말기암 환자와 가족의 의료 및 간호 서비스 요구 (The Study on the Medical and Nursing Service Needs of the Terminal Cancer Patients and Their Caregivers)

  • In this study, we attempted to investigate the needs and problems of the terminal cancer patients and their family caregivers to provide them with nursing information to improve their quality of life and prepare for a peaceful death. Data was collected from August 1, 1995 to July 31, 1996 at the internal medicine unit of S hospital in Seoul area with the two groups of participants who were family members of terminal cancer patients seventy four of them were in-patients and 34 were out-patients who were discharged from the same hospital for home care. The research tool used in this study has been developed by selecting the questionnaires from various references, modifying them for our purpose and refining them based on the results of preliminary study. While general background information about the patients was obtained by reviewing their medical records, all other information was collected by interviewing the primary family caregivers of the patients using the questionnaire. The data collected were analyzed with the SPSS PC/sup +/ program. The results of this study are summarized as follows ; 1) Most frequently complained symptoms of the terminal cancer patients were in the order of pain(87%), weakness(86.1%), anorexia(83.3%) and fatigue (80.6%). 2) Main therapies for the terminal cancer patients were pain control (58.3%), hyperalimentation(47.2%) and antibiotics(21.3%). 3) Special medical devices that terminal cancer patients used most were oxygen device (11.1%), and feeding tube(5.6%). Other devices were used by less than 5% of the patients. 4) The mobility of 70.4% of the patients was worse than ECOG 3 level, they had to stay in bed more than 50% of a day. 5) Patients wanted their medical staffs to help relieve pain(45.4%), various physical symptoms(29.6%), and problems associated with their emotion(11.1%). 6) 16.7% of the family caregivers hoped for full recovery of the patients, refusing to admit the status of the patients. Also, 37% wished for the extension of the patient's life at least for 6 months. 7) Only 38.9% of the family members was preparing for the patient's funeral. 8) 45.4% of family caregivers prefer hospital as the place for the patient's death, 39.8% their own home, and 14.8% undetermined. 9) Caregivers of the patients were mostly close family members, i.e., spouse(62%), and sons and daughters or daughter-in-laws(21.3%). 10) 43.5% of the family caregivers were aware of hospice care. 46.8% of them learned about the hospice care from the mass media, 27.7% from health professionals, and the rest from books and other sources. 11) Caregivers were asked about the most difficult problems they encounter in home care, 41 of them pointed out the lack of health professionals they can contact, counsel and get help from in case of emergency, 17 identified the difficulty of finding appropriate transportation to hospital, and 13 stated the difficulty of admission in hospital as needed. 12) 93.6% of family caregivers demanded 24-hour hot line, 80% the visiting nurses and doctors, and 69.4% the volunteer's help. The above results indicate that terminal patients and their family caregivers demand help from qualified health professionals whenever necessary. Hospice care system led by well-trained medical and nursing staffs is one of the viable answers for such demands.

제 1, 2회 학생 과학 공동탐구 토론대회의 종합적 평가 (Summative Evaluation of 1993, 1994 Discussion Contest of Scientific Investigation)

