In this study, the effect of firm's patent competency on the their management performance was analysed. The number of patents granted to Korean firms, patent grade score as of the firm's patent competence were considered in the perspectives of patent volume and patent value respectively. Specially the analysis were implemented focusing on the high performance venture ranked 200th in Korea. The patent source data were from the Korean Intellectual Property Office, Korean Credit Evaluation Information Company, and the Patent Evaluation System of KIPO and KIPA. And the year sales and net profit volume as of the firm's management performance data from the KIS. Management performance data are consisted of the mean sales, net profit and ROI during the 4 years from FY2005 to FY2008. Major results are as follows. The regression model were proved significantly that the year sales volume and net profit are effected by the number of patents and patent grade score. But the model including the ROI were shown not significantly. So it can be concluded that patent volume and patent value are the important factors on firm's financial performance as of the year sales volume and net profit. Also the regression model including the control variables, firm's number of employee and business year, the number of patents and patent grade score are the significant factors on firms performance. And regression coefficients of patent value model were higher than these of patent volume model. So it can be recognized that patent value of firms' patent competency are more important factor than the patent volume.

As business environment has become more competitive, the R&D strategies of firms have been regarded more important. Patent has information about technology which affects a firm's profit and it is considered as resources which have provided appropriate data for research of innovations and trends in technology. And patent indicators are known as qualitative representation of technology quality in an objective view. Also, they are available for the continuous and systematic analysis. However, most previous studies have focused on developing patent indicators to investigate patent value and characteristics. Furthermore they have limitations that most results is not significant that patent indicators have effect on firm performance-Tobin's q, Intangible assets based on balance sheet, sales and etc. Thus, the purpose of this paper is to propose proper a factor to represent a firm performance and to analyze causal relationship between patent indicators and firm performance. Intangible assets based on market value are employed as one of most significant firm performance indicator. The results indicate that intangible assets are appropriate for analyzing causal relation between patent and a firm performance with 7 significant indicators among 10 patent indicators. Considering firm's exogenous factors, regression analysis of each data for five years is performed. This result is similar to regression analysis of full data for all years.

Now days, firm's technology capability is recognized as important factor to forecast and to evaluate firm's business performance. There are many efforts to develop useful indicators by applying patent information that includes concrete description about technology. Many previous studies analyzed relationship between patent indicators and firm's performance. But they didn't consider time gap between a point of firm's invention activity and a point of firm's performance improvement. They didn't considered a character of industrial fields either. To overcome these limitations, we selected IT industry for target analysis industry. Time-series patent data and financial data from 41 American IT firms between 2000 and 2011 were used to analyze. In this study, We empirically analyzed subsequent effect of patent indicators on firm's business performance by using correlation analysis and regression analysis.

특허 분야에서 자연어처리(Natural Language Processing) 태스크는 특허문헌의 언어적 특이성으로 문제 해결의 난이도가 높은 과제임에 따라 한국 특허문헌에 최적화된 언어모델의 연구가 시급한 실정이다. 최근 자연어처리 분야에서는 특정 도메인에 특화되게 사전 학습(Pre-trained)한 언어모델을 구축하여 관련 분야의 다양한 태스크에서 성능을 향상시키려는 시도가 지속적으로 이루어지고 있다. 그 중, ELECTRA는 Google이 BERT 이후에 RTD(Replaced Token Detection)라는 새로운 방식을 제안하며 학습 효율성을 높인 사전학습 언어모델이다. 본 연구에서는 대량의 한국 특허문헌 데이터를 사전 학습한 KorPatELECTRA를 제안한다. 또한, 특허 문헌의 특성에 맞게 학습 코퍼스를 정제하고 특허 사용자 사전 및 전용 토크나이저를 적용하여 최적화된 사전 학습을 진행하였다. KorPatELECTRA의 성능 확인을 위해 실제 특허데이터를 활용한 NER(Named Entity Recognition), MRC(Machine Reading Comprehension), 특허문서 분류 태스크를 실험하였고 비교 대상인 범용 모델에 비해 3가지 태스크 모두에서 가장 우수한 성능을 확인하였다.

