U.S. Court's Interpretation for Arbitrability (중재가능성에 대한 미국연방법원의 해석)

  • The foundation of arbitration is the arbitration agreement between parties. If no agreement to arbitrate exists, the parties should not send to arbitrate their disputes. In the United States, there are no provisions as to arbitrability under the Federal Arbitration Act. Before a court can enforce arbitration, it must first determine arbitrability. The general presumption is that the issue of arbitrability should be resolved by the courts. The question of whether parties have submitted a particular dispute to arbitration raises a question of arbitrability which is an issue for judicial determination unless the parties clearly and unmistakably have provided otherwise. Determining if the parties agreed to arbitrate a dispute involves inquiries into whether there is a valid agreement to arbitrate the claims, and the dispute falls within the scope of the arbitration agreement. Therefore, the purpose of this article is to review how to settle the issue of arbitrability in the U.S. federal courts.

  • Primordial germ cells (PGCs) in aves are the progenitor cells for the gametes. These cells first appear in the epiblast (Eyal-Giladi et al.. 1981). Then translocate and concentrate to endoderm of germinal crescent area in the junction of the area opaca and area pellucida lateral to the primitive streak in stage 4 through 7. They separate from the endoderm, temporarily circulate via the blood vascular system, leave the blood vessels, and finally settle down in the gonadal anlagen at stage 20-24 where they rapidly proliferate to form germ cells. Recently, several attempts have been made to introduce foreign gene into the avian genome to form a transgenic chicken. The stem cells most readily available as vehicles for genetic manipulation of germline in avian species are the PGCs. PGCs have recently been manipulated genetically and used successfully as a vector for gene transfer.

  • The twenty-first century is era of cultural infrastructure during which cultural and economic power is greater than any other era in the fast, For this reason, all the countries in the world recognize that it is more important than any other things to plan to establish a structure which is suitable to the real conditions of a region in order to efficiently manage or operate their cultural environment. in particular, they think it is urgent that they should contrive to develop Their regional industries with new information media, introduction and spread of the up-to-date technique of design. However, our regional related industries very difficulty for the moment for them to apply new designing technique or to settle technical bottlenecks themselves. Accordingly, in order to resolve such a structural point at issue, this study has carried the newly designed and developed, 18 wooden, cultural craft items that were Produced by utilizing the ultramodern digital M/C installed at TIDIC (Tourism Industry Design Innovation Center in Kwangju University), it would contribute to achieve some global cultural products.

  • This paper examines characteristics of the accounting rate system whereby international telecommunications carriers settle net balances of account arising from bilateral traffic flows. Using a two stage game model, we explain problems in the system: growing traffic and payment imbalances, and resulting conflicts regarding accounting rates between carriers of, say, developed and developing countries. In this paper, we view the problems as a splitting-a-pie game in which one carrier cannot get more without a loss of the other, but total pie size depends upon the accounting rate. Therefore, a natural solution should be inevitably of a Coasian-type to establish a mutual agreement. In this regard, we first derive an efficient accounting rate, in the sense that it can make both carriers better off. Next we suggest some ways of attaining the efficient outcome. Regulatory and policy implications are also discussed.

  • With the advent of the Fourth Industrial Revolution, software(SW) education has become a necessity, not a choice of those who live in the digital age. Recently, many countries around the world have been actively promoting software education based on Computational Thinking(CT) for K-12 students, so software education in schools has bigger meaning as basic literacy education of future digital generation rather than coding skills. However, the integration of software education as a formal curriculum in schools is still ongoing in even other countries. Korea is also pursuing software education, but it is in the beginning stage. Therefore, we need to study the cases of other countries that have already started software education at the national level. In this paper, we first investigate the software education cases of three countries, e.g., UK, France and China with a respect of background & educational objective, development stage, and curriculum and we suggest education policies that software education can settle in Korea schools to foster a creative talented people.

  • In this knowledge based society, the circulation of knowledge and information is more and more increasing. Terms, as denominations of every specialized concept, has grown in quantity and there are considerable amount of foreign terminology coming to settle down in Korean language. Since terminologies quickly generate and be extinguished, it is important to translate in appropriate way at the very first phase of terminology implementation. This article aims to elaborate the typology of korean terminology translation forms, and propose some guidelines for terminology formation and translation methodology. ISO terminology principle and other institutes' propositions for term formation as well as translational theories constitute two basic columns of the guidelines.

  • In this study, we investigated the application of oriental history of mathematics in school mathematics teaching. We set up three study problems to achieve this purpose. First, we analyze the middle and high school mathematics textbooks and auxiliary books. Second, we survey the mathematics teacher's knowledge and degree of application on history of mathematics. Third, we develop the teaching and learning materials on oriental history of mathematics. We performed three study-methods to settle above study problem. First, we analyzed 24 textbooks and auxiliary books for study problem 1. There were 6 middle school mathematics textbooks and 6 auxiliary books and also 6 high school mathematics textbooks and 6 auxiliary books. We categorized the contents into "anecdote", "systematization", "application of problem", "expansibility of thought", and "comparative of the contents". Second, we surveyed the 78 mathematics teachers's knowledge and degree of application using questionnaire about knowledge and application on history of mathematics. The questionnaire was made up of four types of question; the effect of material about history of mathematics, the understanding of western history of mathematics, the understanding of oriental history of mathematics; the direction of development of teaching material. Third, we exemplified the teaching and learning materials about three categories: "anecdote", "comparative of the contents".

  • The purpose of this study was to find out the effects of a career education program during a discretional activity class in elementary school. It established the following questions to achieve the objectives. First, does a career education program In a discretional activity class have an effect on elementary schooler's career maturity? Second, does a career education program in a discretional activity class make an influence on elementary schooler's self-concept? To settle these subjects, it assigned two classes in 5th grade of A elementary school, city of Anyang, Gyeonggi-do, experiment group and control group. It was applied the experiment group a career education program. As for measurement, it was used career maturity level test for elementary and middle schoolers' and 'the self-concept diagnostic test'. It was examined career maturity and self-concept of the groups through the pre-test post-test, applying cross-tabulation analysis to career choices pattern and t-test to career maturity level and self-concept. The results were as follows: First, students of experiment group showed meaningful differences in career choice pattern, career choice attitude, and career choosing skills compared to control group, and that presented a career education program made a positive impact on elementary schooler's career maturity. Second, it showed that there was a significant difference in self-concept, showing students of experiment group took better place. it is believed that a career education program had a potent influence on the self-concept of elementary students.

Second, the effect appears as an industry that creates jobs for the populace to replace the social security system, social safety net is considered as an industry. Third, this is an industry that can be self-reliant in the short term at least political support, the industry is considered in the industry to maximize the effectiveness and efficiency of the support policy.

  • Since 1970s, the metropolitan-cities in Korea constructed enormous capacities of apartment housings to settle the inferior housing conditions. However, from a stand point of children, the formality of the apartment housing is too tight and specialized to give children enough space to play in and the location and physical area of that is bad and insufficient either. In this study, progressive method for the playground is offered to improve the conditions of playground in apartment housings through the examinations of the utilization of the playground and the problems of that. As a result, three of items for the improvement of the playgrounds are suggested. First, re-interventions for the rules which prescribe the area of the playgrounds are needed. Second, the locations of the playgrounds should be based on the children's playing activities and parents' profitable apprehend. Third, the access to the playgrounds should be based on the children's conveniences. In order to perform these recommended items, objective POE data for the playgrounds through the systematic examinations are also needed in addition to the abilities of the planners.
