Study on the Design of the Standard Model for the Undergraduate Curriculum in Higher Education in Private Investigation Study (탐정학 고등교육 학부과정 표준모델 설계에 관한 연구)

  • In Korea, the permission for private investigation(PI) industry was implemented in 2020, and many PI associations and education institutions are currently training private investigators in the form of private qualifications. In line with the expansion of PI industry, universities are also establishing and operating private investigation study departments or major courses, and are constantly developing research and programs to provide education that meets the purpose and characteristics. This study compared and analyzed the subjects of various domestic universities that already operate the detective department and suggested the direction necessary for the development of PI market in Korea and the revival of private investigation studies in the future. The contents of the study include the composition of an educational model reflecting the field, the expansion of professors specializing in PI studies, and the development of original subjects in PI studies that break away from subjects such as police science and criminology. It is hoped that suggested direction will be actively reflected to lay the foundation for the development of private investigation studies and private investigation industry.

  • Since there are no related laws and regulations in the Korean private investigation industry, anyone can freely operate it if they report the business to the tax office. The reality is that companies hire PI to investigate rival companies and employees for specific reasons, as they generally rely on individual requests. The Korean PI industry is divided into two parts. The first are retired police officers and investigators who have experience in criminal investigation. The second are private citizen who can conduct investigation service activities runs a PI agency after everyone has registered with the tax office. It is no exaggeration to say that the current legal conflicts and legal problems that arise in the PI service cannot be ruled out because civilians are relatively less knowledgeable than PIs and legal experts. Therefore, in order for PI industry to operate stably in Korea, we will first study the concept and type of PI industry, comparative analysis of past PI laws, current status and reality of PI industry, and study the current status and references.

  • Citizens living in modern society are exposed to various types of crime, are increasingly concerned about safety issues, and have a high level of awareness of crime in reality. Accordingly, efforts are being made to prepare response plans at the judicial agency level and strengthen security services, but the reality is that various limitations are being revealed. To complement and replace this, the private investigation industry was created, but since there are no laws or restrictions on business activities, social side effects are occurring. This study seeks to determine the policy direction to secure public institutionalization in the private security service area of private investigation before the legalization of private investigation. To this end, we focused on borrowing a public model by studying and comparatively analyzing previous studies, cases, and systems related to the domestic and foreign private investigation industry. Through this, it must be developed in a way that improves the public and social functions of private investigation. This is a combination of the private investigation function of the private investigation industry and the surveillance function of specialized areas with specialized knowledge in each social field, it is to expand the scope of public interest private investigator who play the role of such as the fair election surveillance function and environmental crime surveillance function. By increasing public interest as an essential condition for the development of a sustainable private investigation industry, the private investigation industry will be established as a social tool that protects the interests of the people and improves their rights.

  • In investigating missing persons cases, the focus is on strengthening the efficiency of detectives' work in investigating missing persons cases. Disappearance cases are seen as a problem that directly affects social safety and individual well-being. The research has the following structure. The introduction presents the necessity, scope, and methodology of the study. Next, we analyze the definition, causes, types and actual conditions of disappearance cases. In terms of problems in the process of handling missing persons cases, the initial response process, problems in the response of related agencies after reporting, problems due to the prolongation of the case, and problems due to legal restrictions are analyzed. In the plan to improve the work efficiency of detectives for disappearance cases, the revitalization of public interest investigation networks, strengthening of capacity related to disappearance case investigation, professional public interest detective certification system, and establishment of exception provisions for detective activities are discussed. In the conclusion, we present what is necessary for the activities of public interest detectives specializing in missing persons cases.

A Study on the Role of the Private Investigator in the Industrial Security Market (산업보안 시장에서의 탐정 직무역할에 관한 연구)

  • This objective of this study is to identify the roles of private investigation in the industrial security market. In order to achieve this, the converged security framework was subjected to analysis, with the x-axis defined as prevention, monitoring, and follow-up, and the y-axis defined as administrative security, physical security, and technical security. To gain a more detailed understanding of job classification, the job duties were analyzed using the ASIS industrial security certification framework, and job roles were derived according to the process. As a result of the study, 25 job role derived from 8 areas for industrial security investigation from the perspective of converged security. The job areas are as follows: prevention-management, prevention-physical, prevention-technical, monitoring-management, monitoring-physical, monitoring-technical, post-management-management, post-management-physical security, and technical security. This study has enabled the duties and role tasks of private investigation in the industrial security industry to be identified, and it has also facilitated the specifiction of the role of industrial security investigation and their revitalisation. Furthermore, the finding of this study represent an initial effort to delineate the role of the private investigarion in the industrial security market. It may serve as a foundation for future research into strategies for revitalising the private investigation industry.

