  • Every crime involves a victim and an offender. The offender, from the start of the criminal investigation, is considered as a suspect. After prosecution, he/she becomes the accused, and under consitutional law and criminal procedural law, has the right to enforce the contests of the acts. On the other hand, the victim or his/her family, despite being the person harmed, has very few and comparatively weak rights. To overcome this problem, the Korean criminal justice has recently recognised 'the protection and support of the victim' as a major proposition, and the police as well as the prosecutor's office have been releasing improvement plans for the protection of victims. Setting the above as the background, this thesis deals with the current victim protection acts and discusses the methods to improve them. This study will investigate a more reasonable and effective method of victim support and protection. Currently korea's laws regarding victim protection are not satisfactory, however it is fitting to say that it is certainly an external outline of what it should be. This has been due to the enforcement and creation of 'criminal victim protection' and has acted as a key to more improvements ever since. Despite this, the lack of commitment in human and financial resources to enforce these laws has now produced a possibility of the laws proving to be nothing but an unopened letter. Pneumatic Separation on Separating Unit of a Combine Harvester (콤바인 선별실(選別室)의 기류선별(氣流選別)에 관한 연구(硏究))

  • This study was attempted to investigate the pneumatic separation on separating unit of a combine harvester. The aerodynamic characteristics of threshed materials were analyzed by experiments. The air velocity distribution within the separation chamber was measured for various speeds of the winnower and suction fans to find out the operational and design conditions of the separating unit which would serve for reducing the grain loss from chaff outlet. The results of study arc summarized as follows: 1. Based on the separation curve of threshed materials analyzed, it was shown that three different kind. of materials-kernels, straw chaff, and leaf chaff were as a whole able to be separated pneumatically, regardless of varieties. However, a small amount of the separation grain loss may be expected to occur if the complete separation between kernels and straw chaff would be undertaken because some portion of their separation curve were overlapping. 2. The analysis of air velocity distribution showed that the separation chamber may be divided into two regions, the discharging and separating. The air velocity of the discharging region was 5-15 m/s and that of the separating region 2-5 m/s. 3. The air movement of the separation chamber may be a turbulence flow, being its speed became greater as it moves from the left to the right section of the separation chamber. The equi-speed line. of air flow had a steep gradient in between the discharging and the separation regions. The air velocity in the discharging region was much higher than the terminal velocity of kernels, because of which those kernels appearing in the region could be possibly exhausted as the grain loss from the chaff outlet. 4. The motion trajectory of threshed material in the separating region was dominantly affected by the winnower fan, on the other hand, its motion in the discharging region was affected by suction fan. 5. The grain loss from the chaff outlet was affected greatly by the winnower fan and the trace of kernel movement. It was observed that the optimum working speed to give minimum grain loss from chaff outlet for the combine tested should be maintained at 950~1,150 rpm for the winnower fan and 1,850 rpm for the suction fan. 6. It was shown that a large portion of grain loss from chaff outlet may occur when the kernels may bump against a portion of separation chamber wall and those kernels thus scattered into the discharging region were sucked by the suction fan. It was accordingly recommended that a new design of the wall of separation chamber so as to bump down kernels may be necessary to reduce grain loss from the chaff outlet.

  • As digital systems were introduced to automotive design in the mid 1980s, the design process has adopted many digital programs to save time compared to the conventional hand drafting. Digital technology was introduced not only to satisfy the reeds of the global environment, as the number of automobiles exported to many different parts of the world has increased, but also to save time and effort in developing several models of quality automobiles. Therefore, every automotive manufacturer in the world has expanded its virtual reality(VR) studio to establish visualization systems that visualize automobiles in the actual size and a co-operation system that enables simultaneous feedback from all of its design studios around the world. Unlike the existing design reviewing methos, the new improved feedback system is assessed as a reasonable method to evaluates and understand how the automobiles are actually manufactured in simulation. It is especially helpful when advanced products and concept cars require fast results. Other strengths of the new system include shorter development period, cost efficiency, no more manual labor, various designs within a short period of time, and realistic visualization of concepts. Large-scale products, including automobiles, need to be projected in the actual size and high clarity through the Power-wall System and are examined in a virtual space called a Cave. Therefore, it took much time to establish digital infrastructure. An infrastructure would constantly require system improvement and performance enhancement, but it is certain that now is the right time for the take-off to utilizing the strengths of digital design and improve the weaknesses. In this respect, this study provided an understanding of the importance of digital design based on digital reinforcements and examined an effective utilization of digital technology for an efficient development of automobiles in the future.