  • The first and the second "Discussion Contest of Scientific Investigation" was evaluated in this study. This contest was a part of 'Korean Youth Science Festival' held in 1993 and 1994. The evaluation was based on the data collected from the middle school students of final teams, their teachers, a large number of middle school students and college students who were audience of the final competition. Questionnaires, interviews, reports of final teams, and video tape of final competition were used to collect data. The study focussed on three research questions. The first was about the preparation and the research process of students of final teams. The second was about the format and the proceeding of the Contest. The third was whether participating the Contest was useful experience for the students and the teachers of the final teams. The first area, the preparation and the research process of students, were investigated in three aspects. One was the level of cooperation, participation, support and the role of teachers. The second was the information search and experiment, and the third was the report writing. The students of the final teams from both years, had positive opinion about the cooperation, students' active involvement, and support from family and school. Students considered their teachers to be a guide or a counsellor, showing their level of active participation. On the other hand, the interview of 1993 participants showed that there were times that teachers took strong leading role. Therefore one can conclude that students took active roles most of the time while the room for improvement still exists. To search the information they need during the period of the preparation, student visited various places such as libraries, bookstores, universities, and research institutes. Their search was not limited to reading the books, although the books were primary source of information. Students also learned how to organize the information they found and considered leaning of organizing skill useful and fun. Variety of experiments was an important part of preparation and students had positive opinion about it. Understanding related theory was considered most difficult and important, while designing and building proper equipments was considered difficult but not important. This reflects the students' school experience where the equipments were all set in advance and students were asked to confirm the theories presented in the previous class hours. About the reports recording the research process, students recognize the importance and the necessity of the report but had difficulty in writing it. Their reports showed tendency to list everything they did without clear connection to the problem to be solved. Most of the reports did not record the references and some of them confused report writing with story telling. Therefore most of them need training in writing the reports. It is also desirable to describe the process of student learning when theory or mathematics that are beyond the level of middle school curriculum were used because it is part of their investigation. The second area of evaluation was about the format and the proceeding of the Contest, the problems given to students, and the process of student discussion. The format of the Contests, which consisted of four parts, presentation, refutation, debate and review, received good evaluation from students because it made students think more and gave more difficult time but was meaningful and helped to remember longer time according to students. On the other hand, students said the time given to each part of the contest was too short. The problems given to students were short and open ended to stimulate students' imagination and to offer various possible routes to the solution. This type of problem was very unfamiliar and gave a lot of difficulty to students. Student had positive opinion about the research process they experienced but did not recognize the fact that such a process was possible because of the oneness of the task. The level of the problems was rated as too difficult by teachers and college students but as appropriate by the middle school students in audience and participating students. This suggests that it is possible for student to convert the problems to be challengeable and intellectually satisfactory appropriate for their level of understanding even when the problems were difficult for middle school students. During the process of student discussion, a few problems were observed. Some problems were related to the technics of the discussion, such as inappropriate behavior for the role he/she was taking, mismatching answers to the questions. Some problems were related to thinking. For example, students thinking was off balanced toward deductive reasoning, and reasoning based on experimental data was weak. The last area of evaluation was the effect of the Contest. It was measured through the change of the attitude toward science and science classes, and willingness to attend the next Contest. According to the result of the questionnaire, no meaningful change in attitude was observed. However, through the interview several students were observed to have significant positive change in attitude while no student with negative change was observed. Most of the students participated in Contest said they would participate again or recommend their friend to participate. Most of the teachers agreed that the Contest should continue and they would recommend their colleagues or students to participate. As described above, the "Discussion Contest of Scientific Investigation", which was developed and tried as a new science contest, had positive response from participating students and teachers, and the audience. Two among the list of results especially demonstrated that the goal of the Contest, "active and cooperative science learning experience", was reached. One is the fact that students recognized the experience of cooperation, discussion, information search, variety of experiments to be fun and valuable. The other is the fact that the students recognized the format of the contest consisting of presentation, refutation, discussion and review, required more thinking and was challenging, but was more meaningful. Despite a few problems such as, unfamiliarity with the technics of discussion, weakness in inductive and/or experiment based reasoning, and difficulty in report writing, The Contest demonstrated the possibility of new science learning environment and science contest by offering the chance to challenge open tasks by utilizing student science knowledge and ability to inquire and to discuss rationally and critically with other students.

뉴스기사를 이용한 소비자의 경기심리지수 생성 (Construction of Consumer Confidence index based on Sentiment analysis using News articles)

