This study is concerned with the identification of the concepts and characteristics of the traditional access of small scale fishery and traditional small scale fishery based on the classification of fisheries under Fisheries Law, As we called, these fisheries are the small scale of artisanal fisheries. These traditional small scale of artisanal fisheries have been developed throughout the most coastal fisheries but have never been included the institutional fishery system and policy since industrial fisheries have been exploited. By this reason there was no studies to understand and identify these fisheries as fisheries under category of institutional fishery system. Recently by the Fisheries Law, my Person who desires to operate these fisheries, shall report to the provincial governor and then these fisheries were incorporated into the category of fisheries to be reported. But this case of the administrative practices should be not consistent with the classification of fisheries under Fisheries Law. The traditional access of small scale fishery is a derivative concept of fishery categories under the institutional fakery system Because this fishery under institutional fishery system can not be establish the right of fishing by fishery right system technically but the right of fishing is supported by the fishing access system only. Therefore, It is a mistake for the provincial fishery governor to adopt such a policy that the fishing right of the traditional access of small scale fishery which is different from the fishing based right is restricted by the factors of fisheries to be reported. On the other hand the traditional small scale fishery is coincident with the traditional access of small scale fishery and the common fishery under the style of utilization of fishing gear and fishing gear and methods. But this fishery has never been included the fishery categories supported by the government subsidy policies and considerations and has been remained with indifference during the last few decades. Anyhow the fishing right of these fisheries have been assured under the institutional fishery system, any person who desires to operate this fishery should have a fishing right against the public or private uses of fishing ground such as land reclamations and other coastal zone development. A deprivation of the fishing right of this fishery by the conflicts of these public and private uses of fishing ground is not regarded as appropriate according to the social welfare policy. Also it is the administrative expediency to support the fishing right of this fishery under the fisheries lobe reported.
It can be said that the fishery industry in ancient China did not originally occupy a very special economic area even when it was started. At that time, the fishery industry was only treated as a means for the livelihood of ordinary people. Over time, the value and economic benefit of aquatic products began to be valued. Its origin can be said to have originated from Yugong(禹貢), which was established by King Yu. These records made it clear that the ancient kings placed great importance on the economic value of seafood and the importance of the fishery industry in the government. Thus, the fishery industry was established as a part of the socio-economic system. In ancient China, the fishery industry was one of the industrial systems that supported traditional Chinese society along with agriculture. It will be possible to analyze the way of thinking of modern Chinese people on the fishery industry through the study of the fishery industry in the traditional era of China. And based on this analysis, I think that it will be able to contribute to a certain extent in establishing a theoretical foundation for countermeasures against the reckless overfishing of fishery resources by Chinese fishermen in the West Sea, which is currently a problem.
In this paper, fishery economics is reviewed to extend a basic opportunity for developing new fishery economics and to evaluate the effects of the import liberalization on the fish trade structure of Korea. The principle outline of extensions emphasis to realize the modern fishery problems based on fishery economics and develop the practical methodology in order to analyze the impacts of the import liberalization on the fishery and fishermen welfare. During the process of export - oriented industrilization, the role and position of fishery in the economy is changed dynamically. When faced with the imperative of the role and position of fishery in the economy, fishery economists and domestic policy makers must decide how to organize themselves for solving fishery problems under the new regime in the import liberalization on the fish trade. Fishery problems impacted by the new regime can not be solved by fishery itself but be solved by the centralized efforts of all contributors in national views. Therefore the new systematic analytical methodology must be develop and the traditional fishery economics must be related to the regional development strategy and fishery sociology as subsidiary theories specialized. Due to the impacts of the import liberalization on the fish trade structure, fishery economists face with radical changes in the domestic fishery : a place of the resources harvest to place of the combination resource harvest and its demand, a fishing as a resource exploitation to a fishing as a resource management, a traditional small scale costal fishing to a modernized and scaled fishing, fishery using the given natural resource itself to fishery as technology intensive industry, and a food supply industry to a welfare indusry based on the regional and economic resource and social environment. As these changes, fishery and its community's regional and economic resource and social environments as multiple roles of the regional economic development are emphasized in fishery economics under the new regime in the import liberalization on the fish trade. Furthermore, domestic policy makers and administrators in a public sector must realize the above radical changing trends in fishery and understand a social and economic environment in fishery and develop a new fishery structure focusing on the fishing system and the fishery laws. As this point, they make efforts to improve and develop fishery as a food supply industry. Japan, for example, has a non - governmental organization to conflict the problem of international fishery such as a movement of a civil environmental protection. Also fishermen in Japan already realized conservation and pollution problems in fishing as fundamental issues of human being.