  • Modern society is operated based on the internet, wireless networks, and digital devices to the extent that it is called a digital society. In particular, as most of financial transactions, information movement, and commercial activities are based online, various social problems and side effects related to this are increasing rapidly. Representative examples include industrial espionage activities and leakage of industrial technology, and social problems such as illegal goods trade such as drugs using online and online gambling are increasing to a serious level. These digital-based social problems cannot be solved only by the activities and capabilities of judicial institutions such as police and prosecutors. Now that the private investigation market is open, active intervention using them is necessary. To this end, it is necessary to actively cultivate private investigator's ability to investigate and collect evidence in relation to digital social and criminal problems. In addition, each private investigation education institution or association should actively invest and research this.

  • In modern times, damage caused by the spread of the Internet has become very diverse. In particular, due to the craze of K-pop since 2008, the damage caused by copyright infringement in the domestic and international music markets has become the biggest problem in the Internet market. However, the manpower of the police and copyright protection agencies to solve these increasingly intelligent crimes is insufficient. Therefore, we are trying to find out the role of the public interest detective as a supplementary force for the public authority and as a substitute for the copyright protection agency that can provide legitimate help for victims in the prevention of music copyright infringement and disputes. For this study, first, the concept and types of music copyright, the concept of public interest detectives, the current status and system of music copyright were identified, and the role of detectives for music copyright protection was explored through system operation and status analysis of protection agencies and literature review. Through the results of this study, it is hoped that the role of a professional detective in the public interest dimension of music copyright protection can be a good soil for the development of the detective industry in the future.

Japanese Private Detective Investigation of Long Term Missing Person (일본 탐정의 장기미제 실종자 조사)

  • The purpose of this study is to suggest legalization of private investigation system by giving an example of Japanese detective investigation on people who have been missing for a long time. To accomplish the research purpose, this study reviewed literature and used preceding researches on Japanese detective system to complete theoretical background. This study also identified the missing people in Korea and Japan to accomplish the research purpose. Conclusion: In Japan, about 80,000 people are reported to be missing every year. Although most of them are found on that day or within a week, some of them are not found for more than a week. There even a case where the person was missing for more than 3 years. In such case, the Japanese citizens requests detectives to find the missing person instead of depending on the police. When Japanese detectives are paid by their client, they provide the security service requested by the client. Japanese detectives receive about 100,000 yen to 700,000 yen for finding missing person and they find the missing person through investigation on voluntary or involuntary missing person. Such activities of Japanese detectives point out the necessity of introducing private investigation system in Korea. Currently, most missing people are not found in Korea. Introduction of private investigation system will help in finding the missing person, reducing the excessive workload of police, and creating jobs.

The Analysis of the Effectiveness of CPTED Implementation in Underground Public Walkway Facilities (지하 공공 보도 시설의 CPTED 적용 효과 분석 : 사례 비교 연구)

  • This study evaluates the safety and usability of three underground walkways in Seoul by applying Crime Prevention Through Environmental Design (CPTED) principles. The 2024 survey focused on five key concepts: Access control, Surveillance enhancement, Maintenance, Legibility enhancement, and Territorial usability enhancement. The results showed that Access control in the underground walkways was limited. While Surveillance enhancement proved effective in some walkways, Legibility and Territorial usability enhancements were generally lacking. Ultimately, using the Analytic Hierarchy Process (AHP) for evaluation, both the Yeoksam and Jonggak underground walkways received a "Very Good" rating, while the Seolleung underground walkway received a "Good" rating. The research highlights the need for improvements in applying CPTED principles to underground walkways and emphasizes the importance of continuous maintenance. These measures, the study suggests, will contribute to crime prevention and enhance the overall usability of these spaces.

  • The private investigator service in Korea is to protect our legal market from personal right, creation of job, legal opening via OECD and FTA as well as the prevention of negative private investigation such as service center and private investigator operated without any control. Therefore, this study compares the civil research systems of advanced countries, reviews the legal process to introduce private investigator service as well as considers the previous studies to suggest the work sectors of private investigator service appropriate to Korea. As a result, it distinguished the private investigation work into corporate, finance, insurance, medical service, Cyber, traffic accidents, intellectual property right, lost and forensic science.
