A Study on the Effectual Operating Device for Private Security Service (민간경호업무의 효율적인 운영방안에 관한 연구)

  • The suggestions that follow are about the effectual operating device for private security service. First, in legal and institutional policy, new establishment by law for private security and more support from government is asked. Moreover, the restructuring or M&A between petty companies and the pricing for security service should be performed. Second, in the structural aspect of private security industry, the professional education center for private security guards should be established and the terms of payment and welfare should be improved to the level above standard. In addition, it should be achieved to change the public to have a new and correct understanding of private security and develop the specialized parts suited to the characteristic and ability of each companies. Third, the construction of operating system for private security service should be achieved; recruit system for competent security guards, marketing strategy and enforcement system, widely known confidence to client, normal training system for security guards and post management system for client. This is also to be suited to the characteristic of each companies.

  • From now on, the direction of fishery products circulation measure should be improved the system to give just the right of free choice of sale route like retail, direct sale, direct dealings and direct shipping only for fishermen to produce them diversifing the function and the role of current fish market in the production to prepare the fishery internationalization, to improve the competitiveness of coastal and off-shore fishery. Practically wholesale market in land and fish market in the production have the different function and role, the organization of wholesale market in land can't substitute the essential function and role which fish market in the production should perform. So far, fisheries cooperatives as a managing subject of fish market in the production have depended on the consignment sales and purchases of fishery products but, from now on, it should be explore the widespread supply way of fishery products by producing value - added fishery products that should bring higher demand from the consumers, producer - consumer direct marketing system through not only consignment sales but also direct sales that common processing and manufacturing system of fishery products under the management of FC has been established. The direction of the idealest structural improvement of fishery production circulation organization is to establish the the position of the fishery retail price leader based on the standard of market in the fisheries production due to existing characteristics of fisheries, accordingly, to harmony the market organization of direct transportation, direct sales and direct dealings form by producer and group of producers with market organization in the fisheries production, and to make the condition to do the appropriate distributive function.

  • In an era of very rapid technological change, standardization organizations have been confronted with the problem that they should develop more new and more complex standards as strategic tools for enforcement of competitive power in shorter time according to the reduction of Life Cycle of products and the increase in the number of standards and their complexity. To cope with this challenge, we introduce the functionalities and development directions for implementing standardization information system. Also this paper describes the architecture of the next generation system for standard information that enabling information sharing and exchanging using XML. Finally, we suggest implementation framework of Standardization Vortal Site for the One-stop service of integrated standards information which provide users with standards development roadmap and give brief introduction to SOL(Standards On-Line) site which is operated by ETRI/PEC.

  • In 2008, North Korea revised its Foreign Economic Arbitration Act. To some extent, the new Act reflected such international standard of arbitration as UNCITRAL Arbitration Rules. In this paper, the said Act will be evaluated, and then cooperation ways of South-North Korea on Inter-Korean Commercial Arbitration will be suggested. In 2007, the Ministry of Unification has designated the Korean Commercial Arbitration Board as Inter-Korean Arbitration Committee and has made efforts to prepare follow-up measures on the two Agreements of Inter-Korean Commercial Arbitration. In 2008 however, the follow-up measures has in fact been suspended. In order to revitalize the Inter-Korean commercial arbitration, some prerequisites must be satisfied. First, Inter-Korean Arbitration Committee for Inter-Korean commercial arbitration should re-open as soon as possible. Second, as North Korea recently shows interest in joining the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards(now so called New York Convention), Governmental Authority of Rep. of Korea should also actively assist and support their joining in New York Convention. Third, both Korean governments should carry out joint study on raising the efficiency of the arbitration system which they will use. Fourth, comparative study on arbitration systems used in both countries should be conducted. Also, it may is very timely to discuss the issue in international arbitration community such as "North-East Asia International Arbitration Conference" or other similar events. In conclusion, continuous study on prevention of commercial disputes between South-North Korea and ways to resolve disputes when they arise should be conducted.

