When newcomer countries consider a nuclear power programme, it is recognized that the most important organizations are the Nuclear Energy Programme Implementing Organization (NEPIO), the regulator, and an operating organization. Concerning the number of construction delays these days, one of the essential organizations is an Authorized Inspection Agency (AIA). According to World Nuclear Industry Status Report, all of the reactors under construction in eight out of the thirteen countries have experienced delays. Globally, the Flamanville 3 project and Sanmen Unit 1 are 6.5 years and 5 years late respectively. One of the major reasons of delay is due to inappropriate manufacturing and inspection on safety class components. The recommendations are made to develop such an organization: (i) find existing inspection organizations in relevant industries, (ii) contract with expatriates who have experience on nuclear inspection, (iii) develop a legislative framework to authorize the inspection organization with enforcement, (iv) include a contract clause in the BIS for developing the AIA, (v) hold training programmes from vendor country, (vi) during manufacturing and construction, domestic AIA shall be involved.
A special government agency has been charged with implementing quality management to guarantee the quality of wild-simulated ginseng. However, these processes are carried out by use of documents, and this has resulted in information omission and high document management costs. To solve this problem, this study analyzed the existing quality management process by using a smart contract for the existing offline form and proposed a new quality management system for storing and managing all log data in the blockchain. This system reduced documentation management costs about quality management and recorded information in the previous step through the quality management steps, thus forming a step-by-step record chain. Experiments were conducted by implementing this system, which improved data integrity and reliability. Additionally, sensitive information, such as personal information, was included in the system by use of the off-chain technology.
Where an insurer has unreasonably refused to pay a claim or paid it after unreasonably delay, the existing law in England does not provide a remedy for the insured. Accordingly, the insured is not entitled to damages for any loss suffered as a result of the insurer's unreasonable delay. This legal position differs from the law in Scotland and most major common law jurisdictions. LC thought that the legal position in England is anomalous and out of step with general contractual principles. LC considered that a policyholder should have a remedy where an insurer has acted unreasonably in delaying or refusing payment of claim, and, therefore, recommended a statutory implied term in every insurance that the insurer will pay sums due within a reasonable time and breach of that term should give rise to contractual remedies, including damages. More detailed recommendations of LC are as followings. First, it should be an implied term of every insurance contract that, where an insured makes a claim under the contract, the insurer must pay sums due within a reasonable time. Secondly, a reasonable time should always include a reasonable time for investigating and assessing a claim. Although a reasonable time will depend on all the relevant circumstances, for example, the following things may need to be taken into account, that is, (1) the type of insurance, (2) the size and complexity of the claim, (3) compliance with any relevant statutory rules or guidance, and (4) factors outside the insurer's control. Thirdly, if the insurer can show that it had reasonable grounds for disputing the claim(whether as to pay or not, or the amount payable), the insurer does not breach the obligation to pay within a reasonable time merely by failing to pay the claim while the dispute is continuing. In those circumstances, the conduct of the insurer in handling the dispute may be a relevant factor in deciding whether the obligation was breached and, if so, when. Fourthly, Normal contractual remedies for breach of contract should be available for breach of the implied term to pay sums due within a reasonable time. Finally, In non-consumer insurance contracts, the insurer should be permitted to exclude or limit its liability for breach of the obligation to pay sums due within a reasonable time, unless such breach was deliberate or reckless, and such an insurer's right to contract out will be subject to satisfying the transparency requirements.
