This study is intending to look into the status of the hitherto established local governments light pollution control ordinance, and to use the ordinance status as basic data of ordinance enactment related to light pollution in time of its establishment and revision in accordance with regional characteristics of each local government for the time to come. This study conducted this research in a total of 3-phase research methods. 1) This study inquired into the direction of the research plan through the theoretical consideration and analysis of the preceding researches after setting up research objectives according to research background and purpose. 2) Targeting 11 local governments which are enforcing the hitherto established ordinance, this study surveyed the status of the light pollution control ordinance. 3) This study carried out the contents analysis of the ordinance in the method of doing a comparative analysis of each provision of the ordinance according to local governments. It's hoped that on the basis of this research, local governments across the nation, which have not yet established the same ordinance, could minimize the damage to natural eco-system due to artificial lighting by promoting the urgent ordinance establishment suited for each region, and create human-oriented light environment by modifying various disorderly lighting environment.

This study conducted a comparative analysis on ordinances on landscape composition by local governments, which are a part of the policy to activate landscape composition, by examining the cases of Korea and Japan. For the purpose of specialized landscape compositions according to the own characteristics of Korean local governments, this study suggests factors to consider on the enactment of ordinance on landscape composition as follows. First, in order to compose landscape with an unique figure of the local government, it is required to collect and analyze informations about the local landscape, to provide consistent programs of education and publicity related to the landscape composition and to encourage the involvement of local citizens and reward it. Second, the construction of the ordinance needs to build a plan of landscape composition for each district focused on the landscape composition, to introduce a system which enables self-designation of an ordinance, to establish a detailed guidance, to assign the duty to keep the guidance and regulate punishment in case of a violation of the guidance. It could be done by completing the common or basic elements on the construction of the ordinance on landscape composition.

기초자치단체에서 제정하여 운영하고 있는 도서관 관련조례는 모두 321개로 조사되었다. 그중에서 도서관운영조례가 185건(57.6%)으로 가장 많고, 작은도서관조례가 54건(16.8%), 새마을이동도서관조례 24건(7.5%), 독서진흥조례 29건(9.0%), 기타 관련조례 29건(9.0%) 등의 순이었다. 도서관조례는 지방자치제도가 본격화된 1996년 이후 제정되어, 해마다 지속적으로 증가하고 있다. 새마을이동도서관조례는 1990년대에 주로 제정되었고, 작은도서관조례와 독서진흥조례는 2009년 이후 급속히 증가하고 있다. 도서관조례는 사업의 목적을 분명히 하기 위해 도서관이란 명칭이 반드시 포함되는 것이 필요하다. 장차 도서관조례는 공공도서관, 작은도서관, 새마을이동도서관, 독서진흥 등 유사분야 조례를 통합하는 방식으로 정비되는 것이 바람직하다.

Purpose: In Seongnam City, a number of festivals are held in various areas, led by the city and private organizations. The necessity of developing a representative festival of Seongnam City, which can enhance the brand value of Seongnam, a cultural city, and promote a sense of local community and economic effects, is emerging. The purpose of this study is to analyze festival-related ordinances of Gyeonggi-do local governments, and to derive implications necessary for the development of festival support ordinances representing Seongnam City. Research design, data, and methodology: This study used the database of National Legal Information Center of the Ministry of Legislation and the autonomous legal information system to thoroughly investigate the ordinances related to festival support of basic local governments in Gyeonggi-do and the whole country. To do this, descriptive statistics analysis was conducted. Results: As a result of the study, it was found that 168 organizations (68.6%) of 245 local governments nationwide have adopted the festival support ordinance, and there are a total of 231 ordinances. In the case of basic organizations, out of 228 basic organizations, 151 organizations, including Seongnam City, adopted the ordinance on festival support, showing an adoption rate of about 66%. As a result of analyzing the basic organizations that enacted representative festival related ordinances among Gyeonggi-do basic organizations, 9 out of 28 cities adopted 16 representative festival ordinances, based on the legal and institutional basis for supporting representative festivals. Conclusions: In the case of Seongnam City, it is believed that in order to develop a representative festival, an ordinance to support the representative festival must be established. Considerations regarding the composition of the ordinance for the representative festival were discussed.

