Specialty Hospital and Keyword Searching Ads Regulation (전문병원과 키워드검색광고 규제)

  • The (Korean) Medical Services Act revised in 2009 introduces the accreditation of specialty hospital. When a hospital meets prescribed standards, passes a board review, and is accredited as a specialty hospital by the Minister of Health and Welfare, then it may use 'specialty hospital' in its name and certification mark of specialty hospital. The problem is that the (Korean) Fair Trade Commission and the (Korean) Ministry of Health and Welfare, both of which have authorities to regulate advertising in general and in health care service in turn, announced the guidelines to prohibit internet (portal) service providers to provide keyword search ads service using key-words such as 'specialty' or 'specialized in' for those who are not accredited by the Minister of Health and Welfare. In this article, whether these guidelines can be justified by the current regime and whether the current specialty hospital policy is agreeable would be examined. To do this, the legal nature of accreditation of specialty hospital, the limit of advertisement regulation, the law of keyword search ads, and the liability of internet service providers also would be analyzed.

A Study on the Effect of Food Service Franchise's Support System on Franchisee's Trust, Financial Performance and Intention of Multi-Store Operation (외식 프랜차이즈 가맹본부의 지원시스템이 가맹점 신뢰와 재무적 성과 그리고 다점포 운영의도에 미치는 영향에 관한 연구)

  • The purpose of this study is to determine the impact of food service franchise's support system on franchisee's trust, financial performance and intention of multi-store operation. For this purpose, the results of the survey were collected for 111 small and mid-sized food service franchisees in Korea with less than 100 brand franchises, referring to article 9 of the act on Fair Trade. Structural equation model analysis was used for hypothesis testing. The results of the study are as follows; First, a support for store development, education, logistics, and supervisors among franchise's support system were found to have a significant impact on the franchisee's trust, but public relations support was not significantly affected. Second, a support for store development had significant influence on the financial performance, but the support for education, logistics, supervisors and public relations did not significantly affect the financial performance. Third, franchisee's trust has been shown to have a significant impact on financial performance and intention of multi-store operation. Fourth, financial performance was shown to have a significant impact on the intention of multi-store operation. Finally, confirming the mediated effects of financial performance on the effect of franchisee's trust and intention of multi-store operations also proved to have indirect effects. This study identified the impact relationship between the small and medium-sized food service franchise support system, franchisee's trust, financial performance and intention of multi-store operation. In particular, it is deemed meaningful that the performance of Korea's small and medium-sized food service franchises and the relationship of influence that can grow together through the qualitative growth of the franchise's system.

A Study on Rational Improvement of the Gift Regulation in the Telecommunications Market (통신시장의 경품규제에 대한 합리적 개선방안 연구)

  • A variety of customized marketing strategies are being implemented in the telecommunications market, including the offering of gifts to consumers, as competition in the market is being restructured with the focus on bundled products. However, the Korea Communications Commission (KCC) has recently imposed fines for user discrimination on telecommunication carriers whose marketing strategies have included the award of excessive prizes. In that regard, various issues related to the suitability and appropriate limit of the current gift regulation in the telecommunications market have been raised. Since the Fair Trade Commission, which had a similar scheme to that of the KCC, abolished the regulation on gifts in July 2016, disputes have arisen as to whether the current regulation on gifts is practically effective from the perspective of consumer benefit. In other words, discussions on the rationality of the theoretical and empirical grounds for the regulation on gifts only in the telecommunication market but not in other commodities markets have begun. As such, this study aims to empirically analyze the suitability of the current regulation on gifts in the domestic telecommunications market under the new competitive environment centered on bundled products, and to seek the rational improvement of, and infer the implications for, the regulation on gifts in the telecommunications market based on the results of the analysis.

