VHF DSC에 의한 동해권 어업 VMS의 통신운용 설계 (A Design on Radio-Communications Operation of the Fishery VMS by VHF DSC in the East Sea Area)

  • 5톤 이상의 어선에는 VHF(Very High Frequency) 대역의 DSC(Digital Selective Calling)가 어선법과 선박안전법에 의무화되어 있다. 어선의 무선설비 관련 규정에는 안전운항을 확보하고 해양사고 발생시 신속하게 대응하기 위하여 선박의 소유자는 국토해양부장관의 고시에 따라 어선위치 자동발신 장치를 갖추도록 규정하고 있다. 따라서 어업정보통신국은 2012년 동해를 시작으로 남해와 서해에 연차적으로 VHF 해안국을 설치하고, 웹기반으로 리모트 콘트롤 및 모니터링에 의하여 DSC를 원격으로 운용하는 연안 VMS(Vessel Monitoring System) 구축사업이 추진중에 있다. 모든 어선의 VHF DSC는 GPS와 연동되며 DSC의 호출에 의하여 자동으로 위치정보를 중계소에 전송하게 된다. 본 논문에서는 동해권의 VHF DSC 해안국을 대상으로 통신해역 설정과 운용 그리고 등록선박의 항해에 따른 권역별 로밍서비스를 실현하는 항적추적과 RSSI (Received Signal Strength Indication) 기법을 병행하는 알고리즘을 연구하였다.

소형 선박용 안전장치 (The Safety Equipment for Small-Size Vessel)

  • 최근 연안지역에 선박 통항량이 증가하고 있어, 그에 따른 해양사고도 증가하고 있다. IMO에서 안전운항을 위하여 안전 장비를 의무적으로 장착하도록 권고하고 있다. 대부분의 중대형 선박은 거의 안전운항 장비를 구비하고 있지만, 소형 선박은 선주의 재정상 어려움 또는 무관심 때문에 구비하지 않는 경우가 많이 있다. 그러므로 여안 지역에서 소형선박의 안전을 위하여, 좌초, 침몰, 그리고 충돌 등과 같은 해양 사고를 미리 예방하거나 또는 사고 발생 시 신속히 대처할 수 있어야 한다. 이 논문에서는 이와 같은 기능을 수행하는 소형선박용 안전 장비를 개발하였다. 이 장비는 선원의 스마트폰 및 저렴한 전용 단말상에 이런 상태를 표시해 주고 동시에 이런 상태를 제어센터와 인근에 있는 선박에 전송함으로써 무방비 상태에 있는 소형 선박의 안전을 상당히 보장해 줄 수 있다.

  • 세월호 사고 이후 내항선 분야의 해사안전관리를 강화하기 위하여 해사안전감독관 제도가 도입되었다. 이들은 선박에 대한 정기 및 수시 지도·감독 중 선박의 시설 분야에서 중대한 결함사항이 발견되면 시정이 완료될 때 까지 선박의 항행을 정지하는 행정처분을 하고 있다. 항행정지명령은 내항선박에 대하여 해사안전감독관이 행사하는 강장 강력한 규제행위의 일종이다. 선박의 안전과 해양환경보호를 위한 해사안전감독관에 의한 내항선박의 지도·감독의 중요성은 아무리 강조해도 지나치지 않을 것이다. 그러나 각 지방해양수산청의 선박에 대한 규제의 정도는 이를 집행하는 사람에 따라 다소의 개인차가 있을 수 있으며, 집행과정에서 개인의 고의 또는 과실이 발생할 수가 있다. 지방해양수산청에 의한 선박의 억류는 선박운항 상의 지체를 가져오기 쉽고, 용선계약의 정지에 의하여 선박의 소유자는 많은 경제적 손실을 입을 수 있다. 그럼에도 불구하고 해사안전법에서는 해사안전감독관에 의한 항행정지명령의 행정처분에 대하여 이의신청과 같은 불복절차를 규정하지 않고 있다. 따라서 이러한 문제점을 극복하기 위하여 지도·감독의 근거가 되는 해사안전법 상에 개인의 고의 또는 과실에 의한 부당한 항행정지 행정처분에 대하여 이의신청을 통한 권리의 구제가 가능하도록 제도를 개선해야 한다.