본 연구는 전국 245개 광역 및 기초자치단체가 제정하여 운영하고 있는 도서관 자치법규를 전수 조사하여 분석하였다. 연구의 분석결과를 통하여 자치법규 제정현황을 점검하고, 도서관 설치 및 운영을 뒷받침하는 법제적 근거로 작용할 수 있는 자치법규 제정의 개선방안을 제시하고자 한다. 조사결과 우리나라 245개 광역 및 기초자치단체가 운영 중인 도서관 자치법규는 조례가 393건, 규칙이 187건, 훈령(규정)이 43건, 예규(지침)가 6건으로 모두 629건으로 조사되었다. 또한 도서관 관련 자치법규가 전무한 지방자치단체는 32개이며, 도서관운영 조례가 없는 지자체는 40개, 작은도서관 운영조례가 없는 지자체는 144개, 독서문화진흥조례가 없는 지자체는 196개에 이르고 있는 것으로 조사되었다. 본 연구결과는 향후 우리나라 지방자치단체에서 도서관 자치법규 제정의 기초자료로 활용할 수 있을 것이다.

본 연구는 발달장애인 권리보장 및 지원에 관한 법률과 이를 모법으로 하는 지방자치단체의 유사 조례간 연계성(일치성) 및 자치성(차별성)을 분석하였다. 2017년 10월 기준으로 조회된 전국 63개의 지자체 조례와 발달장애인법을 분석 대상으로 하여 모법의 조항별 내용을 기준으로 조례와의 일치성을 분석하였고 자치성은 조례의 내용적 측면에서 모법과 다른 사례가 있는지 행정적 측면에서 이행 의지를 보다 강조한 사례가 있는지 내용분석으로 시행하였다. 분석 결과 첫째, 모법의 조례 반영률은 조항별로 다르게 나타났는데, 복지지원을 강조하는 측면에서 일치율이 높았고 발달장애인의 권리 보장은 조례상 반영률이 낮았다. 이는 발달장애인을 보호적 관점에서 보는 법적 제도적 특징을 보이는 증거로 볼 수 있다. 향후에는 발달장애인 당사자의 의사결정에 대한 존중이나 권리보장에 관한 내용이 조례에 적극적으로 포함될 수 있도록 하는 정책방안이 필요하다. 둘째, 조례 반영률이 0%인 조항도 있었는데, 해당 지역에서 타법에 의해 보장될 수도 있기에 지역 내 관련 제도의 부재를 의미하지는 않으나 제도적 사각지대의 가능성이 있다. 향후에는 발달장애인 관련 지역 내 여타 법제도와의 상보성에 관한 검토가 이루어져 제도적 사각지대에 발달장애인이 놓이지 않도록 해야 할 것이다. 셋째, 지역의 자치성이 내용적 측면 및 실질적 이행을 돕는 행정적 측면에서 검토되었다. 단체장의 책무를 강조하거나 실태조사를 강조하거나 복지위원회 운영을 명시하거나 모법상에 없는 내용을 추가적으로 조례에서 담아내고 있기도 했다. 향후 조례제정을 고려하는 지자체는 이와 같은 사례를 참고하여 지방자치의 특성을 살린 지역 밀착적인 실현가능한 조례를 제정할 필요가 있다.

본 연구는 지방자치단체 조례분석을 통해 장애인생산품 우선구매 활성화방향을 제시하는데 목적이 있으며, 2015년 7월 현재 지방자치단체가 제정 또는 입법예고한 조례 44건을 조례의 각 항목을 분석하였다. 분석결과를 살펴보면 첫째, 전국 지자체 중 44개 지자체에만 조례가 제정되어(18.1%) 더 많은 지자체의 조례제정이 필요하다. 둘째, 조례의 구성내용 분석결과 조례의 목적 및 적용대상기관, 이행계획, 구매 협조 요청, 구매촉진 의무는 대부분의 지방차지단체에서 제시되고 있었다. 반면에 그 외 항목은 명시되지 않은 곳이 많았고 특히, 지자체장의 책무는 30개만 명시되어(68.1%) 있었다. 셋째, 상위 법령 위반(불일치) 조항이 있었다. 넷째, 이행계획 수립을 위한 위원회 설치에 관한 조항은 한 곳도 명시되지 않았다. 우선구매 확대를 위해 계획단계에서부터 학계, 현장, 장애인당사자가 포함된 위원회 설치의 검토가 필요하다. 다섯째, 적극적인 우선구매를 위한 조례 항목의 신설이 필요하며, 효과적인 생산 유통 판매 기반마련을 위한 규정이 필요하다. 마지막으로, 중앙정부가 지자체의 장애인생산품 우선구매 관련 조례와 실적 등을 모니터링하고 이를 개선해 나가기 위한 노력이 요구된다.

