안전관리는 건설사업의 시공과정 중에 발생 가능한 유해, 위험으로부터 인명을 보호하는 것이며, 건설사업의 주제는 발주자로서 발주자 역할의 극대화는 효과적인 건설재해 방지의 관건이다. 건설프로젝트의 발주자, 설계자, 감리자, 시공자, 협력업자 등 다수 참여자의 장기간에 걸친 공동작업으로 이루어지는 건설공사의 특성을 고려할 때, 기존의 건설안전관리체제로는 건설공사에 수반되는 이와 다양한 유형의 사고를 방지하기 위한 근본적인 처방으로는 미흡하며, 건설산업의 총체적인 안전수준의 향상을 통한 시설품의 생애주기 전반에 걸쳐 안전성을 확보할 수 있는 근원적인 안전관리제도의 구축이 요구되고 있다. 실태조사 결과 공공발주자와 민간발주자의 안전의식 및 안전관리실태에는 격차가 크며, 대다수 발주자의 안전관리에 대한 책임의식이 미흡하며, 민간발주자의 경우가 훨씬 열악한 것으로 나타났다. 정부 감독기관의 발주자에 대한 안전책임 부여도 소극적이다. 발주자 안전관리가 미흡한 원인과 이의 촉진 방안에 대한 도출이 필요하다. 발주자에 대한 접근 방법의 홍보를 통한 책임의식의 고취, 발주자를 위한 안전관리매뉴얼 등 안전관리 도구의 제공, 법령을 동한 명확한 책임의 부여, 발주자가 책임을 이행할 수 있는 자질있는 안전전문가의 활용이 긴요한 것으로 사료된다.

Construction clients are the key player in that they initiate construction projects and are in a position to influence the efficiency and productivity of the projects. Construction projects by nature require team-working so clients's leadership is the crux of project success. The objective of this paper is to suggest characteristics of construction clients' leadership in terms of best practice based on the analysis of project success cases. Four key elements of construction clients' leadership are identified and best practice from the case studies were related to the elements.

The purpose of this study is to develop the efficient information system for managing owner's requirement(O/R) throughout the design phases. In order to derive an improvement, current status of O/R management both in domestic and foreign design company has been analyzed. Through the literature reviews and interviews with experts, the Information on design process and detailed activities were investigated. Based on the basic research, inputs, outputs and participants were defined and information flow diagram was drawn. O/R's were categorized according to comprehensive interviews with specialists, and a prototype system was suggested. Conducting systematized O/R management will improve the confidence of owners' role on design, reduce re-work in design tasks, and finally elevate design quality.

Purpose: In order to establish a safety management system led by an orderer in the construction industry, the orderer should be positioned at the peak of the construction industry safety management system and a system that can effectively support safety supervisors who can assist the orderer's role should be reflected. Method: This study collected and analyzed data on the status of safety management of construction business owners through prior research on safety management of construction business owners and a survey on the actual condition of those involved in the construction business. Results: The top priority is to improve the safety awareness and safety management capabilities of the orderer, and through these efforts, the orderer-led safety management system will be established when a national consensus on the responsibility of the orderer, such as the Serious Accident Punishment Act and the Occupational Safety and Health Act, is formed in the event of an accident such as a serious accident. Conclusion: In order to establish a safety management system led by an orderer in the construction industry, it contributes to disaster prevention by positioning the orderer at the peak of the construction safety management system and reflecting a system that can effectively support safety supervisors who can assist the orderer's role.

공사대금에 대한 압류나 가압류가 이루어진 경우 하도급대금 직접 지급 가능 여부와 관련한 논란에 대해 사업부가 가능하다는 판결을 내려 주목된다. 전주지방 법원 제2민사부 (재판장 조현욱 판사)는 "기성금의 청구일자보다 제3 채권자의 압류나 가압류일 자가 앞선다고 하더라도 직접지급합의서가 제3채권자의 압류나 가압류보다 먼저 작성됐다면 발주자는 하도급대금을 수급사업자에게 직접 지급해야 한다"고 판결했다. 3개의 전문건설업체가 전주국도유지건설사무소를 상대로 '하도급대금을 직접 지급해 달라'고 청구한 소송에서 재판부는 "발주자가 하도급대금을 수급사업자에게 직접 지급하기로 발주자,원사업자,수급사업자 간에 합의한 경우에는 '그 합의한 때' 발주자의 원사업자에 대한 대금지급채무는 소멸된다'며 이같이 판결했다. 이번 판결이 하도급거래공정화에 관한 법률 제14조 제 2항에서 규정하고 있는 '발주자의 원사업자에 대한 대금지급채무의 소멸시기'가 '수급사업자가 하도급대금의 직접 지급을 요청한 때'가 아닌 '발주자,원사업자,수급사업자 간에 직불을 합의한 때'임을 분명히 한 것이어서 하도급대금 직불에 미온적이었던 발주기관들의 관행을 개선시키는 계기가 될 것으로 예상된다.