유류오염 리스크와 보험담보의 문제 (A Study on the Insurance System for Oil Pollution Risk)

  • With the rapid development of oil and chemical industry in the late 20C, massive transportation of oil by oil tanker vessel has grown and it caused the big oil pollution accidents. When oil spill from the oil tanker, damages reach into the astronomical figures in economically and damages affect wide area and many people with break the balance of ecosystem. Recently in Korea, the oil pollution accidents has occurred frequently as growing of oil consumption and it caused large-scale damages to the victim. Oil pollution in Korea offshore takes not only Korean fisherman from their life ground and break the ecosystem but it takes too much time and money to recover. To minimize oil pollution damages, it is necessary to make pre-caution effort as a ship owner and relevant government bodies should endeavor to prevent from more damages. But once oil pollution accidents occurs in territorial sea, compensation for victim is very important. But it is true that compensation is not paid to victim smoothly. So this study aims at the problems of oil pollution compensation to the Korean victim and find the best way to get reasonable compensation.

해상에서 두 선박이 서로 만나는 세가지 전형적 양태와 그 항법에 관한 고찰 - 국제규칙을 중심으로 - (A Study on the Three Typical Approaching Aspects of Two Vessels at Sea and on Their Steering and Sailing Rules)

  • Although there are numerous regulations provided for the Steering and Sailing Rules on the International Regulation forPreventing Collisions at Sea, 1972(hereinafter called COLREG), the most important Sailing Rules for approaching between two vessels in sight of one another could actually be defined as three typical aspects based on both the COLREG and practical sea experience. The Rules are overtaking , head-on situation and crossing situation applicable, those clearly prescribes on the COLREG. Thus, for easy understanding of these Rules comprehensive legal research is performed by every chapter in this paper so as to make practical implementation by duty officer of apprentice of shipping concerned. Consequently an aim of the study intends not only to exonerate any vessel, or the owner, master or crew there of, from consequences of well understanding and timely implementation to complying with the aforementioned three typical Steering and Sailing Rules which may be required by ordinary practice of seamen but also to avoid risk of collision at sea.

좁은 수로에 있어서의 항법에 관한 연구 - 완도구역 연안항로를 중심으로 - (A Study on the Navigational Rules and Regulations for the Narrow Channel)

  • Recently, as the coastal trading is being increased rapidly, risk of collision being increased especially in the coastal route near around the port of Wando. In this paper, with the reference to various literatures and papers on collision avoidance rules, the navigational rules and regulations for the coastal area-especially for the narrow channel-are construed and introduced in brief. Also, 3 collision cases near around the port of Wando and statistical data during 5 years(1996 to 2000) are studied. The results of this study are as follows; 1. It is strongly recommended to separate the route of east-bound and west-bound in this area due to removing the risk of collision between the vessels in reciprocal way. 2. The owner of the fleet should lead that the master should con the vessel by himself when passing this area. 3. For the introduction of the Coastal VTS, it is required to investigate the capability to cooperate with military radar sites which based on all over the coast.

A Comparative Study on Marine Transport Contract and Marine Insurance Contract with Reference to Unseaworthiness

  • Purpose - This study analyses the excepted requirement and burden of proof of the carrier due to unseaworthiness through comparison between the marine transport contract and marine insurance contract. Design/methodology - This study uses the legal analytical normative approach. The juridical approach involves reviewing and examining theories, concepts, legal doctrines and legislation that are related to the problems. In this study a literature analysis using academic literature and internet data is conducted. Findings - The burden of proof in case of seaworthiness should be based on presumed fault, not proved fault. The burden of proving unseaworthiness/seaworthiness should shift to the carrier, and should be exercised before seeking the protections of the law or carriage contract. In other words, the insurer cannot escape coverage for unfitness of a vessel which arises while the vessel is at sea, which the assured could not have prevented in the exercise of due diligence. The insurer bears the burden of proving unseaworthiness. The warranty of seaworthiness is implied in hull, but not protection and indemnity policies. The 2015 Act repeals ss. 33(3) and 34 of MIA 1906. Otherwise the provisions of the MIA 1906 remain in force, including the definition of a promissory warranty and the recognition of implied warranties. There is less clarity about the position when the source of the loss occurs before the breach of warranty but the actual loss is suffered after the breach. Nonetheless, by s.10(2) of the 2015 Act the insurer appears not to be liable for any loss occurring after the breach of warranty and before there has been a remedy. Originality/value - When unseaworthiness is identified after the sailing of the vessel, mere acceptance of the ship does not mean the party waives any claims for damages or the right to terminate the contract, provided that failure to comply with the contractual obligations is of critical importance. The burden of proof with regards to loss of damage to a cargo caused by unseaworthiness is regulated by the applicable law. For instance, under the common law, if the cargo claimant alleges that the loss or damage has been caused by unseaworthiness, then he has the burden of proof to establish the followings: (i) that the vessel was unseaworthy at the beginning of the voyage; and that, (ii) that the loss or damage has been caused by such unseaworthiness. In other words, if the warranty of seaworthiness at the inception of the voyage is breached, the breach voids the policy if the ship owner had prior knowledge of the unseaworthy condition. By contrast, knowingly permitting the vessel to break ground in an unseaworthy condition denies liability only for loss or damage proximately caused by the unseaworthiness. Such a breach does not, therefore, void the entire policy, but only serves to exonerate the insurer for loss or damage proximately caused by the unseaworthy condition.