Effective Measuring Method of Discontinuity Orientation (불연속면 방향의 효율적인 측정 방안)

  • This study is aimed at the effective measurement plan of discontinuity orientation on rock mass. The discontinuity orientation is expressed as three methods. strike/dip. dipdirection/dip (a three digit number / a two digit number) and right hand rule. Generally, strike/dip is measured with clinometer. and dipdirection/dip with silva compass(type15). A sign of strike/dip. discontinuity orientation is used to geological survey. and dipdirection/dip to engineering. Dipdirection/dip converted by strike/dip measured with clinometer is useful on the statistical analysis of a lot of data. To measure the azimuth of the dip with clinometer and to change strike/dip to dipdirection/dip may have potential errors in each person. The newly designed apparatus, clinometer equipped by a rotational azimuth plate and an arrow to measuring strike and dipdirection, has been developed to measure effectively the discontinuity orientation with two method (strike/dip and dipdirection/dip). The measuring method of discontinuity orientation with clinometer having newly designed apparatus is effective one for accurate measurement of strike as well as dipdirection which is degrees counted clockwise from true north. Used by clinometer with newly designed apparatus, concurrent measuring strike/dip and dipdirecton/dip of discontinuity is possible. In application to measuring discontinuity orientation on rock slope, it has been recognized that the newly designed method, unambiguously, led to drop measuring errors comparing with existing measuring apparatuses. Therefore, it is considered that measuring method of discontinuity orientation (strike/dip and dipdirecton/dip) by the newly designed apparatus is useful to one in geological engineering investigation of road design, and to unskilled investigator.

The Diagnostic Value of Dynamic US in the Extensor Tendon Dislocation at the Metacarpophalangeal Joint (중수지 관절부 신전건 탈구에서 실시간 표시 초음파의 진단적 가치)

  • Purpose: We studied the diagnostic value of dynamic US in the extensor tendon dislocation at the metacarpophalangeal joint. Materials and Methods: From January 2007 to October, we studied 6 cases that had been diagnosed and followed over 5 months (2-10) in average. US examination using a 10-MHz linear transducer were performed in three cases. The causes of dislocations were traumatic in 5 cases and congenital in one case. Results: In only 3 cases which could not be diagnosed clinically, we performed US. In dynamic US, all three cases showed the extensor tendon dislocation evidently. Operative findings were sagittal band rupture in 4 cases, capsular loosening in one case and sagittal band thinning in one case. Sagittal band repair was performed in 4 cases and capsular augmentation in one case. In case of congenital dislocation showing 4 digital extensor tendon dislocations in right hand, we operated only the second extensor by sagittal band repair with augmentation by looping. At last follow-up, no case showed recurrence or limitation of motion. Conclusion: In case of extensor tendon dislocation without apparent clinical finding, US with dynamic study has so great value that it can detect the dislocation in real time, which is superior to MRI.

Issues and Directions of National Policy on Sports Facilities (정부의 체육진흥시설 정책의 과제)

  • The purpose of this study was to review the government's policy on the enhancement of sports facilities for community residents regarding the lack of knowledge surrounding the infrastructure of sports facilities. The government has invested approximately 2.4 trillion won to establish 220 community sports centers, 385 billion won for 194 multi-purpose indoor centers, and 1.3 trillion won for rebuilding 1,870 school outdoor fields. On the other hand, there are problems with the link between the crumb rubber infill on sports fields and cancer, a lack of availability of indoor sports centers, and an increased federal budget deficit. It is the responsibility of government to plan and construct outdoor fields that are large enough to accommodate all people and allow them to play activities. In addition, the guidelines should ensure that the indoor space required for physical activities at each teaching station is large enough to accommodate all students in the class and handle two classes. The government should suggest the federal government guidelines based on a good understanding of the concept of infrastructure in sports facilities. The government also should make efforts to reduce the regulatory powers and provide the community with an autonomous right to plan and construct sports facilities.

