A study on the duties of an issuing bank and a negotiating bank and proper law issues with the documentary credit (신용장거래에서 개설은행과 매입은행의 주의의무와 준거법 -대법원 2011. 1. 27. 선고 2009다10249 판결의 평석을 중심으로-)

  • Even though there are some discrepancies in detail with the legal characteristic of the issuing bank's notice to the beneficiary of opening of the letter of credit, article 25 of "the Korean Private International Act(hereunder, 'KPIA')" can be applied to the legal relation between the issuing bank and the beneficiary or the negotiating bank. According to article 26 of the KPIA, if there is no agreement between the issuing bank and its opponent party as to the governing law issues, a state's law which has the closest relationship with the subject case may be applied. In the latter case, given the facts that the issuing bank plays important roles in every phasis of the sale of goods by the letter of credit, a law of place where the issuing bank's business premises is situated(the $lex$ $situs$) can be the applicable law. Meanwhile, "the Korean Supreme Court(hereunder 'KSC')" held that the beneficiary or the negotiating bank can claim any damages arising due to the refusal or deferred payment of the issuing bank, and the law which governs the above mentioned situation is the same law that is applicable to the legal relation between the issuing bank and the beneficiary or the negotiating bank. The main reason of the KSC's ruling is that the nature of the legitimate interest rate which is stated in article 3 of "the Act on Special Cases concerning Expedition etc. of Legal Proceeding(hereunder 'ASCELP')" is substantial matters, not procedural. Taking into account, however, that the main object of ASCELP lies in expedition of legal proceeding, prompt realization of people's rights and duties, and prevention of delayed legal proceeding, it is recommendable that ASCELP, instead of the law applicable to the legal relation between the issuing bank and the beneficiary or the negotiating bank, should be applied to the cases in which the malicious debtor's only and main purpose is delaying the legal proceedings. On the other hand, even if the issuing bank's duty of examination of the documents which were tendered by the beneficiary or the negotiating bank is restricted to the formality and strict conformity of the documents and not the substantiality of the documents, the issuing bank still has to examine the documents with due diligence that is required to the banks whose main business is sales of documents, not the real goods. In this regard, under the circumstances where the document lacked the regularity and/or the formality on its face because of the forgery of the document and where it was expected that an ordinary banker might have easily found any faults with the document, the issuing bank must compensate any parties for damages when it pays money without due diligence as a banker who engaged in the sales of documents.

The Effects of Financial and non-Financial Factors on the Formation of Main Bank Relations of Parts and Material Industry in Pusan-Kyungnam Region (기업의 재무적 및 비재무적 특성이 주거래은행관계 형성에 미치는 영향을 : 동남경제권 부품소재산업을 중심으로)

  • The purpose of this paper is to analyse the effects of a firm's financial and non-financial factors on the relationship formation with its main bank in the industry of parts and material in Pusan-Kyungnam region. The results, out of accordance with the relation-banking or regional financial market perspective, do not support the hypothesis that regional financial institutions would be useful for decreasing the financial difficulties of the small and medium firms in the region. The analyses about the effects of non-financial factors on the formation of main bank relations show that while Kookmin Bank and Industrial Bank play important roles as main banks of small businesses other national banks put emphasis on the transaction lending. And the analyses about the effects of financial factors show that firms having main bank relations with non-bank financial institutions and Kookmin bank are more profitable and stable than firms having main bank relations with other banks including local banks. On the whole it seems that local banks are not making a commitment to the regional economy and their operational grounds are not strong enough.

Internal Company Factors as Determining Variables for Improving Bank Lending

  • This study seeks to examine the main factors, external and internal to the bank, that enhance bank lending. Bank lending is one of the connecting bridges in sustaining society. Internal factors consist of ROA, DPK, and CAR. External factors are economic growth and interest rate of Bank Indonesia. The population of this research consists of traditional commercial banks listed on the IDX over the 2014-2017 period. Samples were chosen by purposive sampling method. This study uses secondary data with 56 samples; data analysis uses multiple linear regression. The findings of the study show that internal factors have a greater impact on increasing bank lending than external factors. The main variable among internal factors that influences increase in bank lending is ROA. DPK is the internal factor with the smallest impact on increasing bank lending. The implication of the study is that determining the bank lending should take more account of CAR, DPK, ROA, BI interest rates, and economic growth in making decisions about the amount of lending. These variables can only have a slight effect on increasing lending, though. Besides, internal factors such as NPL, LDR or non-economic factors also need to be considered in channeling bank credit.