용선계약하에서 위험물취급에 관한 고찰 -영미법논리를 중심으로- (Handling of Dangerous Goods Under Charterparties - Focusing on Anglo/American Law and Practicies -)

  • The implied obligation under the contract of affreightment not to carry dangerous goods without prior notice to the carrier applies to the contractual relationship between the charterer and the owner under charterparties. The charterers will be in breach of an implied undertaking under the common law if they load dangerous cargoes without making notice of dangerous nature of them to the owner. It is indicated to be necessary to change the term "shipper" to "charterer", with relation to such implied obligation, where the Hague/Hague-Visby Rules are incorporated into the charter, however, it is not so apparent where an actual shipper is involved. So long as an actual shipper could be identified, the shipper rather than the charterer shall be responsible for damages arising from the dangerous nature of the cargo itself. In this case, the actual shipper is interpreted to have an implied contractual relationship with the carrier just by the act of delivering the cargo to the carrier for loading. If the vessel were damaged by shipment of the dangerous cargo under charterparty, the carrier can claim against such damages based on the contractual obligations under charterparties: "implied and expressed duty not to ship dangerous cargo without notice to the carrier"; "Art.IV.6 of the Hague/Hague-Visby Rules"; "Indemnity Clause" and "Redelivery Clause". The carrier has the conventional right under the Hague/Hague-Visby Rules to land, destroy or render the goods innocuous where the dangerous cargo threatens the means of transport or other interests on board. When the carrier has not consented to make the shipment, the carrier's disposal right could be exercised without limitation. However, where the carrier has consented to make the shipment of the dangerous goods with the knowledge concerned, the right of disposal of such goods should be exercised with limitation.

  • UN해양법협약은 해양에서 선박통항의 자유를 인정하되 선박에 대한 관할과 관리는 선적국에 부여하고 있다. 그런데, UN해양법협약 등에서 선박의 국적부여 권한을 각국에 맡겨 선박의 소유국과 선적국의 불일치를 인정함으로써 해양질서 유지에 어려움을 초래하고 있다. 특히, 형사관할에 대하여 기국위주의 배타적 행사를 인정하여 선적국의 관할권 행사가 이루어지지 않거나 피해국 입장이 반영되지 않는 문제점이 노정되고 있다. 본고에서는 이러한 문제의식하에 UN해양법협약을 중심으로 선박과 기국에 관한 국제법적 규정과 이에 따른 문제점들을 해양사고 발생에 따른 형사관할권의 소재를 중심으로 살펴보고 기국주의에 따른 형사관할권이 어떻게 결정되는지 몇 몇 사례에서 살펴본다. 또한 국제 형사실무에서 이루어지는 형사사법 공조체계를 살펴보고 기국관할에 따른 문제점을 보완할 수 있는 몇 가지 대안을 제시해 보고자 한다.

유조선, COT Vent Pipe용 Anti-Splash Device 최적 모델 개발 (Oil Carrier, Development of on Optimized Anti-Splash Device Model for COT Vent Pipe)

  • Application of newly conceptualized Anti-Splash Devices designed for COT vent pipes were studied on a P/V valve located on the upper deck of an oil carrier vessel. Anti-Splash devices are used in the shipbuilding industry in order to avoid oil overflow and spray accidents caused by excess pressure and vacuum condition in the cargo oil tanks. These conditions are caused by the transverse and longitudinal sloshing forces that arise from ship motion during sea voyages. The main issue with existing Anti-Splash device model is flux at the outlet of the Anti-Splash Device, and so, new conceptual models for the Anti-Splash device were developed and compared to existing Anti-Splash device model using CFD analysis. Transient analysis was used to capture the flow and velocity of each model and a comparative analysis was performed between old and new-concept models. This data was used to determine the optimal design parameters in order to develop an optimized Anti-Splash Device. A Factory acceptance test was performed on the new-concept models in order to verify the performance and efficiency against their design requirements and other criterion. The final step performed was to apply the optimized Anti-Splash Device models for COT vent pipes to an actual vessel and verify performance through a seawater cargo operation during a sea voyage as per the ship owner's request. The patent for the aforementioned device was obtained by the Korean Intellectual property Office dated Dec. 18th,2014.
