This thesis analyzes the Apple Inc.'s case from the viewpoint of the necessity for the protection of information privacy related to location data as for information society and ubiquitous community. Meanwhile, the regulatory conformity to equilibrium of contradictional value between personal data protection and utilization of information is debated from the fundamental right as for constitutional law concept to the commercial and technological structure in terms of economic and business point. Therefore, this paper reaches the conclusion that the legislative system should form a harmonious relationship between legal protection and lawful utilization to reappraise the present condition of legalization on personal data protection from guaranteeing rights and interests of information subject in the perspective of human rights to information guarantee consequently. As a result, it is required to revaluate the lawfulness of the fine on the violation of administrative duty levied by KCC(Korea Communications Commission).
This article aims to identify organizational factors that influence the performance of implementation of the U.S. Freedom of Information Act (FOIA) and to investigate the strength and direction of their effects. Explanatory variables include administrative resources, organizational culture, litigation cost, and the complexity of FOIA requests. The study will analyze quantitative secondary data from official statistics of federal agencies and the 2006 Federal Human Capital Survey as well as qualitative data from semi-structured interviews of FOIA officers. The results of statistical analyses are as follows : FOIA funding significantly affects median processing time and number of requests pending. There is a significant relationship between bureaucratic culture and number of requests pending, but not between bureaucratic culture and number of requests pending. There exists a significant relationship between the cost of FOIA litigation to federal agencies and the performance of FOIA implementation. There exists a significant relationship between the complexity of FOIA requests and the performance of FOIA implementation. This study also has important implication in South Korea, which has been under a sharp confrontation with North Korea for more than 50 years. As illustrated by the conflict between people's right to know and national security during the investigation of recent Sinking of the ROKS Cheonan, efforts should be made to prepare legal and institutional mechanism for freedom of information policy which can maintain a balance between conflicting values as well as efficient information disclosure in Korea.
It is commonly emphasized that the metaphor of the monster is a rhetoric universally used to identify the "main enemy" of a society, for its effective function is seen as useful for the uniting of citizens to bend together to survive or succeed before the external threat. The problem of this metaphor is that it homogenizes and dehumanizes the heterogeneous individual members of the subsequently identified enemy group. This study emphasizes the importance of some traits of the posthuman subject, such as the flexibility and the multiplicity of consciousness, to overcome the otherizing binary perspective which is commonly held regarding the concepts of good and evil. To observe specific dimensions of the posthuman consciousness, we analyze three films based on Spanish history and reality: The Spirit of the Beehive, The Day of the Beast and Pan's Labyrinth. All of these films progress around the figure of the enemy-monster(s), showing how to transgress the dichotomous structure of consciousness that defines the self/good dividing it from the other/evil. The heroes in the films seek to overcome the fear about the monster, and approach him to discover new ethical horizons, that can emerge only when an individual's consciousness chooses to stay on the border between the established beliefs and the unfamiliar voice of the dangerous stranger(s).
As the expansion of the cultural industry expands, various competitive structures are formed and the methodologies for producing commercial success are being discussed. Among them, Hollywood studios use political relationships and apply ideologies that can produce the best interests. Also, they use a structure that can convey this ideology, which is a mythology. The myth has satisfied the public for a ling time. Campbell suggested that strategies come from the myth, and the ideology emerged as a result of what mythology has to do with existing powers. Disney and Dream Works use the mythology and combine their own values into ideology. Disney and Dream Works choose conflicting ideologies in a different growth background. If Disney is recognized as an educational animation by the ruling class, Dream Works are supported by the public for their actions against Disney. Disney has conservative and patriotic personality, Dream Works is more liberal and progressive. Disney's structure came out first, and Dream Works parodied it. So we can compare Disney and Dream Works with similar myths to create a storytelling structure that embodies ideology. As a result, Disney and Dream Works have been choosing the 9 stages the key of Ideology form the 17 stages of the mythology and reduced them to the introduction, growth and completion. In the first units of the introduction, Disney dealt with the subject of social leaders who sacrificed to the ruling class and Dream Works hinted at the overthrow of the ruling class through the irony. In the second units of growth, Disney organized the process of accepting the value of the ruling class, and Dream Works showed the individual values, not the values of society. Through the structure of Disney and DreamWorks, we learned how to utilize the mythical structures that transform according to ideologies. The right way to organize works will require the strategic approach to storytelling.