본 연구는 노인일자리 지원조례의 형식과 내용을 분석하여 해당 조례가 형식적 타당성과 실효성을 갖고 있는지를 확인하는데 목적이 있다. 이를 위해 서울특별시 내 자치구의 조례 13건을 분석대상으로 선정하여 각 조례의 내용과 구성을 분석하였다. 분석결과 조례의 제정목적과 사업내용 등 주요한 형식구성에는 큰 차이가 발견되지 않았다. 그러나 정책 적용대상 범위와 전달체계 관련 조항 유무에는 각 조례별 차이가 확인되었다. 특히 서비스에 대한 주민의 권리는 모든 조례에서 존재하지 않았으며 노인일자리 제공에 대한 자치단체장의 의무는 그 구체성이 부족하여 개선이 필요하였다. 실효성 측면에서는 전달체계 관련 조항이 없거나 규정의 강행적 성격이 부족하였으며 위원회 구성과 권리구제 관련 조항은 전반적으로 존재하지 않았다. 본 연구에서는 이 같은 분석을 기반으로 조례의 개선 보완 방향을 제안하였다.

이 연구는 우리나라 지방자치단체의 자치법규인 독서문화진흥을 위한 조례의 제정과 시행에 대한 현황과 내용을 조사 분석한 후 조례와 규칙의 운영에 대한 효율적인 개선방안을 제시하는데 있다. 이를 위해 문헌고찰과 관련 조례를 조사 분석하였다. 연구의 결과는 1) 전국 245개 광역 및 기초자치단체가 운영 중인 독서관련 자치법규는 조례가 77건, 규칙이 7건으로 나타났다. 2) 지자체와 교육지자체의 조례와 규칙명칭이 다양하게 나타나고 있다. 3) 조례와 규칙의 명칭에 따라 내용의 구성요소가 다양하게 나타나고 있으며, 같은 조례 규칙의 명칭을 부여하고 있음에도 서로 다른 구성요소를 가지고 있다. 4) 현재까지 폐지된 지자체 독서관련 자치법규는 조례 10건, 훈령 2건으로 나타났다. 이에 독서문화진흥정책의 활성화를 위한 방안을 제시하면 1) 독서진흥정책 홍보를 통한 인지도를 개선해야 한다. 2) 지자체의 독서진흥의 환경을 고려한 최적의 자치법규 조례명칭을 부여해야 하며, 조례 규칙의 내용은 통일성을 가져야 한다. 3) 조례는 폐지하기에 앞서 폐지 후 나타난 문제점을 면밀히 살펴본 후, 주민들이나 전문가들의 의견을 충분히 수렴한 후 대체 자치법규를 제정하여야 한다.

Purpose - The purpose of this study is to compare and analyze the ordinances of other local governments to propose implications and improvement plans for the ordinances of Chuncheon City. To this end, cases of overseas legislation related to youth labor rights, domestic laws and major policies of the central government were reviewed. Design/methodology/approach - This study mainly utilized literature research methods. In addition, it was based on foreign laws and case analysis, domestic laws and ordinances, and preceding research and data related to government policies. Findings - Chuncheon city ordinances are superior to those of other local governments. However, the details of the establishment of the implementation plan, the actual condition survey, and the establishment of the consultation system are included in the project contents of Article 6, so it is not concrete and clear. And there were no articles related to the labor environment check. Research implications or Originality - It is proposed to make the contents of the establishment of an implementation plan, survey, and consultation system as independent provisions. It is also proposed to establish a new article related to the youth labor environment check. In addition, it is desirable to establish detailed regulations by establishing the ordinance enforcement regulations.