The purposes of this study were to a) measure the IC identified of CFMC (contract foodservice management company) ,b) examine IC circumstance of CFMC, c) evaluate practically IC measurement tool of CFMC, and d) present information for selecting an adequate CFMC to clients. The questionnaires of IC measurement were handed out to 108 CFMCs, there composing of main office employees, foodservice managers, customers, and clients of 207 school,38 hospital, and 86 husiness/industry foodservices. The statistical data analysis was completed using SPSS Win (ver 12.0) for descriptive analysis, t-test, Mann-Whitney U test. First, CFMCs had operational experience for an average of 8 years and 8 months, and served an average of 38,540 meals a day. Most of the respondent companies specialized in the school foodservice field and managed an average of 66 clients for the contract period of 2 years and 3 months. Second, the respondent companies had gotten a score of 77.78 points for the total average, 77.7 points in the large enterprise group and 78.1 points in the small and medium-sized enterprise group. Therefore, the minimum number of points for the accrediting license on Qualification is suggested to be over 70 out of a 100 point scale; this study would be serve as reference for the certification license on qualification. On the level of evaluation category, the scores were 14.15 to 20 points on $\ulcorner$finance$\urcorner$, 19.24 to 25 points on $\ulcorner$customer$\urcorner$, 19.33 to 25 points on $\ulcorner$process$\urcorner$, 14.31 to 20 points on $\ulcorner$human resource$\urcorner$, and 8.6 to 10 point on $\ulcorner$renewal and development$\urcorner$ . $\ulcorner$Renewal and development$\urcorner$ and $\ulcorner$customer focus$\urcorner$ received better grades than other evaluation categories. Third, $\ulcorner$Finance$\urcorner$ indicated similar distribution overall. Small and medium-sized companies had lower grades than large companies on 'market ability' of $\ulcorner$customer$\urcorner$ , but, clients of small and medium-sized companies had higher grade for 'client satisfaction' than large companies. Most of the companies supported 'infrastructure support for foodservice operation' of $\ulcorner$process$\urcorner$ by the main office of CFMCs, but, the branch chain offices of CFMCs were not applied efficiently. Large companies made more effort to improve the 'employee ability' of $\ulcorner$human focus$\urcorner$ than small and medium-sized CFMC. The 'research and development cost' of $\ulcorner$renewal and development$\urcorner$ was increased compared to the previous year. In conclusion, if CFMCs were to perform self-evaluation and a routine checkups by utilizing CFMC's IC measuring tool, improvements in CFMC operational capacities as well as foodservice quality can be noted. Railway projects have been consistently increasing in Korea. In relation to this trend, the mechanized tunneling using Tunnel Boring Machine (TBM) is preferably applied for mining urban areas and passing under rivers. The TBM tunneling under difficult grounds like mixed faces with high water pressure could require ground improvements for stable TBM advance or safe cutter head intervention (CHI). In this study, pre-grouting works for CHI in Daegok-Sosa railway project are presented in terms of the grouting zone design, the executions and the results, the lessons learned from the experience. It should be mentioned that the grouting from inside TBM was carried out several times and turned out to be inefficient in the project. Therefore, grouting experiences from the surface are highlighted in this study. Jet grouting was implemented on CHI points on land, while permeation grouting off shore in the Han River, which mostly allow to access the cutter head of TBM in free air with stable faces. The results of CHI works have been analyzed and the lesson learned are suggested.
As the popularity of logistics service outsourcing has been continuously growing, one of the most frequently addressed issues is how to estimate the effect of cost reduction for users and profit gains from outsourcing contract for providers. Many manufacturing companies agree that logistics outsourcing helps to reduce their operating costs, but some other companies still do not achieve the cost saving or do not trust logistics service providers, so they keep up in-house logistics operations. On the other hand, logistics service providers have low profitability from domestic business activities since they should meet the requirements for highly customized and diverse services from customers and unstable market situation. This study provided the status report dealing with logistics service contracts in Korea. From the focused group interview with logistics professionals, we found out that service scope, scale and cost structure are the most influential factors affecting logistics service contracts. Also, logistics service providers are more sensitive than users regarding value-added logistics service, contract duration and process. Moreover, this study also proposed the standard clauses for logistics service contract and types of logistics contract applied in current logistics fields. As a result, it is expected that these achievements from this study can be utilized to improve the satisfaction of logistics outsourcing in upgrading service quality and customer service level.

In defense and military facility projects, adjustments to contract amounts due to design changes directly or indirectly affect factors such as increased construction costs and extended construction periods. Moreover, they can lead to differences of opinion and conflicts between the military and contracting parties. This case study analyzed the integrated management of defense and military facility projects by the Gyeonggi Southern Facilities Division, which oversees projects in Seoul and the southern Gyeonggi Province region for the Army, Navy, Marine Corps, and Air Force. Out of 388 completed projects, 103 cases with design changes were selected for analysis, aiming to ensure the reliability of data regarding the proportion of design changes in project completion. The study classified samples by the causes of design changes specified in the Ministry of Planning and Finance's contract regulations, assigning rankings based on the occurrence rates of each cause. Furthermore, it analyzed detailed factors for each cause of design change and derived implications to propose improvement measures. Considering the limited access to military primary data, this case study is expected to contribute to minimizing design changes in defense and military facility projects. Additionally, it is anticipated to be practically useful for subsequent research on contract amount adjustments resulting from design changes.