The level of genetic variation and relationships in three native Korean goat populations (Dangjin, Jangsu, and Tongyeong) as well as the populations of a farm were analyzed, based on 30 microsatellite markers. A total of 277 distinct alleles were observed across the four goat populations, and 102 (36.8%) of these alleles were unique to only one population. The mean observed heterozygosity and polymorphism information content were calculated as 0.461~0.651 and 0.462~0.679, respectively. In the NJ tree constructed based on Nei's $D_A$ genetic distance, the four populations represented four distinct groups. However, the genetic distances between each Korean native goat population and the farm population were two times those among the three native Korean breeds. The genetic structure within the three Korean native goat populations was also investigated. Cluster analysis, using the STRUCTURE software, suggested three clusters. The molecular information of genetic diversity and relationships in this study will be useful for the evaluation, conservation, and utilization of native Korean goat breeds as genetic resources.
This paper was written for the purpose of using as the theoretical basic data of judgment in the situation that there is a growing demand for intelligent design theory to be taught in public schools along with evolution theory. In order to verify the possibility that intelligent design theory, which has little empirical evidence unlike evolutionary theory, could be a scientific theory, what intelligence is and whether the trace of intelligence is actually found in nature was confirmed through literature. If intelligent elements, which are traces of intelligence in nature, are discovered empirically in nature, then intelligent design theory can be recognized as a scientific theory and can also be taught in public schools. The identity and traces of intelligence were found in relevant literature and the traces are found not only in various artificial products derived from human beings such as thinking, knowledge, and civilization, but also in all phenomena of nature. Based on these results, this paper provides a discussion on how the evolutionary theory and intelligent design theory should be handled in the field of school education, as well as how to resolve the conflicts between evolutionary theory and intelligent design theory.
It is commonly believed that disease of human or economic traits of livestock are caused not by single gene acting alone, but by multiple genes interacting with one an-other. This issue is difficult due to the limitations of parametric statistical method like as logistic regression for detection of gene effects that are dependent solely on interactions with other genes and with environmental exposures. Multifactor dimensionality reduction (MDR) nonparametric statistical method, to improve the identification of single nucleotide polymorphism (SNP) associated with the Hanwoo(Korean cattle) carcass cold weight, is applied and compared with ANOVA results.
Can law be combined with television entertainment programs? This paper explores the ways in which law systems and law culture are reflected in and reflect the television legal series. TV legal series, such as legal dramas and infotainment shows, provide platforms for the audiences, who otherwise have few opportunity in real life, to engage with legal systems in societies. Adopting loosely dramatized reality programs, these legal series not only entertain and inform audiences but also educate citizens. This paper combines analyses of theoretical debates on law and television with analysis of TV text. The result shows that , dramatized enactment based on true stories and criminal cases, may have an important ideological role in which fictionalized dramas mask the hard realities and authoritative legal systems. By doing so, TV legal shows play their roles not as mere symbolic representation but as powerful institutions that construct the image of law and reality.
The purpose of this study is to review and criticize the articles that analyzed Frozen by using the semiotic method of Greimas. The study also aims to apply the semiotic method of Greimas correctly to find the deep structure of the narrative of Frozen. The results of the narrative analysis based on the actantial model and the semiotic square show that Frozen is not Elsa's heroic narrative but Anna's one. Because Elsa and Anna are the opposing elements in this narrative, the success of Anna is the failure of Elsa. Frozen does not convey the subversive message about the gender roles by representing an independent and active woman who resists the patriarchal discourse. Instead, Frozen reproduces the conformist ideology by saying that love is the most valuable thing and that everyone should accept the role given to him/her by the community.
This paper examined the role of social workers in the redistribution policy process in Korea, based on the materials of case studies on the Korean redistribution policy. The findings and assertions in this paper are as follows: In the Korean redistribution policy process clients could not fully reflect their interests, because they were lack of the power resources such as money, knowledge, time, social status, etc. The process was initiated by the President and bureaucrats who were not oriented to social welfare. As a result, the redistribution policy in Korea has not been well-developed in terms not only of the policy for clients, but also of the policy for social integration. In the policy process, somebody is needed that issues the policy problem, watches the agenda setting process, the polcy making process and the implementation process in order to keep the interests of the have-nots. I assert that a social worker have taken these roles in the field of the redistribution policy process, because he/she is an expert equipped with professional knowledge and skills about social action.
