Japan has enacted the Public Records and Archives Management Law from 2011 in order to prevent mismanagement of records management and to fulfill accountability to the public. However, in 2013, The Designated Secrets Protection Act was enacted before the Public Records and Archives Management Law brought changes to administrative institutions. The Designated Secrets Protection Act have raised concerns that the public's right to know and the transparency of administration are being retreated, especially the development of freedom of information and records management systems. This article analyzed the background of the establishment of Designated Secrets Protection Act and the contents of legal composition. It also identified the possibility of human rights abuse in the aptitude assessment system, the lack of independent monitoring agencies, the impossibility of internal accusations, and the possibility of wide confidentiality designation. Furthermore, analyzed how the problem affects Japanese records management and freedom of information system. Through this, I suggested the improvement of the system of the secret level records management system in Korea, the establishment of the clear purpose of the secret record management, the application of the Tshwane principle, and the establishment of the independent and professional monitoring agency.
This study is on management present and improvements on National Records Designation System. National Records Designation System is a system that supports management and preservation of changes of records designated by the government through consideration that such records are worth preserving permanently nationally among records acquired by individual or organization. This system is meaningful in a way that it established systematic foundation to hand down by informatizing historic private records which are in danger to be lost or damaged due to lack of proper care. However, compared to the number of designated records, the information that could be practically drawn from such records are limited. This triggered this study to be launched. National Archive sometimes promotes designation and management of National Designated records. Yet archival information service offering access of user to national designated records are very rare. I conducted survey and interview of managers, field research, and documentary research of 10 records holding institution that keeps national designated records currently. I considered that current management status of National Records Designation System can be figured out minutely through these research. As a result of such research, most of the records holding institutions offered display as their least archival information service. The objective of records informatization was to utilize the records. Also further plans on information service related to records and various utilization were suggested. records holding institution manager did not give positive answer on effect of designating national designated records and cooperation between National Archive. Support to National Archive only focused on preservation. For national designated records holding institution designated after 2011 were not getting proper support. In addition, National Archive's support rarely met records holding institution's need. In such circumstances, things to consider for improvements of National Records Designation System is as following. First, designation of national designated records should be based on the utilization of the record. Each records holding institution's willingness to utilize corresponding records and National Archive's ability to draw the willingness out should be considered. Also, it shouldn't be left as mere complementary policy of National Archive's selecting policy. Second, for National Records Designation System to be managed permanently, it should be changed as the system that supports enhancement of private records management. The aim should point to the direction where private can manage and preserve the records on their own. Third, There needs to be changes on the subject and process of national designated records designation. National designated record is the record that was considered valuable by the government among private records. Thus, such records should be the best one to show private field. Accordingly, records that represent contemporary society and include various states and contents should be chosen to be designated. Moreover, public discussion be formed by citizens and related professionals in order to properly select the record.

This study was conducted to provide sustainable measures for conservation and management to protect valuable natural/ecological resources, offer differentiated quality assurance services for eco-tourism products, and explore measures for eco-tourism certification/designation systems. To achieve its goals, the study discussed domestic and overseas trends and literatures that concern eco-tourism certification/designation system and investigated case studies that were presently operational. A group of experts and a group of non-experts were surveyed separatedly to investigate the awareness of the national eco-tourism certification/designation system. The results from the investigation indicate that Europe, since the late 1990s to early 2000, has actively introduced a system that establishes and operates a dedicated institution, and European members have created a cooperation framework to formulate international partnerships and develop standardized assessment benchmarks to adhere to the goals of the system, the period for certification was designated from one year to five years, and renewals were granted based on periodic monitoring and reassessment. In Korea, from early 2000, the Ministry of Culture, Sorts and Tourism and other organizations have certified product quality and assessed travel products and national park tour programs. The certification period was established to be set between one and three years, and the vast majority were not reassessed. Upon investigating the results for awareness of national eco-tourism certification/designation system, a high number of respondents agreed with the need to establish a eco-tourism certification/designation system (90% of respondents), and the respondents cited eco-tourism quality assurance, conservation of value, means to maintain established institutions, and environmental education and information as reasons for needing a certification/designation system. In Korea, a certification/designation system for the eco-tourism industry is presently in operation, but the system regulates target institutions based on their characteristics. Therefore, this study proposes its suggestions via various categories, including designated institutions, designated purpose, designated subjects, designated organization, laws, regulations, and incentives.