A Study on the Minimization of Problems of the Direct Payment for Subcontractor's Work in Public Construction Project (공공건설사업(公共建設事業) 하도급대가(下都給代價) 직접지급(直接支給)의 효과분석(效果分析)을 통한 문제점(問題點) 저감방향(低減方向)에 대한 연구(硏究))

  • To execute a construction project, many construction participants are engaged in the project. Especially many subcontactors role is very important, but their contract statute seems weaker rather than prime contractor. So to protect the subcontractor and to activate fair subcontract, Fair Transactions in Subcontracting Act was enacted. Direct payment to subcontractor clause of the act can protect subcontractor from the fear of insolvency of prime contractor, on the other hand can cause dispute about the interpretation of defect liability. Therefore the positive act and regulation were examined, and the effects of direct payment to subcontractor were analyzed. And the treatment direction of direct payment were suggested in this paper. Summary is as follows; (1) Statute of subcontractor for the ordering subject must be considered (2) Contract relationship must be reflected in the performance bond, subcontract bond, and subcontract construction conditions (3) To clarify the defect liability for the direct payment, retainage to guarantee the repair during contract period may be reflect on the subcontract construction conditions.

  • Changing our monopoly broadcasting advertising system into free competition system may give rise to serious troubles that intensify commercialism of broadcasting and reduce diversity of public opinion. In the boundaries of public interest out of danger, korean broadcasting system should adopt a system that partially adopts the principle of free market. Broadcasting advertising sale system affect the whole broadcasting system because it functions as an effective capital-resource provider. Thus, it affects the broadcasting policies' righteousness and efficiency. Due to the non-elastic nature of the total advertising market, broadcasting advertising's size affects other media's capital allocation process. Therefore, broadcasting advertising sales system not only affects broadcast's social duty and public interest, but also affects the whole media industry. First, provide fair and open-competitive measures to support broadcast sales policy so that the market-based system can be run smoothly. Second, block any un-due influence from advertisers by separating production/programming and advertising sales. Third, sustain public broadcast system, not based on the advertising sales but based on the subscription fee. Fourth, social intervention of the advertising market. Fifth, provide policies that can set up multiple media channels/outlets and public opinion. By providing the minimum capital resources to the public broadcasting system, the broadcasting system can act on its public-interest duty and support the people's right-to-know rights.

A Study on the Problem and Improvement of Screening System of Low Price Subcontracting by Analyzing a Standard of Judgement Criteria (원도급자 측면에서의 저가하도급 판정기준의 문제점과 개선방안)

  • As the Fundamentals of Construction Business Act was revised in December 2004 and its implementing ordinances and enforcement regulations were adjusted in June 2005, the screening system of low price subcontracting has been an obligation to the public owners, having brought about arguments for and against since it enacted in 1983. The statutes for low price subcontracting have been reinforced from this year; for example, it underlines to submit to a project and builds an information network of subcontracting works. The system's original intention was that prevents shoddy and fraudulent constructions caused by low price subcontracting and precludes disturbances of fair trade by screening that whether it satisfies the conditions or not in advance. But, the criterion for the existing low price subcontracting has several issues having held up a true mirror to the real situation. It is arguable to discharge an important task with the primary purpose. This dissertation have researched the problem with a deposit of subcontract and the low price subcontracting basic rate are being used by the criteria for deciding whether it is a low price subcontracting or not, so showing the plan of reformation based on the findings, it wishes to contribute toward making the most of the system's essential intent.

  • Currently, in the field of community service, it is expected that the demand will further increase in the future by enabling the form of providing various types of services. However, the local community service investment project is an abstract Although the structure for fair competition was created by introducing a market mechanism derived from the action or principle of psychology that affects human behavior in the field, systematic management and monitoring of the quality of social services is insufficient. The purpose of this study is to find out the relationship between service selection factors and service quality in order to improve the quality of social services in the consumer's way to meet these environmental needs, and to utilize the research results for quality improvement. The research model to be used in this paper measures the five element areas of service satisfaction such as reliability, responsiveness, empathy, certainty, and tangibility, which are used to measure the quality of local community service investment projects. In addition, we are various strategic implications that can induce the quality improvement of local community service investment projects are presented by finding the main factors of the four research hypotheses of this study and utilizing the results.

