  • Supreme Court of Korea has been mitigating the burden of proof on the malpractice and causal relation by a patient in accordance with the practical transfer of such burden of proof on causal relation as well as relieving a doctor's burden of proof on mistake in the civil damage claim suits on the malpractice. However, a prosecutor shall strictly prove the causal relation between malpractice and unfavorable results as well as a doctor's mistake in the criminal cases for making a doctor accept the professional negligence resulting in death or injury in accordance with In Dubio Pro Reo principles. Furthermore, it shall not be allowed to relieve the burden of proof on malpractice and causal relation which has been frequently applied in the civil proceedings. Nevertheless, it was widely known that the front-line courts accepted the malpractice and causal relation by quoting the legal principles on relieving the burden of proof on malpractice and causal relation applied in the civil cases even in criminal cases with no or insufficient proof on malpractice or causal relation. However, the latest precedents in Supreme Court explicitly declared the opinion that there was no reason to apply the legal principle to relieve the burden of proof on the malpractice and causal relation in the criminal cases requiring the proof 'which doesn't cause any reasonable doubt' on malpractice and causal relation in accordance with the legal principles 'favorable judgment for a defendant in case of any doubt' on the basis of the strict principle of 'nulla poena sine lege.' Accordingly, Supreme court definitely clarified that there would be no reason to relieve the burden of proof on malpractice and causal relation in criminal cases by reversing several original judgments accepting malpractice and causal relation even though there were no strict evidence.

  • The job characteristics and competencies of 285 dietitians in employee foodservices were investigated by worker-oriented job analysis methodology. The purposes of this study were to : a) determine the knowledge, abilities, skills and other characteristics(KASO, hereafter) needed for dietitians in two types of employee foodservice groups(self-operated vs. contracted) and b) the analysis of the degree of frequency and importance and entry requirements of KASO items listed below : their degree of frequency, the level of importance and their function as entry requirements. The 134 KASO items would be divided into 12 task categories. The questionnaire was mailed to 250 dietitians who are members of The Korean Dietetic Association Practice Group in self-operated foodservices(hereafter group A) and 250 dietitians who are employed in contracted foodservice companies(hereafter group B). Completed questionnaires were received from 285 dietitians(121 in self-operated, 164 in contracted) ; with a response rate of 57%. Statistical data analysis was completed using the SPSS/win and the SAS/win packages. The results of this study can be summarized as follows. 1) Analysis of the degree of frequency, importance and entry requirements of 134 KASO items in group A showed a high priority(score〉4.0) placed on 14 items in relation to dietetic tasks and 9 items in relation to human attributes, whereas in group B 19 items in relation to dietetic tasks and 11 items in relation to human attributes. 2) Comparing responses about the KASO items in the 12 task categories, there was a significant difference between the two sample groups with regard to degree of frequency : group A scored 3.29, group B scored 3.50(p〈0.01). With regard to importance of KASO items in 12 task categories, group A scored 3.78 and group B scored 3.88 showing no significant differences. With to entry requirements of KASO items in 12 task categories, group A scored 3.29 and group B scored 3.46 showing a significant difference(p〈0.05). • This study aims to discuss how job stress of private security guards would influence organizational commitment and turnover intention, and it basically looks into mediating effects of job burnout to understand the former's effects on the latter. In order to conduct the analysis, the study selected private security guards working for security agencies located in Seoul as a research subject, and carried out a survey targeting 700 of those security guards who had been gathered by a random cluster sampling method. The survey was conducted for about four months from May of 2014 to September of the same year and with 24 samples that had not been returned or that had been observed to have some outliers excluded, a total of 676 samples were applied as final data. The study used SPSSWIN 18.0 Statistical Package for analyzing the data, and hypotheses were confirmed via a Frequency Analysis, Factor analysis, Cronbach's Alpha, Person's Correlation Analysis, regression analysis and a path analysis. Findings of the analysis reported that emotional exhaustion has partially mediating effects on relations among role conflict, role overload and organizational commitment and that role ambiguity is not significantly connected. In addition, as for a relation of role conflict and turnover intention, emotional exhaustion was turned out to have a full mediating effect on the relation. The study did not notice any significant connection between emotional exhaustion and role ambiguity. Add to that, in terms of a relation between role overload and turnover intention, emotional exhaustion appeared to have a partial mediating effect on the relation which helped a relevant hypothesis to be partly adopted. Regarding a relation of job stress with organizational commitment, according to results of a path analysis on dehumanization, dehumanization does not significantly affect a relation between role ambiguity and organizational commitment and as for role conflict and role overload, the study confirmed that they have a partially mediating effect on this relation of dehumanization with organizational commitment. The study learned then that dehumanization does not have a significant influence on a relation between role ambiguity and turnover intention. However, the study figured out that when it comes to a relation of role conflict and role overload, dehumanization has a partially mediating effect on the relation and as a consequence, a relevant hypothesis was adopted in part.

