지구온난화가 진행되면서 태풍, 홍수, 호우 등 기후변화에 기인한 재해의 피해수준이 심해지고 범위도 날로 확대되고 있다. 한국의 경우에도 집중호우와 그로 인한 침수피해 등 자연재해로 인한 피해가 늘어나면서 자연재해에 대응할 수 있는 재난행정에 대한 관심이 높아지고 있다. 그럼에도 불구하고 복합적인 양상을 보이는 재난에 효과적으로 대처하기 위한 행정체제에 대한 연구는 아직 부족한 실정이다. 특히 재난행정이 오랫동안 발전해온 미국과 일본의 체제 각각에 대한 연구는 있어왔으나, 한미일 3개국의 재난행정체제를 체계적으로 비교하고 한국에 필요한 시사점을 도출한 연구는 많지 않았다. 따라서 본 연구는 한국의 행정체제의 발전에 오랫동안 지대한 영향을 미쳐온 미국과 일본의 재난행정체제를 분석하고 최근의 재난 양상과 관련해 한국에 필요한 시사점을 도출한다. 본 연구의 연구방법으로는 비교제도분석을 실시했다. 우선 선행연구 검토에 기반하여 재난행정체제의 비교분석에 필요한 비교틀을 구성하고, 분석틀에 기반해 한국, 미국, 그리고 일본의 재난행정체제를 비교한다. 분석결과 한국의 재난 행정체제는 미국 및 일본과 같은 재난행정의 선진국가와 비교할 때 재난관련 법률이 통합적이지 않고 분산되어 있어 상호중복 및 충돌의 소지가 있으며, 재난관리 단계에 있어서도 예방보다는 대응과 복구에 중점을 두는 것으로 나타났다. 또한 재난대응의 1차 책임소재도 불명확하며 민간네트워크도 재난에 효과적으로 대응할 수 있는 수준으로 발전되지 않은 것으로 드러났다. 이러한 문제점에 대한 개선방안으로서 미국과 일본의 재단대응체제으로부터 다음과 같은 시사점을 얻을 수 있다. 첫째, 기존의 분산되어 있는 기본법들을 통폐합하여 재난관리를 통합적으로 다루는 기본법을 제정할 필요가 있다. 둘째, 지방정부의 재난대응역량을 강화시키고 보다 많은 책임과 권한을 부여해야 한다. 셋째, 재난관련 기관들의 역할을 명확히 분담하고, 정보를 공유하며, 조정기제를 효율화하여 재난대응시 협업이 효과적으로 이루어질 수 있도록 하여야 한다. 이를 위해서는 분산적인 재난관리체제를 통합적 성격의 체제로 전환해야 한다. 넷째, 주민단위 재난대응조직과 협력의 틀을 구축하여 민관네트워크를 활성화하여야 한다.

Purpose: The purpose of this study is to identify the legal status of enterprise disaster management standards established as part of business continuity management and to ensure resilience, and to improve the problem of application of industry disaster management standards in related industries. Method: We collected relevant data for the study and conducted a literature review on the logistical definition of laws and academic systems such as constitution and enterprise disaster reduction law, and HLS structure. Results: It has been confirmed that the enterprise disaster management standards in the Enterprise Disaster Management Standard are higher in the legal status than the ISO 22301: 2012 international standard. Conclusion: Through this study, it is necessary to establish a development direction of application and related regulations by clarifying the enterprise disaster management standard according to the enterprise disaster reduction law.

Korean Government decided to establish the Ministry of National Emergency Management and has reformed the emergency management system due to Sewol ferry disaster. These efforts has been focused on the hardware rather than the software. All-hazard approach has been employed as the one of main principles in the emergency management in the United States. All-hazards approach concerns arrangements for managing the large range of possible effects of risks and emergencies. Once the priority of risks and emergencies is decided, agencies prepare for them. In addition, interagency collaboration is critical for the preparation of risks and emergencies such as cooperation with local governments instead of FEMA alone. It is necessary to consider employing all-hazard approach for the Ministry of National Emergency Management. Moreover, 'Korean All-hazard approach' should be developed in order to manage upcoming emergencies.

중대재해처벌법이 도입되었으나 여전히 실무적으로 정착되고 있지 못한 실정이다. 이에 공무원과 공공기관 652명의 실무자들을 대상으로 중대시민재해 관련 실무상의 애로사항과 중대재해처벌법의 개정방향에 대하여 설문조사를 실시하였다. 그 결과 다양한 애로사항의 상당부분은 관련 기준이 부재하여 발생하고 있었으며, 중대재해처벌법 개정방향도 높은 비율로 의무사항을 준수하기 위한 구제적인 기준 제시가 필요한 것으로 조사되었다. 그러므로 구체적인 기준제시를 위하여 시행령 개정과 함께 관계부처가 발간한 중대재해처벌법 해설서를 개정 및 보완할 필요가 있다.

