본 연구는 우리나라 성인 522명을 대상으로 지적장애인 성범죄 하급심 판결문에서 인용된 감경 사유에 대한 동의 여부 및 법정 형량의 적절성에 대한 온라인 설문조사를 실시하였다. 전체 응답자의 약 80%은 현행 지적장애인 성범죄 법정 형량을 적절하다고 판단하는 것으로 나타났다. 다만, 동의하지 않는 경우 현재보다 더 엄벌이 필요하다고 인식하였다. 거의 대부분의 응답자는 피고인의 '연령', '건강 상태', '사회경제적 수준', '성장배경 및 가정환경'과 같은 일신상의 이유 또는 범행이 '음주', '성적 충동', '우발적'으로 발생했다는 점을 감경 사유로 사용하는데 있어 동의하지 않았다. 반대로 '자수', '미수', '피고인의 지적장애', '진지한 반성' 등을 감경 사유로 사용하는데 있어서 동의 비율은 상대적으로 높았으나, 여전히 응답자의 절반 이상은 동의하지 않는 것으로 나타났다. 성별과 학력에 따른 감경사유 인식의 차이는 존재하지 않았다. 반면 응답자의 연령이 낮을수록 감경에 대해 더 엄격한 태도를 갖는 것으로 나타났다. 마지막으로 본 연구는 국민들의 의견이 반영된 양형기준의 필요성을 제안하였다.

Open port has the designated course and traffic jam of ships happens often. This fact may connect to ship crash easily. And the accident happens due to violation of navigation mainly. In ship crash between Neoblue and Shinkwang 7 at incheon open port, the Korean incheon maritime safety tribunal shows that the violation of navigation and duty of attention at the open port would produce ship crash directly. Wherefore, the interpretation and application of navigation are important to protect future ship crash accident. The points of navigation as objects of study are divided into two categories, interpretation and application of navigation on crashing between the ship which navigate the designated course and the ship which enter into the designated course from the another course or outside the course, interpretation and application of navigation on crashing between two or more ships, which navigate violating the navigation every ships and violating agreement rule each other. And as conclusion, I refer the legal responsibility both Neoblue and Shinkwang 7 in detail. The results of this study as follows : First, in case of crashing between the ship which navigate the designated course and the ship which enter into the designated course from the another course or outside the course, public order in open port act can be applied by priority. However, in applying the public order the principle of trust and reasons of crew, cause and effect, the time of navigation application are mandatory considerations. Second, in case of crashing between two or more ships, which navigate violating the navigation every ships and violating agreement rule each other, we should focus on the reasons of crew. Also, the reasons of crew need strict conditions. These means that the awareness of crash danger and recognition of special circumstance including limit state of ships, existence of emergency danger, non escaping crash danger by only observance of navigation. And in case of this state the public order the principle of trust and reasons of crew, cause and effect, the time of navigation application should be considered by priority, too.

이유의 공지성 논제에 따르면 행위에 대한 이유는 본질상 공적인(즉 모두에게 속하는) 것으로서, 이는 한 사람이 갖는 이유의 규범적 효력이 다른 사람에게도 확장될 수 있음을 의미한다. 월러스는 공적 이유가 갖는 규범적 효력의 양상이 이른바 방해하지 않음의 요구조건에 의해 남김없이 설명될 수 있다고 주장하는데, 이 경우 우리가 적극적 도움과 관련된 이유들을 어떻게 취급해야 하는가라는 문제가 생겨난다. 이러한 우려는 일반적 관계와 특수한 관계성 모두에 해당될 수 있는 것으로서, 월러스는 전자의 경우 도덕원칙에의 호소가 그러한 이유들을 설명해준다고 말한다. 그러나 이러한 주장이 비록 참이더라도, 그 주장이 의존하는 전제, 즉 공지성 논제와 도덕원칙이 정합적으로 연결될 수 있다는 전제는 논쟁의 여지를 갖는다. 이러한 관점에서 논자는 공지성 논제와 도덕원칙 간의 내재적 연관성을 입증하는 고유한 논변을 통해 월러스의 주장의 타당성을 옹호한다. 다음으로 논자는 월러스가 전혀 주의를 기울이지 않는 특수한 관계성의 경우에는 그 관계성 자체를 규정하는 특정한 요구조건들에 의해 적극적 도움의 이유들이 근거 지워질 수 있다는 주장을 편다. 이처럼 일반적 관계와 특수한 관계성에서 성립하는 적극적 도움의 이유들에 대한 고찰을 통해 논자는 행위의 이유와 관련된 우리의 실천적 추론을 이원론적 관점에서 접근하며, 아울러 이러한 이원론이 공지성 논제에 아무런 걸림돌이 되지 않는다는 것을 보인다. 이상의 작업들을 통해 이 논문은 공지성 논제에 대한 월러스의 해석을 강화하는 한편, 그 논제가 윤리학적 논의에서 행하는 이론적 역할을 보다 명료하게 한다.