The relatively recent emphasis on a total allowable catch(TAC) system is placing new demands on fisheries management. Korean fisheries law has provided recently for implementation of the TAC based on fishery management system, in order to conserve and manage fisheries resources rationally in its exclusive economic zone(EEZ). In 1998, the TAC system was first applied to Korean fisheries. This TAC system is currently undergoing a second trial period, having been put under the system for 20012002 and continuous trial basis until the complete settlement of EEZ system agreement among three countries, Korea, China and Japan. The TAC system implementation needs are sophisticated information collection, analysis and modeling that will continue to increase and require the high management resources. In addition, data on social and economic impacts on TAC system is sometimes inadequate. The implementation of the TAC system provides a unique opportunity to examine the limits of management information and resources, and to solve the problems in Korean fisheries management system, These limits and problems are complicated by an inadequate biologically and economically information and insufficient management resources. Government and fisheries cooperatives must be cooperated in the management process in order to minimize its conflicts and maximize commitment to sustain fishery development. Recognition of the ineffectiveness and its potential consequences leads to the adoption of the cooperative-based co-management approach in implementation of TAC system. In 1998, the TAC system was first applied to Korean fisheries, where traditional fishery management has consisted mainly of technical measures and input controls. The QMS of TAC system has been implemented in the form of cooperative-based co-management framework. This QMS framework was chosen to overcome many difficulties and limits that a competitive TAC system would impose on Korean traditional fisheries management. The implementation of the QMS of TAC system provides a unique opportunity to examine the limits of management information and resources, and to solve the problems in Korean fisheries management system.
The study examined overuse of the fishery resource. Influence of fishing activity was estimated by application of Schaefer model's. Fishing efforts that produced the maximum sustainable yield were determined in the model, allowing the effect of overfishing to be assessed. In the model, a wide variety of fish species as well as crustaceans and shellfish were susceptible to overfishing, while mollusks were not. Overfishing by modern techniques exacted a greater toll than more traditional methods. The results of the modeling study suggest that the 'Buy bag' input-control system of fisheries resource management warrants consideration, as does modernization, expansion and strengthening of self-control management of the fishery resource. Finally, more effective efforts in dissemination of policy information and education concerning the fishery resource are needed.
The existing Law of fisheries Management of China was firstly established on October 30th, 1986 and revised in October, 2000. The new Law of Fisheries Management provided a basis for introduction of the TAC (total allowable catch) system into China. Introduction of the TAC system is a natural result of the practise of EEZ (exclusive economic zone). In addition, the inability of the traditional fishery management system and the promising results obtained by conductions of TAC system in some countries with advanced fishery also make the introduction of TAC system a necessity, However, the contradictions between the unrealistic introduction of the fisheries management systems, the small-scale operation, higher expense of the conduction and supervision of the systems, and the insufficiencies of human power, financial fund, and scientific technique of the underdeveloped country resulted in the ineffectiveness of the new systems. So this study is to discuss the background and the possibility of TAC system implementation in china. The results of this study showed that many factors restrict the implementation of TAC system into China at present. It will take a long time to practise the new system. meanwhile, reforming and improving the functions of the existing systems to provide a better environment will play an important role in the introduction of the TAC system into china.

The fisheries resources control system in the Fisheries Act of Korea is introducing technical management method and input control method that controls fishing effort. Fishing effort control system of Korea aiming at realizing the maximum sustainable yield does not regulating the limitation of fishing quota and the limitation of fisheries object target fish. Therefore fishing operators who have fishing permit can use fishery resources without any restriction of fishing quota. But there are no rules that can controlling capacity of productivity of fishing by developing of fishing technic and fishing gear. For those reasons, productivity of fishing is superior to reproductivity of fisheries resources. Therefore, the Fisheries Act of Korea rearranges a legal basis for an introduction of fisheries resources management system by TAC, but the contents to be possible for a legal guarantee is not included and it is exceedingly defective as abstract and institutional devices. And that the affairs to be required for an enforcement of the said regime was placed in an administrative mandatory legislation and the danger to be degenerated is high in accordance with the bureaucratic self-righteous and/or the coercion of group's interest concerned and accordingly its substitute legislation system is keenly required. TAC system that is going to be introduced in our country is expected to enforce the Olympic fishing method and the individual quota method in parallel. This method is not certainly proper, because it occurs to overcapitalize and to compete fishing amounts between fishery operators. So as to prevent overcapitalization and fishing competition between fishery operators, and the exhaustion of coastal fisheries resources, individual transferable quota system should be introduced in Korean sea. Accordingly this thesis has attempted to constitute a view to improving problems of the traditional fisheries resources control system and introducing TAC fisheries resources control system.