As contemporary building construction type is getting higher and deeper,construction equipment usage is getting more, and related fatal accidents are on an increasing trend. In these days, due to the deteriorating construction business circumstance, job finding problem of equipment operator, and dumping contract, equipment lease suppliers are putin jeopardy. In high-rise building construction, especially tower crane, mobile elevated work platform and other High place operation cars among construction equipment cause many critical accidents because of drop supply of construction biding bringing out dumping contract could cause unsafe and poor construction management. Because of this, a method was drawn which could grasp the present state of construction equipment management and manage safety of the equipment more easily for accident prevention by choosing 2 kinds of Construction equipment which cause safety accident frequently among the equipment mainly used in construction site. This study suggested a method about construction equipment safety management using "smart phone" base which could be used in safety management for construction equipment by whomever in construction site. After attachment of QR code included safety checklist, It became possible that site managers could check more efficiently by scanning with their smart phone when they inspect equipment. Moreover, by the construction interested who didn't know what and how they have to inspect could point out unsafe condition in the early stage of equipment entering or take unsafe one out of the site by using new smart phone safety checking system is installed, it became possible that critical accident caused by construction equipment was prevented in advance.
‘Schiedsgutachten’ is more of a law phenomenon that appears frequently in privity of contract rather than a concept that is .generally established in the positive law. There is no definition of this in the positive law which makes it difficult to put a finger on the concept but when the concerned party of the conflict puts the establishment of a fact that is a premise to the legal relationship or the right about the legal right's content or the supplementation of the legal relationship to a third party and makes an agreement to follow the third party's judgement, the process is called the contract of schiedsgutachten. At this point, the judgement of the third party is called the schiedsgutachten. This thesis strives to search for an activation of the schiedsgutachten system in Korea by analyzing and researching the systems in various European countries including Germany where the above mentioned schiedsgutachten system is relatively well-developed. First of all, the three types of schiedsgutachten in the German law will be looked into. Based on this, the theories and judicial precedents of Swiss law, French law, Italian law, and British law will be looked into as well. By doing this, similarities and distinction standards between the various countries' legal systems will be further analyzed. Along with this, the legal qualities and the binding power of the schiedsgutachten will be searched out. In Korea, the term schiedsgutachten itself is not customary as the system itself is not actively being carried out. However, in car damage compensation lawsuits which occupy a big percentage, if the schiedsgutachten system were to be used, the problem would be easily solved without progressing to lawsuits. Korea should actively seek out this system with the various models of different countries including Germany which has been introduced in this thesis as a model.
The subject of this study is whether the relevant ordinances of Chungcheongnam-do's five local governments, operating intermediary support organizations for contracted-out community building, comply with the regional innovation and cooperative governance-based perspective. The examination results are summarized as follows. About the normative system: first, village building does not present that it is a participation- and cooperation-based collective activity of various related actors; second, the cooperative governance-based implementation system was not presented as a key term; third, "numerous relevant subjects' participation" and "democratic decision-making and cooperative promotion" are not presented as basic principles; fourth, the subjects are limited to residents and the administration, and only their responsibilities are presented. About the effectiveness system: first, the establishment of a master plan, a primary means, and the establishment of an in-charge department and collaboration system in the administration are presented as optional provisions; second, the nature of the relevant committees and intermediary support organizations is not presented as "public-private cooperation-based system"; third, the area of the function and authority of the relevant committees is limited to review and consultation. Fourth, the related information about the intermediary support organization structure and system, the establishment and operation of the secretariat, and the practical operation of the center is not presented. In sum, to make related ordinances become institutional grounds with stronger effectiveness, reconstructing them by strictly applying the perspectives of regional innovation and cooperative governance is necessary.
