  • Human, physical damage is happened frequently to consumer's safety accident by product defect on modern industrial society. Accordingly, advanced nation including the United States of America enforce product liability law and is protecting consumer more actively from danger of product defect. Our country(Korea) may enforce product liability law since July, 2002, and if business does not grope effective confrontation way about PL, capital strength weak smaller enterprise and venture business corporation's competitive power may affect much corporation's competitive power enfeeblement and survival. This research supplement based on induction and operating QMS in smaller enterprise essential factor that corporations must equip according to product liability law enforcement. And we present integration quality management system model of Product liability to do so that smaller enterprises may can cope effectively at force of Product liability law.

Extracting Priorities of Strategic Components of Product Liability Response System using AHP (AHP기법을 활용한 제조물책임 대응시스템 구축요인의 전략적 우선순위 도출에 관한 연구)

  • Purpose: To develop efficient PL response system, SMEs should decide which component of PL response system is important and implemented with priority under limited resources. To accomplish this goal, we propose strategic priority components of PL response system for SME manufacturer. Methods: We categorize the components of PL response system based on prior research results - System, Organization, Training, Technology, Cost, and Awareness. AHP (Analytic Hierarchy Process) is applied to extract important components of PL response system, which is used in assigning the priority of component. To analyze effects of each components, performance sensitivity analysis is applied. Results: The survey analysis results show Technology is the most important components. Organization and Cost component are follows. As the importance of Technology is changed, we can find Organization, Cost is second and third important components. Conclusion: Our research shows Technology which is related to make a safe product with systematic process, is a basic enabler of PL response system. Also, building a PL team and securing a budget for PL activity should be carry out with limited resources.

  • The purpose of this study is to suggest the rational plans of Construction Policies under Product Liability Law. The results of this study are summarized as follows: 1) Analytical survey of actual Influence under Product Liability Law in Construction Industry. 2) Review of Business Strategies of Constructor and Building Material Supplier. Although real estate including apartment is excepted from the application of product liability law, constructor are not perfectly free to the product liability law. And the expectancies of this paper are that it can be used as efficient data for improvement of system to systematize contents of Product Liability Law in korea.

A Study on the Effects of Total Product Liability Activities on Firm Performance (전사적 제조물책임활동이 경영성과에 미치는 영향에 관한 연구)

  • The purpose of this study is to find empirical relationship between PL activities and firm performance. Five categories of PL activities and three performance measures were examined. Using a sample of 135 companies, we found that activities related to TQM practices and manufacturing defect had significant impacts on all three measures of performance. Activities related to design defect, warning defect and sales partially influenced performance measures. The result suggests that performance could be maximized by the mutual organic combination of the product safety efforts with the overall process from design to sales.

  • Beginning from July. 2000, the product liability of Korea is designed for reduction of customer loss by defective products. Therefore, most of company are supposed to be ready for taking care of safety and quality of products. ISO9001:2000 quality management system reform to emphasize continual improvement of the process with customer satisfaction. First of all, this paper start with introduction motive of the product liability and examine distinctive mark of the ISO9001:2000 quality management system. We consider the correlation between ISO9001:2000 quality management system and product liability and would like to propose product liability prevention by ISO9001:2000 quality management system with classification a defect style of product, the management guide and the law case.

A Survey on Cognition Levels of Consumers and Producers for Product Liability (제조물책임에 대한 소비자와 생산자의 인식수준에 관한 연구)

  • A company is liable for its products and has the responsibility to make good on any loss or damage incurred by the user of its product. The purpose of the Product Liability Act(PLA) is to protect consumers against damage caused by defective products, and contribute to the safety of the citizen's life and the sound development of the national economy by regulating the liability of manufacturers, etc. for damages caused by the defectiveness of their products. In this study, the cognition levels of consumers and producers for PLA were surveyed. The cognition levels of four factors of acknowledgement, comprehension, necessity and impact for PLA were assessed. The results were as follows : i) Acknowledgement and comprehension levels of consumer were assessed low but they assessed necessity and impact of PLA high; ii) Producers assessed necessity and impact of PLA higher than their acknowledgement and comprehension levels; iii) Overall cognition levels of producers were higher than those of consumers.

Finding and Analysis of Defective Elements of an LED Streetlight Lamp Based on the Product Liability (PL에 근거한 LED 가로등의 결함 요소 발굴 및 분석)

  • The purpose of this study is to present the range of defects mentioned in the Product Liability (PL) and to establish an objective basis and grounds for the analysis of accidents expected to happen by analyzing and presenting the external flame pattern and electrical characteristics of an LED streetlight lamp, a new lighting lamp. From the analysis of the cross-section of a cable carbonized by an external flame, it was observed that the wire's strand and insulation material had solidly adhered, and that greater voids were formed at the surface than at the center. Irregular carbide lumps were formed in the globe directly exposed to the flame, and the globe carbonized by the indirect flame showed characteristics that they had melted and flowed downward. It was found that the forward and backward resistances of the normal LED were approximately 1.74 [$M{\Omega}$] and 140 [$M{\Omega}$], respectively. The lamp burnt by the strong flame exhibited infinite forward and backward resistances and the LED did not emit light. The carbonized LED lamp was gray and exhibited fine delaminations. According to the Product Liability, a product defect signifies a simple product defect. Most of the defects were caused by the lack of stability, and the defect of the product itself occurred during the design and manufacture. The defects in warnings and markings include an insufficiency of handling manuals and warnings, expressive warranty violations, defective markings, etc. In order to prevent an accident resulting from a product, it is necessary to prepare safety warnings and documentation, establish clear-cut lines of liabilities, and subscribe insurances. However, it could be seen that important factors against the Product Liability were product improvement, response to compensation requests and law suits, credit restoration, etc.

Thus, the safety of the product becomes one of the most important elements in modern corporate management. Diamond tool industries producing risk-high products cannot make an except to this situation. This research presents how Diamond tool manufactures in korea to respond effectively to Product Liability through construction of Product Safety Management System.