  • Ubiquitous City (u-City) and Intelligent Transport System (ITS) provide services, which are different from each other yet have close relation to each other partially. Thus, since a redundancy issue occurs or it is difficult to efficiently provide services depending on the relation degree, it is required to analyze the relation of services between the two systems and to elicit a priority. A table of relation among the services was created and the relation degree was analyzed by performing a survey for experts. As a result of calculating the total marks by accumulating and summing up the survey results, the incident management service and u-accident/calamity and disaster service of the ITS had the lowest value. The project priority was as follows: The basic principle of the project was that services with high relation degrees shall be worked on first. The services were categorized in each step and packaging the services could result in the synergy effect. This study is significant since it analyzed the relation degree between u-City and ITS and proposed schemes for efficiently working on the project by eliciting the priority of the services based on the analysis results.

  • This study aims to prove the mediating effect of emotion dysregulation and perceived social support in the relationship between covert narcissism on the relation addiction. The researchers surveyed college students for about 3 weeks through a questionnaire on college campus or with the help of their colleagues and professors. The subjects were 362 students. SPSS, AMOS and Mplus were used for statistical analysis, correlation analysis and structural equation analysis. The conclusions are as follows : First, emotion dysregulation, relation addiction and covert narcissism showed positive correlation and covert narcissism, emotion dysregulation, relation addiction and perceived social support showed a significant negative correlation. Second, it was found that after investigating the mediation effect of emotion dysregulation and perceived social support in the influence between covert narcissism and relation addiction, emotion dysregulation turned out to have a significant mediating effect while perceived social support did not. Third, dual mediating effect was significant in emotion dysregulation and perceived social support in the influence between covert narcissism and relation addiction. These findings proved that covert narcissism, emotion dysregulation, perceived social support are variables that effect relation addiction, and also clarified that emotion dysregulation is a strong mediating variable in the influence between covert narcissism and relation addiction. Finally, when counseling a client with the same tendency as covert narcissism, it gives an opportunity to be aware of the emotional problem and an opportunity to positively perceive its own social resources, so as not to reach interpersonal problems such as relationship addiction pointed out the need for an approach.

  • This paper examines the dispersion relation governing the wave propagation on cylindrical shells. The assumption of thin shells allows the dispersion relation to be separated into three relations related to the propagation of flexural waves and two types of membrane waves. Those relations are used to identify the characteristics of the wave number curves. The dispersion relation provides two and three closed wave number curves below and above the ring frequency. Above the ring frequency three wave number curves are clearly identified to be those of flexural, shear and longitudinal waves, respectively. Below the ring frequency, the characteristics of two wave number curves are identified with dependence of the direction of wave propagation.

  • The true stress - true strain relation of SA508 steel was evaluated with analytical and experimental equation on the base of the indentation load-depth curve obtained from the modeling of ball indentation test. The evaluated relation between true stress and true strain is agreed well with that of SA508 teel defined in the modeling. The distribution of effective stress along the center axis of indentation depth was calculated with Tresca criteria in the modeling. The representative strain, which are defined in this study as the corresponding strains obtained from the maximum effective stress, have a linear relation with the true strain. The true stress - true strain relation of austenitic stainless steel was evaluated by the modeling of ball indentation test to verify the case of A508 steel.

  • SNS is one of the fastest service entering in mature stage. But now there are not any empirical analysis the effect of SNS from user point of view. In this paper, we investigate the effect of self presentation on SNS to interpersonal relation and intention to use. we set online presentation self-efficacy and involvement as two antecedent factors. And we suggest that the purposes of using SNS be Image improvement and knowledge contribution. The change of interpersonal relation in offline is set a result of using SNS and a mediating variable between online self-presentation and intention to use. In the results, firstly, we confirmed that the online presentation self-efficacy and involvement are predisposing factors for online self-presentation on SNS in the positive direction. Secondly, the using SNS has significantly positive effect on the change of interpersonal relation. Especially, the improvement of interpersonal relation is originated from image improvement and knowledge contribution. Thirdly, the improvement of interpersonal relation have also significantly more higher effect on the intention of use.
