  • The seller may take a warranty with respect to the goods. If they are not as warranted, they may be held liable for the breach of warranty. Even when they has not made a warranty, the law will in some instances hold them responsible as though they had made a warranty. An express warranty is a part the basis for the sale. That is, the buyer has purchased the goods on the reasonable assumption that they were as stated by the seller. When the buyer intends to use the goods for a particular or usual purpose, as contrasted with the ordinary use for which they are customarily sold, the seller makes an implied warranty that the goods will be fit for the purpose when the buyer relies on the seller's skill or judgment to select or furnish suitable goods, and when the seller at the time of contracting knows or has reason to know the buyer's particular purpose and his reliance on the seller's judgment. A merchant seller who makes a sale of goods in which he customarily deals makes an implied warranty of merchantability. The Uniform Commercial Code expressly abolishes the requirement a privies to a limited extent by permitting a suit for breach of warranty to be brought against the seller by members of the buyer's family, his household, and his guests, with respect to personal injury sustained by them. Apart from the express provision made by the Code, there is a conflict of authority as to whether privies of contract is required in other cases, with the trend being toward the abolition of that requirement. At common law the rule was that only the parties to a transaction had my rights relating to it. Accordingly, the buyer could sue his immediate seller for breach of warranties. The rule was stated in the terms that there could be no suit for breach of warranty unless there was a privies of contract. The code expressly abolishes the requirement of privies to a limited extent by permitting a suit for breach of warranty to be bought against the seller by members of the buyer. Apart from the express provision made by the Code, there is a conflict of authority as to whether privies of contract is required in other cases, with the trend being toward the abolition of that requirement.

  • Bills of lading are crucial in international sales on shipment terms since they guard buyers against loss of or damage to the goods in transit by giving them the rights against carriers. A bill of lading, as document of title, gives the buyer the right to demand physical possession of the goods from the carrier and enables the buyer who is in possession of damaged or short-delivered goods to sue the carrier. In this context the buyer in sales on CIF or CFR terms or FOB terms with additional services benefits from the bill of lading which functions as a receipt of goods and a evidence of the terms of the contract of carriage. Protection of such buyer's interests can be provided in the sale contract through appropriate express or implied terms on the seller's documentary obligations: Which transport document, a bill of lading or a sea waybill, is required? Who should be named as the consignee in the transport document and, in case of bill of lading, by whom should the bill be endorsed? What should be stated in the bill of lading for the quantity of the goods? How about a bill of lading that contains so called "unknown clause"? How many bills of lading for the entire contract goods should be tendered? Can a bill of lading stating that the goods have been shipped in apparent good order and condition also state that the goods were damaged after shipment? This paper seeks to provide answers for these particular questions.

  • This paper is concerned with the attitude of the Guro inhabiants concerning medical care system in terms of the credibility of hospitals. The credibility may be consisted of three components : availability, friendliness, and expertness. These were considered as dependent variables. Independent variables were age/education/income/perception of differentiation. The questionnaire was administered to 127 stratified samples in Feb. 1982. The results were as follows : 1) The group whose age was above 50 years gave a favor for the medical care system in terms of credibility. This fact implied that cultural influence on the perception and attitude about medical care system was very crucial, and it was noticed that doctor-patient relationship have been changing. 2) The attitude of the inhabitants on the credibility was appeared generally as unfavorable and indifferent. 3) According to $X^2$-test, education, income, and perception of differentiation were identified as having statistically significant trelationships with friendliness factor.

  • Purpose: To compare normal weight children with obese children in terms of family factors, eating habits, and sociocognitive factors. Method: This study compared 217 obese children with 231 normal standard weight children of 4th-6th graders from 7 elementary schools in Kangwon province. The study also surveyed 817 their parents using questionnaires in which familial factors, eating habits, and sociocognitive factors such as dietary self-efficacy, locus of control and self-esteem were included. Result: Obese children had more obese family members, more family members with chronic metabolic disease, and lower breast-feeding rate than normal weight group. Dietary self-efficacy was positively correlated with eating habits and locus of control while no correlation was found with obesity index.. Self-esteem was negatively correlate with obesity index. Both the parents and the childrens eating habits showed significant positive correlation to the obesity index. Conclusion: These results implied familial factors, eating habits, and sociocognitive factors influenced childhood obesity. Thus, further research targeting to positive attitude toward familial dietary practices combined with significant sociocognitive factors, may lead to prevention and effective management of childhood obesity.

