On the Japanese New Alternative Dispute Resolution System in the Financial Sector (일본의 금융분야 ADR 에 관한 검토)

  • In the past, ADR has not been used as frequently in Japan as it has in other parts of the industrialized world. However, though litigation is still the most utilized vehicle of dispute resolution by Japanese financial institutions, this will be changing. The New Financial ADR system, which was created by a June 2009 amendment to the Financial Instruments and Exchange Act, is meant to deal with every stage of financial-related disputes and, as such, strives to resolve disputes before they become significant and acts to ameliorate any post-ADR issues that may remain, thereby completing the FIEA's purpose to protect investors. Since the foundation of the New Financial ADR system applies to all related industries, new provisions were set out in 16 business related acts, such as the Banking Act, the Insurance Business Act, and FIEA itself. October 2010 will mark the formal introduction of a new system of financial ADR in Japan. New Financial ADR in Japan will be modeled on the Financial Ombudsman Service in the United Kingdom, but will not feature one comprehensive dispute resolution system in which one dispute resolution institution covers all disputes in the financial field. The New Financial ADR system is merely one step towards a foundation of comprehensive financial ADR such as FOS. It must be noted, however, that this all important first step was over seven years in the making, involving a great deal of discussion, debate, and compromise amongst many parts of Japanese government, business, and society. The New Financial ADR system grants participating parties the ability to stop the clock on any statute of limitations which may correspond to any future possible court cases related to the dispute,13 and further grants the ability to suspend related court proceedings while the parties are utilizing the New Financial ADR system. In addition, where financial institutions have not accepted dispute resolution proceedings or have not accepted a special conciliation proposal, the Ministry of Finance may issue an order compelling compliance if it is found that certain actions are necessary to ensure the appropriate operations of a financial institution's business.   • This research has a significance on providing basic material of landscape ecological planning and open space planning of the future site by selecting Sinseo innovative city area, large residential land development district in rural area, by classifying biotope types and implementing recreational value assessment in the level of area. First of all, as a result of classification of biotope types in research site, total 11 biotope type groups including stream biotope and its subordinate 51 biotope types. Also, as a result of the first value assessment of classified biotopes, there are total 5 types such as vegetation-full natural river, fallow ground in I grade. In addition, it is analyzed that grade II have 18 types, III are 10, IV are 12, the least valuable V are 6. Especially, grassland biotope(GD) was classified into grade II, which is one grade raised, because it is analyzed that it has high value in terms of normal access and availability although it was assessed as grade ill in terms of natural experience quality. Lastly, as a result of the second assessment, special areas for natural experience and recreation(1a, 1b) are 15, areas for natural experience and recreation(2a, 2b, 2c) are 47. Especially, the 52th drawing mark space was grade II in the first assessment but its value grade was upgraded because of its high value in terms of use evidence, size of the area, accessibility with housing area, history and cultural character and so on.

Implementation of a unified live streaming based on HTML5 for an IP camera (IP 카메라를 위한 HTML5 기반 통합형 Live Streaming 구현)

  • This paper presents a unified live-streaming method based on Hypertext Mark-up Language 5(HTML5) for an IP camera which is independent of browsers of clients and is implemented with open-source libraries. Currently, conventional security systems based on analog CCTV cameras are being modified to newer surveillance systems utilizing IP cameras. These cameras offer remote surveillance and monitoring regardless of the device being used at any time, from any location. However, this approach needs live-streaming protocols to be implemented in order to verify real-time video streams and surveillance is possible after installation of separate plug-ins or special software. Recently, live streaming is being conducted through HTML5 using two different standard protocols: HLS and DASH, that works with Apple and Android products respectively. This paper proposes a live-streaming approach that is linked on either of the two protocols which makes the system independent with the browser or OS. The client is possible to monitor real-time video streams without the need of any additional plug-ins. Moreover, by implementing open source libraries, development costs and time were economized. We verified usefulness of the proposed approach through mobile devices and extendability to other various applications of the system.

  • The vertical displacement of a ship on the basis of the sea level is an important parameter for its stability and control. To indicate the displacement on operating conditions, "draft marks" are carved on the hull of the ship in various ways. One of the methods is welding. The position, shape and size of the marks are specified on the shipbuilding rules by classification societies to be checked by shipbuilders. In most cases, high-skilled workers do the welding along the drawing for the marks and welding bead becomes the marks. But the inaccuracies due to human errors and high labor cost increase the needs for automating the work process of the draft marks. In the preceding work, an indoor robot was developed for automatic marking system on flat surfaces and the work proved that the robot welding was more effective and accurate than manual welding. However, many parts of the hull structure constructed at the outdoor are cowed shapes, which is beyond the capability of the robot developed for the indoor works on the flat surface. The marking on the curved steel surface requiring the 25m elevations is one of the main challenges to the conventional robots. In the present paper, the robot capable of climbing vertical curved steel surfaces and performing the welding at the marked position by effectively solving the problems mentioned earlier is presented.

