The purpose of this study aims to explore scope of damages resulted from early redelivery under time charter with the Golden Victory case. In this case, disputes arose in relation to the quantum of damages recoverable by th owners. The owners contended that the second Gulf War was irrelevant to their claim, which was to be assessed at the difference between the charter rate and the lower market rate for the whole of the remaining four-year period of the charterparty. The charterers contended that since clause 33 would have entitled them to cancel the charter on the outbreak of the second Gulf War, two years after the repudiation, the owners' claim for damages only ran for those two years. There was no such rule as was contended for by the owners, and that the damages had to reflect the fact that, had there been no repudiatory breach, the charterparty would not have run its full term because the charterers would have cancelled the charter on the outbreak of the second Gulf War.

Formal Concept Analysis (FCA) is a widely used methodology for data analysis, which extracts concepts and builds a concept hierarchy from given data. A concept consists of objects and attributes shared by those objects, and a concept hierarchy includes information on super-sub relations among the concepts. In this paper, we propose a method for extracting Implication and Association rules from a concept hierarchy given a query by a user. The method also describes a way for displaying the extracted rules. Based on this method, we implemented an automatic tool, QAG-Wizard. Because the QAG-Wizard not only elicits relation information for the given query, but also displays it in structured form intuitively, we expect that it can be used in the fields of data analysis, data mining and information retrieval for various purposes.

The purpose of this paper is to examine the consideration factors, from both parties' perspective, to select the most appropriate arbitral institution when they inset an arbitration clause in their contract. Accordingly, the author analyzed the advantages of institutional arbitration compared to non-institutional arbitration. The typical advantages of institutional arbitration would include: $\bullet$ Benefits of using an established set of rules $\bullet$ Services provided by the institution $\bullet$ Low risks of obstruction $\bullet$ Enhancement of the possibilities of enforcement $\bullet$ Forecast of the estimated cost $\bullet$ Specially useful for existing disputes Next, this author examined the consideration factors when selecting the institution in respect of the following factors: $\bullet$ Institution's arbitration rules $\bullet$ Institution's rule regarding the appointment of arbitrators $\bullet$ Ability of administrators of each institution $\bullet$ Reputation of the arbitral institution and the likability of enforceability of its award $\bullet$ Cost $\bullet$ Choice of the arbitral institution in relation to the choice of place of arbitration Finally, this author reviewed Model Arbitration Clause of major international or local Institutions, including ICC, AAA, LCIA, KCAB, CIETAC, ICSID and WIPO. Further examination was given to the selection of the numbers of the arbitral tribunal, the seat of arbitration and the language of arbitration, according to the designated articles in each institution's arbitration rules.

by A.C. Clairaut was written based on the historico-genetic principle such as his . In this paper, by analyzing his we can induce six principles that Clairaut adopted to teach algebra: necessity and curiosity as a motive of studying algebra, harmony of discovery and proof, complementarity of generalization and specialization, connection of knowledge to be learned with already known facts, semantic approaches to procedural knowledge of mathematics, reversible approach. These can be considered as strategies for teaching algebra accorded with beginner's mind. Some of them correspond with characteristics of , but the others are unique in the domain of algebra. And by comparing Clairaut's approaches with school algebra, we discuss about some mathematical subjects: setting equations in relation to problem situations, operations and signs of letters, rule of signs in multiplication, solving quadratic equations, and general relationship between roots and coefficients of equations.

Although there were some technological developments in improving the collaborative filtering, they have yet to fully reflect the actual relation of the items. In this paper, we propose the recommendation system using associative web document classification by word frequency and ${\alpha}$-cut to address the short comings of the collaborative filtering. The proposed method extracts words from web documents through the morpheme analysis and accumulates the weight of term frequency. It makes associative rules and applies the weight of term frequency to its confidence by using Apriori algorithm. And it calculates the similarity among the words using the hypergraph partition. Lastly, it classifies related web document by using ${\alpha}$-cut and calculates similarity by using adjusted cosine similarity. The results show that the proposed method significantly outperforms the existing methods.

The filial piety culture represented by Cao-e was regarded as moral rule mechanism in order to maintain patriarchal system and property relations in ancient China as an agricultural society. Exactly, In the process of Cao-e's story spreading, oral inheritance and literature processing have a relation of learning and penetration each other in order to beautify, deify, systematic stories. This is expression of human being's thought method of pursuing perfection. For instance, The traditional piety culture is increasingly weakened, that is why it is important to recognize the fundamental connotation behind the cultural identity in the modern society, to create the social foundation of Cao-e' filial piety cultural contents root, and to explore the core values of piety culture contains. Looking Cao-e' filial piety Culture and culture archetypes as study object, this article analyzes the spreading of Cao-e's story texts for understand the connection between literature processing and image formation from aspect of Cao-e deification.

In aspect of HCI(Human Computer Interaction) gameplay is the procedure to solve the problem that gamers encounter in order to generate or discover a new rule to achieve gamers' goal. The goal of this research is to investigate the structure and understand the gameplay in aspect of affordance from ecological psychology rather than the traditional problem solving theory. This research selects App. game based on smart phone. Expert gamers participated in this experiment. We record all gameplay using audio and video device. We conducted protocol analysis as qualitative method based on the verbal report and action protocol during game playing. As result, gameplay based on affordance includes selection and relation. We found that subjects selected one thing at once with attention. Moreover, we found that there were two behaviors : exploratory action and performatory action. We believe that exploration, action, and transformation for affordance appear. The result of this research imply to suggest design guideline for game design methodology when designers develop game.

The expansion of internet and the development of communication technology have brought about an explosive increasement of data. Further progress has led to the increasing demand for efficient and effective data analysis tools. According to this demand, data mining techniques have been developed to find out knowledge from a huge amounts of raw data. This paper suggests a generalization based classification method which explores rules from real world data appearing repeatedly. Also, it analyzed the relation between weather data and forest fire, and efficiently predicted through it as a prediction model by applying the suggested generalization based classification method to forest fire data. Additionally, the proposed method can be utilized variously in the important field of real life like the analysis and prediction on natural disaster occurring repeatedly, the prediction of energy demand and so forth.

The impact ionization(I.I.) is necessary to analyze carrier transport properties under the influence of high electric field. The full band I-k relation and Fermi's golden rule are used for the calculation of impact ionization rate. We have investigated the temperature- and field-dependent impact ionization coefficient for silicon using full band Monte Carlo simulation. The impact ionization coefficients calculated by our impact ionization model are agreed with experimental data at look. We know that impact ionization coefficients and electron energies are decreasing along increasing temperature due to increase of phonon scattering, especially by emission. The logarithm of impact ionization coefficients are fitted to linear function for temperature and field. The residuals of linear function are within the error bound of 5%. We know logarithmic impact ionization coefficients are linearly dependent on temperature and field.

This paper is proposed a wavelet-based the order statistics MAD(Median Absolute Deviation) method of image fusion of Multi-image contaminated with visible image and infrared image. also The method of compared and defined the threshold the wavelet coefficients using MAD of the wavelet coefficients of the detail subbands was proposed to effectively fusion which of selected the high quality image of the two images. The existed fusion rule may be possible to get the distorted fusion image especially by the distortion in the relation between the pixel and indicator of two images in the existed fusion rules. In order to complement the disadvantage, the threshold of the proposed method sets up the image statistic and excludes the distortion. The hardware design is used FPGA of Xilinx and DSP system for the image fusion and compressed encoding of the proposed algorithm. Therefore the proposed method is totally verified by comparing with the several other multi-image and the proposed image fusion.
