Purpose - This paper examines the international R&D contest in which the extent of intellectual property right (IPR) affects both the size of prize for the winning firm and the extent of positive spillover through cost of firms. Recognizing the possibility of incomplete protection of IPR, the present paper analyzes the effect of changes in the extent of IPR on payoffs to firms and social welfare. Design/methodology - This paper examines coordination of IPRs by countries in economic integration. The paper then develops a general model of international R&D contest with incomplete protection of IPR. An increase in the extent of IPR augments the share of the prize the winning firm can appropriate, while decreasing the positive cost externality. To derive sharper results, the paper considers the cases of linear and fixed spillovers. Findings - Under plausible assumptions, an increase in the IPR augments the payoff to each firm and the aggregate payoffs as well. The paper also shows that the number of firms participating in the R&D contest can be endogenously determined in the two-stage R&D contest. The higher the extent of cost spillover, and the larger the effective prize, the more firms participate in the international R&D contest. Originality/value - Existing studies assume that firms winning the R&D contest enjoy perfect IPR to the output of their R&D activities. This is a very restrictive assumption in that other firms can copy the new products or processes. By allowing for the incompleteness of the IPR, the present paper develops a more realistic model of R&D contest. The novelty of the present paper is to allow for the possibility that the higher extent of IPR increases the prize and decreases positive cost externality at the same time. The findings of the present paper can serve as a basis for government policy toward R&D activities of firms and protection of IPRs.
In this study, we investigated the effects of perceived health and ageism experience of the elderly on successful aging, which were respectively presumed as predictors of biomedical model and psychosocial model of the successful aging. As important research results, firstly, negligence among ageism experience constructs appeared higher than other discriminatory experiences. Secondly, male showed significantly higher discriminatory experience than female in the area of 3 constructs such as property, negligence and employment ageism. Also there were some different discriminative experiences in the area of perceived health and ageism in terms of age, wealth and education. Finally, the results of hierarchical multiple regression hired to find out factors influencing successful aging showed that the factors such as sex, wealth, perceived health and property discrimination of ageism affected successful ageing. Based on the analytic results, we verified that perceived health, i.e., predictor of biomedical model had higher effect on successful aging than ageism experience, i.e., predictor of psychosocial model of successful aging. Thus, it was suggested that health promotion policy should be considered with priority and also combating ageism as well for successful aging.

In order to efficiently manage groundwater resources, it is necessary to establish clear definition about the rights to use groundwater because it directly governs the interests of various stakeholders, from users to policy makers. In this paper, we examined the characteristics of Korea's rights to use groundwater through legal precedents, public recognition, laws, and institutional stipulaton. Inclarity about the scope and definition of the right, and the absence of legal basis ruling the exclusion and duration of groundwater use have entailed numerous cases of legal disputes between the parties with incompetible interests. In the perception survey, various responses were obtained from the surveyee regarding the scope of rights perceived by groundwater users, how to respond to groundwater shortages, and opinions about expanding public uses of groundwater. In Korea, the legal authority to use groundwater is governed by different laws while considering groundwater as both private and public property. In foreign countires, the right to use water is separated from property ownership, and it limits the volume and pumping rate of groundwater during a specified period. In order to better manage groundwater resources, it is necessary to come up with a public consensus on the right to use groundwater by considering the opinions of various stakeholders and accomodating them in adminstrative effort in directing groundwater management.