  • Nuclear Safety Act had described the three types of licenses on radioisotope handling, such as a general license, a special license and a supervisory license. Applicants should be qualified by careers and qualifications for the education and training to acquire the licenses. In particular, the information on the estimation for the career is notified by Nuclear Safety and Security Commission(NSSC). In this paper, we suggest an improvement by analyzing survey data at the end of the education course on a license for the supervisor of radiation handling. We applied the learning evaluation to improve the education course. The level of satisfaction with the improved curriculum was compared with the existing curriculum. The improved curriculum with the learning evaluation has shown high grades of performance, i.e. above 4.0 points (full mark: 5.0 points) on the level of satisfaction and field application. The learning evaluation should be applied to the basic education course on a general license for radioisotope handling.

Enter your information in the EMR, which was developed markers that inspectors use to compare the before and after images PACS satisfaction. Convenience than using traditional, consistency, the entry of the missing were higher as a statistically significant difference. A test strip automatic enrollment programs are developed in this study. You can increase the stability of the patient by checking the image to show the real tester, we expect the quality of care would be improved.

  • Purpose : The purpose of this study is to analyze the history of nursing and medicine as phenomena of knowledge/power from the viewpoint of Foucault. Method : The present study adopts the genealogical method by Foucault, which tries to unite languages and knowledge. Foucault who attempted to show that the basic ideas which people normally take to be permanent truths about human nature and society change in the course of history. Results : It has been emphasized that the development of modern health care has been due to the progressive efforts of medicine and to medical discoveries. Foucault examines the institutionalization of knowledge and the power exerted thereby, with special reference to the devices of social regulation and their function over the madness, the disease, the crime, and the sexuality. The concept of power is that it is exerted spontaneously in verbal behaviors of individuals through knowledge of everyday life such as definition of body or mind. Therefore as to the problem of knowledge/power, this study tries to understand the meaning of history of nursing and medicine through an analysis of the formation of text of history. In order to have authority in a power relation, the medical professional asserts that medical discourse is the most scientific knowledge. Conclusion : According to the above findings, it can be concluded that the body is also directly invested in a political field: power relations have an immediate hold upon it; they invest it, mark it, train it, torture it, force it to carry out tasks, to perform ceremonies, to emit signs. Therefore the devaluation of nursing care is reinforced by the medicine which has the legitimate authority through use of the political skills about the body.

  • Gianni Versace is one of the most influential Italian designers between the 1980s and 1990s and a representative person to add sexiness and splendour to Italian fashion. This study aimed to analyze the design identity that resulted in the successful handover to Donatella Versace and to review how effectively differentiated and unique heritage elements of Versace were transferred and operated. Literature reviews were performed to find Gianni Versace's design identity and archive. The scope of this study was Donatella's collection from 2018 to 2020. In particular, Signature, the most remarkable design identity of luxury brands with a visual identity that includes the mark, logo and symbol and design elements such as the item, colour, materials, details, etc., were the special focus. In this study, the elements of the visual identity of the signature were classified with the logo, icon, silhouette, materials, patterns, colours, and changes in details that were applied with the uniqueness and philosophy of the differentiated brand. Donatella Versace empathized with Versace's heritage as the brand heritage recalling Versace's honour in the 1990s and reproduced his honour again by reinterpretation of Versace's design images. Donatella is considered an excellent creative director who leads the brand by keeping the heritage and applying the trends of the times. This study as a case study of Versace has the meaning that Versace has maintained the brand identity starting from Gianni Versace as the first generation and successful takeover after the change of directors upon recreation to meet the modern times.

Predictive Factors of Health promotion behaviors of Industrial Shift Workers (산업장 교대근무 근로자의 건강증진행위 예측요인)