In the construction industry, success or failure depends on the capability and role of the project owner's organization, which has an effect on the peoples' lives and national finance because of a lot of involvement from the project owner. Therefore, it is required that the project owner has the sufficient capability for the success of relevant industry and the further development of whole industry. Therefore, at the viewpoint of successful accomplishment of the construction industry, systematic and in-depth research that defines and evaluates the capability of the project owner's organization is necessary. As-Is and To-Be competency can be measured by the individual areas and elements through the survey. By evaluating these capabilities simultaneously, it is possible to assume not only the project owner's organizational competency but also constant other capabilities. It is become to make plans for strengthening the capabilities and to establish the strategy, by catching which capabilities are really necessary. It will result in positive effects on improving the capabilities of the project owner's organizational competency.

건설공사 분리발주가 공공의 이익이 매우 큰 것으로 분석됐다. 또 분리발주로 인한 공사지연, 하자분쟁 등 효율성 저하는 철저한 공사관리와 발주자 보호장치 활용으로 해결, 일부의 우려는 기우에 불과하다는 분석자료가 나왔다. 대한건설정책연구원(원장 노재화)은 박근혜 정부의 주요 국정과제 중의 하나인 공공공사 분리발주 법제화의 효과를 분석하고 향후 도입방향을 제안한 '공공공사 분리발주 법제화의 효과와 도입방향' 보고서를 발간했다. 홍성호 연구위원이 발표한 이 보고서에 따르면 공공공사의 20% 수준으로 분리발주 적용범위 결정 시 4,693억원의 공공예산 절감과 4,198억원의 부가가치, 2만6,048명의 고용이 증진되는 등 공공의 이익이 매우 큰 것으로 밝혀졌다. 또한 발주자 선택권과 자유계약 원칙을 중요시하는 미국, 일본, 독일 등 선진국도 분리발주의 법제화 또는 적극적인 활용을 통해 공공예산 절감, 부가가치 및 고용창출효과를 거두고 있을 뿐만 아니라 통합발주의 문제점도 해결하고 있다고 밝혔다. 선진국은 또 전기 소방 통신 설비공종 뿐만 아니라 건축 및 토목공종에 해당되는 여러 개의 공종을 분리발주하는 다공종 분리발주 방식을 많이 활용하고 있는 것으로 나타났다. 연구원은 또 일부에서 우려하는 다수의 공종 패키지로 인한 효율성 저하는 통합발주에서도 동일하게 발생하는 현상이며 철저한 공사관리와 발주자 보호장치 활용으로 해결 가능하므로 이같은 우려는 현실성 없는 기우에 불과하다고 밝혔다. 이와 함께 분리발주로 인해 발주자 관리업무는 일부 증가하지만 건축 및 토목공종의 일부만 분리된다면 그 증가폭은 크지 않아 크게 문제되지 않고 있으며 향후 CM용역을 통해 충분히 해소 가능할 뿐만 아니라 오히려 건설산업 발전에 필요한 'Smat 발주자 육성'이 가능하다고 전망했다. 본지는 지면관계 상 연구논문 중 공공공사 분리발주 도입에 따른 효과와 공공공사 분리발주의 도입 방향 부문만 게재한다.

올해부터 건설현장의 직접시공 및 하도급 위반 여부에 대한 발주기관 점검이 강화될 전망이다. 국토해양부는 이를 위한 '발주자 현장점검 조치요령'을 마련해 전국 지자체 및 발주기관에 통보, 시행한다고 밝혔다. '발주자 현장점검 조치요령'은 개정 건산법령상 건설공사 점검 및 확인사항을 발주기관이 알기 쉽게 조치할 수 있도록 짜여졌다. 국토부 관계자는 "발주기관이 점검사항을 정확히 파악해 충실히 조치할 수 있도록 한 가이드라인"이라며 "최근 바뀐 건산법령에 따라 의무하도급 등 폐지된 내용을 빼고 직접시공의무제, 동일업종 간 하도급금지 의무 등을 새로 담아 점검과정의 혼선도 없앴다"고 설명했다. Construction industry is based on receiving an order. So, it has a special feature that market and manufacture activity is formed by a user. For this reason, it has a great influence on other industry compare construction industry with other industry. Specially when build public structure as infrastructure, importance of owner is emphasized then private construction because the primary role of owner have a great effect on national finance. Inspite of that, the importance of a faculty and role of an owner and an ordering organ, it is weak that a study about objective and meaningful evaluation of the specially, common standard and ability of public ordering organ as a major user of domestic construction industry. So, this study define the evaluation sphere and an element of an ordering ability for develop an ordering ability evaluation guide which can evaluate objective ability of an ordering organ. Apply its evaluation sphere and element, judge a standard of an owner, thought the judgement, it can judge accurately of short ability and if it can make future oriented strategy, it can elevate the efficiency of an owner organization management.

Recently, operation of highway is the complex digital Infrastructure based on complicated IT. The application of IT is increasing more and more in digital Infrastructure. Though IT is very convenient, if unpredicted operating risk of highway occurs, widespread damage can be large. When operating risk of highway occurs, road users are out of smoothly-run service because of the operating interruption. This risk causes unpredicted operating management cost and additional maintenance cost. It will excess over the planned operating cost, which may leads to users's unsafety and operator's insolvency because of income loss. Until now, related studies to find out the risk are not sufficient. The purpose of this study is to suggest risk cost items and to estimate the reasonable risk cost by using simulation method in case of occurring the huge power failure at the operating digitalized highway. This study indicates the several plans to hedge against risk cost and the management of highway project. From now on, it will be used as basic data to confirm the soundness of operating system in Digital Infrastructure.
