Mediating Effects of Self-esteem on the Convergent Relationship between Respect for Human Rights and School Adjustment of Adolescents (청소년의 인권존중과 학교적응의 융합적 관계에서 자아존중감의 매개효과)

  • The purpose of the study was to examine the mediating effect of self-esteem on the convergent relationship between respect for human rights and school adjustment of adolescents. Data came from the Korean Survey on the rights of Children and Youth in 2016 and a total of 2,366 of the 2nd grade students in middle school were employed. Structural equation modeling approach was utilized to test the goodness of research model fit and especially the mediating effect was tested by bootstrapping method. Results showed that goodness of model fit was acceptable and self-esteem mediated the convergent relationship between respect for human rights and school adjustment of adolescents. This indicates that the more experiences in respect for human rights and the higher their self-esteem students have, the better school adjustment they acquire. The results of the study imply that it is necessary to expand the human rights education for teachers and develop a new educational program that links between respect for human rights and self-esteem.

  • In the traditional medical field, the patient was a person to receive protection from the doctor because there are vertical relationship between the patient and the doctor. But in modern medical field, patients change their role to health-care consumer to be guaranteed their rights more actively. This study compare patient's rights in doctor's vocational ethics and patient's rights in law, consumer rights. This study analyzes what is type of law-relationship between patients and doctor and how can they act health-care as health-care consumer.

  • The distinctive design of apparel product is the crucial factor that provides the powerful competitive advantage and customer satisfaction. However, knock-offs or copycats easily copy the design of apparel product and its problem tends to be assented in real world. Design right is one of intellectual property rights that would be produced by intellectual activity and the appropriate means to establish the exclusive rights to the design should be established. Legal protection to the design right is the system that can prelude copycats from eroding an exclusive position in the market place. The present study was to analyze the trend of registration of design rights in apparel products and to point out problems of current protection law to design.

XrML을 이용한 디지털 저작권 관리구현

  • 전자상거래(e-commerce)의 발달은 과거의 전통적인 상거래를 IT기술을 이용한, 새로운 시장구조를 제공하고 있다. 특히 인터넷을 통한 소프트웨어, 게임, 동영상 등 디지털 컨텐츠(digital contents)에 대한 상거래가 크게 증가하고 있어, 이러한 디지털 컨텐츠의 유통에 신뢰를 제공할 수 있는 시스템, 즉 디지털 저작권관리(digital rights management system), 또는 디지털 지적 저작권관리(digital intellectual property system)에 대한 유통 비즈니스 모델이 필요하다. XrML은 권리(rights)를 명시하는 언어로써 본 연구는 XrML을 이용하여 저작권관리에 필요한 권리구조를 구현한 시스템(prototype)을 표현했다. 벤츠와 그에 따른 서비스들을 사용할 수 있는 권리와 조건들을 명시해준다. XrML은 현재 디지털 저작권관리(Digital Rights Management: DIPR)에 가장 많이 쓰이고 있는 Rights Language이다. XrML은 ContentGuard가 개발한 DIPR 서술 언어로 전 세계 산업계 표준으로 추진하기 위하여 파트너 회사 확대, 기능 확장, 무료 / 공개 형식으로 보급을 추진중이다.

  • The ocean is very important to mankind for its infinite value in resource storage and utilization. In shallow coastal waters, landfill as well as pollution damage occurs frequently for the promotion of important public and private projects that are the driving forces of national development. In this case, compensation paid for the loss or damage of fishing rights acquired by the fishing community shall be distributed to each individual of the fishing community in accordance with the appropriate balance. In reality, as fishing communities in different sectors coexist, the voting rights of the general meeting of fishing communities are ignored as a minority, and the demand for the rights is ignored by the majority. Many other industries receive fish compensation, even though they have not suffered much damage. As a result serious conflicts between the individuals of the fishing community have caused social problems. Therefore, similar cases are investigated and analyzed to provide a reasonable solution.

  • Education is a key element in shaping the worldview of the next generation and determines society's core values, ideology, and basic understanding of human rights. While Kyrgyzstan is a secular state, Islamic education, backed by Arab and Turkish sponsors, continues to increase in popularity with the construction of thousands of mosques and dozens of new Islamic educational institutions. Young women have become an important target for Islamic ideology and Islamic educational institutions seek to introduce a new type of ideal woman who is obedient, submissive, and modest. This research uses curricula content analysis, participant observation, and in-depth interviews with teachers and students to examine the effects of newly introduced Islamic education institutions and concludes that the schools are succeeding in training female Kyrgyz students for sheltered lives of dependency, threatening to fundamentally erode women's rights in the country. Two tasks thus demand the attention of policymakers: preserving Kyrgyzstan's secular state and introducing new interpretations of the Quran, which strengthen support for women's rights among believers.