  • As it is known, during the Second World War Greece has fought on the side of the allies and the end of the war found the country on the winners' side. However, the struggle for authority right after 1945 was merciless and extremely difficult, as well as dangerous for the course of the country to the future. The political powers were divided between the legal authorities that were represented by the king and formed the exiled government on the one hand and the part of the resistance teams and the rebels of the left that had a soviet friendly direction on the other. Thus, the start of a civil war was just a matter of time. It fin ally started in 1947 and lasted for more than two years. The consequences were disastrous for the country's economy and decisive for the future course of Greece. The national army prevailed with the help of, mostly, the English. Royal parliamentary democracy was established with a clear political turn to the west, as a completion and adaptation of the Agreement of the Great Powers at Yalta. Art had a 'similar' route. Dipolar, contradictory: conservative choices on the one side, and a will for pioneering inspiration and perspective on the other side. The 'dominate' trend was first evident in sculpture and mainly in the public monuments. Their construction aimed mostly at the public propaganda and at the promotion of the sovereign ideology. On the one side we have the public sculptures composed of faces of contemporary heroes or leading figures of the civic war and the national resistance. On the other side we have monumental statues mainly that appeal to a 'public' outside of the country's borders and mostly of the north borders, where there are countries with a communistic regime, like Bulgaria, Serbia and Albania. Their subject is derived from the heroic events of the Balkan Wars (1912-1913) and ancient historical figures like Alexander the Great as the Greek army leader, his father, Philippos II and Aristotle, who was of a north-Greek origin. The political message is twofold: on the one side the 'inner enemy' the communists that were defeated and the promotion of the new liberal social system and on the other side the north neighbours, which not only represent the East Block, but they also conspire the history and the culture of the Greeks. This is the way how the 'Cold War' was resulted in a full and totalitarian expression in art.

A Study on the Payment Mechanism of Independent Guarantee -focusing on matters that the relevant parties involved should know- (청구보증상 지급메커니즘에 따른 실무상 유의점)

  • Independent guarantee is a creation of the need from the both sides, i.e. the applicant (principal debtor) and the beneficiary (creditor). The former used to have to deposit cash in favor of the beneficiary in case of his default, which laid a burden on his liquidity while the latter still wanted to have the equivalent to cash. Independent guarantee satisfied the both parties by freeing the applicant of a deposit and maintaining the beneficiary's right at the same time. The fact that independent guarantee has three payment mechanisms is not widely known to the public. They are (i) payment on first demand, (ii) payment upon submission of third-party documents, (iii) payment upon submission of an arbitral or court decision. From the applicant's point of view, the order in his favor is (iii), followed by (ii) and (i). As there shouldn't be a case where one party is at a disadvantage against the other, useful insight is being sought for the benefit of the applicant. First, the applicant can offer his intention to provide a payment mechanism (ii) or (iii) rather than (i) if he must deliver it. Second, if the beneficiary still wants to have (i) and the applicant is in a position not to reject it, the latter should thoroughly check any provisions that may work against him later. Third, the applicant could use counterbalancing provisions in underlying contract to cope with protective clauses in the guarantees. Forth, the applicant should review the beneficiary's sincerity to prevent unfair calling risks. The applicant may use an ECA(Export Credit Agency) in his country to which he can transfer not only unfair calling risks, but also political risks. On the other hand, a bank needs to keep the following advice in mind. The foremost important thing for the bank not to forget is that it provides a guarantee as a service provider, not as a responsible party for the feasibility of the project, etc. Credit risk of the applicant should require the greatest attention when issuing a guarantee: the bank should look into the possibility that it can procure immediate reimbursement from its customers after payment to the beneficiary. Second, the applicant's ability to complete the project should be reviewed by checking its track records, techniques and reputation, etc. Third, the bank may also use an ECA to cover the beneficiary's unfair calling risks as well as political risks. In the case of Korea, as Korea Export Insurance Corporation(KEIC) can cover all the risks mentioned above, the bank could use its service called 'Export Bond Insurance.' What's better for the bank is that ECA cover can enhance the bank's asset quality by putting it zero on its risk weighted asset.

