  • While the medical supplies have positive functions such as extending lifespan, recovering health, and preventing diseases, they also cause unexpected tragic consequences due to their side effects, and the magnitude of such damage inevitably increases due to the mechanism of mass production, mass distribution, and mass consumption of those medical supplies. Therefore, needless to say, the optimal way to prevent or reduce such damage is rather through medical supply manufacturers' producing non-defective products, or through the government's controlling production and sales of medical supplies with more aggressive exercise of regulatory authority on medical supply manufacturers, than through a remedy by a legal relief after using medical supplies. In this case, although the victim died due to the defect of the cold medicine, 'CONTAC 600', the drug company's responsibility to cover damages was not recognized because a defect could not be found in the then-manufacturing process. Thus, while pharmaceutical companies are gaining economic profits by producing and selling a medical supplies, if they do not take any remedy measures for the victims of their products' side effects, the victims have to use medical supplies under their own responsibility of taking a risk, and they have to accept the full damage of the potential consequence. Therefore, to remove such absurdity and contradiction, and to practically remedy the victim of medical supplies' side effects, the pharmaceutical side effects remedy project pending in the the Drugs, Cosmetics and Medical Instruments Lawneeds to be actively implemented.

  • During enlarging an existing tunnel under operation, unexpected excessive overbreaks and large cavities around the tunnel were found. It was an issue that they might influence the stability the new tunnel. The overbreaks and cavities are assumed that they were attributed to excessive blasting under the condition of insufficient ground investigation. To enlarge the existing tunnel safely, therefore, a remedy measure for the overbreaks and cavities is suggested.

  • Pulsatillae Radix and Cicadidae Periostracum have long been used for treatment of injuries, inflammations or itchiness in Korea. This study was carried out to examine the acne-remedy effects of the mixture made with equal parts of Pulsatillae Radix extract and Cicadidae Periostracum extract (PRCP) compared with 2%-benzoyl peroxide (Standard) used commercially as anti-acne. The results showed the mixture (PRCP) was more effective than each crude drug extract. The 10%-PRCP showed significant antimicrobial activity against Propionibacterium acnes, the major cause of acne, and also showed significant inhibition from type 1 $5{\alpha}$-reductase ($5{\alpha}R$), another cause of acne, And the cream made with PRCP demonstrated anti-sebum and acne-improvement effects on examinee's facial skin.

  • The purpose of this study is to provide a basic data for architectural planning on the wards and special quality of physical remedy spaces of geriatrics hospital. This research, to analyse dependency degree of inpatients in geriatric hospital, shows relativeness between remedy space and wards, and to show behavior of each patients reaction to there space. Result of interviewed inpatients who were sorted by age, sex, dependency degree, and days in hospital, suitable space programming is to need for physical and mental state. On the bases of survey and analysis, the basic data for planning and design the hospital for the elderly with dementia has been proposed.

The method of the Korean Traditional Folk Remedy used in this area was mainly food, which can be easily found around their house and easy to use.

  • Unlike continental European legal systems (civil law systems), specific performance in common law refers to an equitable remedy requiring exactly the performance that was specified in a contract. It usually granted only when money damages would be an inadequate remedy and the subject matter of the contract is unique. Thus, under common law specific performance was not a remedy, with the rights of a litigant being limited to the collection of damages. Consistent with the practice in civil law jurisdictions, United Nations Convention on Contracts for the International Sale of Goods (CISG) makes specific performance the normal remedy for breach of a contract for the sale of goods. Therefore, the buyer may require a breaching seller to deliver substitute goods or to make any reasonable repair. Likewise, the sellermay require the buyer to taker delivery of goods and pay for them. Despite this, Article 28 of the CISG restricts the availability of specific performance where it would be unavailable under the domestic law of the jurisdiction in which the court is located. Thus, the CISG's more liberal policy toward specific performance is restricted by common law. There are some legal issues in CISG's specific performance availability by Article 28. This paper analyzes these issues as interpreting Article 28 of CISG, by examining various theories of application to actions for specific performance and comparing CLOUT cases involving CISG Article 28.

Effects of Herbal Remedy for Diabetes Mellitus-01 (HRDM-01) on Liver and Serum Lipid Level in Diabetic Rats (당뇨한약복합처방(Herbal Remedy for Diabetes Mellitus-01, HRDM-01)이 당뇨병성 흰쥐의 간 및 혈중 지질에 미치는 영향)

