Global trade protectionism has increased further and U.S. priorities and protectionism have strengthened since Trump took office in 2017. Trump administration is actively implementing tariff measures based on U.S. domestic trade laws rather than the WTO rules and regulations. In particular, the American government has recently been imposing high tariffs due to national security and imposing economic sanctions on other countries' imports. According to the U.S. Trade Expansion Act Section 232, the American government imposed additional tariffs on steel and aluminum imports to WTO member countries such as China, India, and EU etc. on march 15, 2018. Thus, this study aims to investigate whether the U.S. Trade Expansion Act Section 232 is consistent with GATT/WTO rules by comparing the legal basis of US / China / WTO regulations related to Section 232 of the U.S. Trade Expansion Act, and gives some suggestions for responding to the Section 232 measure. As the Section 232 measure exceeded the scope of GATT's Security Exceptions regulation and is very likely to be understood as a safeguard measure. If so, the American government is deemed to be in breach of WTO's regulations, such as the most-favored-nation treatment obligations and the duty reduction obligations. In addition, American government is deemed to be failed to meet the conditions of initiation of safeguard measure and violated the procedural requirements such as notification and consultation. In order to respond to these U.S. protection trade measures, all affected countries should actively use the WTO multilateral system to prevent unfair measures. Also, it is necessary to revise the standard jurisdiction of the dispute settlement body and to explore the balance of the WTO Exception clause so that it can be applied strictly. Finally, it would be necessary for Chinese exporters to take a counter-strategy under such trade pressure.
In the US, the Sections 301 of the Trade Act of 1974 are still being used to resolve disputes. The U.S' such unilateral retaliations grounded on the Sections 301 of the Trade Act, in fact, violate the WTO agreements and hinder the development of international trade as the trade partner may assume it as a reprisal move impeding the fair settlement of disputes. Here, this study is going to examine the characteristics and functions of the WTO dispute settlement system briefly and compare the countermeasures recognized to be legitimate by the WTO with the U.S' unilateral retaliation. Also, this author will analyse the US-Japan Automobiles (DS6) and EC-Bananas III (DS27) as one of the typical cases resulted from the unilateral retaliation. According to the result, these cases do not conform to WTO-consistency, and it implies that it is absurd to accept the US' unilateral retaliation internationally. In conclusion, presently, it is a global trend to solidify protectionism, and to vitalize trade and resolve trade disputes efficiently, it is needed to prohibit the recourse to unilateral retaliations and also positively apply the WTO dispute settlement system(DSU) defining rules about how to strengthen the multilateral system.
공기업이 민영화가 이루어졌다고 해서 자동적으로 WTO GPA 양허대상에서 철회될 수 있다는 것을 의미하지 않는다. WTO GPA 양허목록에서 철회되려면 여타 회원국의 동의를 받아야 한다. 그러나 문제는 회원국들로부터 동의를 받기도 어려울 뿐더러, 현재 WTO GPA에는 공기업 민영화에 대한 명확한 기준을 가지고 있지 못하다는 점이다. 따라서 공기업이 민영화가 되었다고 하더라도 민영화에 대한 판단 기준이 없으므로 민영화 이후에도 양허대상에서 제외될 수 없다. 이러한 문제점을 해결하기 위해서는 공기업 민영화에 대한 명확한 기준의 설정이 요구되나, 이러한 판단 기준은 우리나라 독자적인 힘으로는 만들 수 없다. 그러므로 일본, EU 등 민영화 판단 기준에 대한 제안을 WTO에 제출한 회원국들과 협조하여 명확한 공기업 민영화 기준을 설정하는 노력이 요구되며, 이를 통하여 민영화된 공기업이 양허대상에서 제외 될 수 있도록 하여야 할 것이다.

In order to promote the domestic aircraft manufacturing industry, this study analyzed the limitations of the preceding study on the WTO dispute concerning civil aircraft by summarizing the latest developments and issues in the mid-range aircraft dispute between Brazil and Canada and the large civil aircraft dispute between the United States and the EU. Based on the results of the study, we should look closely at WTO regulations and existing cases of disputes to find maximum support measures, and we believe that in order to stimulate the domestic aircraft manufacturing industry, we should refrain from publicly specifying support measures in the data, such as laws and policies, utilize the WTO SCM Agreement exceptions, and strengthen links with international cooperation and other industries.
Although the WTO has fulfilled several key tasks it was set up to do - providing periodic reviews of members' trade policies, resolving disputes, supporting negotiations - with the notable exceptions of the Trade Facilitation and Information Technology agreements, WTO members have not been able to negotiate new rules on "bread and butter" trade policies. The importance of doing so was illustrated by the COVID-19 pandemic which saw widespread uncoordinated recourse to trade policy instruments. This paper highlights four reforms that would bolster the effectiveness of the WTO as a forum for trade cooperation: (1) improving collection and reporting of information on trade-related policies; (2) supporting analysis-informed deliberation to establish a common understanding of the need and scope for cooperation in specific policy areas; (3) putting in place a stronger multilateral governance framework for plurilateral cooperation between groups of WTO members; and (4) reestablishing an effective dispute settlement system.
