  • In order to reduce the construction cost and period without degrading the quality, construction companies are making a lot of efforts to prefabricate and mechanize the construction process, and introducing and utilizing various techniques of construction time management in the process of construction. However, due to the various factors (such as weather conditions, labor factors, supply of equipment and materials, safety accident, etc) in the process of construction, construction projects are not frequently completed within the scheduled Period. This research is to examine the current status of construction time management and factors causing delay in construction with regard to the concrete work (such as form work, steel reinforcement, and concrete work) in building apartments.

  • In constructing projects, there exist various kinds of work interferences, which cause a delay of the outset and completion of planned schedule because of some attributions, such as variability, uncertainty and complexity. and so schedule delay has been treated as a natural phenomenon. To reduce or prevent the schedule delay, a constant confirmation of schedule delay and a preparation of counter plans for finding out the cause structure of schedule delay should have been done. However, all this time the research has been mostly done on the calculation method or claim cases of schedule delay. Moreover, the analysis method did not consider the trait, which cause the schedule delay, in constructing projects. This paper restricts the range of the cause analysis of schedule delay to the field of site management in the projects and divides the cause structure of schedule delay into the cause objects and cause attributes of schedule delay according to the input elements. The system of classifying causes of schedule delay is examined by interviews with experts and questionnaire. Additionally, this paper analyzes the attributes of cause attributes and cause subjects and presents the analysis method and procedure of schedule delay with the application of VSM.

  • 공정거래위원회의 불공정 하도급거래 제재 무게 중심이 대금 지연이자 수수료 미지급, 부당특약 설정 등에서 추가공사, 설계변경에 따른 대금 지급 여부로 확대되고 있다. 공사물량이 추가 변경됐는데도 수급사업자에 변경 계약서를 발급하지 않고 대금을 제대로 주지 않는 행위들이 여전히 제재 사각지대에 놓여 있다는 판단에서다.

  • The impact of the global financial crisis, which began in the United States in 2007, had a major impact on the domestic shipping and shipbuilding industries. In this regard, the domestic shipyard has established an order-taking strategy in several ways as an alternative to lowering the amount of construction of commercial vessels due to deterioration of the shipping industry, and selected industrial sector was the offshore plant sector. However, the domestic shipyard has under performed the offshore plant in order to just increase sales and secure work without any risk analysis for EPC contracts. As a result, the shipyard has been charged more than the initial contract price with the offshore plant contractor, or the shipyard has become a legal issue requiring payment of liquidated damages due to delays in delivery of the product. The main legal disputes are caused by the thorough risk analysis and the inexperience of process control that can occur during offshore plant construction. and In particular, there is no sufficient review of the unequivocal provisions in the contract as an element of risk management. There is no human resource to review these contractual clauses. Therefore, this study identifies the existence of specific risks that could lead to delays in offshore plant construction, and examined the existence of any unequivocal clauses in contracts for offshore plant construction. and also discussed how the toxic clause applies to the actual parties and how the concrete risk factors in the construction contracts are transferred and expressed by referring to the interviews with the project manager of the domestic shipyard and the previous research. As a result, This paper examined the legal liability of the contracting parties regarding delayed delivery of the products due to the offshore plant construction contract. And to improve the domestic shipbuilding industry.

  • 서울시는 앞으로 제휴 금융기관을 통해 모든 공사대금을 원도급(종합건설업체)대금과 하도급(전문건설업체)대금으로 분리해서 지급한다. 또 공사대금 지급상황을 실시간으로 확인할 수 있는 시스템을 구축, 하도급대금 미지급이나 지연지급, 현금수령 후 어음지급 등 부정, 부당행위를 예방키로 했다. 서울시는 지난 1월 19일 금융기관 2곳과 연계한 '하도급 대금지급 실시간 확인시스템'(hado.eseoul.go.kr) 구축을 완료하고 본격 시행에 들어간다고 밝혔다.