  • Objective:The Herbal Remedy for Diabetes Mellitus-01 (HRDM-01) is composed of 11 species of medicinal plants. HRDM-01 is used as anti-hyperglycaemic agent. Anti-hyperglycaemic agents in western medicine often have hepatotoxicities. Therefore, we investigated safety of HRDM-01, especially in liver functions. Methods:We investigated the effects of HRDM-01 on liver function measuring serum AST, ALT and LDH levels and histopathological changes of liver tissue using photomicroscope. In addition, we also investigated the effects on serum lipid levels such as total cholesterol, HDL-cholesterol and triglyceride. Results:In our experiment, single injection of streptozotocin elevated levels of AST and ALT in serum. But LDH level was not affected. In addition, our animal model showed elevated levels of total cholesterol and triglyceride in serum. 30 days treatment with HRDM-01 lowered serum AST level. Serum levels of ALT and LDH did not affected. In addition, HRDM-01 lowered serum triglyceride level significantly. In histopathological observation, we did not find any abnormal changes in all experimental groups. Conclusions:Briefly, HRDM-01 did not elevate serum levels of ALT, LDH, total cholesterol and did not affect histopathological changes in liver tissues. Moreover, HRDM-01 lowered serum AST, triglyceride, which are elevated by induction of diabetes mellitus. These results suggest the safety of HRDM-01 in diabetic treatment.

Psychological Factors of High School Girl Students on Drug Use (여고생의 약품사용과 심리적 특성)

  • This study was designed to figure out current situation of use of non prescription drugs and psychological factors of high school girl students on drug use, and conducted from Nov. 1 through Nov. 20. 1998. 536 girl students were randomly selected for this study. Symptom Check list-90-Revision questionnaires used for interview. The data obtained were analyzed by SAS program. The results are as follows: 1. 94.8% of students had experiences of using more than one kind of drug; lenitive(57.8%), digestant(74.1%), remedy for colds(84.9%), antibiotic(9.3%), stimulant(3.2%) remedy for constipation(22.4%). 2. Students had experiences of using non prescription drug, lenitive(88.1%), digestant(91.7%), remedy for colds(57.4%), antibiotic(58.0%), stimulant(88.2%) remedy for constipation(88.3%) 3. 19.4% of students had experiences using drugs more than one time a week and 23.5% of students experienced tolerance, prescription group(11.1%) and non prescription group(88.9%) and 21.4% of students were keeping some medicine who experienced tolerance. 4. The scores of Symptom Check list-90-Revision of students' were higher than Kim's standard group and the psychological states were worse than Kim's standard group. 5. There were significant differences among groups(no use of drug, use of less than three kinds of drugs, use of more than three kinds of drugs) in Symptom Dimension without Paranoid Ideation and Phobic Anxiety and between using group and non using group of drug in Psychological factors on Drug use by lenitive, antibiotic, and stimulant.

A Study for the Application and the Buyer's Remedy for the United Nations Convention on Contract of the International Sales of Goods to the Government Foreign Procurement Contract (정부 외자조달계약의 국제물품매매협약의 적용과 매수인의 구제에 관한 연구)

  • Korea has become a member of the United Nations Convention on Contract of the International Sales of Goods (the 'CISG') effective since March 1, 2005. As, therefore, the governing law of the general terms and conditions (the 'GTC') in the Government Foreign Procurement Contract (the 'Contract') is mandatorily fixed to the Korean Law, the CISG, as an International Convention, now having an equivalent or even higher status to the Korean Law, unless expressly excluded, will be priorly applied to the Contract where a transaction occurs between its members. In this regard, this study focuses on how to find the way for the CISG to be a governing law of the GTC in order to eliminate legal uncertainties and lacks of foreseeability prevailed in the international trade. For that purpose, the legal aspects of GTC, and the Buyer's remedy for the Seller's breach of the Contract are analyzed in accordance with the comparative study between the CISG and the GTC including the relevant case studies. As a result of this study, the application of the CISG into the GTC is highly recommended in order to reflect into the Contract such features as fairly harmonized for the interest of both parties. Taking this opportunity, a GTC, amended from the existing one, or newly formed, within the perimeter of not conflicting with the provisions of the CISG, including but not limited to the Civil Law and Commercial Law, is required in order to evenly share each party's responsibilities and obligations where the breach or remedy of the Contract is, and, thus, which will ultimately contribute to an efficient conduct of the Contract.

The Remedial Effect Measurement of an Obesity Remedy Machine for Home Use (새로운 가정용 비만치료기의 비만치료효과 측정)

  • This paper reports the remedial effect measurement of an obesity remedy machine for home use which has been developed by H Co. and the authors. It is expected that the machine enhances it's remedial effect and usability by utilizing medium frequency and thermotherapy belt etc. In order to measure it's remedial effect, a clinical experiment, which participates eight young female subjects, has been conducted for one month. The experiment includes the measurements on the changes of Gas-Exchange Responses of subjects through Cardio-Pulmonary Exercise Testing. The experimental results show that the obesity remedy machine helps the subjects to reduce their weights, fat rates, and $VCO_2s$. Thus, it turns out that the machine can be a good candidate for medical treatment on the obesity.