대다수 국가에서 공공도서관은 공적 기관이며 민주주의 사회를 상징하는 아이콘이다. 그러므로 공공도서관은 공공성을 절대 가치로 삼아야 하며, 이윤을 추구하는 방향으로 관리되지 않아야 한다. 그럼에도 불구하고 최근에 많은 자치단체가 신축에 따른 예산부담이 가중됨에 따라 공공도서관의 운영관리를 위탁하고 있다. 이 방식을 적용하는 핵심논거는 비용절감, 서비스 제고, 자치단체의 강한 의지에 있지만, 국내에는 검증된 결과가 존재하지 않는다. 이에 본 연구는 공공도서관 위탁경영의 변용과 현주소를 살펴본 다음에 쟁점을 분석하고 해법을 제시하였다.

There has been pointed out that a great portion of hospitalized patients stay in hospitals longer than necessary, often even after the completion of necessary care. This causes that hospital resources are not used efficiently. In order to identify underlying forces in postponing inpatients' discharge, this study aimed to investigate reasons for long-term stay of patients admitted in general hospitals. A total of 135 patients, who were staying at 7 general hospitals in Inchon and Kyonggi-Do for more than 60 days, were surveyed with a self-administered questionnaire between April 3 and April 10, 2000. Medical reasons including incompleteness of necessary care, difficulty in receiving outpatient-based care, and being under physical therapy were the most significant factors associated with long-term stay, followed by the lack of familial resources to take care of patients after discharge. Financial problems such as inability to pay for hospital bills were not significant factors influencing long-term stay. Regression analyses were conducted for medical reasons, familial resources, and financial problems, respectively. It was shown that receiving physical therapy and the number of admission in the past were significant predictors for medical reasons. The lack of familial resources as a reason for long-term stay had a positive relationship with the degree of need for aid in daily living. It may be recommended for the hospitals to cope with administrative problems due to the patients' long-term stay, considering the reasons of it, and their characteristics. And also, institutional efforts like vitalizing the home care service systems by hospitals as the continuing care after discharge should be needed.

This article studied on international trade dispute of enforcement procedure of foreign arbitral awards at Korean Supreme Court, which is especially related to New York Convention article 5, The key points of most enforcement procedure were about public policy according New York Convention article 5, 2, b and New York Convention article 5, 1. Particularly, Judgement of public policy from Supreme Court represented that the recognition and enforcement of foreign arbitral award is to present and protect basic moral conviction and social order from spoiling, and not only domestic situation but also international stability of transaction should be taken into consideration in judging on recognition and enforcement of foreign arbitral award, which is construed under certain limitation. Recently, the oriental medicine industry in Korea has faced much hardship, due to the decreasing number of patients. Therefore, it is essential to investigate the reasons why patients are avoiding oriental medicine, because the percentage of people consuming medical service is an important marker that assesses the value of medical service. The researcher(s), based on theories on factors that affect health, health behaviors, and diseases, sought to find reasons why oriental medicine clinics saw a decline in the number of patients. Also, by proposing the problems inside the oriental medicine, I came to the following conclusion. -Because Koreans have low expectations for oriental medicine, they do not consider it as full medical service. Also, when they get sick, they are reluctant to seek oriental medicine because of reasons such as the limits of oriental medicine and check-ups, expensive medical cost, negative perception of oriental medicine, not enough support from the media, the old image of the oriental medicine and the little power the industry has on the society. -Among the inner problems of the oriental medicine community was the limitations that the science face on incurable and chronic diseases in terms of treatment and management, little professionalism, lack of scientific evidence, the attitude of the oriental medicine society, lack of sophistication in research methodology, and limitations in responding to changes in public health and the surroundings. The purpose of medicine is to eliminate the possibility of shortened life and dangers by treatment of diseases and health maintenance. For this to happen, structural and developed medical theories and means of treatment are necessary. The researcher hypothesizes that the problems that the oriental medicine society is facing mainly come from the lack of efforts and ability to provide such necessities.

어느 지역이든 공공도서관이 생활밀착형 지식정보서비스 기관, 문화향유 및 평생학습 공간으로 자리매김하려면 서비스 대상인구에 대한 인식조사가 선행되어야 한다. 이에 본 연구는 대구 시민을 대상으로 설문조사 방식을 적용하여 공공도서관의 비중과 중요성, 이용실태와 비이용 이유, 독서프로그램 참여 및 비참여 이유, 도서관 확충(신설) 요망지역 등에 대한 인식을 조사 분석하였다. 이를 바탕으로 국내외 관련 연구, 관계법령, 국민 독서실태조사, 전국문화기반 시설 총람, 대구시민 의식조사, 대구 도시브랜드 시민의식 조사, 광역시도 및 대구시 기초자치단체의 공공도서관 현황 등과 비교하여 대구시 공공도서관의 인프라 충실화 및 이용제고 방안을 제시하였다.
