This paper analyzed articles of u-City Construction Law, which has been enacted on 29th of September last year, and evaluated their appropriateness and other laws associated with u-city services for better provision of u-cities and u-city services. The enacted law established the concept of u-city in Korea and provided relating industries with construction procedures, technology developments, and standards. These efforts have substantial implications as the first stepping stone, but also raised several problems. Hence, this paper suggested that the u-City Construction Law should be amended as follows. First, The minimum size of u-cities, that is required by the law, should be decreased. Second, various kinds of incentives should be provided to the u-city project companies. Third, new organizations such as u-City commission and National or Regional Control and Management Center will be necessary. Fourth, technology standards and inter-operability among cities should be provided in the areas of the control and management centers. And Finally, more measures of and focuses on project financing issues should be made.

유비쿼터스도시의 건설 등에 관한 법률은 2010년까지 신도시 지역에 활발히 추진된 U-City 사업의 제도적 근간으로 작용하여 왔다. 그러나 최근 기성시가지 재활성화, 도시재생 중심으로 국가의 도시정책이 변화됨에 따라 신도시 중심의 절차법적 성격이 강한 U-City법 개정에 관한 요구가 증대되고 있다. 이에 본 연구에서는 국가 도시정책의 변화와 U-City를 둘러싼 여건변화를 감안하여 U-City법 개정방향을 U-City 사업다양화, U-City 관리운영 강화, U-City 사업지원으로 설정하고 그에 따른 세부 추진방안을 제시하였다. 본 연구는 국가 도시정책 흐름 및 수요를 반영함에 있어 실무적 관점에서 현행 U-City법이 가지는 문제점을 살피고 그 개선방안을 제시하는데 그 목적이 있다. 본 연구의 결과는 지속적인 U-City 발전 및 확산을 법제도적으로 지원하기 위한 기초자료로 활용될 수 있을 것으로 기대된다.

U-City의 계획, 건설 및 개발 후 운영 관리를 지원하기 위한 "유비쿼터스도시의건설등에관한법률(이하 u-City 법) 이 제정 공포되었다(2008.3.28). 본 법률을 근거로 한 국가주도 u-City도입의 궁극적 목표는 이미 선진국 궤도에 근접한 우리나라의 IT, 공간정보인프라를 적극 활용한 도시공간 이용 및 관리의 첨단화에 있다고 하겠다. 법에 의한 u-City의 정의는 물리적 도시기반시설에 u-City기술을 적용하여 u-City기반시설 화하고 이를 통해 다양한 u-City서비스를 제공하는 도시로 규정되어 있다. 그러나 현 법규정의 가장 핵심개념에 해당하는 u-City서비스, 기술 및 기반시설과 이들의 상호관계의 상세 정도로는 각 지자체의 특성과 역량에 맞는 도시기반시설지능화 및 이를 통한 u-City서비스 제공 등의 가이드 효과를 충분히 기대하기 어려운 실정이다. 따라서 본 연구의 목적은 안정적이고 만족도 높은 u-City서비스의 계획, 구축 및 운영관리를 위한 법제도 정비의 핵심사안의 하나로서 서비스-기술-기반시설간 상호관계 정립의 기본방향 및 추진전략을 제시하는데 있다.

The vision of u-City is an implementation of ubiquitous environments that makes anybody to be able to access the source of information and knowledge in anywhere and anytime with any methods. It is necessary to study the law and institution of u-City about a role of the government and local governments to have a new growth power. We need to improve the related law and institution with standardization of u-City service to regulate and coordinate diversity of main organ and business area. In this paper, we select service modes to consider the priority order of service and suggest a reform measure of law and institution classified by service models

Starting from 2005, as the new city paradigm, the term 'u-City' was created in Korea. U-City service, as defined in "u-City law", is a service that connects and intermediates among government, traffic, welfare, environment, disaster mitigation, etc., and their data based on ubiquitous city technology and infrastructure. According to the survey executed by local governments, the improvements in the standard of living of citizens have in turn increased the needs for anti-mitigation services. Such trend is bolstered with the recent disasters such as the conflagration of Korean Soong-rae Gate and the devastating earthquake of Sichuan province. This article describes a concept of the u-City disaster prevention service and looks into the activities and planning of u-City disaster prevention service of local governments. This paper also briefly looks into the law and policies to derive the needs of u-City disaster prevention service as well as the current technologies and u-City disaster prevention services of local governments. Ultimately, this paper offers the strategic direction of developing u-Disaster Prevention City.