  • NIR(New Inspection Regime, hereinafter NIR) relating to the PSC(Port State Contorl, hereinafter PSC) has implemented in Asia-Pacific region under Tokyo-MOU from last January 2014. The most noticable difference between NIR and existing TF(Target Factor, hereinafter TF) is to evaluate company performance and to conduct PSC with flexible inspection interval on the basis of Ship Risk Profile; High Risk Ship, Standard Risk Ship and Low Risk Ship. Particularly deficiencies related to ISM Code, more than 5 deficiencies and detention record have a serious effect on the evaluation of Ship Risk Profile. Therefore ship and company are requested to ensure proper implementation of Safety Management System for the changed PSC tendency. Also RO(Recognized Organization, hereinafter RO) and Administration respectively should take suitable actions different to previous measures, such as implementation of cooperation and support system between vessel and company, changing subject and object for avoiding Mannerism in SMS audit, strengthening supervision on RO by Administration and establishment of private-public Partnership network.

  • In order to clearly recognize illegality of insurance crime, declaring the provisions on insurance crime is preferable. An insurance fraud differentiated from Configuration Requirements of general fraud should be established And differentiation in accordance with the act type of insurance crime the degree of organizational involvement is required. Also the introduction of civil sanctions and creation of additional punishment provision about Organized insurance fraud are required.   • A recent trend of global shipping industry adopting Port State Control (PSC) system is recognized as a proficient mechanism in preventing maritime accident and protecting marine environment. Disadvantages of Korean shipping companies in PSC inspection are unavoidable as Tokyo MOU imposed priority listed flag to Korea Having stated above, appropriate research and prompt preparation in compliance with current PSC requirements for the Korean shipping companies have become an immediate need The objectives of this study are: First, to review in understanding of PSC in overall and foundation of enforcement. Second, to study interaction of international treaties regarding PSC. Third, to compare practical compliance among the countries and to open up a case study on Korean shipping companies in adopting PSC Last, to suggest direction to the Korea shipping companies the most proficient way in compliance with the current Tokyo MOU requirement.

  • This study discusses effective extraterritorial application of criminal Law outside the territorial sea. The paper focuses on the factual differences between vessels and cars which justify the varying standard. Thus, warrantless searches and safety inspection need to be validated because of the exigent circumstances of the sea. Warrantless searches at sea may also be justified based on border search exception. These theories in U. S. law will be helpful for legislation and law enforcement related to the Korean Coast Guard's mission. The paper also discusses Korean Coast Guard's Act's newly enacted provisions concerning search, arrest and hot pursuit.

Second-Hand Smoke in Public Spaces: How Effective has Partial Smoke-Free Legislation Been in Malaysia?

  • Background: This study was performed to gather data on second-hand smoke (SHS) concentrations in a range of public venues following the implementation of partial Smoke-Free Legislation in Malaysia in 2004. Materials and Methods: $PM_{2.5}$ was measured as a marker of SHS levels in a total of 61 restaurants, entertainment centres, internet caf$\acute{e}$s and pubs in Kuala Lumpur, Malaysia. Results: Under the current smoke-free laws smoking was prohibited in 42 of the 61 premises. Active smoking was observed in nearly one-third (n=12) of these. For premises where smoking was prohibited and no active smoking observed, the mean (standard deviation) indoor $PM_{2.5}$ concentration was 33.4 (23.8) ${\mu}g/m^3$ compared to 187.1 (135.1) ${\mu}g/m^3$ in premises where smoking was observed The highest mean $PM_{2.5}$ was observed in pubs [361.5 (199.3) ${\mu}g/m^3$]. Conclusions: This study provides evidence of high levels of SHS across a range of hospitality venues, including about one-third of those where smoking is prohibited, despite 8 years of smoke-free legislation. Compliance with the legislation appeared to be particularly poor in entertainment centres and internet caf$\acute{e}$s. Workers and non-smoking patrons continue to be exposed to high concentrations of SHS within the hospitality industry in Malaysia and there is an urgent need for increased enforcement of existing legislation and consideration of more comprehensive laws to protect health.

  • As the IEEE 802.11 WLAN has widely installed as a high-speed wireless network information infrastructure, there has been growing interest in both security and mobility of mobile terminals. However, for the case of mobile terminal employing IEEE 802.11i security standard, it is known that the user authentication procedure of IEEE 802.1x for stronger security enforcement may, due to its large delay, not be suitable for real-time multimedia communication. In this paper, we have proposed fast authentication method to resolve the above authentication delay problem, and verifies its performance via simulation analysis. Mobile terminals can get AP information reliably, and selectively execute authentication in advance during handover, which results in fast user authentication. In addition, by effectively managing the authentication information in mobile terminal, which are distributed in advance for pre-authentication, the problem of long-time revelation of authentication information has been solved.
