This study was to analyze the trademarks of The Polo Lauren Company in fashion products and its analogous trademarks that have been applied or registered in the Korean Patent Office. The data was collected from the Korean Patent Office and KIPRIS search system was used. Total 468 trademarks applied by the date of September 10, 2003 including 317 registered trademarks of the Polo Lauren Company and 151 its analogous trademarks applied for fashion products, were used for the analysis. The results were follows. (1) Total 73 different types of trademarks of the Polo Lauren Company were registered for 26 product classification. Trademarks were composed of all possible combination of letter, sign and sketch to prevent the registration of its analogous trademark. Also even the same trademarks were registered for each different product classification. Since the early 1990s the extended trademarks for each segments reflecting diverse lifestyles were frequently registered. (2) Total 134 trademarks that had applied for registration were rejected due to its analogousness to the Polo Lauren. Most of them were seem to purposely analogous to mislead and to confuse consumers. The major type was to add one or two words as brand extention to the genuine Polo brand. Next type was minor modification of genuine trademark. The last type was almost same brand names in different product categories. (3) Total 3 trademarks were not permit to register by the objection of the Polo Lauren Company. Total 19 trademarks were permit to register. Those showed low degree of analogousness. However most of these trademarks were cancelled by the lawsuit of the Polo Lauren company.

국민안전처에서 수행하고 있는 소방안전 연구개발사업 주요 내역사업으로는, 화재예방 및 경계기술개발, 특수재난 진압 대응 기술개발, 인명 구조 구급 및 현장대응요원 안전확보 기술개발 등 세개 내역사업으로 구성되어 2007년부터 수행하고 있다. 주요 성과지표로는 (1) 국내외 특허, 실용신안, 디자인(의장) 등 산업재산권 출원/등록 건수 (2) 현장실험, 상용화를 위한 성능기준 확보, 시제품 개발, 소프트웨어 등록, 기술료 발생건수 (3) 수행과제와 관련하여 국내외 학술지에 게재된 연구논문 및 수행과제 결과물을 이용한 정책활용 건수 (4) 연구과제 수행기간 동안 발생된 고용창출 및 인력양성 실적 등으로 구성되어 있다. 본 연구에서는 2012년부터 2014년까지 수행한 소방안전분야 연구개발사업의 특허 성과, 논문 성과, 소프트웨어 등록 성과에 대해 조사 분석하였다.

Objectives : The aim of this study is to analyze the patent trend in Traditional Korean Tea. In this paper, we investigate the diversity of Korean Tea registered as patents focusing on the kinds of medicinal herbs used, processing methods, and types of tea. Methods : We collected patents data using KIPRIS, and WIPS database. We conducted Quantitative Analysis by year and main patentee, and Qualitative Analysis by patent's contents. Results : 313 patents are selected from 2001 to May 2017. The number of patents have been on the rise and reached 44 in 2014. Individuals have registered the most patents, followed by companies, Industry-University Cooperation Foundation, and local autonomous entities. Ginger, Omija and Cactus were used at high frequency among 109 tea containing one medicinal herb. Licorice and Jujube were frequently used among 204 tea containing more than two kinds of medicinal herbs. In classification of patent by efficacy, 'health promotion and function recovery' and 'treatment and prevention of diseases' are most frequently specified. 128 patents are presenting processing methods for medicinal herbs in the order of roasting, fermentation, and fumigation. Among 164 patents presenting tea types, liquid type accounts for more than half and there are 67 leached tea, and 32 powder tea. Conclusion : The analyses results showed that lots of new recipes, efficacy, processing methods and tea types are being studied and registered as patents. In order to help Traditional Korean Tea industry to develop, active patent registration and further study about up-to-date patent trend would be required.

본 논문에서는 ICT(Information and Communications Technology) 산업 관련 기술을 주제로 경상북도의 특허출원 동향과 특허맵 중 하나인 특허 포트폴리오 분석을 적용하여 ICT 기술의 향후 방향을 살펴본 연구이다. 이에 본 연구는 경북지역 ICT 산업의 기술 동향 및 기술개발 실태를 특허정보를 통해 살펴보고, 특허 포트폴리오 분석을 통한 지역 ICT 산업의 기술방향 정도를 가늠하여, 연구개발전략 수립에 활용되는 것을 그 목적으로 한다. 경상북도에서 출원된 특허를 대상으로 국제특허분류(IPC: International Patent Classification) 별 기술동향 파악을 하였고 향후 미래유망기술 도출에 대해 분석하였다. 동향파악을 위해서는 ICT 분류코드에 의거하여 각 부문별로 출원된 특허에 대해 분석하였다. 그 결과 경상북도의 특허 출원 동향과 기술별 점유율 및 구간별 특허활동 현황, ICT 중분류 기술별 특허 출원 동향, ICT 기술시장 성장단계현황, 연구주체별 특허 출원 동향, 연구주체 간 공동연구 현황, 주요 출원인 특허 출원 동향 분석 등의 분석결과를 제시하였다. 또한 유망기술 도출을 통해 경북 ICT산업의 기술적 방향을 살펴보았다. 연구결과를 바탕으로 경북 ICT 산업의 기술 경쟁력 확보에 기여하고자 하였고, 더불어 향후 ICT 산업기술의 지향 방향과 기술정책 전략 수립에 도움이 되고자 하였다.