U-City법의 제정 및 시행에 따라 U-City를 건설하기 위한 제도적인 기틀은 마련되었으나 U-City법에 의한 계획체계가 정립되어 있지 않고 세부적인 지침도 마련되어 있지 않다. 특히 U-City의 핵심인 정보와 관련해서도 구체적인 계획과 지침 등이 마련되어 있지 않다. 따라서 본 연구에서는 U-City법에 의해 국가와 지자체에서 수립해야 할 U-City종합계획과 U-City계획에 포함되어야 할 U-City정보의 생산 수집 가공 활용 및 유통 등 정보관리에 관한 사항을 제시하였다. 먼저 U-City종합계획은 U-City계획 수립의 방향성을 제시하며, 우선적으로 추진해야 할 세부 실천과제는 '연계 및 공유를 위한 U-City정보 생산 수집 가공 기준 수립', 'U-City정보의 가공 및 활용 활성화 방안 수립', 'U-City정보 유통체계 기반구축', 'U-City정보 품질 및 가격제도 확립'이다. 그리고 U-City계획은 U-City종합계획을 기반으로 지자체단위의 정보의 생산 수집 가공 활용 및 유통 등 정보관리사항을 수립해야 한다.

u-City의 계획, 건설 및 운영 관리를 지원하기 위한 "유비쿼터스도시의건설등에관한법률(이하 'u-City법'이라고 함)"이 제정 공포되었다(2008.3.28). u-City 통합운영센터(이하 '운영센터'라고 함)는 u-City의 의미와 상징성에 있어서 그 역할이 매우 크며, 그 제도적 정착이 u-City 실현에 가장 중요한 요소라고 하겠다. 운영센터의 설치는 u-City가 일반도시와 구별되는 가장 상징적 의미를 가질 뿐만 아니라, 일반도시가 u-City화 되기 위한 필수 구현요소에 해당한다. 또한 도시내 다양한 시설, 서비스 및 이를 지원하기 위한 관련 정보시스템과 인프라기반 등의 융복합화를 총괄적으로 관할하는 핵심시설로서 그 의미와 중요성이 매우 크다. 이러한 핵심역할과 상징성에도 불구하고 운영센터의 기초 개념정의, 구조 및 운영방안 등 전반적 사항에 대한 재정리와 이를 적극적으로 표준화하여 제도적으로 정착시키는 방안마련이 매우 미진한 것이 현실이다. 본 연구의 목적은 운영센터의 성공적 구현을 위한 법적 기반 조성의 일환으로 이제까지 거론된 운영센터의 제반 현안들을 정의와 위상을 중심으로 정리하고, 성공적 운영센터구현을 향한 제도적 정착방안 마련을 위한 기본방향과 추진전략을 제시하는데 있다.

2008년 2월 $\ulcorner$유비쿼터스도시의건설등에관한법률$\lrcorner$이 국회를 통과하였다. 이 법에는 유비쿼터스도시 계획, 건설, 관리에 관한 사항들이 정해져 있다. 범국가 차원의 법 추진체계가 마련됨에 따라 향후 도시들이 u-City로 계획되고 건설될 수 있는 법적 근거를 가지게 된다. 앞으로 이 법률에 근거하여 국가차원의 u-City 종합계획 등 계획적 수요가 크게 증대할 것으로 기대된다. 본 연구는 이러한 새로운 수요에 대응하기 위해 u-City를 실제 구현하고 현실화하기 위한 수단으로 계획적 접근방법을 찾아보고자 수행되었다. 저마다 다른 내용과 범위를 가지고 난립하고 있는 u-City 사업을 보다 구조화되고 체계화된 관점에서 수립되도록 규정하기 위한 틀을 제공하고자 하였다. 이에 본 연구는 u-City 구현을 위한 종합적인 계획체계의 틀을 정립하는데 목적을 두고 u-City 계획과 관련된 이론적 근거를 살펴보고 기존 u-City관련 사례 및 관련 계획을 분석하고 이를 바탕으로 u-City 계획체계의 개념, 특성, 구성요소를 정립하였다.

정부는 u-City 사업 활성화를 위한 지원책으로서 '유비쿼터스 도시 건설 등에 관한 법률'을 제정하였다. 그러나 이 법은 몇 가지 쟁점들, 다시 말해 종합계획 내용 및 절차의 보완 필요성, 공공기관 간의 자가통신망 연계 불가, 재원 마련 대책 미흡 등이 여전히 u-City 활성화에 장애가 되고 있다. 이에 본 연구는 관련 법률들을 면밀히 검토 분석하여 "유비쿼터스 도시 건설 등에 관한법률"과 관련한 쟁점과 해결방안을 찾고, 법 개정 등에 필요한 개선사항을 제시하였다.

As a leading nation of ubiquitous technology, South Korea has been promoting u-City pilot projects throughout the country. According to 'Fundamental Construction Law of u-City,' u-City projects are classified into old-town and new-town types. However, most projects have focused only on the new-town type. Pushing forward large-scale land development projects, Korea Land and Housing Corporation (LH Co.) under Ministry of Land Transport and Maritime Affairs (MLTM) has gained a development profit out of the u-City infrastructure and then donated the infrastructure to a local government without making any plan for operations. In the process of u-City pilot projects, old-towns have been relatively ignored and various of unexpected problems have emerged. Building the u-City of an old-town is not easy due to many constraints such as huge initial investment, long validity and verification procedures, lack of useful services for citizens, lack of professional outsourcing methods for business promotion, high operating costs of the integrated control center, inadequate law related, insufficient institutional requirements and so on. This paper introduces a case study on u-City development for an old-town, Ansan City, as a private investment project. The case will help boost u-City projects for old-towns by solving their problems and providing an effective operational mechanism. As the first BTL (Build-Transfer-Lease) project for constructing u-City, 'Broadband Information Network Development Project' of Ansan City will provide a reference model of expanding u-City projects for other cities.