최근 국가연구개발의 집행예산은 증가 추세에 있고, 이에 따라 국가연구개발사업의 양적 성과 또한 증가하고 있으나, 질적 성과의 증가세는 양적 성과 대비 취약한 것으로 나타나고 있다. 특허등급 및 기술이전효율성이 낮은 기술 등 질적 성과 부진의 원인으로 '건 수' 위주의 성과평가에 대한 개선 필요성이 제기되고 있으며, 이에 대한 대응으로 다양한 '질적 성과지표'를 이용한 성과평가가 도입되고 있다. 본 연구에서는 여러 질적 성과지표 중 주요국(미국, 유럽, 일본) 특허청에 모두 출원하여 특허의 해외경쟁력을 측정할 수 있는 '삼극특허' 창출 과제를 대상으로 연구개발사업의 질적성과 평가를 위한 성과지표로서 삼극특허에 영향을 미치는 요인을 분석하였다. 분석결과, R&D규모 요인 및 과제특성 요인 중 일부는 삼극특허 창출에 통계적으로 유의한 영향을 미치는 것으로 나타났다. 본 연구는 성과분석 측면에서 선행연구가 상대적으로 미진한 삼극특허를 관심대상으로 확장하고, 삼극특허 창출의 영향요인을 선형회귀분석(OLS)을 통해 살펴본 초기연구라는 점에서 의의가 있다.

본 연구는 융합전문가 협동을 중심으로 특허경영이 신사업 개발 성과에 미치는 영향에 대한 연구이다. 기존의 연구는 특허경영에 관해 정량적인 특허지표를 통해 사업성과에 미치는 영향을 파악하는 것이 대부분이어서 특허 경영이 융합전문가 협동을 통해 신사업 개발 성과에 미치는 영향에 대한 연구가 매우 미흡한 실정이었다. 따라서 본 연구를 통해 기존의 특허 경영이 신사업 개발 성과에 미치는 영향과 융합전문가 협동을 중심으로 특허경영이 신사업 개발성과에 미치는 영향의 인과관계를 살펴보았으며, 가설 실증분석 검증 결과는 다음과 같다. 첫째, 특허경영은 매개변수인 융합 전문가 협동에 정(+)의 영향을 미치는 것으로 나타났다. 특허경영은 융합 전문가 육성, 융합전문가 활용에 정(+)의 영향을 미치는 것으로 나타났다. 둘째, 특허경영은 신사업 개발 성과에 정(+)의 영향을 미치는 것으로 나타났다. 특허경영은 사업의 성공 여부, 목표 매출액 달성 여부, 새로운 시장 개척, 새로운 기술의 개발, 고객 요구사항의 반영정도에 정(+)의 영향을 미치는 것으로 나타났다. 셋째, 융합 전문가 협동을 매개로 한 특허경영은 신사업 개발 성과 중 재무적성과에 부(-)의 영향을 미치는 것으로 나타났다. 융합 전문가 협동을 매개로 한 특허경영은 신사업 개발 성과 중 비 재무적성과에 정(+)의 영향을 미치는 것으로 나타났다. 재무적 성과로는 사업 성공 여부, 목표 매출액 달성 여부이며, 비 재무적 성과로는 새로운 기술 개발, 새로운 시장 개척 등이다. 따라서 국내 융합 신사업 개발 기업들의 지속적인 경영성과 창출을 위해서는 정(+)의 영향이 확인된 융합 전문가 협동을 중심으로 새로운 기술 개발과 새로운 시장 개척을 통하여 신사업 개발성과로 연계될 수 있도록 힘써야 함을 시사점으로 제시하고 있다.