  • 경제주체들의 경기상황에 대한 판단 및 전망은 경기변동에 영향을 미치므로 경기심리지수와 거시경제지표들 간에는 밀접한 관련성을 나타내는 것으로 알려져 있다. 경기선행지표로 국내에서 많이 사용되는 경기심리지수에는 소비자동향조사, 기업경기조사, 경제심리지수가 있다. 그러나 설문조사를 통해 생성된 지수는 자료의 성격상 속보성이 떨어지는 문제가 있다. 본 연구에서는 이러한 정형데이터의 한계를 보완할 수 있도록 비정형데이터에서 정보를 추출해 경기심리지수를 생성하고, 경제분석에서의 활용 가능성을 검토하였다. 민간소비와 관련된 실물지표에는 소매판매업지수와 서비스업생산지수를 사용하였고, 고용지표에는 고용률과 실업률을, 가격지표에는 소비자물가상승률과 가계의 대출금리를 사용하여 지표들 간의 추이 분석 및 시차구조 파악을 위한 교차상관분석을 수행하였다. 마지막으로 이들 지표들에 대한 예측 가능성을 점검하였다. 분석결과, 다른 지표들의 선행지수로 많이 사용되는 소비자심리지수와 비교해 선택 지표들과 높은 상관관계를 보이며, 1~2개월 선행한 것으로 나타났다. 예측력 또한 향상되어 텍스트데이터에서 생성한 소비자 경기심리지수의 유용성이 확인되었다. 온라인에서 생성되는 뉴스기사나 소셜 SNS 등의 텍스트 데이터는 속보성이 뛰어나고, 커버리지가 넓어 특정 경제적 이슈가 발생할 경우 이것이 경제에 미치는 영향을 빠르게 파악할 수 있다는 점에서 경기판단지표로써의 잠재적 가능성이 클 것으로 보인다. 경제분석에서 비정형데이터를 활용한 국내연구는 초기 단계지만 데이터의 유용성이 확인되면 그 활용도가 크게 높아질 것으로 기대한다.

시스템 설계전제의 변화와 공공부문 과학기술발전관리시스템 구조의 개혁 (The Changes of System Design Premises and the Structural Reforms of Korean Government S&T Development Management System)

  • The objective of this paper is to think about what structural reforms of the Korean government S&T development management system might be. Korean society is currently experiencing a drastic socio-economic transformation. The results of this transformation should be reflected on the determining process of the directions and breadths of structural reforms of government S&T development management system. Because the government system design will be based on the premises of socio-economic conditions under which administrative activities perform and also this socio-economic changes can influence on changes of the premises of government management system design. Moreover, S&T development management system is a subsystem of government system so that the directions of structural reform of those subsystems should be considered in the broad framework changes in the development management system of the government. For the last forty years, the Korean government S&T development management system has been based on the premises including transformation from an agrarian society to an industrial society, authoritarianism and centrally controlled institutions, and exteremely small portions of private investments for science and thechonology R & D of the total. Recently, however, the premises of Korean government S&T development management system have rapidly changed. the characteristics of these changes are including tranformation from an industrial society to a knowledge and information intensive society, globalization, localization, and relatively large portion of private investments for science and technology R & C of the total. The basis of government reforms in Korea was the realization of the performances and values through the enhancement of national competitive capacity, attainment of lean government, decentralization and autonomy. However, the Korean government has attached a symbolic value of strategic organizations representing strong policy intentions of government for the science and technology based development. Most problems associated with the Korean government S&T development management system have grown worse during 1990s. Many people perceive that considerable part of this problem was generated because the government could not properly adapt itself to new administrative environment and the paradigm shift in its role. First of all, the Korean government S&T development management system as a whole failed to develop an integrated vision under which processes in formulating science and thechology development goals and developing consistent government plans concerning science and technology development are guided. Second, most of the local governments have little organizational capacity and manpowers to handle localized activities to promote science and technology in their regions. Third, the measure to coordinate and set priorities to invest resources for the development of science and technology was not effective. Fourth, the Most has been losing its reputation as the symbol of ideological commitment of the top policy maker to promote science and technology. Various ideas to reform government S&T development management system have been suggested recently. Most frequently cited ideas are as follow : (ⅰ)strengthen the functions of MoST by supplementing the strong incentive and regulatory measures; (ⅱ)create a new Ministry of Education, Science & Technology and Research by merging the Ministry of Education and the MoST; (ⅲ)create a new Ministry of Science & Technology and Industry ; and(ⅳ)create a National Science and Technology Policy Council under the chairmanship of the President. Four alternatives suggested have been widely discussed among the interested parties and they each have merits as well as weaknesses. The first alternative could be seen as an alternative which cannot resolve current conflicts among various ministries concerning priority setting and resource allocation. However, this alternatives can be seen as a way of showing the top policymaker's strong intention to emphasize science and technology based development. Second alternative is giving a strategic to emphasize on the training and supplying qualified manpower to meet knowledge and information intensive future society. This alternative is considered to be consistent with the new administrative paradigm emphasizing lean government and decentralization. However, opponents are worrying about the linkages and cooperative research between university and industry could be weakening. The third alternative has been adopted mostly in nations which have strong basic science research but weak industrial innovation traditions. Main weakness of this alternative for Korea is that Korean science and technology development system has no strong basic science and technology research traditions. The fourth alternative is consistent with new administrative paradigms and government reform bases. However, opponents to this alternative are worried that the intensive development of science and technology because of Korea's low potential research capabilities in science and technology development. Considerning the present Korean socio-economic situation which demands highly qualified human resources and development strategies which emphasizes the accumulations of knowledge-based stocks, I would like to suggest the route of creating a new Ministry of Education, Science & Technology and Research by intergrating education administration functions and science & technology development function into one ministry.