본 논문에서는 「중대재해처벌법」과 관련한 중대시민재해의 예방을 위해 BCMS(Business Continuity Management System) 운영체계를 활용하는 방안에 관한 연구이다. BCMS 운영 체계는 시민에게 잠재적인 위협 또는 해당 위협이 발생했을 경우 시민에게 중대재해를 미칠 수 있는 특정 원료, 제조물, 공중이용시설, 공중교통수단 등의 운영·관리에 미칠 수 있는 영향을 사전에 파악할 수 있다. 또한 이를 이용하는 시민과 종사자의 생명과 신체를 보호하고 유해8위험요인으로부터 안전을 확보하는 능력을 갖추어 중대재해를 예방하고 조직의 리질리언스을 확보하는 데 목적이 있다. 따라서 본 논문은 안전 및 보건 확보의 의무가 있는 모든 조직; 사업주, 법인, 경영책임자, 공무원 등의 특성에 따라 접목할 수 있는 BCMS의 PDCA(Plan-Do-Check-Act) 운영체계 설계를 활용하여 중대시민재해 예방 대안을 모색하였다.

As disaster potential power of modern society grows larger, to improve and reinforce efficiently a national system which prepares and responds disasters, analyzed the survey for government officials of the department disaster management. Following is the contents of this research. First, cooperative relationship to disaster management organizations. Second, necessity of law establishment related crisis and disaster department. Third, by recognition regarding disaster management situational variable, overall recognition regarding disaster management situation, overall recognition regarding crisis type, recognition regarding occurrence possibility along disaster scale. Fourth, by recognition regarding structural variable of disaster management, the National Emergency Management Agency regarding disaster management, related organization, recognition difference of local government. It is a research about confusion regarding step of prevention - preparation - correspondence - restoration.

There is insufficient effective management systems to achieve project goalsin disaster and safety R&D. Therefore, to develop an R&D performance management system, this paper develops a R&D performance management matrix based on PMBOK to systematize a process and to enhance efficiency of performance management. Also, this paper identified vulnerable procedures in disaster management by analyzing related laws, work process and performance. Analysis results found that the performance management matrix in disaster management R&D consists of 5 process groups, 7 knowledge areas and 47 processes. Also, the performance of the diffusion knowledge process was evaluated as weak in the present management system. This study defined ITO and developed a data flow diagram for applicationto related work. The suggestions of this study include the related work to enhance R&D performance, contribute to improving diffusion of R&D performance, and enhance the utilization of developed technologies.

본 논문에서는 업무용빌딩 운영 시 중대재해처벌법 시행에 대응하기 위한 방안을 연구하였다. 그동안은 산업안전보건법 중심의 안전관리를 시행하여 왔으나 중대재해처벌법에서는 사업주와 경영책임자에게 안전8보건 관계 법령에 따른 의무이행의 관리상 조치를 하도록 하고 있으므로 업무용 빌딩에 적용되는 관련 법령를 조사하고 이를 체계적으로 관리하기 위하여 빌딩내 시설물·설비 현황을 먼저 파악하였고 각 시설 및 설비별로 적용되는 안전 관련 법령을 확인하여 법령에서 정하는 의무이행 사항을 체계적으로 관리 할 수 있도록 방안을 연구하였다.

"재난 및 안전관리기본법"에서는 재난발생의 위험이 높거나 재난예방을 위하여 계속적으로 관리할 필요가 있다고 인정되는 시설 및 지역을 특정관리대상시설로 지정 관리하고 있다. 그러나 특정관리대상시설의 종류가 다양하고, 양이 방대하며, 상세 안전관련 내용이 개별법에 따라 관리됨에 따라 종합적인 안전관리가 어렵다. 본 연구에서는 특정관리대상시설의 종합적인 안전관리시스템을 구축하기 위하여 "소방시설 설치유지 및 안전관리에 관한 법률"에서 규정하고 있는 특정소방대상물의 소방검사제도를 살펴보고 이를 통하여 각 전문분야 시스템과 연계한 종합안전관리시스템 구축방안을 제시하고자 한다.

최근 건설현장의 사고사망만인율을 줄이기 위해 범 국가적인 차원에서 법,제도 등을 마련하여 적극적인 움직임을 보이고 있다. 산업안전보건법 전면개편,중대재해처벌법 제정,사업장 위험성평가 개정 등으로 법을 정비하고, 중대재해 감축 로드맵을 통하여 사업장의 전반적인 안전관리 가이드에 대해 제시하고 26년까지 OECD국가 기준 사망만인율을 줄이는 것을 목표로 하고 있다.