A Study on Creation of Fair Transaction Environment between Platform Operator and Contents Provider in Broadcasting Industry (방송 산업 내 플랫폼사업자와 콘텐츠사업자 간 공정거래환경 조성 연구)

  • In a broadcasting market environment that has a close interdependence between platform operators and content operators, problems such as conflicts over program usage fees, and home shopping transmission fees are intensifying. This study attempted to analyze the environment of the domestic broadcasting market and present implications, analyze the cause of user fee conflict between the platform and PP, and propose detailed alternatives to resolve user fee conflict disputes. The results of environmental analysis on the domestic broadcasting market are as follows. First, the growth engine of the broadcasting industry has changed to direct resources such as service usage fees and content fees, and commerce is increasing. Second, as hegemony in the domestic broadcasting market changes from terrestrial to paid broadcasting and OTT, monopolies in the entire broadcasting area are being dismantled by voluntary entry. Third, the need to overhaul the existing regulatory system is increasing due to the dismantling and reorganization of the existing broadcasting market. On the other hand, this study proposed a strategy to diversify the profit structure of PP, supply program after pre-contracting, and strengthen CPS bargaining power in order to resolve disputes between paid broadcasting platforms and PP sharply. In particular, as strategies to strengthen CPS bargaining power of small and medium-sized SOs, it proposed to jointly improve CPS-related systems through IPTV and individual SOs, to redefine fees for programs and to voluntarily use programs.

Textile material classification in clothing images using deep learning (딥러닝을 이용한 의류 이미지의 텍스타일 소재 분류)

  • As online transactions increase, the image of clothing has a great influence on consumer purchasing decisions. The importance of image information for clothing materials has been emphasized, and it is important for the fashion industry to analyze clothing images and grasp the materials used. Textile materials used for clothing are difficult to identify with the naked eye, and much time and cost are consumed in sorting. This study aims to classify the materials of textiles from clothing images based on deep learning algorithms. Classifying materials can help reduce clothing production costs, increase the efficiency of the manufacturing process, and contribute to the service of recommending products of specific materials to consumers. We used machine vision-based deep learning algorithms ResNet and Vision Transformer to classify clothing images. A total of 760,949 images were collected and preprocessed to detect abnormal images. Finally, a total of 167,299 clothing images, 19 textile labels and 20 fabric labels were used. We used ResNet and Vision Transformer to classify clothing materials and compared the performance of the algorithms with the Top-k Accuracy Score metric. As a result of comparing the performance, the Vision Transformer algorithm outperforms ResNet.

A Study on the Design of Flower Decoration at the Funeral Altar according to the Social Status of the Deceased (고인의 사회적 신분에 따른 장례 제단 꽃 장식 디자인에 관한 연구)

  • The purpose of flower decoration at the funeral altar is to create various flower decorations at altar according to the social status of the deceased, to console psychological shock and pains of mourners and the bereaved families, and to make them remember the life of the deceased beautifully. In this study, five top funeral service companies in Korea selected by the Fair Trade Commission in 2017 and five repr And this researcher identified problems in flower decorations at the funeral altar in Korea, by comparing and analyzing the styles of flower decorations at funeral altars in Korea and Japan. In addition, this researcher surveyed consumers' preferences by age group. According to the results of the survey, most of the entire age group responded positively to the flower decorations at the funeral altar which focused on the job of the deceased. This means that consumers are demanding changes to the flower decorations at the funeral altar which are made up of the products of funeral service companies. In addition, the results of the survey, it can be seen that most consumers prefer to decorate the altar flowers according to the occupation, hobby, and taste of the deceased and present the altar in three dimensions like a landscape of nature. esentative funeral service companies in Japan were surveyed on the status of flower decorations at the funeral altar.