한국수산업의 해외진출전략에 관한 연구 (Foreign Entry Strategies for Korean Fishery Firms)

  • Fishery resources are still abundant compared with other resources and the possibility of exploitation is probably great. The Korean fishery industry has grown remarkably since 1957, and Korea is ranked as one of the major fishery countries. Its of fishery products reached the 9th in the world and the value of exports was 5th in 1982. But recently a growth rate has slowed down, due to the enlargement of territorial seas by the declaration of the 200 mile, Exclusive Economic Zone, the tendency to develop fishery resources strate-gically in international bargaining, the change in function of the international organizations, the expansion of regulated waters, the illegal arrest of our fishing boats, the rapid rise in oil prices, and the fall in fish prices, the development of fishery resources as a symbol of nationalism, the fishing boats decreptitude, the rise of crew wages, regulations on fishing methods, fish species, fishing season, size of fish, and mesh size, fishing quotas and the demand of excessive fishing royalties. Besides the the obligation of coastal countries, employing crews of their host countries is also an example of the change in the international environment which causes the aggravation of foreign profit of fishing firms. To ameliorate the situation, our Korean fishery firms must prepare efficient plans and study systematically to internationalize themselves because such existing methods as conventional fishing entry and licence fishing entry are likely to be unable to cope with international environmental change. Thus, after the systematic analysis of the problem, some new combined alternatives might be proposed. These are some of the new schemes to support this plan showing the orientation of our national policy: 1. Most of the coastal states, to cope with rapid international environmental change and to survive in the new era of ocean order, have rationalized their higher governmental structure concerning the fishery industries. And the coastal countries which are the objectives of our expecting entry, demand excessive economic and technical aid, limit the number of fishing boats’entry and the use of our foreign fishing bases, and regulate the membership of the international fishery commissions. Especially, most of the coastal or island countries are recently independent states, which are poorer in national budget, depend largely on fishing royalties and licence entry fees as their main resources of national finance. 2. Alternatives to our entry to deep sea fishing, as internationalization strategies, are by direct foreign investment method. About 30 firms have already invested approximately US $ 8 million in 9 coastal countries. Areas of investment comprise the southern part of the Atlantic Ocean, the Moroccan sea and five other sea areas. Trawling, tuna purse seining and five other fields are covered by the investment. Joint-venture is the most prominent method of this direct investment. If we consider the number of entry firms, the host countries, the number of seas available and the size of investment, this method of cooperation is perhaps insufficient so far. Our fishery firms suffer from a weakness in international competitive ability, an insufficiency of information, of short funds, incompetency in the market, the unfriendliness of host coastal countries, the incapability of partners in joint-ventures and the political instability of the host countries. To enlarge our foreign fishing grounds, we are to actively adopt the direct investment entry method and to diversity our collaboraboration with partner countries. Consequently, besides proper fishing, we might utilize forward integration strategies, including the processing fied. a. The enterprise emigration method is likely to be successful in Argentina. It includes the development of Argentinian fishing grounds which are still not exploited in spite of abundant resources. Besides, Arentina could also be developed as a base for the exploitation of the krill resources and for further entries into collaboration with other Latin American countries. b. The co-business contract fishing method works in American territorial seas where American fishermen sell their fishery products to our factory ships at sea. This method contributes greatly to obtaining more fishing quotas and in innovation bottom fishing operation. Therefore we may apply this method to other countres to diffuse our foreign fishing entry. c. The new fishing ground development method was begun in 1957 by tuna long-line experimental fishing in the Indian Ocean. It has five fields, trawling, skipjack pole fishing and shrimp trawling, and so on. Recently, Korean fisheries were successful in the development of the Antarctic Ocean krill and tuna purse seining. 3. The acceleration of the internationalization of deep sea fishing; a. Intense information exchange activities and commission participation are likely to be continues as our contributions to the international fishery organizations. We should try to enter international fishery commissions in which we are not so far participating. And we have to reform adequately to meet the changes of the function of the international commissions. With our partner countries, we ought to conclude bilateral fishery agreements, thus enlarging our collaboration. b. Our government should offer economic and technical aids to host countries to facilitate our firms’fishery entry and activities. c. To accelerate technical innovation, our fishery firms must invest greater amount in technical innovation, at the same time be more discriminatory in importing exogeneous fishery technologies. As for fishing methods; expanded use of multi-purpose fishing boats and introduction of automation should be encuraged to prevent seasonal fluctuations in fishery outputs. d. The government should increases financial and tax aid to Korean firms in order to elevate already weak financial structure of Korean fishery firms. e. Finally, the government ought to revise foreign exchange regulations being applied to deep sea fishery firms. Furthermore, dutes levied on foreign purchaed equipments and supplies used by our deep sea fishing boats thould be reduced or exempted. when the fish caught by Korean partner of joint-venture firms is sold at the home port, pusan, import duty should be exempted.

