A Study on the Service of the Integrated Administrative Information Dataset Management System (행정정보 데이터세트 종합관리시스템의 서비스 방안 연구)

  • According to the amendment of the Enforcement Decree of the Public Records Management Act in 2020, an administrative information dataset record management plan will be enacted, and the National Archives of Korea plans to establish an integrated administrative information dataset management system to support it. However, there is no specific service plan that considers the characteristics of the datasets and the Management Reference Table. Therefore, this paper compared and analyzed the current status of dataset services at 14 domestic and foreign public data portals and archives websites, derived implications, and proposed 6 service plans applicable to the integrated administrative information dataset management system. This study's results will lead to utilizing the administrative datasets and the activation of services.

  • 2018년 물관리 일원화를 위한 정부조직법 개정으로 기존 국토교통부의 「수자원의 조사·계획 및 관리에 관한 법률」 등의 사무가 환경부로 이관되었다. 과거 부처별로 나누어진 물 관리 체계에 따라 부처간 업무중복, 과잉투자 등 수량과 수질에 대한 분리된 관리체계의 한계점으로 유역 상류에 설치된 댐의 경우 저류된 댐 용수의 수질악화의 문제가 발생하였다. 또한, 물관리 일원화 이후, 「제2차 물환경관리 기본계획」에서는 2025년까지 주요 상수원 수질을 좋음(I)등급 달성을 목표로 제시하였고, 이와 연계하여 평가지표 등에 설정한 댐 수질목표를 2025년까지 매우좋음(Ia) 등급 달성을 위해서는 댐 상류 주요 오염원에 대한 과학적 분석이 필요하며 이에 대한 관리대책 마련이 시급한 상황이다. 본 연구의 공간적 범위인 사연댐은 울산공업지구의 공업용수 확보를 위해 1965년 준공되어 울산 일원에 100,000m3/일 이상의 공업용수를 공급하는 수원시설이며, 대곡댐은 기존 울산지역에 공업용수로 사용하던 사연댐의 물을 생활용수로 전환하고, 대곡·사역댐의 연계운영을 통해 연간 66백만의 생활용수를 공급하기 위한 수원시설이다. 수질 목표기준의 경우 대곡댐은 좋음(Ib), 사연댐은 매우좋음(Ia)로 설정되어 있으나, 2015~2019년까지의 TOC, T-P의 평균 달성률을 살펴보면 대곡댐은 TOC 45.8%, T-P 27.1%의 목표수질 달성률을 나타내었고, 사연댐은 TOC 및 T-P 모두 0%로 목표수질을 달성하지 못한 것으로 조사되었다. 본 연구에서는 대곡·사연댐 상류 유역을 대상으로 유역의 특성 및 오염원 발생 특성을 파악하고, 이에 따른 물환경관리 종합대책을 수립하기 위하여 1) 유역 물환경 기초자료 조사와, 2) 모니터링을 통한 댐유역 오염 원인분석을 수행하였다. 그 결과를 바탕으로 소유역별 오염부하량을 분석하고 개선대책(안)을 도출하였다. 이 때, 개선대책의 효과를 분석하기 위해서 유역 모형(HSPF)과 호소수질(AEM3D) 모형을 활용하여 수질모델 구축 및 보정을 수행하였고, 개선 대책(안)에 대한 목표수질 달성여부를 파악하였다. 최종적으로 대곡·사연댐 유역의 호소수질 변화를 파악하고 댐 유역 특성을 고려한 맞춤형 물환경관리 종합대책을 제시하였다.