Objective: This study provides strategies of how to effectively convert an invention, created at universities or government-funded research institutes, into a strong patent with the clear understanding of its unique technological characteristics. Background: Regardless of the amount of research funds available in our country and the decent number of intellectual property rights created using the funds, there was a deficit of more than KRW 6 trillion in the technology trade balance related with intellectual property rights in the year of 2014. One of the reasons was that the vast number of patents that were being produced by universities or by government-funded research institutes were merely performance-based patents, namely, so called "patents for patents". Another reason is that developed technology from research and development could not be transformed into a strong patent right properly due to the lack of related knowledge. Method: After reviewing various references mentioned on the patent strategies, the definition of a strong patent and the strategies of producing a strong patent for an invention drawn out from research performance will be supplied. Results: To produce a strong patent right at universities or government funded research institutes, one should use strategies for strong specifications, strategies of product patents and method patents, strategies of patent portfolios, strategies of know-how, strategies of inventions defined by numerical limitation and strategies of parameter inventions for a more strategic approach. Conclusion: Strong patent rights will be produced with the use of effective patent strategies provided in this study. Application: It is estimated that the results of this study will aid the establishment of strong patents for inventions developed by research performance at universities or government-funded research institutions.

본 연구는 특허출원이 기업 성과에 영향을 미친다는 가정 하에 중소중견기업을 위한 산업별 맞춤형 특허 활동성 제고 전략 5가지를 제안함으로서 향후 중소중견기업의 특허활동 성과 제고에 기여하고자 하였다. 연구대상은 특허 활동이 활발한 25개 산업을 대상으로 2010년부터 5년간의 특허 활동성 통계자료와 2014년도 기준 기업성과 통계자료를 활용하였다. 연구절차는 DEA-BCC 효율성 분석과 특허 활동성 분석, 그리고 특허 포트폴리오 분석을 각각 실시한 후, 이를 종합한 특허 활동성 제고 전략을 제안하는 순으로 진행하였다. 연구 결과, 특허 활동성이 높고 IRS(규모수익체증)형태를 보인 5개 산업의 경우, 특허 효율성이 높은 산업으로서 기업성과 향상에 실질적인 도움이 되고 있음을 확인하였다, 반면, 특허 활동성은 높으나 규모수익이 IRS(규모수익체중)/DRS(규모수익체감)형태로 나타난 12개 산업을 비롯, 특허 활동성도 낮고 규모수익이 DRS(규모수익체감)형태, CRS/IRS 혼합형태, 그리고 IRS 형태로 나타난 8개 산업 모두, 산업별 특성에 따라 특허 효율성도 다양한 형태로 나타날 수 있음을 확인하였다.

21세기를 맞이하여 세계 각국은 자국의 지식재산권을 보호하기 위한 정책을 추진하고 있으며, 이와 같은 지식재산권을 보호강화하기 위한 국제적 동향은 더욱 더 강력해지고 있다. 이러한 환경에서 기업은 사활을 걸고 기술보호와 경영을 어떻게 할 것인가에 대한 최적인 방법을 모색하여야 하며, 기업의 지식재산관리는 관리적인 차원이 아닌 경영적인 차원에서 고려되어야 한다. 즉, 기업은 산업재산권을 경영자원의 하나로서 전환하여야 하며 그 중요성은 기업의 생존에도 큰 영향을 미친다. 특허 데이터는 기업 전략 수립의 중요한 정보이다. 이 연구에서는 우리나라 금속기업 27개사를 대상으로 특허활동을 체계적으로 분석하였다. 2000년부터 2005년까지의 특허데이터를 이용하여 특허경영과 기업경영성과와의 관계를 분석하였다. 이 연구의 주요 결과로는, 노동생산성은 종업원 1인당 특허활동도와 유의한 양(+)의 관계가 있는 것으로 나타났지만, 기업규모와는 유의한 음(-)의 관계가 있는 것으로 나타났다. 따라서 특허 활동은 기업의 연구개발계획을 수립하는데 중요한 역할을 할 젓으로 생각한다.

In a rapidly changing technology environment, managing and rearranging the patent portfolios is one of the main sources of competitive advantage for firms. This study analyzes the effects of patent portfolio composition on new product introduction related to resource allocation. This study also looks at the moderating role of rearranging the patent portfolios on new product introduction. Our empirical analysis of the global pharmaceutical industry shows that firms with high-value patent portfolios exhibit a tendency to launch new products, and patent portfolio diversity shows a U-shaped relationship with new product introduction. In addition, the patent portfolio rearrangement positively moderates the relationship between patent portfolio diversity and new product introduction. The results are expected to provide implications for firms' patent portfolio composition and patent portfolio rearrangement related to innovation performance such as new product introduction.