This paper deals in depth with airline over-booking practices and legal questions therefrom in the light of public interests. Chapter I as an introduction gives clear ideas of what are the over-booking, fact-revealing current state of denied boarding and nature of the problems inherent but veiled in those practices. In Chapter II, it is reviewed whether legal instruments for DBC(Denied Boarding Compensation) are adequately equipped for airline passengers in R. O. K. Upon the results of the review that international law to which Korea is a party, domestic law and administrative preparedness for the DBC are either null or virtually ineffective, the Chapter by contrast illustrates how well the U. S. and the E. U. safeguard civil rights of their passengers from such an 'institutionalized fraud' as the over-booking. In Chapter III on which a main emphasis lies, it is examined whether the over-booking practice constitutes a criminal offense: Fraud. In section 1, the author identifies actus reus and mens rea required for fraud then compares those with every aspect of the over-booking. In conjunction with the structural element analysis, he reviews the Supreme Court's precedents that lead the section into a partial conclusion that the act of over-booking judicially constitutes a crime of fraud. Despite the fulfillment of drawing up an intended answer, the author furthers the topic in section 2 by arguing a dominant view from Korean academia taking opposite stance to the Supreme Court. The commentators assert, "To consummate a crime of fraud, there must be property damage of the victim." For this notion correlates with a debate on legally protected interest in criminalization of fraud, the section 2 shows an argument over 'Rechtgut' matters specific to fraud. The view claims that the Rechtgut comes down rather to 'right to property' than 'transactional integrity' or 'fair and equitable principles'. However, the section concludes that the later values shall be deemed as 'freedom in economic decision-making' which are the benefit and protection of the penal law about fraud. Section 3 demonstrates the self-contradiction of the view as it is proved by a conceptual analysis that the infringement on freedom in economic decision-making boils down to the 'property damage'. Such a notion is better grounded in section 4 by foreign court decisions and legislation in its favour. Therefore, this paper concludes that the airline's act of over-booking is very likely to constitute fraud in both theory and practice.

The challenges of natural and technology in increasing the exposure of people and property to risk pose a dilemma for any government seeking the fullest protection for its people and their property. As society progresses and as technology improves and becomes ever more intricate and far reaching, the human species is confronted with increasingly diverse and numerous catastrophic events. Not so infrequently, unfortunately, the impact of either a man-made or natural disaster is compounded by the fact that policy makers have neither prepared themselves or the public to respond appropriately to a disaster once the tragedy has struck. Many concerns have been raised for importance of emergency management after 1990's numerous urban disasters in Korea. Emergency management is the discipline and profession of applying science, technology, planning, and management to deal with extreme events that can injure or kill large numbers of people, cause extensive damage to property, and disrupt community life. When the primary function of private security is to protect lives and property of clients, emergency management should be included in the security service and many countermeasures should be carried out for that purpose. The purpose of this study is to establish ways and means needed to improve the private security emergency management system in Korea. This study is spilt into four chapters. Chapter I is the introduction part. Chapter II introduces the reader to a private security and emergency management theory, and Chapter III deals with the establishment of an effective emergency management system in Korea private security, Chapter IV is a conclusion. Policy makers and private security industry employers in Korea has not concerned with the importance of training and education by lack of recognition and has been passive about qualified guards. And the authorities supervising and the administrating the guards has not recognized the importance of private security and has neglected the training of the guards. In theses contexts, private security should develop and maintain a educational program of emergency management to meet their responsibilities to provide the protection and safety of the clients. Today's modern corporate security director, is, first of all, a competent, well-rounded business executive and, second, a 'service expert'. And, emergency management personnel in private security industry need continuous training.
The goal of this research is to suggest the desirable directions of the land policies implement system based on analysis of existing those of Korea with the paradigm shift of land policies. We classify the land policies into land ownership, land use, land development and land management ones, and then analyze their implement system characteristics. The results are follows : firstly, the land policies implement systems have been set to large scale and rapid development. Secondly, although the systems have been specialized by their areas, the comprehensive manage systems for the harmony between development and conservation are lacking. Thirdly, the parts of the central government powers related to land use has been hand covered to local governments. And the participations of residences private companies have enlarged in the land development. Fourthly, the purposes of the information management on land use have been changed from tax collection into planned land use, but the information management has not met the need of planned land use. This study shows that firstly, the implement system focusing on large development projects might be no longer effective because of high possibility of the property prices stabilization, so moderately small ones must be found. Secondly, the system cope with the climate change and to realize the efficient utility of land is needed. Thirdly, it is necessary to take the actual measures to participate a variety of subjects. Fourthly, the system modification of the land information manage system as land policies infra is also needed to establish integral land policies.