  • 하천법 개정 및 수자원의 조사·계획 및 관리에 관한 법률 제정으로 하상변동조사를 정기적으로 실시하는 것이 의무화 되었고, 지자체가 계획적으로 수자원을 관리할 수 있도록 제도가 마련되고 있다. 하상의 지형측량은 직접 측량할 수 없기 때문에 수심 측량을 통해 간접적으로 이루어지고 있으며, 그 방법은 레벨측량이나 음향측심기를 활용한 접촉식으로 이루어지고 있다. 접촉식 수심측량법은 자료수집이 제한적이기 때문에 공간해상도가 낮고 연속적인 측량이 불가능하다는 한계가 있어 최근에는 LiDAR나 초분광영상을 이용한 원격탐사를 이용한 수심측정 기술이 개발되고있다. 개발된 초분광영상을 이용한 수심측정 기술은 접촉식 조사보다 넓은 지역을 조사할 수 있고, 잦은 빈도로 자료취득이 용이한 드론에 경량 초분광센서를 탑재하여 초분광영상을 취득하고, 최적 밴드비 탐색 알고리즘을 적용해 수심맵 산정이 가능하다. 기존의 초분광 원격탐사 기법은 드론의 경로비행으로 획득한 초분광영상을 면단위의 영상으로 정합한 후 특정 물리량에 대한 분석이 수행되었으며, 수심측정의 경우 모래하천을 대상으로 한 연구가 주를 이루었으며, 하상재료에 대한 평가는 이루어지지 않았었다. 본 연구에서는 기존의 초분광영상을 활용한 수심산정 기법을 식생이 있는 하천에 적용하고, 동일지역에서 식생을 제거한 후의 2가지 케이스에 대해서 시공간(Spatio-temporal)초분광영상과 단면초분광영상에 모두 적용해 보았다. 연구결과, 식생이 없는 경우의 수심산정이 더 높은 정확도를 보였으며, 식생이 있는 경우에는 식생의 높이를 바닥으로 인식한 수심이 산정되었다. 또한, 기존의 단면초분광영상을 이용한 수심산정뿐만 아니라 시공간 초분광영상에서도 수심산정의 높은 정확도를 보여 시공간 초분광영상을 활용한 하상변동(수심변동) 추적의 가능성을 확인하였다.

  • In the transportation sector, reducing total vehicle mileage and passenger vehicle traffic are proposed as strategies to achieve carbon neutrality. To achieve this, MaaS services must be actively promoted with the goal of revitalizing public transportation. In order to promote MaaS, individual movement data is required, such as the individual's means of movement, route, and conversion of the individual's means of use. However, in Korea, there are legal limitations in collecting and utilizing data on individual movements. As the right to request transmission of personal information was newly established in the revised Personal Information Protection Act in 2023, a law was established to collect and utilize data on individual movements. However, enforcement ordinance, detailed rules, instructions, guidelines must be prepared, and the standardization of data format and transmission system for collecting my data needs to take precedence.

  • The risk assessment under the Occupational Safety and Health Act was implemented in 2013, but since it is not mandatory, companies are operating it as a formality. Although legal obligations have been strengthened, such as the recent comprehensive revision of the Occupational Safety and Health Act and the enforcement of the Act on Punishment for Serious Accidents, the death rate has remained stagnant. Even if a risk assessment plan is properly established in order for employers to prevent industrial accidents through necessary measures, it is necessary to involve relevant workers so that they can understand and implement the contents of the risk assessment. In this regard, this study proposed applying efficient worker participation measures through on-site surveys to activate the participation of vulnerable workers in risk assessments. A Study on Improvements on Legal Structure on Security of National Research and Development Projects (과학기술 및 학술 연구보고서 서비스 제공을 위한 국가연구개발사업 관련 법령 입법론 -저작권법상 공공저작물의 자유이용 제도와 연계를 중심으로-)

  • Korea is among the ten countries with the largest R&D budget and the highest R&D investment-to-GDP ratio, yet the subject of security and protection of R&D results remains relatively unexplored in the country. Countries have implemented in their legal systems measures to properly protect cutting-edge industrial technologies that would adversely affect national security and economy if leaked to other countries. While Korea has a generally stable legal framework as provided in the Regulation on the National R&D Program Management (the "Regulation") and the Act on Industrial Technology Protection, many difficulties follow in practice when determining details on security management and obligations and setting standards in carrying out national R&D projects. This paper proposes to modify and improve security level classification standards in the Regulation. The Regulation provides a dual security level decision-making system for R&D projects: the security level can be determined either by researcher or by the central agency in charge of the project. Unification of such a dual system can avoid unnecessary confusions. To prevent a leakage, it is crucial that research projects be carried out in compliance with their assigned security levels and standards and results be effectively managed. The paper examines from a practitioner's perspective relevant legal provisions on leakage of confidential R&D projects, infringement, injunction, punishment, attempt and conspiracy, dual liability, duty of report to the National Intelligence Service (the "NIS") of security management process and other security issues arising from national R&D projects, and manual drafting in case of a breach. The paper recommends to train security and technological experts such as industrial security experts to properly amend laws on security level classification standards and relevant technological contents. A quarterly policy development committee must also be set up by the NIS in cooperation with relevant organizations. The committee shall provide a project management manual that provides step-by-step guidance for organizations that carry out national R&D projects as a preventive measure against possible leakage. In the short term, the NIS National Industrial Security Center's duties should be expanded to incorporate national R&D projects' security. In the long term, a security task force must be set up to protect, support and manage the projects whose responsibilities should include research, policy development, PR and training of security-related issues. Through these means, a social consensus must be reached on the need for protecting national R&D projects. The most efficient way to implement these measures is to facilitate security training programs and meetings that provide opportunities for communication among industrial security experts and researchers. Furthermore, the Regulation's security provisions must be examined and improved.