  • The factors of uncertainty such as work delay could cause many problems, for example, increase of construction cost and terms of work, and the deterioration of quality. Because of these, the uncertainty risk is regarded as an important management factor to obtain the success of construction project. So, the systematic management plan about the uncertainty factors is needed because it plays an important role in the completion of entire project. And also analysis of some factors which can cause the work delay can be one way of improving construction project's certainty and making it competitive. In this reason, we have to make an effort to set a priority based on analysis of quantitatively numerical value about work delay factors to manage them effectively. Thus, this study aims to suggest the basic data for the effective management and prevention of work delay in steel-frame work which is progressive actively now, along with increasing of demand of high-rise buildings by analyzing each reasons of work delay factors and also by suggesting important management factors that are coded according to each construction work using FMEA method which could give a data about the importance of work delay factors through quantitatively numerical value.

  • The sum of each work duration are entire period in construction project. Each work occurs to be late, the total period of construction project will delays. Therefore, the total period of construction project will not be delayed if probability of work progress makes higher. Finding each work constraints performs constraints analysis in process of construction for checking probability of work progress. Grasp work constraints through the constraints analysis and removes. This research will show preventing delay of construction project, through work condition analysis process.

이슈 & 이슈 - 공공공사 분리발주 법제화 효과

  • 건설공사 분리발주가 공공의 이익이 매우 큰 것으로 분석됐다. 또 분리발주로 인한 공사지연, 하자분쟁 등 효율성 저하는 철저한 공사관리와 발주자 보호장치 활용으로 해결, 일부의 우려는 기우에 불과하다는 분석자료가 나왔다. 대한건설정책연구원(원장 노재화)은 박근혜 정부의 주요 국정과제 중의 하나인 공공공사 분리발주 법제화의 효과를 분석하고 향후 도입방향을 제안한 '공공공사 분리발주 법제화의 효과와 도입방향' 보고서를 발간했다. 홍성호 연구위원이 발표한 이 보고서에 따르면 공공공사의 20% 수준으로 분리발주 적용범위 결정 시 4,693억원의 공공예산 절감과 4,198억원의 부가가치, 2만6,048명의 고용이 증진되는 등 공공의 이익이 매우 큰 것으로 밝혀졌다. 또한 발주자 선택권과 자유계약 원칙을 중요시하는 미국, 일본, 독일 등 선진국도 분리발주의 법제화 또는 적극적인 활용을 통해 공공예산 절감, 부가가치 및 고용창출효과를 거두고 있을 뿐만 아니라 통합발주의 문제점도 해결하고 있다고 밝혔다. 선진국은 또 전기 소방 통신 설비공종 뿐만 아니라 건축 및 토목공종에 해당되는 여러 개의 공종을 분리발주하는 다공종 분리발주 방식을 많이 활용하고 있는 것으로 나타났다. 연구원은 또 일부에서 우려하는 다수의 공종 패키지로 인한 효율성 저하는 통합발주에서도 동일하게 발생하는 현상이며 철저한 공사관리와 발주자 보호장치 활용으로 해결 가능하므로 이같은 우려는 현실성 없는 기우에 불과하다고 밝혔다. 이와 함께 분리발주로 인해 발주자 관리업무는 일부 증가하지만 건축 및 토목공종의 일부만 분리된다면 그 증가폭은 크지 않아 크게 문제되지 않고 있으며 향후 CM용역을 통해 충분히 해소 가능할 뿐만 아니라 오히려 건설산업 발전에 필요한 'Smat 발주자 육성'이 가능하다고 전망했다. 본지는 지면관계 상 연구논문 중 공공공사 분리발주 도입에 따른 효과와 공공공사 분리발주의 도입 방향 부문만 게재한다.

  • The purposes of this study is to survey unfair aspect of specific provisions in the construction contract. The research method of this stud)'includes judicial precedents and a questionnaier survey. The result of thus study are as follows: 1) unfair payment condition gives increase to faulty construction. 2) shift of the responsibility gives increase to delay, 3) adjusted contract sum gives increase inappropriate compensation to contractor.
