trends in responses of developed countries to the Kyoto Protocol, and finally suggests legal and politic counterplans responding to the United Nations Framework Convention on Climate Change (hereafter, UNFCCC).

A Study of Korean Refugee Law on International Refugee Issues

  • Human rights problem of refugee is the most important task to be solved in the international society. The United Nations High Commissioner for Refugees (UNHCR) was established in 1950, with the need for cooperation in the face of the European refugee crisis. In 1951, 'The 1951 refugee convention' was signed for the protection of all refugees. Since the 1951 Refugee Convention, a legal framework has been established for responding to refugees. However, the discrimination and persecution of refugees are still lingering. The interest and the political will of many people in the world are needed to solve this problem. This article analyzes what efforts should be made with respect to human rights issues. This article concludes that, when comparing refugee acceptance and Korea, Korea needs to look at the common denominator of refugee law, human rights law, and international humanitarian law while looking at the treatment of refugees and displaced people from an inclusive approach, and reorganize law and policy. Since Korea is expected to gradually require inclusive policies, Korea should also supplement the legal system and take an inclusive approach. Although Korea as a member of the Refugee Convention, the Geneva Convention, and the Supplementary Protocol, has an obligation to enact domestic implementation laws, it does not reflect all of the obligations required by these conventions, so reorganization is needed.

  • The Purpose of this study is to research the problems of trade restriction for an environment protection. Environmental regulation relate to trade are Convention on International Trade in Endangered Species of Wild Fauna & Flora, Montreal Protocol on Substances that Deplete the Ozone Layer, Kyoto Protocol to the UN Framework Convention on Climate Change, Basel Convention on the Control of Transboundary Movements of Hazardous Wastes & Their Disposal, Cartagena Protocol on Biosafty and WTO Agreement. Regulatory action for environmental protection has economics instrument, command & control, liablity, damage compensation, voluntary agreement. In the case of our country, impact of regulatory action for environmental protection is low. Because is recognized position of developing country yet. For in the balance rules of trade and enviroment, First must satisfy WTO's basic principles and principle of quantitative restrictions prohibition, Second, operation of protection action must reasonable and objective standards Third, must satisfy GATT article 20 (b) clause and (g) protestation each essential factor To grow for environment advanced country, we should do i) using of FTA ii) international cooperation strengthening for developing country position iii) construction of environment information network

  • MICE (Meetings, Incentive travels, Conventions, and Exhibitions) segment is one of the fastest growing segments of the tourism industry today. Especially, the government promotes the convention business as a strategic industry given its growing importance as a high value-added export. The push-pull factor conceptual frameworks were used to identify motives that lead firms to attend conventions. Furthermore, the authors assess firms' service quality, preference, reliability, and positional advantage of Korea Electronics Show(KES). Using data from a number of Korean trading firms, the authors find considerable results and conclude by discussing recommendation for the convention industry.

The Effects of Convention Center Selection Attributes on Participant's Satisfaction and Moderating Effects of City Image and Attractiveness: Focusing on Shanghai Convention Center (컨벤션센터 선택속성이 참가자만족에 미치는 영향과 도시이미지·매력성의 조절효과: 상하이 컨벤션센터를 중심으로)

  • The main purpose of this paper is to analyze the influence of selection attributes of convention center on participant's satisfaction. Specially, this study is focusing on the moderating effects of city image and city attractiveness. In the dimensions of convention center selection attributes, many factors affect participant satisfaction can be assumed that. They are categorized as seven factors; main facilities, subsidiary facilities, operations management, human services, board and lodging, accessibility, and peripheral conditions. The data was collected from 260 foreigners who visited the Shanghai convention center in China. 237 respondents were analyzed via intercept survey based on self-administered questionaries. The results of this study supported the proposed conceptual framework overall. The findings indicate that first, main facilities, subsidiary facilities, human services, accessibility, and peripheral conditions affected positively participant's satisfaction. Second, the high level city image and city attractiveness have moderating effect between some selection attributes of convention center and participant's satisfaction.

Consideration on the Convention of Space Station as Law-Making Process among Nations (다수국간법정립행위로서의우주기지협정에관한고찰(多数国間法定立行為としての宇宙基地協定に関する一考察))

  • This Article examines a structure of two Conventions of Space Station, compares 1988 Convention and 1998 Convention, and tries to apply "model" to it. The structure of 1988 Convention shows us three phases: the Convention as a framework, the bilateral memorandum of understanding and the legislation by domestic process of United States. There were many advantageous provisions for United States. In 1998 Convention, however, those provisions are dampened and provisions become impartial, for example, the criminal jurisdiction, the right of intellectual property and the codes of conducts in Space Station. On the other hand, we sets the "model" up, that is "input of national benefits and ideas ${\Rightarrow}$ process of law-making ${\Rightarrow}$ output of common benefits, universal ideas and wastes." In the case of applying this "model" to 1988 and 1998 Conventions, we are convinced of enough possibility to understand and explain the legal system of Space Station by this "model." This result awakes us that study of legal system of Space Station according to the "model" influences the fundamental theory of International Law Study: the relation between international law and domestic law. This "model" has possibility to change the theory of relation between from "international law and domestic law" to "domestic law and domestic law through international legal system." In the end, we should reconsider on "policy-oriented jurisprudence" by professor McDougal to use his key words for explanation of concepts in the "model," because his theory contains important suggestions to the study of law-making process and legal system for outer space activities in the near future.
