  • As the CISG has been legislated for a new legal system playing roles as uniform rules which govern international sale of goods, it requires appropriate criterion of interpretation. The Convention distinguishes between two levels of interpretation. One concerns the interpretation of the rules of contract law contained in the CISG itself, and the other the interpretation of specific statements or the conduct of the individual parties to a transaction.

  • Because the amount of radiation emerging from the thorax behind the lungs is often literally thousands of times that exiting behind the mediastinum, the dynamic range of X-ray chest image is very large. In order to solve the dynamic range problem, we propose a signal adaptive algorithm which enhances the local contrast and contracts the enhancement of quantum noise by local mean/valiance estimator.

  • This paper presents a formula that relates the optimal exercise boundaries of American call and put options on futures contract. It is shown that the geometric mean of the optimal exercise boundaries for call and put written on the same futures contract with the same exercise price is equal to the exercise price which is time invariant. The paper also investigates the properties of American calls and puts on futures contract.

  • In Korea, the volume of insurance industry has been increased rapidly with helping the economic growth, the increment of GNP and derive of public welfare policy. But the other side of the volume increment, the life insurers have some problems, such as the high rate of turnover, lapses and surrenders, in processing of acquiring more insurance contracts. The object of this paper is the analysis of the causes and properties of the high rate of turnover, lapses and surrenders using statistical survival model. Also we hope that the insurers will use the results of analysis to reduce the rates.

  • Generational contracts are specified into public pensions based on generational solidarity. The Korean National Pension has been reformed with a focus on generational equity with a narrow meaning related to contribution rate and benefit level. As a result, the Korean National Pension has only emphasized generational equity and not contributed to generational solidarity. We investigate changes in the content of the generational contract and propose to reconstruct generational contract to contribute to solidarity with a more comprehensive perspective. A new social contract by reformed pension system should not concentrate on narrowed generational equity. It should be reconstructed in the direction of enhancing efficacy and the stability of generational solidarity with an emphasis on social sustainability. Investment into the next generation would be one of many policy measures to decrease conflicts around intergenerational redistribution and improve the financial stability of the public pension by creating population structure and labor market changes.

  • A construction project consists of a variety of contracts for the completion of work. The large number of contracts involved in a single project increases the likelihood that disputes will arise between the parties involved regarding the terms of service. Actually, there are many disputes that are caused by a change 0 order. While such disputes should be settled by interpreting the terms stipulated in the agreement entered between the two parties, the process of dispute settlement is often restricted to arbitration and lawsuit, and as a result the parties tend to avoid it due to its inefficiency. For this reason, in Korea it is hard to find cases of interpreting terms of service, while in the U.S. it is easy to find diverse cases of interpreting terms of service, since there is a process of dispute settlement by each stage by the party who has placed an order. Therefore, this study presents analysis of case studies of contract changes, looking specifically at changes in the scope of the work, changes in quantity, changes in the period of implementation, changes in the method of implementation or attitude, changes in items provided by the government or the delivery place, and the acceptance of such change procedure by a contractor, and the adjustment of a reduction.

  • The Internet is a wonderland that can be enjoyed by the young, old, and those in-between. It is also a vast commercial market where many contracts are formed every second. The Internet and E-Commerce have created new situations that have generated sweeping proposals for fundamental changes in contract law. During the first half of the 20th Century. when many businesses expanded their geographic scope, there was a tremendous desire for uniform treatment of contracts for the sale of goods throughout the U.S.A. and the whole world. That same dynamic is now occurring in E-Commerce. There is a general recognition of the desirability of uniform contract law to govern E-commerce, but to date that does not exist, though there are extensive proposals for reform of contract law on the Internet. E-Commerce is currently plagued by some of the same problems that led to the passage of the UCC. In the absence of uniform legislation, state-by-state differences are inevitable with respect to E-Commerce. State-by-state differences in E-Commerce contract law is widely viewed as undesirable. To deal with this problem, a number of uniform bills have been proposed including UCITA, UETA, and revisions to Article 2 of the UCC (Subpart B). The thrust of these uniform acts is to create legal parity between paper records and electronic records. There is considerable resistance by consumer groups to this parity and progress towards Passage of UCITA, UETA, and revised Article 2 has been slow. The UCITA covers licenses of computer software but does not cover the sale oil goods on the Internet. The scope of the UCITA includes computer software. multimedia interactive products, computer data and databases, and Internet and online information, The UETA deals comprehensively with E-Commerce and contract law. The UCC covers the sale of goods, which does not necessarily involve E-Commerce. The basic principles of contract law are modified to deal with Internet transactions. Intent is inferred from the operations of electronic agents and "signatures" can occur with a response to an invitation to click to accept.

  • This study examines the foundations of contract farming, the extent of corporate vertical coordination, and farmer's land use in regards to the contract farming between discount store and watermelon farmers in Buyeo-gun, Chungcheongnam-do. In the above case, contract farming is led by the group of producers. As the corporate's role is limited due to the specification of watermelon breed, contract farming takes the form of procurement contract with restrained levels of corporate vertical coordination. Thus, it has become common for contract farmers to freely enter and leave contracts and sign contracts with multiple clients. Furthermore, farmers participate in contract farming by using contract breeds in existing crop rotation systems. Through this process, watermelon farming is undergoing a process of diversification via the spread of contract varieties in this region.
