The Applicable Standards for the Injunction in Letters of Credit Disputes (신용상거래분쟁(信用狀去來紛爭)에서의 법원의 Injunction 적용기준(適用基準))

  • Documentary letters of credit including standby letters of credit are governed by the independence or abstraction rule and the doctrine of strict compliance. Since the former rule requires the issuing bank to honor the drafts regardless of the defective performance of the underlying contract, the applicant(the customer) will be without a remedy if he is unable to make himself whole by litigation on the underlying contract. Therefore, the applicant is exposed to a risk much higher than in the commercial letters of credit. The Uniform Customs and Practice for Documentary Credit(UCP) has no provisions allowing legal relief for the applicant on the abuse of L/C by unscrupulous beneficiary, but UCC ${\S}5-114$ has provision allowing injunctive relief for the applicant. In this paper, I attempted to clarify certain standards of injunctive relief available for the customer in the credit. When there is fraud in the L/C transaction by any of the parties concerned, we must weigh the principle of independence or abstraction and the fraud rules. According to banking practice and judicial precedence, we need not keep the principle of independence and abstaction even in fraudulent transaction and the bona fide sufferer must be protected. The purpose of this paper is to review the studies of Fraud rule and the Injunction and to suggest the applicable standards for the Injunction therory under letters of credit. Specially this paper analysed the following ; (1) the guideline for the fraud (exception) rule to the autonomy principle, (2) the appilcable standards of the Injunction, and (3) the implications on parties concerned in letters of credit transaction. Conclusively, the Injunction should be granted if (1) there is clear proof of fraud (2) the fraud constitutes fraudulent abuse if the independent purpose of L/C (3) irreparble injury might follow if injunction is not granted or the recovery of damages would be seriously endangered.

  • A non-documentary conditions is a condition contained in the credit without reference to the presented document in compliance therewith, thereby causing many problems to all parties involved in letter of credit transactions. The purpose of this study is to examine the regulations on the non-documentary conditions under Uniform Customs and Practice for Documentary Credits: UCP, International Standby Practices: ISP98, United Nations Convention on Independent Guarantee and Stand-by Letters of Credit: CIGSLC and Uniform Commercial Code: UCC and also the opinions on the effect of non-documentary conditions through the analysis of several cases on the non-documentary conditions. The result of this study can be summarized as follows: First, UCP, ISP98, CIGSLC and UCC stipulate that banks will deem non-documentary conditions as not stated and will disregard them. Second, courts used to permit the effect of non-documentary conditions. Finally, all parties should not attempt to put in any non-documentary conditions in order to prevent disputes on the effect of non-documentary conditions.

Design and Implementation of a news Archive System using Shot Types (샷의 타입을 이용한 뉴스 아카이브 시스템의 설계 및 구현)

  • In order to build a news archive system. the news video stream should be first segmented into several articles, ad their contents are abstracted effectively. This abstraction helps the users to understand the contents of the article without playing the whole video stream. This paper proposes a new article boundary detection scheme for the news video streams together with a new news article abstraction scheme using the shot types of the news video data. The shots in the news video are classified into anchor person shots, interview shots, speech shots, reporting shots, graphic shots, and others. Since the news article starts with an anchor shot whose duration is relatively longer than other shots with special screen structure, the article boundary in detected by the computing the length of the shot and checking the screen structure in the proposed scheme. For the effective abstraction of the article video, the graphic image located in the right-top of the anchor shot frames is primarily used in the proposed abstraction scheme since it is the abstraction of the article made by the producer of the news according to its contents so that it contains a lot of meaningful information. The key frames of the other shots except interview and report shots are also used to abstract the contents of the articles in the proposed scheme. Upon experimental results, the precision and recall values of the proposed article boundary detection scheme could be 92% and 96%, respectively. This paper also presents a design and implementation of a prototype news archive system on WWW that consists of an indexing tool, an authoring tool, a database for meta-data of the news, and a browsing tool.

An Associative Search System for Mobile Life-log Semantic Networks based on Visualization (시각화 기반 모바일 라이프 로그 시맨틱 네트워크 연관 검색 시스템)

  • Recently, mobile life-log data are collected by mobile devices and used to recode one's life. In order to help a user search data, a mobile life-log semantic network is introduced for storing logs and retrieving associative information. However, associative search systems on common semantic networks in previous studies provide for a user with only found data as text to users. This paper proposes an associative search system for mobile life-log semantic network that supports selection and keyword associative search of which a process and result are a visualized graph representing associative data and their relationships when a user inputs a keyword for search. In addition, by using semantic abstraction, the system improves user's understanding of search result and simplifies the resulting graph. The system's usability was tested by an experiment comparing the system and a text-based search system.