  • Auf die ganze Welt macht unbemannte $Flugger{\ddot{a}}te$(sog.Drohnen) in vielen Bereichen rasch Fortschritte und Anwendungen gezeigt. Nachdem ferngesteuerte Drohnen $urspr{\ddot{u}}nglich$ $prim{\ddot{a}}r$ $f{\ddot{u}}r$ $milit{\ddot{a}}rische$ Zwecke entwickelt wurden, $erh{\ddot{o}}cht$ sich derzeit ihre zivile Nutzung sowohl im Freizeit- als auch im Dienstleistungsbereich(Paketdrohnen, Drohnen-taxi) stetig. Mit der vermehrten Drohnennutzung steigen allerdings auch die damit verbundenen Risiken und Herausforderungen. In Zusammenhang damit stellt sich dann die Frage, ob $gegenw{\ddot{a}}rtige$ Vorschriften im Bereich von Luftrecht zurecht gekommen sind. Es sieht sich gerade der zwei Schwerpunkt $gegen{\ddot{u}}ber$. Erstens kann $Passagierebef{\ddot{o}}rderung$ mit unbemanntem Luftfahrzeug(mehr als 150kg) im $gegenw{\ddot{a}}ritigen$ Luftrecht keine Anwendung finden. Denn das kor. Luftsicherheitsgesetz und sein Durchsetzungsverordnung definieren die Terminologie von unbemannten Luftfahrzeugen und unbemannten $Flugger{\ddot{a}}te$ als "wenn eine Person nicht an Bord geht und ferngesteuert wird". Also soll Drohne nach dieser gesetzlichen Definition nur "ohne Person" geflogen werden. Das besagt ohne Piloten und ohne Passagiere. Zweitens ist unbemannte $Flugger{\ddot{a}}te$(weniger als 150kg) nicht auf Handelsgesetz anzuwenden, auf das ${\ddot{u}}ber$ Anspruchsgrundlage und Zurechnungsnorm des gewerblichen Luftverkehr geregelt ist. Der unbemannte Luftfahrzeuglieferdienst bringt nicht nur die Gefahr einer $Besch{\ddot{a}}digung$ des Frachtguts mit sich, sondern auch die Gefahr von $Bodensch{\ddot{a}}den$ durch Dritte. Gemäß ${\S}$ 896 des Handelsgesetzes ist aber die Anwendung von unbemannte $Flugger{\ddot{a}}te$(weniger als 150kg) $hierf{\ddot{u}}r$ begrenzt, weil unbemannt $Flugger{\ddot{a}}te$ $einschl{\ddot{a}}gig$ in Ultralight $Flugger{\ddot{a}}t$ ist, die im Handelsgesetz ausschließlich besteht. Technische Fortschritt und die dadurch $erm{\ddot{o}}glichten$ kommerziellen Anwendungen werden die Nachfrage nach unbemannter $Flugger{\ddot{a}}te$ wecken. Die Umsetzung der $bez{\ddot{u}}glichen$ Vorschriften sollte auch diese Entwicklung aktiv begleitet und $fr{\ddot{u}}hzeitig$ kommuniziert und erarbeitet werden, damit Hersteller und Nutzer $fr{\ddot{u}}hzeitig$ Planungssicherheit haben.