  • Industrial shift workers feels suffer mental stresses which are caused by unfamiliar day sleep, noisy environment, sleeping disorder by bright light, unusual contacts with family, difficulty in meeting with friends or having formal social meetings and other social limitations such as the use of transportation. Such stresses influence health of the workers negatively. Thus the health promotion policy for shift workers should be made considering the workers' ways of living and shift work specially. This study attempted to provide basic information for development of the health promotion program for industrial shift workers by examining predictive factors influencing health promotion behaviors of those workers. In designing the study, three power generation plants located in Pusan and south Kyungsang province were randomly selected and therefrom 280 workers at central control, boiler and turbine rooms and environmental chemistry parts whose processes require shift works were sampled as subjects of the study. Data were collected two times from September 17 to October 8, 1999 using questionnaires with helps of safety and health managers of the plants. The questionnaires were distributed through mails or direct visits. Means for the study included the measurement tool of health promotion behavior provided by Park(1995), the tool of self-efficacy measurement by Suh(1995), the tool of internal locus of control measurement by Oh(1987), the measurement tool of perceived health state by Park(1995) and the tool of social support measurement by Paek(1995). The collected data were analyzed using SPSS program. Controlling factors of the subjects were evaluated in terms of frequency and percentage ratio Perceived factors and health promotion behaviors of the subjects were done so in terms of mean and standard deviation, and average mark and standard deviation, respectively. Relations between controlling and perceived factors were analyzed using t-test and ANOVA and those between perceived factors and the performance of health promotion behaviors, using Pearson's Correlation Coefficient. The performance of health promotion behaviors was tested using t-test, ANOVA and post multi-comparison (Scheffe test). Predictive factors of health promotion behavior were examined through the Stepwise Multiple Regression Analysis. Results of the study are summarized as follows. 1. The performance of health promotion behaviors by the subjects was evaluated as having the value of mean, $161.27{\pm}26.73$ points(min.:60, max.:240) and average mark, $2.68{\pm}0.44$ points(min.:1, max.:4). When the performance was analyzed according to related aspects, it showed the highest level in harmonious relation with average mark, $3.15{\pm}.56$ points, followed by hygienic life($3.03{\pm}.55$), self-realization ($2.84{\pm}.55$), emotional support($2.73{\pm}.61$), regular meals($2.71{\pm}.76$), self-control($2.62{\pm}.63$), health diet($2.62{\pm}.56$), rest and sleep($2.60{\pm}.59$), exercise and activity($2.53{\pm}.57$), diet control($2.52{\pm}.56$) and special health management($2.06{\pm}.65$). 2. In relations between perceived factors of the subjects(self-efficacy, internal locus of control, perceived health state) and the performance of health promotion behaviors, the performance was found having significantly pure relations with self-efficacy (r=.524, P=.000), internal locus of control (r=.225, P=.000) and perceived health state(r=.244, P=.000). The higher each evaluated point of the three factors was, the higher the performance was in level. 3. When relations between the controlling factors(demography-based social, health-related, job-related and human relations characteristics) and the performance of health promotion behaviors were analyzed, the performance showed significant differences according to marital status (t=2.09, P= .03), religion(F=3.93, P= .00) and participation in religious activities (F=8.10, P= .00) out of demography-based characteristics, medical examination results (F=7.20, P= .00) and methods of the collection of health knowledge and information(F=3.41, P= .01) and methods of desired health education(F=3.41, P= .01) out of health-related characteristics, detrimental factors perception(F=4.49, P= .01) and job satisfaction(F=8.41, P= .00) out of job-related characteristics and social support(F=14.69, P= .00) out of human relations characteristics. 4. The factor which is a variable predicting best the performance of health promotion behaviors by the subjects was the self-efficacy accounting for 27.4% of the prediction, followed by participation in religious activities, social support, job satisfaction, received health state and internal locus of control in order all of which totally account for 41.0%. In conclusion, the predictive factor which most influence the performance of health promotion behaviors by shift workers was self-efficacy. To promote the sense, therefore, it is necessary to develop the nursing intervention program considering predictive factors as variables identified in this study. Further industrial nurses should play their roles actively to help shift workers increase their capability of self-management of health.

A Study on Outplacement Countermeasure and Retention Level Examination Analysis about Outplacement Competency of Special Security Government Official (특정직 경호공무원의 전직역량에 대한 보유수준 분석 및 전직지원방안 연구)

  • This study is to summarize main contents which was mentioned by Beomseok Kim' doctoral dissertation. The purpose of this study focuses on presenting the outplacement countermeasure and retention level examination analysis about outplacement competency of special security government official through implement of questionnaire method. The questionnaire for retention level examination including four groups of outplacement competency and twenty subcategories was implemented in the object of six hundered persons relevant to outplacement more than forty age and five grade administration official of special security government officials, who have outplacement experiences as outplacement successors, outplacement losers, and outplacement expectants, in order to achieve this research purpose effectively. The questionnaire examination items are four groups of outplacement competency and twenty subcategories which are the group of knowledge competency & four subcategories including expert knowledge, outplacement knowledge, self comprehension, and organization comprehension, the group of skill competency & nine subcategories including job skill competency, job performance skill, problem-solving skill, reforming skill, communication skill, organization management skill, crisis management skill, career development skill, and human network application skill, the group of attitude-emotion competency & seven subcategories including positive attitude, active attitude, responsibility, professionalism, devoting-sacrificing attitude, affinity, and self-controlling ability, and the group of value-ethics competency & two subcategories including ethical consciousness and morality. The respondents highly regard twenty-two outplacement competency and they consider themselves well-qualified for the subcategories valued over 4.0 such as the professional knowledge, active attitude, responsibility, ethics and morality while they mark the other subcategories below average still need to be improved. Thus, the following is suggestions for successful outplacement. First, individual effort is essential to strengthen their capabilities based on accurate self evaluation, for which the awareness and concept need to be redefined to help them face up to the reality by readjusting career goal to a realistic level. Second, active career development plan to improve shortcoming in terms of outplacement competency is required. Third, it is necessary to establish the infrastructure related to outplacement training such as ON-OFF Line training system and facilities for learning to reinforce user-oriented outplacement training as a regular training course before during after the retirement.