  • There were three banks that had the head office in Busan since 1912, Gyong-Nam Bank, Dong-Rae Bank and Busan Commercial Bank. This article tries to catch hold of the characteristics of the establishment and management, and the merging process of three banks. The main stockholders and managers made use of the money of the banks for the enterprises that they operated. Gyong-Nam Bank was combined with Dae-Gu Bank in 1928 to be Dae-Gu Commercial & Industrial Bank. The revised bank ordinance of 1928 regulated that the head office banks had to meet the requirement of the paid-in capital, 2 million yen. Not meeting such an excessive requirement, Dong-Rae Bank was amalgamated to Ho-Nam Bank of Gwang-Ju in 1933. Busan Commercial Bank was absorbed in Cho-Sun Commercial Bank in 1935 because it couldn't get back huge loan from a company which belonged to its three main stockholders. Japanese were already the main stockholders of Cho-Sun Commercial Bank from the beginning of 1920s. The banking agencies were not able to deal with the economic fluctuations effectively, and didn't have any economic organization in support of their profit. Cho-Sun Government-General forced the head office banks to be merged to control the colonial economy.

Customer Communication Strategy for Islamic Banks

  • Purpose - The main goals of this study are (1) to study the information sources used the most by customers of Islamic banks; and (2) to compare this with conventional bank customers. Research design, data, and methodology - 125 Islamic bank customers and 125 conventional bank customers were surveyed. The study employed two independent sample tests. Additionally, an exploratory study was conducted to support the quantitative analysis. Result - The results show that Islamic bank customers use personal as well as marketing information sources more intensely than conventional bank customers, although the result differences were not significant. Specifically, customers of Islamic banks use certain personal resources (parents and friends) and marketing information (marketers)intensely than conventional bank customers. Conclusion - The study revealed that friends and parents are the most important information sources for the selection of the Islamic bank. In addition, based on the resources used, Islamic banking customers can be classified as traditional and religious communities. Therefore, the most effective customer communications will be through Islamic groups such as Islamic social institutions and Islamic educational institutions.

  • Bank Guarantee system is commonly used as useful financial instruments to support various overseas and domestic business activities by providing bank guarantees. Therefore, it will be able to develop as a useful socio-economic useful system. However, some procedural problem can arise from the processes under demands for payment. Therefore, it is very important to review the requirements of the demand for payment and compliance standard for the examination of a presentation under the guarantee system. It is necessary to examine main issues under the revised URDG 758. The URDG introduced the same examination principle of "need not be identical to, but shall not conflict with' as that of UCP 600. The main changes of the URDG 758 like this imply the mitigation of the compliance standard for examination. So, This paper is to provide a comparative study of the regulations and laws for the examination standard and propose their implications and practical notes under bank guarantee system. For this purpose, this study will be examined the practical and legal issues focusing on the relative regulations of the revision URDG 758. It will also be reviewed and compared with the URDG, ISP98, UCP 600 and so on.

The Study on Entering Indian Banking Industry Based on Data Envelopment Analysis (금융서비스산업에 대한 소고 -한.인도 은행 효율성 분석)

  • The objective of this study is to find out whether Korean main banks may have efficiency against Indian major banks. For this purpose, DEA analysis is used for checking relative efficiency levels. The study proposes, as a result, Shinhan bank, Woori bank and Kookmin bank in Korea may consider entering into Indian banking industry because these three banks have relative efficiency against main Indian banks like Yes bank, ICICI bank. The results of the study comply with actual facts since Shinhan bank already came to Indian banking market at first. Shinhan bank have three branches like Mumbai, NewDelhi etc. Wooribank also entered into India in 2012 as second case among Korean banks. But Kookmin bank did not come to India yet so they should consider coming to India. As a preliminary measures, they can send one person as a expatriate to survey the Indian banking industry like KDB in Korea. If they can utilize their core competence in real estate field at India, they may positively think about entering into India as quickly as possible. Although many Korean firms have penetrated into Indian market recently, they almost belong to manufacturing sectors so Korean service firms like banks should consider more coming to India because the most hot sector for FDI in India remain service sector and many foreign service firms already rush to Indian market. If Korean service firms like banks delay FDI further, good market opportunities would not be there any more. DEA analysis can be one of tools to check investment feasibilities. Since India becomes a compulsory subject for most of Korean firms, to increase possibilities of success in India, such Korean banks may consider applying fast-mover investment strategies to the Indian business fields.

  • Riparian vegetation distribution patterns and diversity relative to various fluvial geomorphic channel patterns, stream bank stabilization methods, and stream flow processes are described and interpreted for selected nature-friendly small stream bank protection of Goesan, central Korea. Idong Stream Pilot Project, which began in May 2003 and finished in December 2003, was selected to develop effective methods which was nature-friendly stream bank protection. The project aim to maintain or increase stream bank stabilization ecosystem goods and services while protecting downstream and stream bank ecosystem. A number of protecting methods which were a Flight of fieldstone, Vegetation block, Green river block, Stone net, Green environment block, Eco friendly cobble, Vegetation mat and Geo-green cell and Firefly block were applied on the bank of Idong stream. The stream sites have been monitored about vegetation conditions each method in 2007. We selected six points to separately investigate in left and right bank. The main purpose of this study was to find out suitable methods and to improve stream restoration techniques for ecosystem. On the stream bank, H environment block method (9.7) was the highest average of vegetation coverage and Firefly block method (3.87) was the lowest average in applied methods.
