A Study on the Mutual Cooperation of Private Security and Local Government (지방자치단체와 민간경비의 상호협력에 관한 연구)

  • The suggestions that follow are about the plan for the cooperation between private security and local government and the enhancement of its service for facing the change of public peace environment. Fist, by a local government collecting funds, the business for revitalization of local economics should be done to enhance local economic independence. Second, the autonomous right of a local government should be reinforced and the center for taking complete charge of local security should be established in the self-governing body. Third, the private security should be connected with the local characteristics, the role of which enlarged as well. For this developing the model of security service for the local area and working together between private security and police should be achieved. Fourth, it is necessary for a local government to entrust the private security with its public security service. For this it should be achieved to set up the range of local security service and inform local residents of the advantage of security service entrusted to private security. Finally, in connection with the new system of local police, it is necessary to have clear grasp of the work related to the private security among local police services and private security business and local police should take partial charge of the public peace service. Through the cooperation between private security and local government, the role of private security will be enlarged and its business revitalized as well.

  • China is an ancient country that has one of the oldest civilizations on earth. Since the end of 1970s, China has made her administrative and economic reform and opening up to the outside world. Now the administrative and economic reforms has scored great success with a series of important accomplishments. China's peculiar political economy largely explained the changing reform initiatives over times. The problems confronting Chinese officials are markedly different from the West despite the fact the China and the West have engaged their efforts in undertaking administrative reforms in the last two decades or so. The purpose of this study is to analyze the bureaucracy, especially the police civil service system in China. Core features of the institution of China's civil servant system is discussed in this study.

  • In the outwardly changing environment of public security these days, police administration faces the nation's request for qualitative improvement of police service and the new request of police reformation for changing function of police in Korea. The nation wishes police to provide service fairly. The issue most seriously mentioned in the reliability of police service is very large gap in the recognition of service quality between supplier and consumer. To get the trust of nation in delivering police service, the police must have justness, consistency, punctuality of delivery, propriety and efficiency. However, the recognition of citizen, the consumer of police service is more important. How to correspond to the nation's request to police needs to be decided by evaluating the quality of present police service. It is necessary to be interested in what customer wants so as to evaluate the quality of police activity.

This study analyze recognition and attitudes of citizens on the Policing, participation factors, relationship among many factors between independent variables and dependent variables.   • Since Korea Police Agency had established in 1948, our police have developed with many difficulty. And now, our police have diversity in policing through decentralization and democratization of police organization. But, new policing methods has introduced without our social control system which have based on national police system, without considering basic principles of our police systems. new policing methods are as follows.; enlargement private policeing, introducing community policing, introducing police service, introducing privatization of policing. Therefore, this study examined development process of police conception and policing which is based on many police studies. And this study suggested how we can understand Multilateralization of Policing in Korea. Because basic police conception, public safety and order maintenance function is never changable in spite of various changes in policing.

  • With rapid changes taking place in every field, the expansion and specialization of various social service activities are one of the characteristics of the modem society. However, the increase of crimes and inefficiency of public police service to cope with this situation have caused discontent and distrust on the service among the public, making people more inclined to solve safety-related problems by themselves. Private Security Service(PSS) and Private Investigation Service(PIS) were introduced to satisfy these needs. In the area of PIS, Public Investigation Service System(PISS) has been established for a quite long time in foreign countries. However in Korea, PIS is being provided by unregulated service providers such as errand service center due to the lack of legal system, causing many problems related with illegal practices by the service providers. This paper is the result of the research on how to adopt a relevant PISS in Korea and develop it in the future. This kind of research is much needed to curb the rising illegal practices of the errand service centers, complement the insufficient operation of public police service, and strengthen the competitiveness of our country by taking more efficient actions in the changing public security environment. Based on the research, this paper also examines positively the possibility of introduction of PIS in Korea. This paper also recommends a prompt enactment of PIS regulation and improvement on the legal environment for such introduction of the relevant and suitable PISS in Korea.

  • This article assesses the recent police reform strategy in England and Wales with the Police Reform and Social Responsibility Act 2011. Police and Crime Commissioners have a responsibility not just for the police force but also for reducing crime in their area of responsibility. This ensures that their remit runs much more widely than their predecessor body, the police authority. The article goes on to evaluate the nature and extent of crime by making immediate use of survey of local police commanders. The surveys showed that police commands were swamped with minor crime and anti-social offences. The arrival of Police and Crime Commissioners has meant that now police priorities can be more closely aligned to those of the public and where anti-social behaviour is now recognised as impacting on the lives of many residents more significantly than criminal activity. The article highlights the changes introduced by government following the Winsor Review to police pay, pensions and conditions of service. It reflects on the impact of this on both police morale and professional motivation. It suggests that current government policy is now haemorrhaging the police service as increasing numbers of experienced officers are leaving the police service which could ultimately undermine its long-term resilience as a strategic emergency service.

  • There are two kinds of police authorities in Korean railway industry, that is, the Special Judicial Police and the Local Subway Police. The existence of two separate entities for common objective of railway security has given rise to problems including inefficiency in performance and lack of customers-focused police service and synergic effects. The purpose of this study is to search for solutions to rail crimes that allows for rapid spatial movements since they take place on fast moving trains.

  • The current consitutional law 29-1 is ordaining the State Tort Liability for the illegal action of public service personnel. Based on this regulation, the State Tort Liability Act 2-1 actualizes by indicating, the nation or the local self-governing community is responsible for the public service personnels damaging others during their office hours whether it is accidental or intentional. However, the same law is considered to be inappropriate for the damage relief. In order to supplement this problem, through examinations at both theoretical and systematic levels of Prima facie as well as the objectification and standardization of the damages are required for the national compensation for the police action. According to the objectification and standardization of the damage theory, the faulty actions of the public service personnel are the defects occurred during the office hours. In the case of the police action that frequently uses infringement administration, invading the liberty and rights of the people, it is necessary to interpret faulty damages during the office duties more comprehensively so as to extend its scope of the ordinary public service personnel accidental illegality. In order to warrant effectiveness of the securing the rights, it is crucial to distinguish whether the faulty actions are accidental or intentional. When proven to be damages by illegal police action, the police personnel is responsible for the faults, called Prima facie, the nation is liable for the damage relief.

The Proposal of Problems in Private Security Law (경비업법령의 문제와 개정방향)

  • In 1976, privative security law in Korea was enacted. Through the law has been revised 23 times, and it reflected changing security environment. Since the private security is now in charge of the daily safety as well as the police, private security law should be revised in overall dimension. First, the name of private security service and terms should be reorganized with applying the current environment of security. For instance, there should be an appropriate range of security service which could contain security consulting, planner, private investigator, and convergence security. Second, the errors of private security law should be corrected and applied to the revised law. Third, some inappropriate contents in the private security law should be revised. Forth, revising the private security law should consider to solve problems in selection, education, and election of security instructor.