To prevent illegal building work in advance, regional building safety centers were introduced to perform technical investigations and management. The purpose of this study is to propose the detailed operational directions of the regional building safety center through the analysis on the current status of parameters, such as the operation of designated confirmation and inspection bodies in Japan. We consider the role, building administrative process and establishment criteria of regional building safety centers through the analysis the introduction background and the designation criteria of designated confirmation and inspection bodies. In establishing the center's professional manpower qualifications, we refer to the criteria for the professional qualifications of the designated confirmation and inspection bodies. In addition, the calculation method of required manpower of verification inspectors in Japan was used as a reference in setting the scale of regional professional manpower. Finally, we propose the detailed operational directions of the regional building safety center such as (1)roles of the center, (2)establishing management plan of the center, (3)work scope (4)scale of the professional manpower, (5)qualification of the professional manpower, and (6)funds.

The contract which a data messages is used in the formation may be called electronic contract. The formation of the electronic contract is regulated by the Civil Code or the Commerce Code. The time of the contract formation is regulated by the Civil Code and the Commerce Code. But the time of dispach and receipt of the data message is stated in Article 9 of the Fundamental Law on Electronic Commerce. In this article the dispatch of a data message occurs when it enters an information system outside the control of the originator or of the person who sent the date message on behalf of the originator. The time of receipt of a data message, if the adressee has designated an information system for the purpose of receiving data message, is at the time when the data message enters the designated information system; or if the data message is sent to an information system of the adressee that is not the designated information system, at the time when the data message is retrieved by the addressee; if the addressee has not designated an information system, receipt occurs when the data message enters an information system of the addressee. The time of the electronic contract formation depends on the Civil Code or the Commerce Code and this Article 9 of the Fundamental Law on Electronic Commerce. An electronic contract may be formed by an offer and the acceptance of an offer by dispach or receipt of data message. An offer can not be withdrawn after it is accepted. But in mail-order sales and installment dealing an offer can be revoked after the goods were delivered. In this case the contract is lapsed.
Artificial or natural artifacts, which have historical, artistic, academic or scenic value as national, ethnic or global assets, are designated as "cultural heritages" under the Act on the Protection of Cultural Heritage. Cultural heritages can be divided into tangible cultural heritages, intangible cultural heritages, and monument and folklore heritages. In addition, depending on the object of designation, a cultural heritage can be designated either as a city or a provincial cultural heritage or a cultural heritage material, by a city mayor or provincial governor, and as a state-designated heritage by the administrator of the Cultural heritage Administration. The regular survey is a part of the policy for the preservation and management of state-designated heritages, which requires that surveys be undertaken every three to five years for the preservation, repair and maintenance of cultural heritages. It was stipulated in the Act on the Protection of Cultural Heritage in 2006, and since then has substantially contributed to the preservation and management of state-designated heritages based on the identification of damage to cultural heritages and the application of appropriate treatment measures. However, some parts of the guidelines on the regular survey, legislated in 2006, occasionally give rise to confusion in managing the regular survey system of state-designated movable cultural heritages, and need to be modified to facilitate the systematic management and improvement of the regular survey system. This study attempts to analyze the structure and operation of the regular survey system of state-designated movable cultural heritages, and proposes plans for improving the way of specifying each department which leads, manages and executes the regular survey, the process of entrusting the survey, and its guidelines and forms. I hope that these plans concerning the regular survey of state-designated movable cultural heritages will contribute to improving the quality and management of the system.
In general, Introducing of the Designated Manager System (DMS) of public facilities has been promoted as part of administrative reforms for planning improvement of service for customers by a private and budget cuts of operations management. DMS has begun to be introduced to the public marina facilities in earnest in 2006, it is evaluated positive about efficiency in terms of business(budget cuts). However, there is no discussion about efficiency (likes service satisfaction of client-side) from the marina whose major job is service. The primary purpose of this study is to clarify the benefits and challenges as a result of the Designated Manager System (DMS) launch implemented by local governments, following the relevant amendments to the Local Government Law. The second purpose is to clarify, from the viewpoint of users, what changes have taken place after the DMS launch, focusing on public marinas operated under the DMS. As for the primary purpose, the study is intended to clarify the economic benefits of the DMS and the significance of the DMS launch at a prefectural government level. This will help us assess whether it would be worthwhile to encourage private companies or non-profit organizations (NPO) to participate in the management and operation of public facilities under the DMS scheme. Most of the studies to date have examined the benefits of the DMS launch, focusing on the economic benefits for local governments. This study is intended to clarify the benefits and disadvantages to users of the DMS launch from the viewpoint of users.