Since the declaration made by UN Convention on the Law of the Sea on EEZs, The open seas of Northeast Asia, considerd as a convention area, needed new agreements in conformity with the changes brought by the introduction of the Exclusive Economic Zone(EEZ) system. The Contracting Parties of these agreements set up their own EEZs, which extend certain ranges from their baselines, Fishing in the other party's EEZ is done based on mutual agreements, which take into account traditional fishing activity in the zones. Seperate fishries management systems, in accordance with the relevant legal status of the waters, are applied to individual overlapping areas: Middle Zone in the Bast Sea and the waters south of jeju Island, Interim Measure Zone in the Yellow Sea and East China Sea, and the Transitional Zone in the Yellow Sea. They decided to conclude fisheries agreements as the provisional agreement under Article 74(3) of the UN Convention before the delimitations of the EEZs to avoid the territorial disputes. China and Japan concluded the Fishries Agreement in the November 1997, allowing each coastal State 52 mile EEZ. it was followed by Korea and Japan in September 1998, reaching a final compromise. And also Korea and China came to a satisfactary settlement in November 1998. Fisheries agreements have been established between the three North-east Asian States, the agreement are all bilateral. That implies inefficient resource management on the overlapping waters of the three states, especially on the East China Sea. The Korea-Japan Fisheries Agreement and the China-Japan Fishery Agreement worked as governing rules in the North-east Asian seas before the establishment of EEZs (Exclusive Economic Zones). However the conclusion of the bilateral fishery agreements, Korea China and Japan have developed EEZs, and these three countries have competed for the exploitation of fisheries resources. Therefore, the issue of fisheries resource management was no longer a single countries' problem and emerged as a common issue facing these three countries. In recognition of the above-mentioned problem, it is needed for the construction of cooperative System fishery management in the North-east Asian seas. Therefore, cooperative measures should be establishied. The final goal of the construction of fisheries management cooperative system is to establish sustainable fisheries in the North-east Asian seas. However, there is a big difference in fisheries management tools, fishing gear, exploitation rate of species, etc. This implies that a careful approach should be taken in order to achieve the cooperative fisheries management among Korea, China and Japan. conclusionly, the Governments of Korea, China and Japan should complement three bilateral agreemens, and which they prepares to 'Fisheries Resource Restore Program' Between Korea, China and Japan in the adjacent waters south of Jeju Island.
When the international fisheries order changes following the UN Law of the Sea, the new regional fisheries order is forming among East North Asian states and era of Economic Zones is really coming. In those changes of foreign and domestic fisheries environment, to maintain sustainable growth of the industry in 21st century the North East Asian states plot adjustments to fisheries management, such as introduction of the TAC system and others. The TAC seems to be an appropriate systematic response especially because traditional functions of fisheries management have already demonstrated their limits in regards to fisheries sustainable development. Introduction of the TAC to the North East Asian fisheries not only resolves the inability of traditional fisheries management to develop the industry consequently, but also strengthens the EEZ and existing marine management systems. However, the TAC was born by thewestern industrial mentality, still contains persistent mistakes and is difficult to change. Therefore, its introduction to and implication in North East Asian region might cause numerous problems. From this point of view, introduction of the TAC system will disregard peculiarities of North East Asian fisheries, so main efforts should be concentrated on improving the functions of existing system via consecutive step-by-step approach. In addition, the TAC should be grafted into the existing fisheries system through cooperative management system, creating stable systematic ground and considering scientific and fisheries motives. Especially, TAC system, unlike the traditional fisheries' management system, is scientific, being systematically developed one, and needs to be gradually installed, considering its systematic character. Therefore, the TAC should better be introduced by systematic and scientific approaches, paying more attention to strengthening the existing fisheries system, but not immediately and in the form it is right now. Concluding, introduction of the TAC can not be made considering the outward factors deriving from the UN Law of the Sea without corrections.'h overcome limitations and ineffectiveness of traditional fisheries, most efforts should be concentrated on basic revision of 21st centuries' fisheries and strengthening the functions of traditional fisheries aimed to develop the leading business of marine industries.

There are many bamboo weir (Juk-Bang-Ryeum) with the highest preservation value as a fisheries heritage from Sacheon to Namhae area in the Korea Hanrye National Marine Park. It was designated as a Korea National Cultural Property Sightseeing No. 71, and also as an important fishery asset listed in the Korea National Important Fisheries Heritage No. 3. It is an important cultural heritage that should be preserved for the future as a community asset to the local residents, and should be preserved as it's original form because of unique traditional fishery style in the world as well as natural environment oriented fishing system. The purpose of this study is to review the value of Juk-Bang-Ryeum in the South Sea as well as to preserve the tradition of it. This paper will make a contribution to the registration of it on the list of World Important Agricultural and Fishery Heritage (GIAHS), which is recognized by the United Nations Food and Agriculture Organization (FAO). To make basic data for listing on it, we will analyze the characteristics and structure of Juk-Bang-Ryeum, and also research the value of it from the historical literature review as well state of arts. We also develop a scheme for listing on FAO GIAHS through checking necessary items step by step. Finally, we suggest some idea to preserve it more effectively.
