  • As electronic commerce under the digital economy environment evolves rapidly affecting the structure of our economy and individual life styles, the need for metrics system to evaluate the performance of electronic commerce activities remarkably increases. Reviewing the characteristics of electronic commerce and some issues related to its measurement, this paper proposes a framework to measure the performance of electronic commerce business activities. the proposed framework customizes the balanced scorecard method for electronic commerce practices and can be applied effectively to electronic commerce businesses as an appropriate measure.

  • The European Union(EU) bas enacted a series of directives including the Directive on Electronic Commerce and started harmonizing the national laws in this area. As a result of this effort, Electronic, Commerce bas been vitalized as a part of Information Society Services. This article would be helpful to analyze the new legislations of the EU and to show their essentials as seeming free movement of goods and services by Electronic Commerce in the community. Therefore, this article would be useful to draw up a plan of South Korea Legislations on Electronic Commerce.

Now, information technology has made it possible to pay for the sale of goods and services over the internet. In international trade, there are service providers (Bolero, TradeCard, @Globaltrade) to settle payment electronically through the Internet.

  • The purpose of this study is to examine the legal aspects on the formation of international contract in electronic commerce. The findings could be summarized as follows. rug, the contract doctrine of the contract formation by electronic data message, time of dispatch and receipt of data message, error in electronic communication, contract form and electronic signature could be supported or protected by the existing contract doctrine. Second, In relation to the contract formation arranged by electronic agents, the established contract doctrine provides no clear answer to the question whether changes provided by the interaction of electronic agents are enforceable. The enforceability question is left to future legislation. Finally, It is necessary that a significant level of formality together with the disclosure on the contract formality by certain act be conveyed 10 a potential buyer so that the buyer is impressed that the contact by the certain act could be valid.

  • It is needed to search the electronic commerce standardization and to analysis its policies to meet the international situations strategically and forecast the technology surroundings for electronic commerce. This study aims at searching the current state of electronic commerce standardization and analyzing policies on electronic commerce by the driving subject, that is, government and private organization, major countries, and standard classifications of electronic commerce technologies such as e-documents, e-catalog, e-payment, and e-process. The government and private organizations get information for the current state and policies for standardization on electronic commerce and put them practical use to make policies and strategy applications.

  • As Electronic Commerce is popularized, crimes related to Electronic Commerce are also increasing, Electronic shopping malls and payment gateways focus their attention on network security of payment information or the sizes of encryption keys, In real world, however, the payment-related crimes in electronic shopping malls are not based on the security hole of encryption mechanism of the payment systems, but on the customers carelessness or the insecurity of server systems of merchants or financial institutes. So, this research analyzes the structure of current electronic payment systems, investigates the payment-related crimes, addresses the structural problems of the Korean electronic payment systems, and suggests an alternative general architecture for secure payment systems by incorporating the concept of separation of order information and payment information.

  • DESIGNIN AND OPERATION OF DIGITAL EVIDENCE MANAGEMENT SYSTEM APPLYING COMPUTER FORENSICS AND ELECTRONIC CERTIFICATION Digital evidence will be used as a term, which means the electronic form of information which is necessary to confirm or prove the factum of all kinds of behaviors committed through the devices which have data processing ability including computer. It is expected that there will be the increase of legal conflicts surrounding electronic commerce activities as well as the increase of cyber crimes, as the number of Internet users are getting bigger. In order to solve the problems of conflicts derived from electronic commerce, the factum of electronic commerce activities must be confirmed. In order to confirm the factum of electronic commerce activities, the evidence is prerequisite. Almost all evidences relating to the electronic commerce activities exist in digital form. For the reason that the digital evidence can be easily damaged and changed, special management is required to collect, analyze, and preserve the digital evidence. In order to meet this requirement, this study proposes a basic model of digital evidence management system applying computer forensics and electronic authentication.

The Genealogical Study on Electronic Bill of Lading

  • This thesis examines the problems faced in the electronic bill of lading for which improvements are necessary, and suggests various ways of overcoming those problems. First, to build a negotiation system for electronic B/Ls, active participation from related parties in addition to the government support is essential. Second, electronic B/Ls cannot be utilized within a short period of time in current commercial practices. Third, there should be infrastructure which connects all parties of international commerce through an electronic system. Fourth, instead of promoting mutual recognition through international treaty, there should be a plan which legally specifying mutual recognition between certification authorities. Fifth, it is needed to ease the strictness of electronic signature to promote the global negotiation of electronic B/Ls. Lastly, in prima facie weight of evidence, there was a significant difference with the Rotterdam Rules even in comparison with the Commercial Act which was amended with the significantly advanced rules on electronic B/L. He believed there should be a discreet consideration on these matters at the revision of the Commercial Act. For this, the government has to provide support more aggressively with more interest and commitments.

  • This paper shows the architecture of IPS(Intermarket Payment System), an implementation of the electronic payment function for internet-shopping merchant system. Because the original purpose of commerce transaction is the exchange of money for goods or services, it is very important to prepare an exchangeable economic value or method. The electronic payment system is the hardware or software or both to process an electronic payment transaction. It has two type, the broker type and the electronic value type. The broker type means an intermediator between real bank network and internet commerce transaction. The electronic value type means a substitute for money in the real world. This paper shows the architecture and the function to implement the broker type electronic payment system. The system has two parts. One is the mediator part to support multiple payment systems and to offer common access methods for merchant system database. The other is the executor part to implement the payment protocol and to process payment transaction.

  • Electronic methods are already used in money transfer and credit cards transactions and electronic money and checks, which can substitute cash and coins, are being discussed. Recently, the Acts of Electronic Draft have been enacted, in order to make the money in the market flow efficiently. Also electronic bill of lading has been adopted for the practical use of international shipments. However, despite of the effort from the academia and practice, investments to stocks, especially in the stock exchange, is not quite perfectly electronic. Japan enacted a relevant act in 2004 which make its stock market totally dematerialized. This writing summarizes some issues in interpretation that arise in the course of operation of the Stock Electronic Registration System at the present time of 6 months after it came into effect and its purpose, by doing so, is to prevent in advance the kind of problems in introducing the similar system to Korea.
