  • Dispute related to construction projects involving numerous persons is one of the biggest challenges faced by contractors today. It costs a substantial amount of money and time in resolving these kinds of claims. Recently, with the changes in the construction environment and thought of relation with owner, the number of construction claims has increased. But, a majority of these claims do not prevail, and in fact, frequently get dismissed in its entirety. The reasons for such dismissals include the ignorance about the claims, lack of clear and convincing evidence, and so on. But most of reasons are the claims are not managed well on construction process. This paper analyzes the failure causes by relying on past claim failure cases, and then drew works that have connection with failure causes through interview. It also presented importance degree of construction management works.

  • In this paper, we explore market and environmental factors which affecting organization's priority claim application which is more powerful and prompt strategic method to protect technology from competitors under uncertain and volatile environments. This study empirically examines why organizations strategically choose the priority claim application which is more strong tactics to protect technology as the source of sustainable competitive advantage. We suggest that market and environmental factors, such as exogenous shock, volatility, and uncertainty, may also affect strategic decision that organization take patent application with claiming priority. The results of our analysis of priority claim application in the Korean high-tech electronics industry from 1994 to 2008 showed that these three strategic factors affected the technology protection decision and organization's status also moderate theses effects, as predicted in our hypotheses.

Priority Areas for National Health Care Quality Evaluation in Korea (의료의 질 평가 우선순위 설정)

  • Objectives : To identify target areas and set priorities among those areas identified for national quality evaluation. Methods : Target areas were identified from: i) analysis of the national health insurance claims data, mortality and prevalence data ii) various group surveys, including representatives from 22 medical specialty associations, 19 physician associations, QI staffs in hospital, civil organizations, and commissioners of Health Insurance Review and Assessment Service(HIRA) ⅲ) literature reviews and RAM(RAND/UCLA appropriateness method). The priority areas for national quality evaluation represented the full spectrum of health care and the entire life span. The criteria for selecting the priority areas were impact, improvability, and measurability. The priority areas were divided into three categories : short-term, mid-term, long-term. Results: Based on the group surveys and the data analysis, 46 candidates were selected as quality evaluation priority areas. 13 areas were selected as having a short-term priority areas: tuberculosis, community acquired pneumonia, stroke, ischaemic heart disease, diabetes, hypertension, chronic lower respiratory disease(asthma, chronic obstructive pulmonary disease), intensive care unit, emergency room, nosocomial infection, use of antibiotics, multiple medication and renal failure. This results suggested that we need to enlarge the target priority areas to the chronic diseases in short-term. Conclusions: The priority areas identified from the study will assist healthcare quality associated institutions as well as HIRA in selecting quality evaluation areas. It is required to develope and implement strategies for improving the quality of care within the next 5 years.

  • It is common to experience delays during construction projects. Delays can ca use substantial damages to an owner as well as contractors and is the sources of frequent disputes and claims. Many studies have been carried out to assess the causes of delays in construction projects. They are found to be almost similar, except some prevailed local condition. Most of the common construction delay factors are attributed to design faults, incompetent contractor, lack of team accountability etc. To minimize or eliminate the delay we have to follow the recognized fundamental principles of management such as: cost-time relationship, time priority, accountability, rewards, innovative thinking etc. The root causes of delays found out in this paper are not so much different than other previous study. If the implementing agencies properly followed the, fundamental management principles and some other related corrections as recommended in the paper, much construction delays can be avoided.

A Comparative Study on the Competitiveness of the Alignment Zones in the Capital Area (수도권 정비 권역별 입지 경쟁력 비교 연구)

  • In the context of sustainability which is understood as equilibrium among three elements; human, space and time, the imbalance within the Seoul metropolitan area hinders its own area or the nation from development. Claims for the balanced development in the area are set up on the premise that there is a locational order of priority among the zones named 'overpopulation suppression', 'growth management' and 'conservation'. Based on the systematic consideration of competitiveness this study adopts the premise as a research hypothesis. Factor scales derived from the factor analysis, a kind of multivariate dependence analysis play an important role in this research process since they are measured by interval-ratio level and can be used for dependent variables in the statistical analysis. The hypothesis test carried out by means of the analysis of variance(ANOVA) concludes that the hypothesis assuming no difference in the competitiveness is rejected but the alternative hypothesis of the locational order mentioned above should be adjusted. Eigenvalues derived from the factor analysis could be used as weights for aggregate factor scales and the scales show that the priority is in the order of growth management - overpopulation suppression - conservation zones. This finding has also a significant implication that the countermeasures to cope with the lowering of the competitiveness resulted from the continuous and absolute restraints should be provided. And strategic approaches which are composed of key factors for each zone are deducted from in-depth review. (1) overpopulation suppression zone; health-welfare, educational base, public service factors, focusing on health-welfare one, (2) growth management zone; public service factor and (3) conservation zone; health-welfare, educational base factors, also focusing on health-welfare one.