최근 지식기반경제 구조로의 전환과 함께, 기술이전, 기술사업화와 같은 연구개발 성과의 생산적 활용을 위한 거래가 급격히 늘어남에 따라 특허가치평가의 중요성이 점점 확대되고 있다. 그럼에도 불구하고 국내에서는 거래사례 수집의 어려움으로 실제 사례분석을 통한 결정요인 분석연구는 활발하지 못한 실정이다. 전문가조사법, 비교평가법 등 정성적인 평가기법의 주관적인 결과에 대한 객관성 확보를 위해, 본 연구에서는 평점법에서 적용될 수 있는 정량적인 특허가치 결정요인을 제시하고자 15개의 국내외 특허가치평가 모형을 분석하였다. 이를 통해 공통적으로 중요하다고 판단되는 6개 기술가치 결정요인을 도출하였고, 선행연구를 통해 각각의 결정요인의 대리변수로 활용 가능한 특허정보를 매칭하였다. 또한, 제시된 연구모형이 통계적으로 유의미한 영향을 미치는지 검증하기 위해 공공 및 민간기술거래기관에서 수집된 총 517건의 특허거래사례를 다중 회귀분석을 통해 특허가치를 결정하는 유의미한 특허요인들을 도출하였다. 그 결과 전체산업에서는 특허연계성(인용문헌수) 및 해당 특허기술의 상용화단계 정보들이 기술거래금액에 유의한 영향을 미친다고 분석되었다. 본 연구는 실제 거래사례를 바탕으로 하여 유의미한 특허가치 결정요인을 제시하였다는 데에 그 의의가 있으며, 향후 지속적인 거래사례 수집 및 모니터링을 통해 산업별 연구 결과가 체계적으로 검증된다면, 특허출원 전략 수립 및 연구사업(대표 특허보유) 성과 평가 시 활용할 수 있는 산업별 맞춤 평가모형을 제안할 수 있을 것이다.

The present study was to analyze the trend of registration of design rights in apparel products and tc point out problems of current protection law to design. The research data was total 1,850 design rights in apparel that have been registered to the Korean Patent and Trademark Office from the first design registered in March 1, 1963 through those registered in April 24, 2003. All design rights were analyzed by the year, by the type of product, and by the type of applicant. And also design rights registered under the revised design registration system(without examination) were analyzed by the trait. The results of the study were as follows: (1) Sweater & polo shirts, underpants, and the Korean traditional dress were three major single categories registered in apparel : (2) 54.3% of total design rights in apparel was registered since the legal system of design rights has been revised in March 1, 1998 : (3) Registration by individual applicant were 71.7% of total; (4) About 60% of total design rights were for aesthetic, but in some categories such as vest. brassiere, undershirts, designs for function were more frequently registered than others. And total 68 design rights for the symbol of the organization or uniform, were registered in upper outerwear and pants : (5) As problems of the current legal protection system for designs, the term of “design”(expressed in Korean), double registration of similar designs, malicious intention to register other's trademark as his/her own design. The current legal system for design rights were more used for the product that has relatively long life cycle. And the revised law has been effective in encouraging the registration of design rights. However. the current design law still has some problems to be revised to prevent design rights or trademark infringement.

본 연구는 정부의 대표적인 대형연구개발사업인 21세기 프론티어 연구개발 사업의 성과에 영향을 미치는 요인을 분석하여 향후 대형 연구개발 사업을 추진하는 정부 정책 결정자와 연구단 관계자에게 정책적인 시사점을 주는데 목적이 있다. 기존 대형연구개발사업의 프로그램에 대한 성과분석과 평가는 일부 있었지만, 연구주체, 연구유형, 연구기간, 연구 분야에 따른 성과 특성과 성과에 영향을 미치는 요인을 분석한 연구는 부족한 실정이다. 이를 위해 교육과학기술부가 추진 중인 21세기 프론티어 연구개발 사업단 중 2010년과 2011년 사업단의 연구기간이 종료된 8개 사업단 과제 전체를 대상으로 정책요인별로 가설을 설정하였다. 사업을 수행한 연구주체의 소속(산업체, 대학, 출연연구소)에 따라 연구 성과에 차이가 있는지, 연구유형(기초, 응용, 개발)에 따라 성과에 차이가 있는지, 연구기간에 따라 성과에 차이가 있는지, 연구과제의 기술분야별로 성과에 차이가 있는지 등을 검증하였다. 연구 성과는 대학의 논문 성과가 출연연이나 산업체에 비해 높은 것으로 나타났으며, 산업체는 특허의 국외 출원과 등록이 높은 것으로 나타났다. 개발연구는 국내출원과 등록, 국외출원과 기술이전 계약의 성과가 높은 것으로 나타났으며, 장기간(6년 이상)의 연구가 단기 연구보다 국내출원이 높은 것으로 나타났다. 연구 대상 기술 분야(바이오, 나노, 에너지환경기술)별로도 연구 성과의 차이가 있음을 확인하였다.