Establishment and Operation of the Local Government Archives: Recommendations (지방기록물관리기관 설립의 방향과 방법)

  • Local governments in Korea, sixteen in total, shall establish local government archives to and manage preserve their permanent archives to comply with the Public Records Management Act amended in October 2006. National Archives of Korea(NAK) directed the local governments to recruit legally qualified archivists by the end 0f 2006 and to plan on the establishment and operation of the local government archives by the end 2007. However, none of the government archives was established by far. Government officials in NAK and the local governments raised the limits of the budget and human resources. What is more serious is that they don't concern why the archives are necessary and what missions and functions the archives should have. In this paper, I summarized the present situation and problems in establishing the local archives, and what we will do to establish normal government archives. First, local governments should establish "local government records commissions" and employ qualified archivists. The local government records commission should comprise concerned and qualified members. The records commission, as a policy and decision-making body, should make plans and implement the plans to establish the local archives, establish professional training programs to produce qualified archivists, promote local archives community activities, determine operational issues, and make a long-term development plan satisfying local demands. Second, the local government archives share existing repositories of NAK. Third, after the establishment of the archives, the local archives should perform normal records and archives management of the local governments as records acts mandate, do general records surveys and appraise the records created in the local governments. The local government archives should collect valuable local archives including private archives, and arrange and make usable them to provide access. They also promote and coordinate various cultural heritage community activities related to the local archives.

A Study on the Introduction of Performance Certification System of Inspection and Diagnostic Equipment for Infrastructure (시설물 진단장비의 성능인증제 도입에 관한 연구)

  • Purpose: Infrastructure inspection and its diagnostics technique have been rapidly developing recently. Therefore, it is important to secure the reliability of diagnostic equipment, and this paper deals with inspection of diagnostic equipment, introduction to a certification system and development plans for infrastructure. Method: Several certification systems are established and introduction plans are reviewed through experts by synthesizing the contents of certification research for existing infrastructure diagnosis equipment. In addition, the revision of the law for introduction of the system is reviewed, detailed operation regulations are prepared and phased development plans are reviewed, which are based on the operation scenario. Result: Inspection and certification plans were constructed through four routes in order to consider infrastructure inspection and diagnostic equipment in use, and new diagnostic equipment using state-of-the-art technology. Furthermore, market confusion depending on the introduction of a new certification system is minimized and reliability is secured by transforming a simple inspection system in the short term into a formal certification system in the long term. The law amendments according to the introduction of the system were reviewed and detailed operation regulations were developed. Also, phased development plans, which are based on the long-term development scenario including manpower, infrastructure and specifications, were presented. Conclusion: It is important to secure reliability through the distribution and certification of diagnostic equipment using 4th industrial technology to strengthen the safety management of infrastructure at the national level since the infrastructure is various in type and increasingly large in size. It is also essential to train human resources who can use new technology with inspection and diagnosis system in order to enhance the safety management of all infrastructures. Moreover, it is necessary to introduce a regular inspection system for infrastructure that combines loT technology in the long-term point of view and to promote the introduction by giving active incentives to institutions that actively accept it.

A study on Establishment and Management of the CCTV in Operating Room (수술실 CCTV 설치 및 운영에 대한 고찰)

  • Recently, medical accidents related to surgical procedures have increased. In addition, the media reported that some of these accidents were involved in health crimes. Patient-advocate groups have called for mandatory establishment and management of CCTV in operating rooms. There is a lot of discussion among the interested parties, so it is necessary to review the relevant laws and regulations. The purpose of this study is to identify the characteristics of CCTV in operating rooms and to review legislations related to establishment and management of the CCTV in operating rooms. Medical institutions use CCTV for management of facilities and patient safety and install it in operating rooms optionally. The Constitution guarantees the privacy and the privacy of correspondence of every citizen, but it can be limited by the law for public welfare. Currently, however, there is no existing law about establishment and management of the CCTV in operating rooms and it can be defect of legal system. Under the current legislations, it is likely that the Self-determination can be violated due to the characteristic of healthcare provider when CCTV is mandatorily installed in operating room. In addition, the regulations on access and leakage of confidential information known by operator are insufficient. So that, the safety of the visual data might be threatened. Furthermore, unless the period and the place of storage of the visual data are clearly defined, it is highly unlikely to meet the original purpose of patient safety and prevention of medical accidents. This study is meaningful as there is few previous study on this topic although the need for legal review about this is growing and several bills are being proposed. It is expected that the results of this study can be utilized as basic data for enactment or amendment of the laws and regulations about establishment and management of CCTV in operating rooms.