  • The implementation of the legal mechanism to protect the rights and interests of entrepreneurs in Russia has its unique features. When the rights and interests of a businessman are threatened with infringement, specific legal remedies may be applied, by means of which the violated rights and interests are restored and, thereby, the opportunity to resume entrepreneurial activity is created. The paper explores extrajudicial ways to protect the rights and interests of entrepreneurs in Russia. The study analyzes the forms of self-help, arbitral tribunal, resolution of applications and complaints by executive authorities, the notariate, and work with the business ombudsman and civil society institutions.

Ritualism versus Universalism: The Challenge of Establishing an Effective Rights-Based Labor Migration Regime in ASEAN

  • Southeast Asia accounts for nearly a tenth of total worldwide cross-border movements of migrant workers. Cambodia, Indonesia, Laos, Myanmar, and Philippines make up the sending countries while Malaysia, Singapore, and Thailand are the major destinations. Migrant worker movements are predominantly in production process and low- to medium-skilled sectors. It is not unusual for irregular or undocumented movements to take place. In not a few instances, migrants work under harsh and exploitative conditions. In recent years, however, ASEAN has taken steps to manage labor migration at the regional level. The paper argues that ASEAN has not managed these cross-border labor flows as well as it should particularly in terms of protecting and promoting the human rights of migrants. It will be difficult to establish the genuine building blocks for a regional human rights mechanism unless there is a diffusion of alternative universal norms and standards to what ASEAN already embodies. As long as states resist any attempt to weaken or question or deligitimize their capacity to determine who gets to enter, stay, and leave their jurisdictions, it will be difficult to establish an effective migrant rights framework for the region.

The Performance of Franchisees from the Franchisor's and Franchisee's Intangible Assets

  • Purpose - This study seeks to find out the factors affecting the performance of franchisees from the franchisor's and franchise's intangible assets. In order to explain the process, this study explores the concept of LMX, Relational Capital, and Decision Rights Delegation. Research design, data, and methodology - To verify the proposed hypotheses, a questionnaire survey was conducted for franchise store owners, and to test the hypotheses, structural equation modeling was established. Results - First, franchisor's intangible assets affect the quality of LMX, but don't affect the relational capital. And the quality of LMX affects the relational capital. In addition, "the effect of delegation of decision rights on relational capital" and "the effect of relational capital on franchisee's performance" were significant. However, the effect of delegation of decision rights on franchisee's performance wasn't significant. Second, the intangible assets of the franchise have a positive effect on the quality of the LMX and the degree of delegation of decision rights, and the quality of the LMX has a positive effect on the delegation of decision rights. Conclusions - This study would suggest operational implications for the formation of vertical and horizontal relationships and the cooperation between the main members of the franchise business.

  • 인터넷의 발달은 전통적인 자연 발생적인 시장에 의한 상거래를, 기술에 의한 안전하면서 세계 시장을 쉽게 접근할 수 있는 전자상거래 구조를 제공하고 있다. 현재 전자상거래의 대상은 실물에 대한 상거래와 디지털 컨텐츠에 대한 상거래로 크게 분류할 수 있으며, 실물에 대한 상거래는 전통적 상거래 방식이 컴퓨터로 바뀐 상황이라고 볼 때, 디지털컨텐츠에 대한 상거래 즉, D-Commerce에 대한 상거래의 개념이 도래하고 있다. 디지털 컨텐츠의 상거래에 필요한 요소 기술에 대한 연구, 그리고 특히 새로운 유통 비즈니스 모델에 대한 연구가 필요하다. 디지털 컨텐츠는 생성, 가공, 유통, 분배 둥의 측면에서 많은 장점을 갖는 반면, 복사를 여러 번해도 원본의 품질에 손상 없이 쉽게 복사 될 수 있다는 것이 디지털 저작권 보호에 커다란 문제점으로 대두되고 있다. 디지털 저작권권리(Digital Rights Management: DRM)은 디지털 콘텐츠의 보호와 적절한 유통체계를 설립하여 안전하게 상거래를 할 수 있게 하기 위한 새로운 기술이다.