본 연구는 노인들이 주로 사용하는 야외운동 기구의 특허 현황을 분석하여 노인들의 건강증진을 위한 기초 자료 활용에 목적이 있다. 특허 검색은 특허청 정보 검색 서비스인 키프리스에서 수집하였다. 검색어는 '야외운동기구'이며, 직접적으로 관련된 특허 157건을 최종 선정하여 분석하였다. 분석 결과 첫째, 시대별 특허 경향은 2007년부터 특허 등록이 시작되었으며, 매년 2-3건의 특허가 등록되었다. 둘째, 발전모듈이 작동하여 전기를 생산할 수 있고, 사용자 운동량에 정보를 제공하거나 특성상 중량추 분실 및 도난과 안전사고 방지 등 무선 통신 이용 운동처방 시스템을 제공하는 스포츠융합 관점의 특허가 조사되었다. 마지막으로 사용자 편의성 제공, 운동기구 사용빈도를 증가시킬 수 있는 운동기구 관련 특허가 조사되었다. 본 연구 결과를 통해 야외운동기구가 점점 노인과 편의성 중심으로 개발된다는 점과 기업 및 공공기관에서 노인 야외운동기구에 관심 확대가 나타나고 있음을 파악하였다. 향후 실용적이고 편리한 야외운동기구 개발을 위하여 특허 추이 분석 이외에 야외 운동기구 활용 운동 프로그램과 연계한 후속적인 연구가 필요하겠다.

과거 산업경제의 기업 경쟁력은 생산력에서 비롯되었다면, 최근에는 무형자산인 특허의 확보력이 기업의 글로벌경제 성공요인의 중요한 조건이 되고 있다. 특히 기술의 변화가 빠르고, 국제적 특허분쟁이 심한 IT산업에서는 국내외 특허의 전략적 확보 및 관리의 중요성이 대두되고 있다. 따라서 본 연구는 코스닥기업 중 하드웨어와 소프트웨어 217개 IT기업들의 특허활동을 양적인 요인인 생산성과 질적인 요인인 효율성 및 고급성으로 구분하고, 기업의 재무성과와의 영향관계를 검증하고 시사점을 도출하였다. 본 연구는 자원기반이론을 기반으로 선행연구를 실시하여 개념적 연구모형과 연구가설을 도출하고, 데이터 자료를 다중회귀모델로 실증 분석하여 다음과 같은 연구결과를 얻었다. 첫째, IT기업의 총자산 증가율에 대해 특허의 효율성과 고급성이 유의한 양(+)의 영향을 미쳤다. 둘째, IT기업의 평균매출 증가율에 대해서는 특허의 세 가지 활동요인 모두 유의한 결과를 가져오지 못했다. 셋째, IT기업의 평균 순이익 증가율에 대해서는 특허의 고급성만이 양(+)의 영향을 가져왔다. 본 연구의 선행연구와의 차별성으로 특허활동을 양적인 요인과 질적인 요인으로 구분하여 재무성과와의 영향관계에 대한 연구를 진행하였고, 실무적 기여도에서는 국제적 특허분쟁이 심각한 IT기업들의 특허활동에 대해 전략적인 방향성을 제시하였다는데 의의가 있다.

This study for the development of water purification Artificial floating island maximizing domestic Artificial floating island patent trends and product development, according to the timing of patent registration was analyzed for trends. In particular, domestic leisure space with a growing population and the need for securing emerging role as a reservoir of water only in the past, who do appeal as a tourist destination or as an ecological space utilized, and accordingly will transform and the need to secure a hydrophilic, degrade water quality problems using this aquatic environment (water acquisition and hydrophilic), the requirements are a big obstacle is the reality factor. This patented product differentiation strategy through the analysis of the development of technology progressiveness (Field Application) in terms of water quality improvement and maintenance side, and the hydrophilic side scenery, ecological restoration aspects, and applicability to the field and taking into account existing technology economic aspects of distinction were presented and advertised a lot in terms of cost compared to other techniques without the use of highly efficient methodology for building a water purification and also appears identity appeal, wetlands, rivers, etc. can be applied broadly technician widespread deployment and installation time to less simple and more are expected to spread.