공간분석을 위한 퍼지분류의 이론적 배경과 적용에 관한 연구 - 경상남도 邑級以上 도시의 기능분류를 중심으로 - (The aplication of fuzzy classification methods to spatial analysis)

  • 본 연구는 퍼지이론을 공간분석에 적용하기 위한 이론적인 배경을 고찰하고, 퍼지 분류법의 특성에 대해 살펴본 것이다. 이를 위해 필자는 공간정보의 모호성에 대해 살펴보 고, 퍼지공간분석의 전제를 설정한 다음 퍼지분류법을 소개하였다. 그리고 퍼지분류법의 특 성을 명확히 하기 위해 경상남도 읍급이상 도시의 산업별 고용비율을 대상으로 퍼지분류를 행한 후, 퍼지분류와 전통적인 군집분석의 결과를 비교하였다. 그 결과, 공간정보의 모호성 은 구체성의 부족, 인간행태, 인내치문제, 분류기준의 부족 등에 의해 발생하는데 기존의 공 간분석기법으로는 공간의 모호성을 반영할 수 없으므로 퍼지기법을 도입한 퍼지공간분석의 필요성이 있음을 확인하였다. 퍼지분류법 중, 퍼지이산분류는 계산절차는 상대적으로 간단하 나 분류결과가 집단간의 점이성을 고려하지 못하며, 퍼지중첩분류는 분류집단간의 점이성은 고려하나 분류결과가 지나치게 많아 적절한 분류수준을 선택하기 어렵고 결과해석이 상대적 으로 난해하다는 문제점이 있음이 밝혀졌다, 또 경남의 도시기능분류는 분류기법에 따라 다 르게 이루어졌지만 창원, 울산, 마산, 진해, 김해, 양산, 웅상, 장승포, 신현으로 구성된 제조 업 군집과 단독군집 충무의 존재가 세 가지 분류 모두에서 공통적으로 확인되었다.

Using the METHONTOLOGY Approach to a Graduation Screen Ontology Development: An Experiential Investigation of the METHONTOLOGY Framework

