Estimation of Benefits by Implementing Motor Vehicle Recall System (자동차 리콜제도의 시행에 따른 편익산정)

  • On January 1, 2003, the motor vehicle management system in Korea was transformed from government's vehicle type approval to manufacturer's self-certification. The motor vehicle recall system with self-certification is an essential mechanism to place the liability of the vehicle defects on manufacturers and hence protect consumers from automobile accidents. This study provides a methodology to measure the benefits of motor vehicle recall system in two categories: benefits of reduction in traffic accidents and benefits of severity reduction in traffic accident. Applying the proposed methodology, the benefits of implementing motor vehicle recall system in Korea were estimated. It was estimated that 745 traffic accidents, 12 fatal accidents, and 1473 injury accidents were respectively reduced in 2002 due to implementation of motor vehicle recall system.

A Study on the Improvement of Motor Vehicles Safety Certification System According to the Deployment of Autonomous Vehicle (자율주행자동차 상용화에 따른 자동차 안전 인증제도 개선에 관한 연구)

  • The purpose of this study is to explore ways of improving the motor vehicles safety certification system in preparation for the deployment of Lv.4 or higher autonomous vehicles. In order to effectively achieve the objectives of this study, theoretical and empirical research methodologies were employed, including literature review of prior research, government-published data, etc.; comparative research on legislative cases of other countries regarding motor vehicles safety certification; historical and legal research on domestic systems; legal analysis to explore approaches for improvement, etc. Some argue that the type approval system is needed in preparation for deploying autonomous vehicles, but there are several limitations in moving to the type approval system from the self-certification system currently adopted in Korea. First, there is a possibility that the system may be in conflict with the Korea-U.S. MOU regarding Foreign Motor Vehicles (1988) and the Korea-U.S. FTA (2011); second, there is a risk of undermining the cause of the self-certification system, which is the autonomy of manufacturers; third, the boundary between autonomous vehicles and non-autonomous vehicles is unclear; and fourth, the type approval system may hinder technological competitiveness. On the other hand, considering that the Korea-U.S. FTA and the UNECE IWVTA recognize exceptions to deal with road safety and risks to human health or the environment, and have a pre-certification system for some auto parts such as pressure-resistant containers, it can be said that there is room to introduce the type approval system for supplementation purposes. To improve the motor vehicles safety certification system while ensuring the safety of autonomous vehicles of Lv.4 or higher, the targets of type approval should be defined and the criteria, procedures, etc. for type approval should be established. At the same time, the consistency between motor vehicle-related laws and harmonization with international standards need to be considered.

  • It is very important to construct advanced recall systems in aspects of developing auto industry through strengthening international competitive power, as well as protecting the lives from traffic crashes by vehicle defects. Under the self-certification system, there may be high probability to be defected vehicles because vehicles are sold without testing and approval of governmental sides, even though the system was introduced to give an autonomy to manufactures. Accordingly, it is not optional, but essential concerns to build advanced recall system. As a result of analysis, manufacturers and consumers ask for improvements of domestic recall systems. In this study, policy guidelines were provided on the basis of analyses on several regulations and questionnaires of consumers and manufacturers. The policy guidelines are clearness of recall subjects, prompt collection of vehicle defect information, objective determination of vehicle defects, continuous monitoring of vehicle recalls, etc.

Suggestion for Safety Improvement of Compressed Natural Gas Vehicle (압축천연가스 자동차의 안전성 향상을 위한 제언)

  • Systematic safety research by Korea Government has been made to enhance the safety of CNG (compressed natural gas) vehicles since the burst of compressed cylinder of an urban bus in August 9, 2010. This article summarizes some major activities to ensure the safety of CNG vehicles, which covers review of regulation, safety management system including standard of inspection and certification, and training program of inspectors and car mechanics. Specifically, the followings were reviewed; type of CNG cylinder, location of CNG cylinder, material and type of fuel line and vent line, modification of pipeline connection, installation of gas detector, installation of emergency shutdown valve, installation of protecting cover for cylinder, obligations for CNG vehicle filling station. improving periodical inspection, routine test on gas vehicles, training program for engaged in gas vehicles, and designation of safety manager for CNG bus company. This paper suggests how to improve safety of CNG vehicles as a result of review of above mentioned check items.

  • In this study, it was analyzed that it is necessary to clarify the quality certification parts system, to make certification codes mandatory for self-certification products that are normally distributed, and to conduct follow-up management so that prompt action and thorough management of test reports are necessary in case of defects. Big data-based data, the detailed number of parts replacement cases, parts cost by part group, share, average labor cost, calculated to analyze the detailed automobile parts industry, and automobile parts certification system and automobile parts market in major countries including Korea and Through the distribution structure analysis, improvement plans for the automobile quality certification parts system were derived.

  • The trust issue on the safety of autonomous vehicle is a very important in regard to the demand generation of relevant industries. To secure the trust, The study of legal liability issue should be prior to an accident of the autonomous vehicle. In civil law, it is possible to make the automobile manufacturer take legal responsibility with the "Product Liability Act". Whereas, in criminal law, it is difficult to make him take legal responsibility since the criminal law holds the actor responsible. To solve these problems, this article proposes the establishment of the "Special Act on Autonomous Vehicle". Also, there is a demand for building infra structures and system to operate the (fully) self-propelled vehicle and establishing "certification" systems.

A Study on Recall Systems of Motor Vehicle by Statistical Analysis of Defects Investigation (자동차 제작결함조사 통계 분석을 통한 리콜제도 연구)

  • The basic point of a vehicle recall is to remove vehicle defects as soon as possible and thus prevent possible road traffic accidents caused by the defects beforehand. Therefore, the core of vehicle recall under the self-certification system consists of a timely response and fast remedy of defects. The present study aimed to deduce a plan for improvement of the system necessary for the fast remedy of defects through a phased analysis of defect investigation procedure based on defect investigation statistical data. There will be a need to make the TSB(Technical Service Bulletin) or service campaign data submission of a manufacturer compulsory for the collection of broad defect information in the stage of information analysis and to impose a higher penalty when the manufacturer violates the data submission in the investigation stage. In addition, it is considered that an active service campaign should be induced and a punishment for late recall will be needed for consumer protection.