An Energy Estimation-based Routing Protocol for Maximizing Network Lifetime in Wireless Sensor Networks (무선 센서네트워크에서 네트워크 수명을 최대화하기 위한 에너지 추정 기반의 라우팅 프로토콜)

  • Wireless sensor networks are closely related with the geometric environment in which they are deployed. We consider the probable case when a routing protocol runs on an environment with many complex obstacles like downtown surroundings. In addition, there are no unrealistic assumptions in order to increase practicality of the protocol. Our goal is to find a routing protocol for maximizing network lifetime by using only connectivity information in the complex sensor network environment. We propose a topology-based routing algorithm that accomplishes good performance in terms of network lifetime and routing complexity as measures. Our routing algorithm makes routing decision based on a weighted graph as topological abstraction of the complex network. The graph conduces to lifetime enhancement by giving alternative paths, distributing the skewed burden. An energy estimation method is used so as to maintain routing information without any additional cost. We show how our approach can be used to maximize network lifetime and by extensive simulation we prove that out approach gives good results in terms of both measures-network lifetime and routing complexity.

Scale, Untranslatability, Cultural Translation, and World Literature

  • When literatures and cultures encounter their counterparts in terms of the big data or statistics of a new reconfiguration in the cognitive map, the tangential points of the borderland will be reduced to what Mitchell calls "a mere abstraction on a map," which nevertheless will provide a vast interstitial zone of "intersections, competition, and exclusions." This zone will be the dynamic vortex for the aesthetics, politics, and ethics of cultural translation. The translated discourse will engage in carrying across the disturbing region of untranslatability and demonstrate how the literary texts of world literature reveal enriching but threatening human experience. This dynamic border of vortex will construct the translational space of world literature, transcending the fragmentary untranslatable nature of the hybrid convergence of the ethnic, racial, cultural and national intermixtures and constructing what Pascal Casanova terms "The World Republic of Letters." In this paper, I will demonstrate how the very concept of scale is related to literary space as well as how distance creates a poetics of literary landscapes which looks ahead of world literature. Also, I will attempt to find the possibility to relate the "micro-scale" with the "macro-scale," and to construct the scale politics of representation. "Glocalization" is a convenient theoretical tool for the double movement of the up-scale and down-scale.

  • With the current evolution from paper to electronic records the documentary credit market has been looking to ICC to provide guidance in this transition. To allow bankers and traders to familiarize themselves with this trend, eUCP has come into force from April 1st 2002. The eUCP provides definitions to allow current UCP terminology to accommodate the presentation of the equivalent of paper documents electronically and to provide necessary rules to allow the UCP and eUCP to work together. It is important to understand that many of the Articles of the UCP are not impacted by the presentation of electronic equivalent of paper documents and do not require any changes to accommodate electronic presentation. When read together the UCP and the eUCP will be broad enough to allow for developing practice in this area. The eUCP is not a revision of the UCP. The UCP will continue to provide the industry with rules for paper letters of credit in conjunction with the eUCP. This study comments that some characteristics of the eUCP have unique properties, such as juncture, envelope, homotheticity functions, and some applicable interpretations including abstraction of letter of credit, notice of completeness, notice of discrepancies and corruption of electronic records.

  • The software running on avionic systems is required to be highly reliable and productive. Due to these demands, the standard such as ARINC 653 has been suggested, which includes the abstraction of resource partitioning and defines interfaces between avionic operating system and applications. Though there are many manned aerial vehicles employing ARINC 653 based operating systems, Linux-based ARINC 653 for unmanned aerial vehicles has not been studied yet. In this paper, we propose the design of Linux-based ARINC 653 process model and present preliminary implementation. The experiment results present that the implementation is enough to support control software of unmanned helicopter.

Oriental Painting non-photorealistic Rendering by using a Single 2-D Image (한 장의 2차원 이미지를 이용한 동양화적 비사실적 랜더링)

  • This paper presents an automatic Oriental ink-rendering technique that recreates the artistic style of Oriental paintings from a single image. In Oriental paintings are characterized by strokes with various thickness and disordered dispersion. In this study, a stroke drawing method was developed based on the canny edge detector and radial curvature that are suitable for lines with varied thickness even along a single stroke. A dispersion-shading method was likewise developed by applying a set of iterated dual-filtering, and intensity exaggeration methods. The dispersion-shading method is designed to increase the local shade details, to decrease the global shade. Unlike the existing watercolor-rendering and abstraction system the proposed dispersion-shading method achieves disordered shade details rather than simplification.