  • Ontologies have been adopted in various business and scientific communities as a key component of the Semantic Web. Despite the increasing importance of ontologies, ontology developers still perceive construction tasks as a challenge. A clearly defined and well-structured methodology can reduce the time required to develop an ontology and increase the probability of success of a project. However, no reliable knowledge-engineering methodology for ontology development currently exists; every methodology has been tailored toward the development of a particular ontology. In this study, we developed a Graduation Screen Ontology (GSO). The graduation screen domain was chosen for the several reasons. First, the graduation screen process is a complicated task requiring a complex reasoning process. Second, GSO may be reused for other universities because the graduation screen process is similar for most universities. Finally, GSO can be built within a given period because the size of the selected domain is reasonable. No standard ontology development methodology exists; thus, one of the existing ontology development methodologies had to be chosen. The most important considerations for selecting the ontology development methodology of GSO included whether it can be applied to a new domain; whether it covers a broader set of development tasks; and whether it gives sufficient explanation of each development task. We evaluated various ontology development methodologies based on the evaluation framework proposed by G$\acute{o}$mez-P$\acute{e}$rez et al. We concluded that METHONTOLOGY was the most applicable to the building of GSO for this study. METHONTOLOGY was derived from the experience of developing Chemical Ontology at the Polytechnic University of Madrid by Fern$\acute{a}$ndez-L$\acute{o}$pez et al. and is regarded as the most mature ontology development methodology. METHONTOLOGY describes a very detailed approach for building an ontology under a centralized development environment at the conceptual level. This methodology consists of three broad processes, with each process containing specific sub-processes: management (scheduling, control, and quality assurance); development (specification, conceptualization, formalization, implementation, and maintenance); and support process (knowledge acquisition, evaluation, documentation, configuration management, and integration). An ontology development language and ontology development tool for GSO construction also had to be selected. We adopted OWL-DL as the ontology development language. OWL was selected because of its computational quality of consistency in checking and classification, which is crucial in developing coherent and useful ontological models for very complex domains. In addition, Protege-OWL was chosen for an ontology development tool because it is supported by METHONTOLOGY and is widely used because of its platform-independent characteristics. Based on the GSO development experience of the researchers, some issues relating to the METHONTOLOGY, OWL-DL, and Prot$\acute{e}$g$\acute{e}$-OWL were identified. We focused on presenting drawbacks of METHONTOLOGY and discussing how each weakness could be addressed. First, METHONTOLOGY insists that domain experts who do not have ontology construction experience can easily build ontologies. However, it is still difficult for these domain experts to develop a sophisticated ontology, especially if they have insufficient background knowledge related to the ontology. Second, METHONTOLOGY does not include a development stage called the "feasibility study." This pre-development stage helps developers ensure not only that a planned ontology is necessary and sufficiently valuable to begin an ontology building project, but also to determine whether the project will be successful. Third, METHONTOLOGY excludes an explanation on the use and integration of existing ontologies. If an additional stage for considering reuse is introduced, developers might share benefits of reuse. Fourth, METHONTOLOGY fails to address the importance of collaboration. This methodology needs to explain the allocation of specific tasks to different developer groups, and how to combine these tasks once specific given jobs are completed. Fifth, METHONTOLOGY fails to suggest the methods and techniques applied in the conceptualization stage sufficiently. Introducing methods of concept extraction from multiple informal sources or methods of identifying relations may enhance the quality of ontologies. Sixth, METHONTOLOGY does not provide an evaluation process to confirm whether WebODE perfectly transforms a conceptual ontology into a formal ontology. It also does not guarantee whether the outcomes of the conceptualization stage are completely reflected in the implementation stage. Seventh, METHONTOLOGY needs to add criteria for user evaluation of the actual use of the constructed ontology under user environments. Eighth, although METHONTOLOGY allows continual knowledge acquisition while working on the ontology development process, consistent updates can be difficult for developers. Ninth, METHONTOLOGY demands that developers complete various documents during the conceptualization stage; thus, it can be considered a heavy methodology. Adopting an agile methodology will result in reinforcing active communication among developers and reducing the burden of documentation completion. Finally, this study concludes with contributions and practical implications. No previous research has addressed issues related to METHONTOLOGY from empirical experiences; this study is an initial attempt. In addition, several lessons learned from the development experience are discussed. This study also affords some insights for ontology methodology researchers who want to design a more advanced ontology development methodology.