Expression of Cytokines in Radiation Injured Brain at Acute Phase

  • Objective : Radiation therapy is an important treatment for brain tumor. However, serious complications such as radiation necrosis can occur and it may be secondary to the expression of acute phase genes, like cytokines. In particular, inflammatory cytokines (IL-$1{\beta}$, TNF-${\alpha}$) and other immunomodulatory cytokines (TNF-${\alpha}$, TGF-${\beta}1$) might be changed after irradiation (high single dose irradiation). Although it has been reported that IL-1 level is remarkably elevated within 8 week after the irradiation to the rat brain. the change of cytokines levels at acute phase (within 24 hours) has not been reported. In the present study, we examined TNF-${\alpha}$, TGF-${\beta}1$, and IL-$1{\beta}$ levels in acute phase to clarify the early effect of cytokines on the radiation-induced brain damage. Methods : Fifty Sprague-Dawley rats were used and these were divided into irradiation group and control group. After a burr-hole trephination on the right parietal area using a drill, a single 10Gy was irradiated at the trephined site. Their forebrains were extirpated at 30 min, 2 hr, 8 hr, 12 hr and 24 hr, respectively and examined for the expression of TNF-${\alpha}$, TGF-${\beta}1$, and IL-$1{\beta}$. Results : The expression of TNF-${\alpha}$ and TGF-${\beta}1$ were decreased until 12 hr after irradiation but elevated thereafter. The expression of IL-1 was peak at 8 hr and then decreased until 12 hr but elevated after this time window. The present study indicated that expression of cytokines (TNF-${\alpha}$, TGF-${\beta}1$ and IL-$1{\beta}$) were increased at 24 hr after the irradiation to the rat brain. IL-$1{\beta}$ level, on the other hand. reached peak at 8 hr after radiation injury. Conclusion : These findings indicate that IL-1, among various cytokines, may have a more important role in the inflammatory reaction by radiation injury at acute phase and provide some clues for better understanding of the pathogenesis of radiation injury.

  • Subject : The Association between Extraordinary Organs(奇恒之腑) and Eight Extra Meridians(奇經 八脈). Objectives : This study research some special aspects of Extraordinary Organs and Eight Extra Meridians which differentiated from ordinary Organs and Meridians, and the association between Extraordinary Organs and Eight Extra Meridians. Methods : First, researched classification standard and physiological characteristics of Extraordinary Organs through studying various chapters of HuangdiNeijing. Second, researched The Association between Extraordinary Organs and Eight Extra Meridians through studying on the origin of Eight Extra Meridians in HuangdiNeijing. Third, from accompanying researching the subject of Cheon-gye(天癸) and human body shape, draw synthetic hypothesis on the relationship among ordinary Meridians and Organs, muscles and skins of body shape, Extraordinary Organs and Eight Extra Meridians. Results & Conclusions : The following conclusions could be drawn. 1. Extraordinary Organs afford background for shaping human body. This is same as the properties of the earth which afford background for shaping all creations. The physiological characteristics of Extraordinary Organs is intermediation and regulation between Ki(氣) of Five Viscera & six Bowels and shape of muscles & skins in human body. 2. The origin of Eight Extra Meridians could be found in HuangdiNeijing. The collateral Meridians of the Uterus and Epiglottis Meridian are specifically formulated to supplying for the Uterus or Epiglottis. From this we can draw The Association between Extraordinary Organs and Eight Extra Meridians, that is Eight Extra Meridians are specifically formulated to supplying for Extraordinary Organs. 3. The Cheon-gye(天癸) is doing significant function in Eight Extra Meridians supplying for Extraordinary Organs. Cheon-gye concerned to growth, secondary sexual characters, generative function, aging process. Theses are all concerned with the changing of human body shape. Cheon-gye urge to change the body shape with following the human life cycle. 4. Human body has vertical symmetry because preserve its shape from the gravitational force. Eight Extra Meridians place at the middle or flank axis of human body, thus do physiological function that assistant human body have vertical symmetry shape. The purpose of shaping vertical symmetry is securing space what the inner Twelve Regular Meridians and Five Viscera & six Bowels create there own physical changes. On the other hand the inner changes need deviation between left and right because of mobility and circulation of force. But human body change the shape in the process of growth, reproduction, aging. Eight Extra Meridians play role at time of these processing, thus they deeply concerned to human's life cycle and reproduction. 5. Eight Extra Meridians and Extraordinary Organs were named 'Extra' because of some special aspects which differentiated from ordinary Meridians and Organs. All they play role to have vertical symmetry shape of human body and maintain the shape, thus they deeply concerned to the change of human life cycle. These shaping maintaining and the change of human life cycle are very special aspects of human body. So they needed to differently cognize separate to the ordinary changes of Five Viscera & six Bowels and Twelve Meridians at inner space.