  • The UNCITRAL, during its thirty-two session in 1999 discussed certain issues and problems identified in interactional commercial arbitration practice. The issues discussed include certain aspects if conciliation proceedings ; the legislative requirement of a written form for the arbitration agreement ; arbitability ; soverign immunity ; consolidation of more than one case into one arbitral proceedings ; confidentiality of information in arbitral proceedings ; rasing claims in arbitral proceedings for the purpose of set-off ; decisions by "turncated" arbitral tribunals liability of arbitrators ; power by the arbitral tribunal to award interest ; costs of arbitral proceedings ; enforceability of interim measures of protection ; and discretion to enforce an award that has been set aside in the state of origin. Among those issues discussed, most of States agreed that the issues relating to certain aspects of conciliation proceedings ; the legislative requirement of a written form for the arbitration agreement ; enforceability of interim measures of protection ; and discretion to enforce an award that has been set aside in the State of origin should have priority over other issues. The UNCITRAL may wish to consider the desirability of preparing uniform provisions on any of those issues, possibly indicating whether further work should be towards a legislative text (such as a model legislative provision or a treaty) or a non-legislative text (such as a model contractual rule).

Designing an Effective Pay-for-performance System in the Korean National Health Insurance

  • The challenge facing the Korean National Health Insurance includes what to spend money on in order to elevate the 'value for money.' This article reviewed the changing issues associated with quality of care in the Korean health insurance system and envisioned a picture of an effective pay-for-performance (P4P) system in Korea taking into consideration quality of care and P4P systems in other countries. A review was made of existing systematic reviews and a recent Organization for Economic Cooperation and Development survey. An effective P4P in Korea was envisioned as containing three features: measures, basis for reward, and reward. The first priority is to develop proper measures for both efficiency and quality. For further improvement of quality indicators, an electronic system for patient history records should be built in the near future. A change in the level or the relative ranking seems more desirable than using absolute level alone for incentives. To stimulate medium- and small-scale hospitals to join the program in the next phase, it is suggested that the scope of application be expanded and the level of incentives adjusted. High-quality indicators of clinical care quality should be mapped out by combining information from medical claims and information from patient registries.

Comprehensive Investigations on QUEST: a Novel QoS-Enhanced Stochastic Packet Scheduler for Intelligent LTE Routers

  • In this paper we propose a QoS-enhanced intelligent stochastic optimal fair real-time packet scheduler, QUEST, for 4G LTE traffic in routers. The objective of this research is to maximize the system QoS subject to the constraint that the processor utilization is kept nearly at 100 percent. The QUEST has following unique advantages. First, it solves the challenging problem of starvation for low priority process - buffered streaming video and TCP based; second, it solves the major bottleneck of the scheduler Earliest Deadline First's failure at heavy loads. Finally, QUEST offers the benefit of arbitrarily pre-programming the process utilization ratio.Three classes of multimedia 4G LTE QCI traffic, conversational voice, live streaming video, buffered streaming video and TCP based applications have been considered. We analyse two most important QoS metrics, packet loss rate (PLR) and mean waiting time. All claims are supported by discrete event and Monte Carlo simulations. The simulation results show that the QUEST scheduler outperforms current state-of-the-art benchmark schedulers. The proposed scheduler offers 37 percent improvement in PLR and 23 percent improvement in mean waiting time over the best competing current scheduler Accuracy-aware EDF.

A Study on 'Romalpa' Clause under SGA (SGA상 'Romalpa' 조항에 관한 연구)

  • This study examines Romalpa clause as an extended or enlarged retention of title clause under SGA. Under a simple retention of title clause, the seller retains title to goods supplied until the goods have been paid. A simple retention of title gives the seller super-priority interest in other creditors of the buyer without registering a charge. Aluminium Industrie Vaassen BV v. Romalpa Aluminium Ltd introduced the concept of 'extended reservation of title(so called 'Romalpa clause') in English law. It is because the Court of Appeal held that under an extended reservation about title clause the seller can trace his title into money which constitutes the proceed of sale by the buyer of goods supplied by the seller. However, since Romalpa case, the courts are reluctant to uphold the seller's extended title. Under Romalpa clause, the seller attempts to extend his protection by laying claims to new products manufactured from his goods or to proceeds of sale by the buyer. Where the seller's goods are lawfully used by the buyer to create new goods, the property in the new goods will generally vest in the buyer. It is because there has been discomfort if the seller gains the windfall profit of the new goods. Moreover, regarding tracing proceeds of sale by the buyer, the courts held that the seller must establish fiduciary relationship with the buyer. If the fiduciary requirement cannot be established, the extended retention of title clause is seen as a charge over the proceeds, and void if not registered. For these reasons, it is difficult that the claims based on the extended retention of title clause would be upheld.

LDA Topic Modeling and Recommendation of Similar Patent Document Using Word2vec (LDA 토픽 모델링과 Word2vec을 활용한 유사 특허문서 추천연구)

  • With the start of the fourth industrial revolution era, technologies of various fields are merged and new types of technologies and products are being developed. In addition, the importance of the registration of intellectual property rights and patent registration to gain market dominance of them is increasing in oversea as well as in domestic. Accordingly, the number of patents to be processed per examiner is increasing every year, so time and cost for prior art research are increasing. Therefore, a number of researches have been carried out to reduce examination time and cost for patent-pending technology. This paper proposes a method to calculate the degree of similarity among patent documents of the same priority claim when a plurality of patent rights priority claims are filed and to provide them to the examiner and the patent applicant. To this end, we preprocessed the data of the existing irregular patent documents, used Word2vec to obtain similarity between patent documents, and then proposed recommendation model that recommends a similar patent document in descending order of score. This makes it possible to promptly refer to the examination history of patent documents judged to be similar at the time of examination by the examiner, thereby reducing the burden of work and enabling efficient search in the applicant's prior art research. We expect it will contribute greatly.