한.중 인터넷 이용자들의 한국영화 이해에 관한 비교 연구: <엽기적인 그녀> 영화 사이트의 관람후기 게시판을 중심으로 (A Study on Understanding about the Korean movie of Internet user in China: Focused on the Reply of Movie Web-site in China and Korea)

  • 1990년대 말부터 시작된 한국 대중문화의 유행현상은 "한류(韓流)"라는 이름으로 중국 및 범아시아 지역에 퍼져나가고 있다. 그러나 "한류"에 대한 지금까지의 논의는 경제 논리의 수준에서 한정적인 연구들이 성행해 왔다. 이에 본 연구는 기존의 논의에 문제를 제기하고 대상이 되는 한국의 대중문화 콘텐츠와 이를 받아들이고 있는 수용자들의 대상에 대한 이해를 알아보는 것이 "한류"의 정체성을 밝히는 것임을 주장한다. 이를 위해 중국 인터넷 이용자들의 한국 영화 <엽기적인 그녀>에 대한 이해를 알아보고 문화교차 연구의 한 가지 사례 제시를 주된 목적으로 하였다. 영화<엽기적인 그녀>에 대한 중국 인터넷 이용자의 관람후기 게시판을 분석한 결과 반응의 특징을 크게 다섯 가지로 나눌 수 있었다. 영화의 현실감과 감정의 세밀하고 현실적인 묘사, 남자 주인공이 보여주는 순수하고 자기희생적인 태도에 대한 호감, 다른 영화에서 보여주지 못한 새로운 느낌을 받는다는 의견, 배역의 개성에 호감, "엽기적 행동"에 대한 거부감을 나타내는 의견이 있었다. 이 영화가 "한류"와 한국의 이미지에 어떠한 영향을 미쳤는지 분석한 결과 긍정적인 의견이 많았지만 이면에 저항감도 적지 않았다. 또한 중국 인터넷 이용자들과 한국 인터넷 이용자의 이 영화에 대한 이해를 비교해본 결과 한국의 인터넷 이용자들은 영화의 희극성을, 중국 인터넷 이용자들은 현실적이고 신선하다는 의견이 상대적으로 많았다. 결론적으로 중국의 인터넷 이용자는 이 영화에 대해 신선함과 현실감, 창의성, 내면의 감동에 이끌려 호감을 갖는 것이지 겉으로 드러난 형식이나 방식에 이끌리는 것은 아니라는 것을 보여준다. 또한 중국의 인터넷 이용자들은 이 영화를 한국의 인터넷 이용자와 다르게 이해하고 있으며 이러한 차이는 구성주의와 해석학에서 이야기하는 사회문화적, 역사적 상황이 다른 문화에서는 같은 대상에 대한 이해가 달라질 수도 있다는 예시를 보여준 것이다. 이렇듯 "한류"의 정체성을 파악하기 위해서는 우선 각 문화의 다양성과 특수성에 대한 연구가 선행되어야 하고 현재의 우리와 다른 사람들 사이에 진행되고 있는 문화적 욕구들이 어떻게 생성되고 있는지 현장에서 연구할 필요가 있다. 덧붙여 한국의 대중문화가 이러한 욕구에 잘 부합되고 있는지, 새로운 무엇을 만들어 내고 있지는 않은지 연구할 필요성을 절실히 느낀다.

국제물품매매계약(CISG)의 운송유보권 하에서 운송인의 법적지위에 관한 연구 (A Study on the legal position of the carrier under the right of stoppage in transit of CISG)