Purpose : Customers with loyalty are very important to hospitals for sustainable growth in their medical market. Individuals with loyalty are likely to visit same hospital repeatedly when they need medical services. This study was to identify factors associated with selection of specialty hospitals among customers with loyalty. Methods : The subjects of this study were 735 inpatients in 22 specialty hospitals in 6 designated fields(joints, spine, colorectal-anal, obstetrics and gynecology, ophthalmology, otolaryngology). Customer types classified as customers with high loyalty, neutral customers, and customers with low loyalty according to net promoter score(NPS). Factor analysis was conducted to classify 22 hospital selection factors into some similar properties. Logistic regression analysis was conducted to confirm the selection factors related to loyal customers. Findings : Most of specialty hospitals received high NPS of 8 points or higher in all the designated fields. Five factors associated with selection of specialty hospital are (1) hospital facilities and convenience, (2) trust in doctor and hospital, (3) rapidness of treatment, (4) hospital awareness, and (5) accessibility. As a result of logistic regression analysis, selection factors related to loyal customers were 'hospital facilities and convenience', 'trust in doctor and hospital' and 'rapidness of treatment'. Differences in the degree of importance of three selection factors by customer types appeared for each designated field. Practical Implications : This study confirms the high level of patient experience among inpatients of specialty hospitals. Factors associated with selection of hospital among inpatients with loyalty are 'facilities and convenience of hospitals', 'trust of doctor and hospital' and 'rapidness of treatment'. This study will be meaningful as basic data to systematically enhance the roles and functions of the health care system and to provide securing competitiveness according to designated fields in the management aspect of specialty hospitals.
Purpose: This paper aims to clarify the problems and to examine the improvement methods by investigating the management condition of local-designated cultural property of which management is relatively poor in comparison with state-designated cultural heritage. Method: In order to grasp the management situation of the local-designated cultural heritage, a research on cultural heritage management situation and problems will be carried out with 35 cultual heritages in Goryeong-gun. Also, the improvement methods about the property type vulnerability on the basis of interview with cultual property managers, fire-fighting officers and civil servants, etc. Results: Local cultural heritages were investigated to be very vulnerable to the fire of wooden buildings, the theft of movable cultural heritages, and the effects of wind and water damage. It is because cultural heritages are scattered over wide areas fundamentally. As the result, it has difficulty in the patrols of police officers and fire fighters, and in the situation that it lacks disaster monitoring and CCTV for countermeasures to replace them, electronic security including fire hydrant, sensors, etc and fire extinguishing facilities and so on. It is difficult for local governments managing local-designated cultural heritages to enhance their management systems directly due to their lack of budget and manpower. Conclusion: In order to strengthen disaster and safety management system for the cultural heritages designated by local governments, they have to clarify disaster countermeasure task of fire fighting, police, and cultural heritage managers prepare their manuals, and systematize them through disaster drill mainly in local autonomous governments. Also, so as to establish a surveillance system every day, they have to enhance the community for local cultural heritage manage consisting of local volunteer fire departments, local voluntary disaster prevention organizations, volunteers, etc.
Purpose: This study examined the effects of case management (CM) for Medicaid on healthcare utilization considering the Medicaid system. Methods: Data were extracted from survey data on "Healthcare utilization and health status of Medicaid beneficiaries" conducted in 2007 and 2008 by the Ministry for Health, Welfare and Family Affairs. This study was designed to compare the effects on healthcare utilization between the CM group and the non-CM group. The subjects were 535 Type I Medicaid beneficiaries who utilized healthcare more than 365 days during 2006. Results: The outpatient days and medication days of the CM group decreased significantly more than those of the non-CM group with the copayment system. There were no significant differences of healthcare utilization between the CM group and the non-CM group with the designated doctor system. Conclusion: CM worked effectively on Medicaid beneficiaries' outpatient healthcare utilization with the copayment system. However, its effects on hospitalization, which is a major cause increasing the total expense, were not observed. Therefore, future studies are needed to develop strategies to reduce hospitalization and Medicaid beneficiaries outpatient healthcare utilization with the designated doctor system.