In October 2005, the Russian government started an investigation if safeguard measures against the importation of Korean sodium cyanide products could be taken. With Russia being a non-WTO member country, the Korean side found themselves in different situation from previous negotiation cases with developed or WTO member countries. Although several elements of trade negotiation theories such as goal setting, bargaining power, and relationship could apply, new constraints of limited information access and uncertainty of administrative procedures should be overcome. Combination of the governmental negotiation, assistance of the Russian consumer group, and the application of related laws led the Russian authority to dismiss the case. I suggest that there be some built-in channels for gathering information of non-WTO member countries.
The large increase in RTAs since the late 1980's has challenged the foundations of the multilateral trading system, and thereby has become an axis in the GATT/WTOsystem.While RTAs can be seen to be contradictory to the overall aim of the WTO, they were allowed for in Article XXIV of GATT conditional to certain provision. The failure of compliance and subsequently enforcement of these provisions could be seen as a serious flaw of Article XXIV since the inception of GATT system. Many elements of GATT Article XXIV are not clear and thus lead to divergent interpretations of its disciplines. This considerable divergence in opinions arise from both ambiguities throughout the provisions under GATT Article XXIV. In this regard, both economic and legal work is required to keep up with constantly changing nature of the world trading system. Further, global efforts are required to resolve another teething issue of WTO's problematic institutional framework on GATT/WTO's oversight and surveillance of RTAs. and thereby strengthen the multilateral trading system. Needless to say, theGATT/WTOframework has been essential in paving the way for RTAs while ensuring a more multilateral and liberal trading system. Consequently, global efforts should be made to restructure the WTO for the renewed multilateral trade liberalization in the GATT/WTO.
The main contents of WTO agricultural product agreement are composed of $\circled1$ market access $\circled2$ domestic subsidy and reduction of export subsidy $\circled3$ preferences for developing countries. But there still remains the possibility of laying a protection barrier within WTO regulations. That is to say, with the application of quota system, tariff rate quota system, or different quotas on different countries, and with the practices of government control trade and mark up. This paper is for studying the application of these protection barriers to minimize the impact of agricultural market opening.
This article examines the necessity for the introduction of an ICSID Appellate System. In comparison with the WTO appellate system, the ICSID ad hoc Committee has a very limited mandate. An annulment inquiry under the ICSID arbitration system barely focuses on whether the arbitral decision resulted from a justifiable process. As long as there is procedural legitimacy, the resulting awards remain unaffected under the annulment procedure, irrespective of mistakes of fact or law. In contrast, in the WTO DSS the AB substantively reviews panel rulings and suggestions that are founded on any deficiency of objectivity or error in the interpretation of a particular WTO provision. This defect intrinsic in the annulment procedure could cause injustice to a party earnestly interested in correcting recognized misapplication of law by ICSID tribunals. Accordingly, the establishment of an appellate system would result in a more substantive and procedural review of awards. The creation of such an ICSID appellate system would ensure thorough scrutiny of the decisions of the tribunal of first instance, leading to better reasoned outcomes. This could lead to a crystallization of predictability in investment relations. The end result would be that fairness, clarity, reliability, and legality in the ICSID adjudicative process would be unassailable, to the advantage of all the contracting parties.
WTO는 범세계적 글로벌 경쟁상황에서 국가간 무역거래를 제한하고 자원배분을 왜곡하여 결과적으로 세계 후생의 감소를 가져오는 개별 국가들의 관세 및 각종 비관세장벽, 그리고 자원의 효율적 배분을 왜곡하는 각국 정부의 보조금 정책 시정을 위해 창설되었다. 항공기산업에 있어서 보조금 논쟁의 특징은 주로 선-선진국간 분쟁에 국한된다는 점에서 기존의 WTO에서 많은 갈등을 빚고 있는 선-후진국간의 분쟁과는 큰 차이가 있다. 한국이 주도적으로 대규모 개발사업을 추진하면서 정부보조금을 지급할 경우에는 장기적으로 보조금 분쟁에 휘말릴 가능성이 있다. 그러나 미국/유럽간 쌍무협정 체결 내용에서 보듯이 개발보조금 지급 비중이 전체 개발비의 33%이상이 되지 않을 경우는 큰 문제가 없을 것으로 예상되며, 추가적 지원이 필요할 경우에는 직접적 개발비 보다는 관련 지 원인프라 지원을 통해 특정성 문제를 회피할 필요가 있다. 또한 한국은 아직 WTO 민간 항공기 협정 미가입 상태이기 때문에 WTO로부터 당장 규제대상은 아니다. 실제로 WTO 회원 가입 절차는 WTO로부터 요청 후 국내 검토를 거쳐 예비회원가입(2년 소요)-정회원의 절차를 거치게 된다. 또한 보조금 지급에 의한 경쟁자의 산업 피해가 직접적으로 드러날 때까지는 더 많은 시간이 소요되기 때문에 실제로 WTO 제재를 받기까지는 상당한 시간을 확보할 수 있다. 그럼에도 불구하고 WTO 회원이 되면 항공기산업의 육성에 많은 제약이 따르므로 사전적으로 충분한 정부 지원을 통해 조속히 국제경쟁력을 키우는 전략이 필요한 것으로 보인다.