The purpose of this study is to examine the policy direction and execution plans of the Japanese central and local governments for the use of vacant houses after the enactment of the "Special Act on Vacant Houses." It also seeks to provide suggestions for establishing vacant house policies in Korea by identifying the characteristics of the Japanese policies, and to suggest policy alternatives that can contribute to environmental improvement and regional revitalization through the use of vacant houses. For this purpose, we examined Japan's "Special Act on Vacant Houses," the process of establishing vacant house policies in the Japanese central and local governments, and the contents and direction of these policies. Below are the results of this study. First, the Japanese government revised mid to long-term policies related to housing after the enactment of the "Special Act on Vacant Houses", thereby providing ground for local governments to establish vacant house policies. Second, the government actively supported the operation and funding of related associations so that the private sector rather than the public sector could address vacant house problems. Third, the government subsidized administrative expenses such as cost of finding vacant house owners to prevent neglect of vacant houses, and showed its will to address vacant house problems by revising taxes such as property taxes and transfer income taxes. Fourth, the government has enacted distinct ordinances for each local government and made it possible to perform customized policies such as allowing residents and local stakeholders to participate in the establishment of vacant house policies. Fifth, the government made it possible to manage vacant houses efficiently by allowing the vacant house bank to provide all information related to the use of vacant houses. It is necessary for Korea's central and local governments to refer to these precedent cases and create efforts to reduce trial and error when establishing vacant house policies.
The purpose of this study was to categorize the contribution evasion and develop the expected models for contribution arrears in National Health Care System. The modified logistic regression model in non-payments was used as logistic regression model based on the statistical method. By using this model, we arranged non-payment types and typical branches those are appeared by statistical technique. First fact, sex and age branches those are able to take a part in economy had effect mostly. Also they had difference in non-payment probability by existence of their incomes and property. Especially people who didn't have their own house and car were appeared in high non-payment probability, disease and reduction characteristic(rare diseases, reduction of seniors, handicaps, numbers of medical treatments) didn't effect much in probability. The reason for some characteristic of non-payment which is higher than the correct threshold value of Logistic Regression Model (a suggested model for predicting non-payment)'s distribution of probability was mostly moral hazard. Living difficulty was the bigger reason for non-payment, but moral slackening was the bigger reason for non-payment. But it is careless to decide that moral hazard is just the reason, there is a necessity to examine on the side of sociology based in family. By the reason, the member's non-payment reason can be classified by economy, population, and psychology, but there was a comprehension that losing of work desire could be one reason. So we analyzed informations for composition of family of members. In conclusion, we grasped that family conflict makes non-payment and conversion of member in the National Basic Livelihood Protection System difficult.
The impact of midlatitude synoptic system (upper-level trough) on typhoon intensity change was investigated by analyzing the spatial and temporal characteristics of vertical wind shear (VWS), relative eddy momentum flux convergence (REFC), and potential vorticity (PV). These variables were computed over the radial mean $300{\sim}1,000km$ from the typhoon center by using GDAPS (Global Data Assimilation and Prediction System) data provided by the Korea Meteorological Administration (KMA). The selected cases in this study are typhoons Rusa (0215) and Maemi (0314), causing much damage in life and property in Korea. Results show that the threshold value of VWS indicating typhoon intensity change (typhoon to severe tropical storm) is approximately 15 m/s and of REFC ranges 6 to 6.5 $ms^{-1}day^{-1}$ in both cases, respectively. During the period with the intensity of typhoon class, PVs with 3 to 3.5 PVU are present in 360K surface-PV field in the cases. In addition, there is a time-lag of 24 hours between central pressure of typhoon and minimum value of VWS, meaning that the midlatitude upper-level trough interacts with the edge of typhoon with a horizontal distance less than 2,000 km between trough and typhoon. That is, strong midlatitude upper-level divergence above the edge of the typhoon provides a good condition for strengthening the vertical circulation associated with the typhoons. In particular, when the distance between typhoon and midlatitude upper-level trough is less than 1,000 km, the typhoons tend to weaken to STS (Severe Tropical Storm). It might be mentioned that midlatitude synoptic system affects the intensity change of typhoons Rusa (0215) and Maemi (0314) while they moves northward. Thus, these variables are useful for diagnosing the intensity change of typhoon approaching to the Korean peninsula.