  • CISG 제71조 제2항은 매도인에게 부여된 권한으로 지급을 받지 못한 매도인은 운송 중에 있는 물품에 대하여 매수인에게 인도하지 못하도록 운송을 중지시킬 권한을 가지고 있으며, 운송증권이 이미 매수인에게 교부된 때에도 그러하다고 규정한 소위 운송유보권을 의미한다. 운송유보권 하에서 운송인은 물품에 대한 인도의 책임이 발생하게 되는데, 정당한 증권을 소지한 매수인 또는 선의의 소지인이 물품의 인도를 요구하는 경우, 만약 인도를 거부한다면 매수인으로부터의 손해배상책임을 피할 수 없고, 인도를 한다면 매도인으로부터 손해배상책임을 피할 수 없게 되므로 운송인의 법적지위가 취약하게 될 것이다. 본 논문은 운송유보권 하에서 운송인의 법적 지위의 취약함과 운송유보권의 취지에 맞는 운송인의 법적 행위 및 다양한 매매계약의 성격에 따른 운송유보권의 행사 가능성에 대하여 논하고자 하였다. 이와 관련 매도인이 운송유보권을 행사했음에도 불구하고 매수인이 물건을 수취한 경우, 매수인이 매도인에 대하여 손해배상의무를 진다고 해석, 사실상 매수인에게 물품이 인도되는 것을 방지하고 있다는 주장이 있으나, 이는 운송유보권의 취지에 비추어 볼 때 운송유보권의 발동을 무의미하게 하는 주장이므로 타당하지 않다. 운송유보권이 발동된 경우 매수인은 계약 이행에 관한 적절한 담보를 제공함으로써 운송유보권을 해제하여야 하며, 그렇지 못한 경우 운송인은 매수인에게 화물을 인도함으로써 추후 매수인에게 손해배상의무를 지도록 하는 면책행위를 행하지 못하도록 함이 타당하다고 판단된다. 또한 운송유보권은 물품매매계약의 지급결제방식과 운송방식 및 선화증권의 형태 등에 따라 그 행사유무가 각각 달라질 수 있을 것이다. 신용장 방식의 경우 운송유보권의 행사는 불필요하며, 신용장 이외의 모든 결제방식에서 운송유보권의 행사가 가능할 것이다. 운송방식과 관련하여 대부분의 경우 운송유보권의 행사가 가능하나, 만일 매수인 자신이 선주인 경우나 운송인이 매수인의 대리인인 경우라면 운송유보권은 행사가 힘들다고 판단된다. 또한 운송증권의 형태와 상관없이 운송인이 화물을 매수인에게 인도하기 전이라면 운송유보권의 행사가 가능할 것으로 판단된다.

지역신문 기사생산에 영향을 미치는 요인에 대한 질적 연구 "광주드림" 기사생산을 중심으로 (A Qualitative Study on the Forces that Influence the Article Production of Local Newspapers Focus on the Article Production of Gwangjudream)

  • 이 연구는 무료 일간지임에도 불구하고 지역 언론으로서 나름의 역할을 하고 있는 것으로 평가 받고 있는 "광주드림"의 기사생산과정을 참여관찰과 심층면접을 통해 면밀히 밝히고자 하였다. 특히 기사생산에 영향을 끼치는 요인(힘)들과 이들 사이의 상호작용을 분석하고자 하였다. 이를 통해, 광주지역에 신문들이 난립하고 있지만 지역 언론 본연의 기능을 제대로 수행하고 있는 신문이 거의 없는 현실과 문제들에 대한 이해를 심화시키고 그 개선 방향을 조망하는 데 기여하고자 하였다. 연구결과, "광주드림" 기사생산에 영향을 끼치는 요인(힘)은 크게 다섯 가지로 나타났다; 1) 역사적 요인으로 지역 언론 본연의 기능을 지향했던 "광주드림"의 창간배경, 2) 개인적 요인으로 "광주드림" 구성원들의 주류 사회와 문화에 대한 비판적 성향, 3) 조직적 요인으로 비위계적 조직문화와 편집권의 독립, 4) 관행적 요인으로 출입처 제도의 폐지, 5) 경제적 요인으로 광고주의 영향력, 재정적 열악성, 그리고 독자확보를 위한 경쟁. 역사적 요인과 개인적 요인은 기사생산을 위한 기본적 환경으로, 조직적 요인과 관행적 요인은 실질적 환경으로 작동하면서, "광주드림"이 지역 정치권력에 대한 감시와 비판, 지역성과 시민밀착성, 소수자들에 대한 배려 등과 같은 특성(차별성)들을 지니도록 하였다. 경제적 요인은 이러한 "광주드림"의 특성(차별성) 들을 약화시키는 환경을 제공하였는데, 특히 재정적 열악성은 통신기사의 의존도 그리고 심층성과 전문성이 낮은 기사의 출현가능성을 높였고, 독자확보를 위한 경쟁은 "광주드림" 기사의 연성화를 불러일으켰다. 이 연구의 결과는 지역신문사들이 지역 언론 본연의 기능을 제대로 수행하고 있지 못한 문제를 과도하게 경제적 열악함에 의한 것으로 치부하는 지역 언론계나 학계의 사고 경향에 문제를 제기한다. 또한 지역 신문사들을 살리기 위한 정부차원의 지원은 계속되어야 하지만 지역 신문사들에 대한 정량적 평가를 기준으로 이루어지는 단순한 경제적 지원만으로는 그 목적을 달성하기 어렵다는 것도 시사한다고 하겠다.