  • A motive and aim of enactment of UN Convention on the Use of Electronic Communication in Int'l Contracts is based on need to eliminate legal obstacles that might arise under existing int'l trade law instruments and promote int'l electronic commercial transaction. But when it is used with related articles, 14, 15, 16, 17 for offer under CISG, one of the most successful conventions which produces substantive law for the unification of int'l trade, questions of practical importance, for example possibilities of withdrawal, revocation, rejection of offer, the extent of its criteria arise from therewith. In conclusion, a effective electronic offer has to assure easily access and confirmation of trade terms besides criteria of offer under CISG. An offer can be withdrawal, if electronic message of withdrawal has entered the offeree's server before or at the same time when the offer has reached the offeree but agreement expressly or impliedly, between the parties about type, format, email address is a prerequisited. Implied consent could be presumed through prior conduct or trade usages between the parties under CISG articles 8, 9. The term "have reached" correspond to the time which is able to retrieve the electronic message of withdrawal. But without express or implied agreement between them about electronic communication of type, format, email address, an offer can be withdrawal before or at the same time when it has entered offeree's other e-mail address and confirmed by his retrieval. In case of the revocation, electronic message of the revocation is effective before the offeree's dispatching an acceptance. A prerequisite for the revocation by electronic communication is came as the above mentioned withdrawal except for concept of a time difference for reach. In case of a rejection of offer, when a rejection by electronic communication has entered the offeror's server, an offer is ended. But a prerequisite for the rejection by electronic message is same as the above mentioned withdrawal and revocation.

  • The purpose of this study is to provide a guideline for the programming beginners, including SW non-majors, to reduce the difficulty of establishing procedures for solving problems and to refine the work process properly in a computing environment. To accomplish this, we derive the unfolding types of typical procedures that can unfold the working procedures typically implied in daily operation in terms of recognition(input)-judgment(processing)-behavior(output). Through learning to unfold the procedure for each type, it was confirmed that the learner define the scope and rules of the problem himself and extended the procedure implied in any action. The unfolding model of the procedure developed in this study can be used as a tool for constructing a procedure operable in a computing environment to solve problems in the early stages of programming learning for non-majors or beginners.

  • This paper is, first of all, to explore what kinds of character are implied in Korean policies and support programme for foreign immigrants, secondly to analyze immigrants' recognition on them in terms of their types and dwelling places, and finally to suggest some measures to improve policies and support programme. Policies for foreign immigrants are often classified into three models of assimilation, of differential exclusion, and of multiculturalism, but the marginalization of foreign immigrants is suggested either as a new model or as implied in all of those models. As a result of questionary survey, it is found out that foreign immigrants, irrelevant to their type, recognize their policies as mixing those characters. Finally, multiculturalism with distributive equality and recognition justice to overcome marginationalization, network governance for foreign immigrant policies to reflect their needs and participation, and sustainable and multicultural programmes for improving regional identity, ensuring covil rights, supporting comprehensive welfare, and multicultural education are suggested as measures to improve foreign immigrants' quality of life.

  • Flow-induced forces on two identical nearby circular cylinders immersed in the cross flow at Re =100 were numerically studied. We consider all possible arrangements of the two circular cylinders in terms of the distance between the two cylinders and the inclination angle with respect to the direction of the main flow. It turns out that significant changes in the characteristics of flow-induced forces are noticed depending on how the two circular cylinders are positioned, resulting in quantitative changes of force coefficients on both cylinders. Collecting all the numerical results obtained, we propose a contour diagram for drag coefficient and lift coefficient for each of the two cylinders. The perfect geometrical symmetry implied in the flow configuration allows one to use those diagrams to estimate flow-induced forces on two identical circular cylinders arbitrarily positioned in physical space with respect to the main flow direction.
